THE RAJASTHAN MINIMUM WAGES RULES, 19591CHAPTER I
'Act' means the Minimum Wag~s Act, 1~48 (Central Act Xl of (948);
'Day' means a period of twenty four hour~ beginning at mid.night;
'Authority' means the authority appointed under sub-section (1) of
Prc~iminary
'. 1. Short title and extent-(l) These Rules may be called Minimum Wages Rules, 1959.
(2) They extend to the whole of the State of Rajasthan
2. Interpretation.-In these rules, unless the contextquires;-
(a)

(g) 'Form' mea"Ds a form appended to tbese rules;
{h) 'Inspector' means a person appoi ted as Inspector under section 19;
(i) 'Registered Trade Union' means a trade Union registered under the
Indian Trade.Unions Act, 1926;
(j) 'Section' means a sec.tion of the Act, and
(k) .AII other words and expressions used herein and not defined shall havethe meaning respectively assigned to tbem in tbe Act.
CHAPTER II
Membership, meetings and staff of the.Board and Committee
. 3. Term of office of members of the Committee-Tht term of office of the members of Committee shall be such as in the opinion of the StateGovernment is necessary for completing the enquiry into the scheduled emp'oy.ment concerned and tbe State Government may, at the time of the cons.titutionof a Committee fix such term and may. from time to time, exteno it as circum-
stances may require.
. 4. Term of office of members of the Board- (I) Save as other-wise expressly provided in these rules the term of office of a non-official member of the Board shall be two years commencing on the date of his nomi~ation:
Provided that such member ,hall notwithstanding the expiry of the said period of two years, continue to hold office until his successor is nominated.
(2) A non ollicial member of the Board nominated to fill.a casual vacancy
shall hold office for the remaining period of the term of office of the member inwhose place he is nominated.
. (3) The official members of the Board sholl hold office during the plea-
sure of the State Government.

by notice in writing signed on its behalf and by such member and addressed to the
Chairman of the said committee or the Board as the case may be, nominate a.substitut~ in his place to attend that meeting. ,Such a substitute member shallhave all the rights of a member in respect of that meeting.
5. Travelling allowance--A .noo-official member of the Committee,or tbe Board shall be entitled to draw travelling and halting allowances for aoy
journey performed by him in connection with bis duties as such member & t therates and subject to the conditions applicable to a-Government servant of the firstclass under tbe rules of tbe State Government. .
. 6. Staff-Ii) The Secretary sball be tbe chief. executive officer of tbeCommittee or the Board as the case may be. He may attend the meetings of sucbcommit"" of Board but shall not be entitled to vote at such meetings.
(ii) The Secretary shall aosist tbe Cbairman io coovening meetings and shall keep a record of minutes of such meetings and shall take necessary measuresto carry out decisions of the Committee, or lhe Board, as the case may b~.
7. Eligibility for re-nomination of the members of the.Committee.and the Board~An out going member sball be eligible for nomination for themembership of the committee, or the Board of which he was a member.
8. Resil/nation of the Chairman and members of the Committeeand the Board dfilling of casual vacancies-(l) A member of tbe Commi-ttee. or tbe Board otber than the Chairman may, by giving notice in writing to tbe

10. Disqualification_. (I) A person sball be disqualified for beingnominated as, and for peing a member of the Committee, or the Board, as thecase may be :-
(i) ifll. is declared to be of unsound mind by a competent court, or (ii) if be is an undiscbarged insolvent; or .
(iii) if before or after tbe commencement of the Act, be bas been convicted of an offence involving moral turpitude.
(2) If any Question arises wbether a disqualification bas incurred under sub-rule (1) the decision of tbe State Government tbereon sball be final.

