April 7 was the deadline for the Governor to act on bills passed during the 60-days legislative session
SB 244 and HB374 Amendments to the Homeowner Associa-tion Act were both vetoed
These nearly identical bills sought to among other things cap the cost a Homeownerrsquos Association could charge for disclosure statements at $300
The Governorrsquos rationale for her veto pointed out that the bill(s) would ldquoplace numerous requirements on homeowner associations that would be both burdensome and costly and the procedural requirements would likely lead to greater expenses for both associations and residentsrdquo
The Governor did sign SB387 Qualifying Brokerrsquos License Re-quirements into law This bill increases the requirements needed to become a QB Under the bill ldquoa qualifying broker shall not supervise associate brokers until the qualifying broker has had an active associate brokerrsquos or qualifying brokerrsquos license or equivalent
real estate license for at least four yearsrdquo The bill goes into effect January 1 2018
Another bill supported by RANM HB199 was signed into law This bill creates the Consumer Protection for Distributed Gen-eration Act which provides minimum disclosures for financing of solar systems
Final action on all bills is available on the governorrsquos web site

NAR President-Elect Elizabeth Menden-hall and Region XI RVP George Harvey joined RANM leaders from around the state for our event and both provided information updates to RANM Directors
Directors approved the 2017 RANM Work Plan and confirmed Dan Hernadez Patricia Pipkin Lela Holmes Michelle Martin and Dan Coleman as appointed Directors

Wersquore Off and RunningOver the past couple of years I started a notebook with thoughts for guid-ing RANM forward and increasing our membership participation at all levels
Those ideas included my theme of Showing New Mexico since as REAL-TORSreg we show so much about what we love about our communities
Another idea was REAL-TORSreg Back New Mexico Children which is the program to provide at least 500 backpacks and school supplies to our New Mexico elementary students across the state We are working on details and logistics of this statewide community project Stay tuned for how you can be involved
We will also be pursuing and we are hoping your association will jump on board in increasing our RPAC partici-pation level with FUNraisers Your associa-tion can request a grant from NAR to put on a FUNraiser
such as a tethered balloon ride a motorcycle rally ride a night at the Isotopes or Ruidoso Downs a horse-back ride through Chaco Canyon - you get the idea

At their March meeting the New Mexico Real Estate Commission approved changes to Section 1661198 Broker Duties Disclosure of the Real Estate Rules that govern all New Mexico real estate licensees
The entire section has been reorganized and now includes a ldquoBroker Obligations to Other Brokersrdquo section as follows
BROKER OBLIGATIONS TO OTHER BROKERS
Brokers owe the following professional obligations to other brokers however brokers are not required to provide to one another a list of these broker obligations
A honesty reasonable care and ethical and professional conductB timely presentation of offers or counter-offers and responses thereto unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesC active participation in assisting the party to whom the broker is directly providing real estate services in complying with the terms and conditions of the contract and with the closing of the transaction unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesD compliance with local state and federal fair housing and anti-discrimination laws the New Mexico real estate license law and the Real Estate Commission rules the New Mexico Uniform Owner-Resident Relations Act and other applicable local state and federal laws and regulationsE written disclosure of any adverse material facts actually known by the broker about the property or the transaction or about the financial ability of the parties to the transaction to complete the transaction ad- verse material facts requiring disclosure do not include any information covered by federal fair housing laws or the New Mexico Human Rights ActF written disclosure of any potential conflict of interest that the broker has in the transaction including but not limited to any material interest the broker has in the transaction or any relationship of a business per- sonal or family nature that the broker has with a party to the transactionG non-interference with a purchase agreement or any express written agreement that another broker has with a buyer seller landlord (owner) or tenant

