Leagueline

This edition on Legislation and Codes includes descriptions of who is working to further the profession of Architecture in the New Jersey Legislature, and the process involved with protecting Architects’ interests. The effort that is required is a large one involving many people and should not be underestimated in its importance. The lead article by Scott Lurie, AIA, both a member and chair of the LG&A Committee for about six years gives an excellent description of the process the committee functions within to insure success. He advises us of the importance of action when called upon to contact your local legislators. Certainly a unified voice is better heard in Trenton. The article by Joseph Simonetta of Public Strategies Impact, AIA New Jersey’s governmental relations consultants, describes in detail his work on both the legislative and administrative sides to advocate for our interests through the state regulatory and lawmaking processes.

Finally, Larry Parisi, AIA gives us an update on the Homeland Security issues relating to ‘securing the built environment’ here in New Jersey, while describing the efforts he has made both locally and in Washington at the Grassroots Leadership Conference.

In this issue of Leagueline we explore Codes & Legislation. Most of you may be aware that effective February 20, 2007, the State of New Jersey has adopted the 2006 International Building, Mechanical, Fuel Gas, and Energy Conservation Codes (Residential). The 2006 National Standard Plumbing Code has also been adopted. The 2005 National Electrical Code was adopted on May 1, 2006, The 2006 Commercial Energy Code is ASHRAE 90.1 -2004. To review the code changes there was a joint panel discussion meeting with the Bergen Passaic Municipal Inspectors Association (BPMIA) on Wednesday, March 7, 2007 at Seasons Restaurant, Westwood, NJ. Attendance at this program earned 2.5 HSW CEUs

A number of our members including myself, past President Stacey Kliesch, Kim Vierheilig, Kurt Vierheilig, Scott Lurie, Frank Cunha, Larry Parisi, and Manuel J. Pereiras attended the AIA National’s Grassroots Leadership & Legislative Conference in Washington, DC. We all had an opportunity to meet with our legislators, and attend interesting workshops.

Our February meeting was held at the YMCA/ YWCA building in Ridgewood recently expanded and renovated by member firm Postkanzer Scott. Principals Barry & Larry were on hand to conduct tours.

Our kickoff program for 2007 explored our past 150 years with our featured speaker, AIA- NJ’s Historic Resources chair, Michael Calafati. Michael gave an engaging presentation on “Trends and Public Policy in Historic Preservation” including the proposed NJ Historic Properties Reinvestment Act and the redevelopment of Atlantic City.

The League presented an Appreciation Certificate to Jersey City’s Planning Director Bob Cotter for his contribution and support of the Jersey City Walking Tour last October.

Codes and Legislation Committee

The Architects League of Northern New Jersey established a Codes and Legislative Committee with committee members and duties as follows:

A. Have a minimum of three members.

B. Be liaison with building officials in the four county areas. The committee can arrange for the League to become a member of BPMIA and send its chairperson and members to meetings.

C. Arrange for a joint meeting or special program with building officials if requested by programs and arrangements committee or if deemed appropriate.

D. Bring code changes to the attention of membership at meetings or through newsletter.

E. Review proposed state or local regulations which may affect League members and publish items on political activity important to the membership.

F. Stay in contact with AIA/NJ legislative committee to be alert to any information that committee may have. Attend all AIA/NJ committee meetings.

G. Chairperson of this committee will be the League’s representative to AIA/NJ legislation committee and coordinate League efforts with those of the state.

ALNNJ C&L Committee

As the chairperson of the Architects League Codes and Legislation Committee, I am the League’s representative to AIA/NJ Legislative and Government Affairs Committee.

The Legislative and Government Affairs Committee is responsible for the review of proposed and pending legislation which, if enacted has a direct impact on our profession. The committee also monitors legislation affecting the public welfare as it applies to the built environment. The committee meets several times a year in conjunction with PSI (Public Strategies Impact), our legislative liaison in Trenton. In addition to our regular meetings the committee conducts conference calls and email communications on an ongoing basis when necessary. The committee is

composed of member representatives from most of the sections.

At these meetings the committee decides if AIANJ should support, try to suggest amendments to, oppose or just monitor the proposed legislation as it passes through the Assembly, the Senate and on to the Governor. The past year L & GA has reviewed and commented on legislation on Eminent Domain, Home Inspectors Licensure, Affordable Housing, Interior Design Certification, School Construction and other critical issues.

The committee often writes position prepares for AIANJ. These Position Papers are in turn submitted to the AIANJ Board for acceptance or modifications.

Legislative Advocate (PSI)

A list of legislation pending or moving through the State Legislature is submitted at each meeting by our liaison PSI. There

are generally ten or twenty items to review. Often a Committee member will review legislation and report to the Committee the potential impact it may have.