Provided that on a requisition in writing from not less than one half of the.members. the Chairman shall call a meeting within fifteen days [10m the date of receipt ofsucb requisition.
12. Notice of M eetings-The Chairman shal.] fix t he date, time a nd place of every meeting, and a notice in writing the aforesaid particulars along witha list of business to be conducted at the meeting, shall be sent to each member byregistered post atleast fifteen days before the date fixed for such meeting :
Provided that in the case of an emergent meeting, notice of seven days o>llymay be given to every member.
13.. Chairman-(I) The Chairman shall preside a t the meetings of theCommittee, or the Bo~rd as the case may be.
(2) In the absence of the Chairman at any meeting the members shall eJectfrom amongst themselves one member, by a majority of votes, who shall presideat such meeting. .
1[14. Quorum-No business shall be transferred at any meeting unlessat least one-third of the members, of whom there shall be at least one represen-tative each of both the employees and the employers, are present:
Provided that if at any meeticg less than one-third of the members are present or no representatives of both the employers and the employees are present,the Chairman may adjourn the mc.cting to a date not later than seven days fromthe date of the original meeting and it shall thereupon be lawful to dISpose of the
business at such adjourned meeting irrespective of the number or class of members. present.
15. Disposal of b usiness-All business shall be considered at a mee-ting of the Committee. or the Board as the case may be, and shall be decided by.a majority of the votes of the members present and votmg,. In the event of anequality of votes the Chairman shall have Casting vote: .
Provided that the Chairman may, if he thinks fit, ditect that any matter
shall be decided by the circulation of necessary papers and securing written opinionof the members:
Provi~ed further that no decision on any question which is referred under the first proviso shall be taken, unless supported by not less than two-third of themembers.
16. Method of voting.- Voting shall ordinarily be by show of hands; butif any member asks for voting by ballot, or if the Chairman sO decides, the votingshall be by secret b.,lIot and shall be held in such manner as the Chairman maydecide. .
.17. Proceedings of the meeting-(l) The proceedings of each meetingshowing inter alia the names of the members .present there at shall be forwarded toeach member and to the State Government as soon after the meeting as possibleand in any case, not Jess than seven days before the next meeting.
(2) The proceedings of each meeting shall be confirmed with such modi-fiCations, if any, as m.ay be considered necessary at the next meetirig.

Course of any enquiry. Such summons may require a witness to appear before it
on a date specified therein and to produce any books, papers, ..or other documentsand things in his possession or under his control relating in any manner to theenquiry.
. (2) A summon under sub-rule (i) may be addressed to an individual or anorganisation of employers or a registered trade union of workers.
(3) A summon under this rui, may be served :_
(i) in the case of an individual by being delivered or sent to. him by regis.tered post;
(ii) in the case of an employers' organisation or registered trade union of workers by being delivered or sent by registered post to the Secretary or other
principal officer of the organisation or union, as the case may be.
(4) The provisions of the Civil Procedure Code relating to the summoningand enforcement of appearance of witnesses and the production of documentsshall. so far as may be. apply to proceedings before a Committee, or lhe Board.
19. Expenses of witness._ Every person, who is summonedandappears as a wi~ness before a Committee or the Board shall be entitled to anailowance for expenses, incurred by"him in accordance with scale for the time being in" force for payment of such allowances to witnesses appearing in"civiJ courtsin the State.

Explanation-Every payment made by the employed person to the employer
Of his agent ~ball, .for the purposes of these rules, be deemed to be a deduc~ionfrom wages.
(2) Deduction from the wages of a person employed in scheduled employ-ment shall be of one or more of the followlUg kinds namely:-
(i) Fines-Provided that no fineshall be imposed on any employed personsave in respect of such- acts and omiSSIons on hiS part as the employer with the
previous approval of the State Government may have specified; .
(ii) Deductions-for absence from duty;
. (iii) deduction for damage to or less of goods expressly entrusted to theemployed person for custody, or for loss of money for which he is required toaccount. where such damage or loss is directly attributable. to his neglect or default;
(iv) deductions for house accommodation supplied by the cmployer or theState Government or Municipality or Housing Board and other authorities consti.
tuted by or with the permission of the State Gobernment for providing housingaccomrnpdation; .
. (v) deduction for such amenities and services supplied by the employer asthe _Sl'ateGovernment may by general or special order authorise;
E.,:planafion- The words amenities and services in tbjs clause does not in-clude the supply of tools and protectives required for the purposes of employment.
(vi) deductions for recovery of advances or for adjustment of over pay-
ments of wages;
Provided that such advances do not exceed an amount equal to wages for two calendar months of the employed person and. in no case, shall the monthlyinstalment of ded\.!ctions exceed one-fourth of the wages earned in that month.
(vii) deductions. of income tax payable by the employed person;
(viii) deductions required to be made by order of a court or other compe-
tent authority;(ix) . deductions for subcriptions to. and for repayment of advances from
any proviuent fund to which the Provident Fund Act, 1925 applies or any recogni-sed provident fund as defined in section 58-A of the Indian Income Tax Act. 1922.or any provident fund approved in this behalf by the Slate during continuance of
such approval,
(x) deductions for .payment to co-operative societies .or to a scheme of in..sUJ;ance approved by the Government;
(xi) deductions for recovery of adjustment of amounts other than wagespaid to the emplqyed person in error or in excess of what is due to him; "
(xii) ded~ctjons, for made with the written authorisation of the person emp-loyed for payment of any premium on his life insurance policy to the life InsuranceCorporation of India established under the life Insurance Corporation Act, 1956or for the purchase of ~ecurities of the Government of India or any State Govern-

