Detto obbligo fa riferimento alle legge 09-03 del 25/02/2009 e al decreto 05-467 datato 12/12/2005, relativi alle procedure doganali di controllo sui beni importati. La verifica di conformità dei prodotti da esportare in Algeria si basa sulla revisione di certificati e rapporti prova che ne attestino la qualità, su una ispezione fisica della merce prima della spedizione e, dove e quando necessario, su prove di laboratorio appositamente commissionate. A fronte dell’esito positivo sia della verifica documentale, che dell’ispezione e dell’eventuale test, l’agenzia d’ispezione e certificazione emette il Certificato di Conformità. Questo certificato può anche essere designato come “Certificat de contrôle de qualité”. Un originale del Certificato di Conformità è necessario per ciascuna spedizione e deve essere emesso nel paese di esportazione. Si tratta di un documento obbligatorio per lo sdoganamento della merce presso le Dogane Algerine. OBIETTIVI E PRINCIPI Gli obiettivi principali di questo programma di verifica di conformità sono: Garantire che i prodotti importati in Algeria rispettino le direttive in merito a sicurezza, salute e tutela dell’ambiente come da standards e regolamenti tecnici approvati dallo IANOR (Institut Algerien de Normalisation). Fornire ai consumatori Algerini la certezza che i prodotti importati siano esenti da rischi e idonei all’utilizzo finale cui sono destinati. Evitare costose soste in porto o il respingimento della spedizione qualora vengano rintracciati prodotti pericolosi o dannosi per la salute e la sicurezza. Assistere gli esportatori nel rispetto delle procedure, al fine di ottenere un rapido sdoganamento senza rischi di rifiuto a destino. Ottimizzare le procedure di sdoganamento, promuovere una concorrenza corretta e trasparente e contrastare l’ingresso nel paese di prodotti scadenti e pericolosi. INTRODUZIONE
A Marzo del 2011, il Ministero del Commercio Algerino ha pubblicato una nota agli importatori ricordando l'obbligo di presentare un documento che attesti la conformità di prodotto per la merce in ingresso nel territorio algerino, al fine di ottemperare alle normative vigenti in materia. Detto obbligo fa riferimento alle legge 09-03 del 25/02/2009 e al decreto 05-467 datato 12/12/2005, relativi alle procedure doganali di controllo sui beni importati. La verifica di conformità dei prodotti da esportare in Algeria si basa sulla revisione di certificati e rapporti prova che ne attestino la qualità, su una ispezione fisica della merce prima della spedizione e, dove e quando necessario, su prove di laboratorio appositamente commissionate. OBIETTIVI E PRINCIPI
Gli obiettivi principali di questo programma di verifica di conformità sono:
Garantire che i prodotti importati in Algeria rispettino le direttive in merito a sicurezza, salute e tutela dell’ambiente come da standards e regolamenti tecnici approvati dallo IANOR (Institut Algerien de Normalisation).
Fornire ai consumatori Algerini la certezza che i prodotti importati siano esenti da rischi e idonei all’utilizzo finale cui sono destinati.
Evitare costose soste in porto o il respingimento della spedizione qualora vengano rintracciati prodotti pericolosi o dannosi per la salute e la sicurezza.
Assistere gli esportatori nel rispetto delle procedure, al fine di ottenere un rapido sdoganamento senza rischi di rifiuto a destino.
Ottimizzare le procedure di sdoganamento, promuovere una concorrenza corretta e trasparente e contrastare l’ingresso nel paese di prodotti scadenti e pericolosi.

Intertek possiede il più ampio network mondiale di laboratori che operano sui programmi di verifica di conformità. Questi laboratori offrono un gran numero di test e prove che comprendono l’ambito elettrico, chimico, materiali da costruzione, automotive, e molti altri.
