Mobile Crane LicenseGuidance & Application FormHighways Act 1980

Guidance Notes 1. The placement of a mobile crane within the public highway is regulated

by the Highways Act 1980, and must be authorised by Transport for London (TfL) if a crane is placed in a street where TfL is designated as the responsible highway authority.

2. For the purposes of this application the term ‘Crane’ relates to Mobile Cranes operating on the public highway only, and not those located within the confines of privately owned land. Tower cranes, over sail licenses or Scissor Lifts or MEWP’s are subject to a separate approval process. Application forms for these other licensed activities can be downloaded from TfL’s website.

3. Applications for a license must be made by, and paid for by the mobile crane operator, who must provide documentary evidence of the required level of public liability insurance (currently £10,000,000).

4. Before issuing a license to the applicant TfL will consider the impact of the proposed activity to ensure it does not endanger any road user, cause unnecessary disruption to the movement of all road users, or conflict with any other known activities taking place within the immediate vicinity.

5. Consent to undertake a mobile crane operation shall be given in the form of a license.

The standard terms and conditions relating to an approved crane license are provided later within this application pack. These will be supplemented with any conditions that are specific to the actual operation itself or any localised considerations.

Any crane operators found operating on the public highway without a valid license or in contravention of the specified conditions attached to an approved license may be committing an offence under the Highways Act 1980 and may therefore be liable to prosecution by Transport for London.

6. The processing periods for applications vary depending on the impact the crane operation will have on the road network. The following are the minimum advance notice periods required for giving approval to an application:

a. All works that do not require a Traffic Order - 4 weeks before operation start date

b. Road closure or Banned Movement: - 12 weeks before operation start date

TfL aims to grant licenses within 4 weeks of receipt of a complete application however this can vary depending on factors such as a need to arrange stakeholder meetings, suspend bus stops or parking bays, etc. It is therefore recommended that the applicant plans for a minimum of 6 weeks when making their application.

Where a road closure or a banned movement is required to safely undertake an operation it will also be necessary for the crane operator to apply for a temporary traffic regulation order (TTRO) to legally suspend the normal operation of the road network. Application forms for a TTRO that are related to a Mobile Crane License can be obtained from [email protected] Completed Applications Forms for the TTRO and Mobile Crane License should be returned to the same address. In the case of an emergency where a danger to life or property is identified a retrospective approval process will be implemented.

7. A site meeting may be required depending on expected impact. The applicant will be responsible for arranging a site visit with all necessary stakeholders to evaluate the proposed operation following acknowledgement from TfL that the application has been received and is considered complete. A list of the relevant stakeholders together with their contact details will be provided. These stakeholders will include, but are not be limited to the following:

10. The total fee to be included with the application is £1595.00, which comprises of the following:

A deposit will be held on account for the duration of the Crane Operation to cover any consequential damage caused to any public highway assets by the crane operation. In the event that consequential damage is identified TfL will instruct its term highways maintenance contractor to undertake the necessary remedial action to restore the highway back to the same state prior to the crane operation commencing. The cost for this work and all other reasonable costs incurred to restore the highway shall be deducted from the deposit received. If the costs of this remedial work exceed the deposit amount TfL will seek to reclaim these from the licensee separately. Failure to reimburse TfL with any losses incurred may compromise any future approvals required.

Refused Applications11. An applicant may appeal to the magistrates’ court where TfL has:

a) Refused to grant a license to place a mobile crane on the public highway; or

b) Refused to grant a license except on terms prohibiting its assignment

Traffic Management Requirements12. Traffic Management drawings should provide the following as a

minimum:

a) Dimensions and residual carriageway running lane widthsb) Location details – Borough and Road Name, Northing and Eastings and

USRNc) Current road-layout ensuring bus stops, parking/loading bays, road

markings are displayed d) Full area of occupation including lead and end taperse) In the instance of a footway closure, a suitable and realistic pedestrian

diversion needs to be shownf) Clear diversion drawings for banned turns and road closures, ideally

already route tested for normal vehicles and HGV’s4

g) Swept path analysis drawings at relevant locations – particularly roundabouts, chicanes

h) Proposed location of pedestrian marshalsi) Temporary signals – provide the proposed temp signal phasing (ideally

on a separate sheet and not on the TM drawing)

Standard Conditions of the LicenseThe following conditions are applicable to all licenses. Supplementary conditions will also be applied at the discretion of Transport for London

1.1 A license may only be granted to the applicant and is not transferrable.

1.2 The license is only valid for period stated. Failure to comply with the dates specified within the license is guilty of an offence under the Highways Act 1980 and liable to a fine not exceed level 5 on the standard scale.

1.3 For the purposes of protecting and maintaining the condition of the highway asset, TfL will carry out all necessary inspections of the highway to record the condition of public highway, prior to operations commencing and following completion of the licensed activity.

1.4 Should a crane obstruct the footway, permission will be required from TfL. In any event a minimum of 1.2m must be made available for pedestrians at all times. At no time should pedestrians be diverted across the carriageway unless consent to do so is given as part of consenting to this licensed activity.

1.4 The proposed application must conform to all current codes of practice and legislation such as BS 7121-2-7:2012+A1:2015– “Safe Use of Cranes”.

1.5 The works must be carried out and completed without delay and in accordance with a schedule of work agreed with TfL.

1.6 The applicant agrees that any damage caused to the public highway as a result of the operations at the location described will undertake to pay Transport for London the total cost of any repairs to the public highway, including the road surface and any street furniture as deemed necessary.

For this purpose a deposit will be held until TfL has confirmed there is no damage to the highway following the crane operation.

1.7 In addition to these standard conditions, TfL will stipulate in the license any other conditions that are considered appropriate in the interests of safety. By accepting the license approval the applicant agrees to any additional conditions imposed.

1.9 The owner of the equipment has a statutory duty to ensure it is properly maintained at all times.

1.10The crane shall not be positioned on the public highway until a license is obtained.

1.11If the crane or the lifted materials are situated on the highway the appropriate traffic management plans is to be submitted to TfL as part of the application. All traffic management is to be implemented in accordance with the Traffic Signs Manual Chapter 8 and the Safety at Street Works and Road Works Code of Practice.

1.12All applicants must provide a site specific risk assessment to include existing underground structures and services.

1.13Materials are not to obstruct or interfere with the drainage of the street or with access to or operation of the apparatus of the public utility companies.

1.15The licensee and their employees or agents shall comply with any instructions given (whether in writing or otherwise) by TfL regarding the safety of highway users, or the provision of lighting and warning signs.

1.16The site shall not be used for the placement of advertisements.

1.17The license does not exempt the License holder from any parking or stopping controls and appropriate arrangements must be made for exemptions prior to placement.

1.18Any request for an extension to the period for which the license is granted must be made in writing at least 5 working days prior to the expiry of the license.

Failure to comply with the terms and conditions of the approved license is guilty of an offence and liable to prosecution in accordance with the provisions stated under the Highways Act 1980. It is incumbent on the applicant to ensure that the guidance and terms and conditions provided herein are fully understood before submitting an application.