(5) The amount of fine ;mposed under sllb-rule (5) shall be utilhed only
for such purposes beneficial to tte employees as are approved by the SlateGovernment.
(6) Nothing in this rule shall be deemed effect the provisions of the Pay-ment ot Wages Act, 1936.

Old Rules 22. Publicty to the mimimum wages fixed under theAct--Notice in form X containing the minimum rates of wages fixed toge!her with extracts from the Act, the rules made thereunder and the name arid addressof the Inspector shaH be displayed in English and in a language understood by themajority of the worken in the employmenf at such place, as may be selected bythe Inspector and shall be maintained in a clean and legible condilion. Suchnotices shaH also be displayed on the notice boards of all sub-divisional aDd District Offices.
23. Weekly Holidays-(l) Unless other\\.ise per",itled by the StateGovernment no worker shall b e required or allowed to work in a scheduled employment on the first day of the wee-k (hereinaffer referred to as tbe said dayeXl.:ept when he has or will 11ave a holiday for a whole day on one of the lhreedays immediately before or after the said day, for which he shaH receive paymentequal to his avetage daily wages during the preceding week:
Provided that the weekly lwliday may be substituted by another day:
Provided further that no substitution shall be riJade whir:h will result inany working for more than ten days consecutively without a holiday for a wholeday.
(2) Whether in accordance with the provision of sub rule (I) any worker works on the said day and has had a holiday on one of the five days immedia-tely preceeding it, the said. day shall, for the purposes of calaulating his weeklyhours of work be included in the preceding week. .
E~planation.-For the purp0ses of this rule. 'week' shall mean a. period of seven days beginning "t mid-night on Saturday night.
24. Number of hou.rs of work shall constitute a normal work-ing day. No adult worker shall be required or allowed to work in a scheduleemployrn_ent for more than nine hcurs in a day a nd forty eight hours in anyweek.

Lvery employer shall keep exhibit the following .notices in a conspicuous placein the factory, workshop or place where the workers in the Schedule employment31~ employed and in the case of out workers in such factory, workshop orplaceas: is used for giving out work to them :-