Il nostro staff è professionalmente preparato per interpretare e comprendere un gran numero di standard nazionali e
internazionali, inclusi quelli dell’Algeria, così come è attento a considerare le esigenze di esportatori e importatori. Intertek può fornire assitenza tecnica relativamente agli standard e alle norme riconosciute e autorizzate. Il Certificato di Conformità emesso da Intertek beneficia degli ultimi ritrovati in materia di codici crittografici, filigrana e
altre misure di sicurezza, che ne renderebbero impossibile la contraffazione e l’alterazione. Intertek può fornire servizi rapidi e dedicati per venire incontro ad esigenze particolari quali:
a. Richieste di certificazione on-line b. Notifiche automatiche (via e-mail) sullo stato della certificazione c. Soluzioni personalizzate per la consegna del Certificato di Conformità a fronte di grandi volumi di
esportazione.
PROCEDURA PER LA CERTIFICAZIONE DEI PRODOTTI REGOLATI
Le spedizioni in Algeria vanno sottoposte a verifica di conformità agli standards nazionali e internazionali, ai requisiti fondamentali e/o alle specifiche del produttore. Il processo di verifica della conformità può comportare l’ispezione pre-imbarco ed il prelievo di campioni da sottoporre a prove di laboratorio. Il processo di certificazione si svolge come segue: 1. L’Esportatore sottopone la Richiesta di Certificazione (RFC) allegando la relativa documentazione
L’Esportatore contatta l’ufficio Intertek locale e sottopone la richiesta di Certificazione. L’ Esportatore allega le seguenti informazioni:
a. Dettagli sui prodotti in spedizione b. Nome e indirizzo di esportatore e importatore c. Luogo dove si trova la merce e possibile data di disponibilità per l’ispezione pre-imbarco d. Dettagli relativi a pagamento, porto di partenza, porto di destino e modalità di spedizione
L’ Esportatore allega i seguenti documenti: a. Test report/Certificati di Analisi/Certificati di Qualità b. Schede tecnichr/Schede di sicurezza (MSDS) c. Certificati relativi al Sistema di Qualità/Sicurezza (ISO 22000, ISO/TS 16949, ISO 13485, e simili) d. Fattura
L’Esportatore invia la domanda di certificazione e la relativa documentazione all’ufficio Intertek di competenza 2. Verifica della richiesta di certificazione (RFC) e della documentazione allegata da parte dell’ufficio Intertek di
competenza L’ufficio Intertek esamina la documentazione fornita dall’esportatore e procede con un controllo preliminare per
verificare che essa sia idonea e sufficiente per la valutazione della conformità dei prodotti secondo gli standard di riferimento.
In caso negativo, l’ufficio Intertek incaricato richiederà all’esportatore di fornire maggiori informazioni e/o documenti. A questo punto, all’Esportatore verrà sottoposta la quotazione per i costi d’ispezione e certificazione e se accettata, verrà organizzata l’ispezione e la campionatura per test/analisi di laboratorio, queste ultime ove ritenute necessarie.

3. Ispezione L’ufficio Intertek coordina l’ispezione in accordo con l’esportatore e l’ispettore Una volta fissato l’appuntamento, l’ispettore Intertek verifica che la merce in partenza sia conforme alla
documentazione, così come lo stato fisico dei prodotti, gli imballi e le marcature. Controlla inoltre che la quantità corrisponda alla fattura. Se necessario l’ispettore potrebbe essere autorizzato a prelevare dei campioni per ulteriori verifiche di laboratorio.
4. Emissione del Certificato di Conformità/Qualità
A fronte della verifica documentale e dell’ispezione fisica con esiti positivi, Intertek emette il Certificato di
Conformità. Nel caso l’esportatore lo richieda, possono essere fornite copie conformi del Certificato.
TARIFFE
L’emissione del Certificato di Conformità è soggetta al pagamento di una tariffa relativa allo svolgimento di ispezione, valutazione, testing e ogni altra attività tecnica e amministrativa necessaria per la certificazione della spedizione oggetto del certificato medesimo. Ad ogni richiesta di certificazione l’ufficio Intertek fornirà una quotazione specifica per il servizio. Ad accettazione della stessa potrà avere inizio il processo di verifica di conformità.

