Conditions of Sale

The property offered in this sale and listed in this catalogue is being sold by The Old Vic Theatre Trust 2000 (“The Old Vic”), a company located at The Old Vic, The Cut, London SE1 8NB and registered with the Charity Commissioners under the number 1072590.

The following terms and conditions govern the sale of all property offered by The Old Vic and, by bidding on the auction, the bidder is deemed to have read and agreed to be bound by these Conditions of Sale.

1. Event Technologies acts as agent for The Old Vic and provides the auction software and equipment only. The sale of the Lots will result in contracts made solely between The Old Vic and the Buyer.

2. The Buyer shall be the person with the highest bid accepted by the auction software at the time of the auction closing, which shall be determined by The Old Vic.

3. The Old Vic has the right to refuse any bid and, in the case of error or dispute, to put up an item for bidding again.4. Statements by The Old Vic in the catalogue or made orally or in writing elsewhere, regarding the authorship, origin, attribution,

genuineness, provenance, condition or estimated selling price of any Lot are merely statements of opinion, and are not to be relied upon as statements of definitive fact. The Old Vic is responsible for the correctness of any such statement nor for any other errors of description or for any faults or defects in any Lots. Catalogue images are for guidance only.

5. Buyers are responsible for satisfying themselves concerning the condition of goods and the matters referred to in the catalogue description. Any property in this catalogue may be withdrawn by The Old Vic at any time before the auction and The Old Vic reserves the right to amend any information about a Lot in this catalogue by oral announcement or amendment notice at the auction.

6. Subject to The Old Vic’s discretion, the closing of the silent auction shall mark the acceptance of the highest bid and the conclusion of a contract for sale between The Old Vic and the Buyer.

7. Following the sale, the Buyer must provide The Old Vic with his or her name and contact details.8. All Lots are to be paid for in full on the day of the sale at the payment desk. Payment can be made in cash, by credit or debit card, or by

cheque made payable to “The Old Vic”. The Buyer will not acquire title until the Lot has been paid for in full. The purchase price will be the hammer price. No buyers premium will be charged on any sale of property listed in this catalogue.

9. These Conditions of Sale are subject to English law, which shall apply to their construction as well as to their effect. The Old Vic and the Buyer submit to the exclusive jurisdiction of the English courts.

10. If the Buyer fails to pay, in addition to any rights that The Old Vic has by law, The Old Vic may cancel the sale of the Lot and resell it (in which case the original Buyer will be liable for payment of any shortfall between the original sale price and the price achieved on resale).