Provided that where the minimum daily rate o f wages of the worker asnotified under the Act has been worked out by dividing the minimum monthlyrate of wages by twenty six or where the actual daily rate of wages of the worker has been worked out by dividing the monthly rate of wages by twenty-sIx and suchactual daily rate of wages of the worker is not less than the notified minimumdaily rate oewages of the worker no wages for the rest day shall be payable, arid in case the worker works on the rest day and has been' given a substituted rest day,he shall be paid only for tbe rest d ay o n which he worked, .ao amount equalto the wages payable to him at the nvertime rate:
Provided further that in the case of a worker governed by a piece-ratescheme, the wages for the rest day. or as the case may be, for the rest day andthe substituted rest, shall be such as the State Governme~t may from time to timespecify in this behalf having regard to the minimum rates of wages fixed under theAct in respect of the Scheduled employed. . .
Explanatiorl:-In this suh rule, "next preceding day" means the last day onwhich the worker has worked, which precedes the rest day or the substituted restday, as the case may be; and where the substituted rest day falls on a dayimmediately afler the rest, the next preceding day mean's the last day on whichthe worker has worked, which precedes the rest.
(5) The provisions of this rule shall a pply to the worker in scheduled employment other than agricultural employmeDt,
(6) The provisions of this rule shall not operate to the prejudice nf morefavourable terms, if any, to which a worker Dlay be entitled under any other lawor under the terms of any award, agreement or contract of service, and in such acase, the worker shall be eDtitled only to the more favourable terms afuresaid.
Explanation :-For the purpose of this rule. 'week' shall means a period of seven days beginning at midnight on Saturday night .
.24, Numberof hours of work that shall constitute a workingday:-(1) The number of hours of work constituting a normal workingday 5hall-
(a) in the case of an adult worker, be nine hours, inclusive of interval forrest as specified in sub-rule (2),
(b) in the case of child, be 4i hours.
(c) in the c ase of a n a dolescent, be 9 hours or 4 } hnurs as the case may be, according as the adolescent may be certified to work as an adult or a child bya registered medical practitioner approved by the State Government. .
(2) The period of work of an adult worker each day shall be so fixed thatno period shall exceed five hours and that no worker shall work for more than fivehours before he has had an interval for rest of at least half an hour.
(3) The periods of work n f an adult worker shall be so arranged lhatinclusive of his intervals for rest under sub-rule (2) they shall not spread over more than ten and a half hours in any day:
Provided that the inspector may, for reasons to be specified i n " writingincrease the period over to twelve hours.
(4) No woman shall be employed or permitted to work beyond 6.00 p. m.and earlie.f than 6~. m. during 1st Sept~mber, to the end of February or beyond7.00 p. m, and earher than 7 a, m. from the 1st March to 31st August.
(5) The provisions of sub.rule (I) io (4) shall in the case of workmen inagricultural employment he subject to such modifications as may, from time totime be nntified by the State Government.

124-A-The provisions of section 13 (1) and rule 23 and 24 shall apply tothe classes of employees specified in seclion 13 (2) only to the eXlq1d and subjectto the conditions specified below :-
(I) No worker shall be allowed or required to work continuously for aperiod of more than fourteen days without a rest day of 24 consecutive hours.
(2) Every worker shall be allowed a substituted rest day within a fortnightof the rest day on which he is allowed or required to work and an intimationthereof shall.he sent to the Inspector so as to reach him at least 24 hours before
the substituted rest day is allowed.
2[(3) No worker in any establishment shall be required or allowed to work for more than 9 hours a day and 48 hours in any week:
Provided that the total number of hours of work including overtime shalInot exceed ten hours on any working day: . .
Provided further that the total.number of over-time hours worked by any
worker shall not exceed 50 hours in a quarter.]
(4) The payment for the work done in excess of the normal working hour,fixed in rule 24 shall be made at the overtime rate fixed by the :state Government.
(5) A notice of overtime work to be taken from tbe workers shalI be affixed in the premises of the employment before the commencement of tbe work mentio~ning the names of the persons put on overtime work and the purpose and dura-tion of such employment. A copy of such notice shall also be sent to the inspector concerned within 24 bours of the start of tbe work.
25. Night shifts.-(l) Where a worker in a scheduled employmentworks on a shift which extends beyond midnight:-
. (a) for the purpose of rule 23, a holiday for the whole day shall mean inhis case a period of twenty four consecutive hours beginning when his shift ends
. (b) the folIowing day for him shall be deemed to be the period of twentyfour hours begiocing when such shift ends, and the hours he bas worked aftermid-night shall be counted towards the previous duty ..

26. Extra wages for overtime- yv'hen a worker works i.ll/an employment
for more than nine hours on any day. or for more than forty-elgh~ hours in any
week, he sball, in resp~ct of overtime work, entitled to wages:, (a) in the case of employment in Agriculture, atone and a half time the
ordinary rate of wages.
(b) in the case of any other scheduled employment, at double the ordinaryrate of wages. .
Explanatio,,:-The expression 'ordinary rate of wages' means the basic w~geplus such allowances including the cash eqUIvalent of the advan.tages accruingthrough the concessiomd sale to.the person, empl?yed, of. foodgrarns and .. otherarticles as-the person employed IS, for the tIme bemg, entItled to, does not Includea bonus.