SUBMISSION OF THIS APPLICATION CONFIRMS CONSENT TO THE TERMS SET OUT BELOW
1. Unless otherwise explicitly agreed between the parties in writing, any Certificate or report issued in response to this application is issued strictly subject to Intertek's General Terms
and Conditions, a copy of which is available from our nearest Country Office or at our website: http://www.intertek.com/terms/.
2. Intertek represents and warrants that any Certificate or report issued in response to this RFC is issued in good faith and in the reasonable belief that it has authority to do so from the respective authorities or within the provisions of relevant decrees issued by them.
3. The Request for Certification (RFC) sets out the entire agreement and understanding between the parties in relation to its subject matter. The Exporter acknowledges that, in submitting the RFC, it has not relied on any oral or written representation, warranty, or other assurance (except as provided for or referred to in this RFC) and waives all rights and remedies which might otherwise be available to it in respect thereof, provided always, that nothing in this clause limits or excludes any liability for fraud.
4. Inspection Auditors and/or Observers from the Country Office are to be allowed access to the Exporter’s inspection site without prior notice for the purpose of ensuring that a recently performed inspection has been correctly conducted. The Auditors and/or Observers are authorized by the Country Office to amend or overturn the inspection outcome if the result of the audit supports this action. In their course of action, Inspection Auditors and/or Observers will not hamper or hinder the export process.
5. In the event of conflict between the Exporter and an Approved Laboratory relating to the testing of the products, the dispute shall be resolved by the two parties, without
involvement or responsibility on the part of the Country Office (CO), Registration and Licensing Centre (RLC), Centre of Technical Expertise (CTE) or Programme Management (PM). PM shall be informed of such dispute to allow a reassessment of the laboratory’s approval status to be made if warranted.
6. In the event of conflict between the Exporter and any of the COs, RLCs or CTEs relating to the inspection, evaluation, licensing, registration or certification of the regulated products, the Exporter shall be entitled to submit a complaint to the CO, RLC or CTE. If no agreement can be reached, the exporter is entitled to submit an appeal to the Programme Management within two (2) weeks from the date of submittal of the complaint to the CO, RLC or CTE. Documents supporting the Exporter’s point of view shall be attached to the appeal. Programme Management undertakes to investigate the complaint in accordance with Intertek’s internal complaints procedure, and issue a decision thereon within one (1) month from the date of receipt.
7. The Exporter is responsible for informing Intertek in advance of any applicable import/export restrictions that may apply, including instances where products, information or technology may be exported to a country that is restricted or banned from such export.
8. The Exporter commits to fulfill the certification requirements, including implementation of appropriate changes as and when advised by Intertek.
9. The Exporter makes all the necessary arrangements for the investigation of complaints, should the need arise.
10. The Exporter commits to use the Conformity Certificate solely for the purpose for which it has been issued for and must refrain from any form of misuse or make any statement that may cause disrepute to Intertek. The Conformity Certificate issued is only for the shipment verified by Intertek and must not be used in communication media and marketing documents to indicate otherwise. The Exporter must not use the Intertek logo in any documents, brochures, etc. without prior consent from Intertek.
11. If the Exporter provides copies of the Conformity Certificate to other party, the document shall be reproduced in its entirety.
12. The service undertaken by Intertek does not absolve the Buyer and Seller from their contractual obligations to each other, or from compliance with any other import or export regulations.
13. Unless otherwise explicitly agreed between the parties in writing, the above conditions shall be governed by English law and any dispute arising out of this RFC to which these conditions apply shall be subject to the jurisdiction of the English Courts. This Clause supersedes Clauses 22 and 24 in Intertek’s General Terms and Conditions with respect to jurisdiction.