Many times the L&GA Committee will call on a member of AIANJ who has particular expertise in a field of architecture to testify before the State legislative Committee reviewing a proposed Bill. Even when we may support a piece of legislation we may offer suggestions for change and modifications.

Since Governor Jon S. Corzine signed an Executive Order calling for the reduction of greenhouse gas emissions to 1990 levels

by 2020 and there are several LEED and sustainable design pieces of legislation being proposed the Committee are very busy communicating positions to the state legislation our concerns and positions on this issue.

We currently have a Leed Certified Architect testifying on these issues. The Committee is currently reviewing and providing either testimony or written comment on the following bills: S 2030 & 2146.

We are supporting R 1018. A bill requiring as built surveys. The Committee also has inquiries questioning the legitimacy for legislation requiring Home Inspectors to certify the energy efficiency of a residence.

The Committee suggests to the AIANJ State Board to place inquiries to either the NJ DCA or the State Board of Architects for clarifications on issues pertaining to licensure or practice. Currently there is a request moving forward asking for a clear

definition of “closely allied professionals” as it pertains to certain legislation. In the recent past and on an ongoing foray the Committee is reviewing concerns and clarifications of the Interior Design Certification process and eligibility.

This year we have good tools with which to have our voices heard at the state capitol. Along with Joseph Simonetta, of PSI, steering us with good insight on the State’s leanings we also have the opportunity to work with other organizations such as USGBC NJ and NJHEPS in relation to Green Building.

Representative

Although not part of AIANJ, we work closely with the APAC (Architects Political Action Committee). APAC often calls on AIANJ to provide an Architect or Architects to attend functions that are of particular interest to our developing relations. As APAC has strengthened so has the ability to be heard in the legislature. APAC is open to everyone whether or not an AIANJ member. Any party with interest in promoting the issues of architecture or the built environment may become a member of APAC.

Members Role

This last section is perhaps the most important part of this article… YOU.

As mentioned above we depend on the expertise of our membership to assist us in making sure our Legislators receive a clear understanding of how their proposals may affect not just our profession but the health, safety and welfare of our states citizenry. Along with that AIANJ often receives an inquiry from APAC to have an architect who understands the AIANJ Position Papers and may be familiar with or know a particular State Legislator. These Architects are often sent to breakfasts, luncheons or dinners honoring the legislator or even fund raising events.

An occasional golf outing is even a possibility. They are often brief encounters; however, even these meetings make a difference when we need to speak to the particular legislator at a later date to have our concerns heard.

We also need your expertise. Maybe you specialize in schools, hospitals, urban renewal, senior or affordable housing or you are a code consultant. Your knowledge could be valuable to a legislator who needs technical assistance in understanding the issues set before them.

When you receive a request to write to your Legislator, DO IT.

The last part is one of the most important parts of the work you can do. If you receive a request to contact your Local Legislator it is because we need your support. What

is heard in Trenton is numbers. People and votes count along with certain political contributions.

Consider being a voting member of APAC. As an L & GA representative, I see the importance of supporting those legislators who understand the importance of architects in the decision making process.

If we are to succeed we must be heard and have impact. Last year we won many points but lost some bigger ones. Do not let your profession be eroded because of your lack of participation.

Get involved and write or call when requested.

Administrations and legislatures come and go. But no matter what the political climate, Public Strategies Impact is ready with a team of bipartisan professionals who have a thorough knowledge of the lawmaking and regulatory processes in New Jersey. We also know the people who make the laws and administer them.

On the legislative side, we:

n Together with you, formulate and implement a comprehensive legislative strategy to initiate, support, oppose, or amend bills of particular interest.

n Identify and alert you to new legislation of potential interest. We join with you to interpret bills and develop a position.

n Seek sponsors of favorable legislation in the Senate and Assembly, as appropriate, and work for the passage of such legislation when introduced.

n Closely monitor all legislation, flagging and responding to important developments as they occur.

n Issue periodic written reports including notices of bills scheduled for consideration and action taken on bills of interest. We also make written legislative reports to your Board of Directors, legislative or other appropriate committees.

n Testify before committees or draft written or oral testimony for you, as necessary. We will also contact key legislators in advance of votes on bills of concern.

n Advise you as to when your members’ direct involvement is necessary and how best to affect it. We coordinate appearances and set up meetings as called for.

n Maintain relationships with legislators and staff in order to enhance their under-standing of your issues and concerns.

n Throughout this process, we develop and work with allies and form and maintain relationships with appropriate coalitions.

n Develop a legislative agenda, the

overview of your governmental positions and goals, yearly or as may be needed and assist in the publication of this document.

n Raise the profile of member architects and the architectural profession before all governmental branches, agencies, authorities and other appropriate entities.