CHAPTER V
Form of Registers and Records
27'. Wage registers and Slips-1(1) A regisler of wagesshall be maintained by every employer ane kept in ,"ch FOJ m a' may be notifi,d by the Governmentand shall include the following particulars:-
(a) the gross wages of each worker of each wage period;
(b) all deductions made from wages, with an indication, in each case, of the kinds of deJuctions mentioned in sub-rule (2) of rule 21;
(C) the wages actually paid to each worker for each wages period and thedate of payment;
(d) rates of wages payable;
(e) a register of wages shall be maintained by every employer at the work spot in Form XI."
(2) Wage slips in form XII shall b e maintained by every elLployer toevery person employed by him at least a day prior to the disbursement of wages.
(3) Every employer shall get the signature or the thumb impression of every person employed on the wage book and [wage slip. .
(4) Entries in the wage books and wage slips shall be authenticated by theemployer or any person authorised by him in this behilif. ,
(5) A Muster Roll shall be maintained by every employer at the work spotand kept in form V. "
.1"(6) In the case of the employment on the construction or maintenance of the ro~ds or in building operation's only and in agriculture. the owners of suchemployments may Iwt be required to maintain registers, forms and returns requi-red under the Act, provided, that:-
(ar the o wner of the house builds a house for his own use, the v alue of which does not exceed Rs. 30,000 or repairs or alteTS his own house, the value of which does not exceed Rs, 10,000 at a time. , ,
(b) the owner of the cultivated land, owns a land, acreage of which 'is llotabove 25 acres.
(7) Notwithstanding anything contained in this Rule where a combined form is sought to be used by the employer to avoid duplication of work for com-
pliance with the provisions of any other Act of the rules framed there-under, and

be used with the previous approval of the Labour Commisioner of the State.(8) The following shall be cases and circumstances in which an employee

Scale of costs in proceedings under this Act
31. Costs-( I) The Auihority, for reasons to be recorded in wntmg.maydirecl that the COSISof any proceedings pending before it sball not follow Iheev(nt.
(2) The costs which ,may be 'awarded sball include :_
(i) expenses incurred on accocnt of court fees;
(ii) expenses incurred on subsistence money to witnesses; ahd
(iii) pleader's fees to the extent of ten rupees provided that Ihe Authority Inany proceeding, may reduce the, fees toa sum not less than five rupees or for reasons to b e recorded if writing increase it to a sum not exceeding25 rupees.
(3) Where there are more than one pleaders or more than one applicantsor opponents the Authority may subject as aforesaid to the successful party orparties such costs as it may deem proper.
32 Court fee-The Court fee payable in respect of proceeding under section 20 shall be :_
(i) for every application to'summon a witneSS-one rupee in respect of eachwitness.
(ii) for ,every application made by or on behalf of an individusals-One~rupee.
l(iii) for every application made on behalf in respect of a number of emplo-yees-one rupee per employee:' .

I. WHOM THE ACT AFFECTS.
(aJ the Act applies to persons engaged on scheduled employments on speci-fied class of work in respect of wbich minimum rates of wages have been fixed.
(b) no employee can give up by contract or agreement his rights in so far as it purports to reduce the minimum rates of wages fixed under the Act.
H. DEFINITION OF WAGES
2. "Wages" means aU remuneratiQns payable to an employed person onthe fulfilment of his contract of employment and also includes house rent allowance.If excludes:
(i) the value of any house accommodation, supply of light, water, medicalattendance o.r any other amenity or any service extensions by general or specialorder of the appropriate Government.
(ii) Contribution paid by the employer to any pension fund, providentfund or under any scheme of Social Insurance;
(iii) the travelling alJowance or the value of any travelling concession;
(iv) the sum paid to the ptrson employed to defray special expenses entail-ed on him by the nature of his employment.
(v) Gratuity payable on discbarge.
The minimum rate of wages may consist of-
(i) A basic rate of wages and a special allowance called the cost of livingallowance.
(ii) A basic rate of wages with or witbout a cost of living allowance and tbecash value of any concessions like supplies of essential commodities at conceSSIOnrates; .
(iii) On all inclusive rate comprising of basic rate cost of living allowance
and cash value of concessions, if any;3. The minimum wages payable to employee of scheduled employment
notified under section 5 read with section 3 may be;
(a) a minimum time rate,

176 of the Indian Penal Code.VIII. CLAIMS AND COMPLAINTS
Where.an employee is paid Jess than the minimum rates of wages f ix ed for hisclass of work of less than the amopnt due to him under the provi5ions of this Act,he can make an application in the prescribed form witi:in six months to the 3uthOl ityappointed for the purpose. An application delayed beyond this period may beadmitted if the authority is satisfied that the applicant had sufficient cause for notmaking the application within such period.
Any legal practitioner, .official of a registered Union, Inspector under theAct or other person acting with the permission, the A uthority can make thecomplaint on behalf of an employed person.
A single application may be presented by or on behalf of any number of persons belonging to the same factory the payment of whose wages has beendelayed.
A complaint regarding less payment of notified wages under section 22 of theAct can be made to the court only with the sanction of the Authority without onemonth of the grant of such sanction.
A complaint under section 22 of the Act can be made to the ~OUrt only byor with the sanction of an inspector within six months of the date on which theoffence is alleged to have been committed.
IX. ACTION BY AUTHORIrY
When any application under sub-sec.(2) of sec. 20 is entertained, the authorityshall hear tbe applicant and the employee or give thell1 an opportunity of beingheard, and after such further inquiry, if any, as it may consider necessary, m,ay.without prejudice to any other penalty to which tbe employer may be liable uDder the Act, direct:
(i) in the case of a claim arising out of ;Jayment of less than the minimum
rate of wages. the payment to tbe employee of the amount by which the minimumwages payable to him exceed the amount actually paid together with the paymentof such compensation as the Authority may think fit, not exceeding ten times tbeamount of such excess;
(ii) in any other case, the payment of the amouDt due to the employee,together with the payment of such compensation as the Authority may think fit notexceeding ten rupess and the Authority may direct payment of ~uch compensationin cases where the excess or the a mount due is paid by the employer to theemployee before the disposal of the application.
X. PENALTIES FOR THE OFFENCE UNDER THE ACT
An employer who pays to an employee less than the Minimum rates of wages o r less than the amouo"t d ue to him under the provisions of the Act or contravenes any rule or order reg;lrding hours for a normal working day. etc. shall
be punishable with imprisonment for a teem which may extend to six months or
with fiDe which may extend tho five hundred rupees, or with both. ..Any employer who contravenes any provision of the Act or any rule made
there under shall if no olher penalty is provided for such contravention by theAct, be punishable with the fjne which may. extend to five hundred rupees.The authority in. imposing such fine shall a lso take into consideration theamount of any compensation already awarded in any proceeding already held
before the Authority.

XI COGNIZANCE OF OFFENCES'
No Court shall tak.e cognizance of a complaint against any persons for anyoffence in cases of less payment tban the minimum rates of wages.fixed or les~ than the amount due unless an a pplication in r es- peetiof the faets constitotmg :::uchoffence has been presented before the Authority.and bas b'een granted wholly or in part and the Gov~rnment or any other officerauthorised by the Government in this behalf has sanctioned, the making of suchcomplaint and in cases of contravention of any rule or order made regarding hours-
for a normal working day or for not providing fur a day of rest or for no~
provi-ding payment for work on a day of r~st unless the complaint has been made by orwith the sanction of the Inpeetor and the complaint in either of the cases has.been presented before the court within one month of the making of the said sanc-tidn and for all other contraventions of the prosions oftbe Act, OJ of any rule ororder made there under unJess the complaint has been made by or with the sanc-tion of the Inpector and th~ same has been presented within six- months cf the dateon which the offence is alleged to have been committed.