n Work with the Governor’s office and appropriate legislative offices to secure the appointment of AIA/NJ supported individuals to boards, councils, agencies, etc.

n Attend all legislative committee meeting and prepare background materials for all issues of concern. This includes a synopsis of the document, its effect on AIA/NJ and the architectural profession and recommen-dations for action, when appropriate.

n Participate in Section Activities, if requested, to present at least annually the legislative activities and programs of AIA/NJ.

n Provide Special analysis of election year activity and its relationship to AIA/NJ and its members.

n Work with the committee to create an AIA/NJ Grassroots Outreach Plan. This includes an “Architect Ambassador” program to provide contact with local legislative offices by appropriate constituents in all 40 legislative districts

n Organize, manage and implement a Bi-annual or Annual Legislative Day in Trenton in cooperation with the goals of the committee and the Executive Committee

n Keep current on all issues of AIA at the federal level and attend appropriate events, conferences and activities as requested.

On the administrative front, we:

n Monitor the New Jersey Register and flag proposed rules and rule changes as they appear.

n Communicate with rule makers through meetings, formal oral or written testimony, or informal contacts to present your position regarding proposed regulations.

In addition, we act as consultants, advisors, and managers of the Political Action Committee activities of APAC.

February 7-10, 2007, some 800 AIA architects from across the country gathered at the Grand Hyatt Hotel in Washington D.C. for the American Institute of Architects annual Grassroots Leadership and Legislative Conference.

This year the main focus was on Sustain-able Design and Green Architecture. The purpose of our visit is to meet with our local district representatives, Congressmen and Senators to encourage them to vote in favor of Bills and Legislature that AIA believes will be beneficial to the practice of Architecture and the general Health Safety and Welfare of all concerned.

On the way to Capital Hill, it was difficult not to notice the increased amount of vis-ible security, especially at the Capital build-ing, the House of Representatives and the White House. The photo above illustrates barriers that remain in a defensive position to stop vehicles from entering the grounds of the Capital Building. Upon entering these buildings you have to go thru a

secure detection device and have your bags inspected. It is the same procedure for all the museums and Government Agencies throughout the city.

My Representative is Congressman Albio Sires (D-NJ). As New Jersey Speaker of the General Assembly, Albio Sires created the Assembly Committee on Homeland Security and State Preparedness wrote the law to overhaul New Jersey’s Department of Motor Vehicles so that terrorists cannot obtain access to fake driver’s licenses, helped communities with the cost of home-land security, and increased homeland security funding for the state police.

When asked as Speaker of the Assembly; What is the most important state issue before Congress right now?“Homeland security and how to fund it. The realities of 9/11 have placed added pressure on states - particularly New Jersey - and the federal government must devise a plan that finances state and local homeland security efforts in a fair and equitable manner.”

In a telephone interview with Congressman Sires I asked if he is still active in Homeland Security in Washington. He said that Homeland Security remains a significant issue for him, and although he is very active with his committees on Financial Services and Foreign Affairs, he stays in touch with congress members who are active with Homeland Security.Congressman Sires saw the necessity to coordinate all of the emergency governmental agencies here in New Jersey. One of the critical issues on 9/11 was the inability for the different governmental agencies to communicate and coordinate services. He was responsible for coordinating each of the County Emergency Services. He is also very concerned with the protection of the Ports, Bridges and Tunnels in New Jersey.

He is newly appointed to the House of Representatives replacing Congressmen Menendez who replaced Governor Corzine’s position in the Senate.Homeland Security remains a vital issue in our country and in particular here in New Jersey. My committee AIANJ Homeland Security Committee continues with efforts toward assembling pertinent information related to securing the built environment. I am seeking a few good architects who would like to participate on the AIANJ Homeland Security Committee.

AIA�50 School Initiative

The School Initiative has been developed by AIANJ150 for a statewide participation to celebrate the AIA 150. The program topic is “The AIA’s 10 Principles for Livable Communities”. The presentation is targeted for 6th graders throughout the State. The AIANJ150 Committee has prepared the program information which was released to all the participants during the Training Session on February 27, 2007 at Somerset Marriott. The ALNNJ has approx. 20 participants. The volunteers are responsible for making arrangement with their selected local school. Presentations will be the week of March 28, 2007.

The presentation is an interactive program, where the students will assist in building a simulated community on a computer or manually by hand with various components of a community, and to see if they are able fulfill the 10 principles of a livable community. Buda TripletsTheir names are Antonina (2lbs 8oz), Francesca ( 2lbs 12oz) and Alessia (2lbs 7oz). They were born on October 29th at the Valley hospital in Ridgewood. They were at 29 weeks gestational age and in the NICU at the hospital for 11 weeks. The babies were considered micro-preemies. Both myself and my wife Krista were very happy and excited to have had them home for Christmas. Joe Buda