NARrsquos has identified and is monitoring several issues on the federal level that are of critical importance to REALTORSreg
Tax Reform - NAR Issue Summary
The new leaders of Congressrsquos tax-writing committees Ways and Means Chairman Kevin Brady (R-TX) and Fi-nance Chairman Senator Orrin Hatch (R-UT) have each expressed a strong desire to accomplish tax reform And now that President Trump has taken office and has made it clear that he shares the goal of modernizing the tax code we are facing the possibility of big changes being enacted to the tax law than we have seen in a long time
The path forward to tax reform is still quite cloudy howev-er with policymakers of all stripes expressing a willingness to simplify the tax law and to broaden the base and lower the tax rate a very real possibility exists that common ground on tax reform can be found
Along with this possibility is the danger that the tax incentives for owning a home (such as the elimination or reduction of the Mortgage Interest Deduction) could be diminished for the majority of Americans and that vital provisions for commercial real estate (such as elimination of 1031 Exchanges) could be repealed or limited in order to ldquopay forrdquo lowering the tax rates
NAR acknowledges the complexity of the current tax sys-tem and seeks to assure that tax reforms support the goals of homeownership and the freedom to buy maintain and sell real estate
Tax reform legislation is likely to come into focus this year in late summer
Flood Insurance - NAR Issue Summary
America needs the National Flood Insurance Program which
bull Protects homes and businesses with over 5 million policiesbull Safeguards communi- ties across the countrybull Shields homeowners from devastating costs The average flood claim is $43000
The National Flood In-surance Program expires on September 30 NAR is working closely with federal regulators and members of Congress to strengthen the program and clear the way for a private market to take hold NAR has also issued a series of principles to improve access and afford-ability for consumers
NFIP legislation is likely to move in late spring this year
Government Sponsored Enterprises Reform (Fan-nie Mae and Freddie Mac)
- NAR Issue Summary
Fannie Mae and Freddie Mac play a key role in the secondary mortgage market which is crucial in providing capital for mortgage lend-ing Without the GSEs and FHA-insured loans there would be almost no capi-tal available for mortgage lending This would severely restrict if not curtail home sales and any supporting an-cillary home sales services
There is no projected start date for GSE legislation
It is essential for REAL-TORSreg to highlight NARrsquos positions on these issues to ensure Members of Con-gress do not enact proposals that would disrupt real estate markets around the nation
RANM members will be visiting with New Mexicorsquos Congressional delegation next month during NAR Legislative Meetings to make sure they know where the REALTORSreg stand on these and other issues

Brokers be aware that the rules that apply to the advertising of property that is not listed with your brokerage apply to social media sites that permit the user to ldquosharerdquo or otherwise disseminate information from another userrsquos social media pagepost or from a third-party source Such ldquosharingrdquo is the equivalent of copying another brokeragersquos listing and placing it in your print or website advertise-ment
Strangely nowhere in the NM Real Estate Brokers Act nor the NMREC regulations does it explicitly state that a broker cannot advertise a property listed with another broker without the permission of the listing broker or the seller (pro-vided NMREC advertising rules are followed) So where is this prohibition
To begin Standard of Practice 12-4 from the REALTORSreg Code of Ethics provides that ldquoRE-ALTORSreg shall not offer for salelease or advertise property without authorityrdquo Furthermore MLSs as a matter of local discretion may prohibit participants from advertising specific
properties which are list-ed with other participants (unless the participant has obtained permission from the listing participant)
In the listing agreement the seller grants the list-ing broker the authority to advertise the property The listing agreement also may authorize the listing broker to permit other brokerages to advertise the property conditionally or uncondi-tionally
The placing of a listed prop-erty on a social media site does not give every other brokerage permission to share that listing unless the posting includes language conveying such permission
Such language must be clear as to what permis-sion is given For instance a listing that appears on a social media site that states ldquoCooperating brokers have permission to share this listing on their social media pagerdquo grants the cooperating broker permission to post on hisher social media page only
In contrast a broker that states ldquoThis listing may be shared by any cooperating brokerrdquo places no limitation on how the listing is adver-tised by a cooperating bro-ker which means that the cooperating broker is free to place an advertisement
using any medium though this may not have been the intent of the listing broker or the understanding of the seller
In short just because a social media site permits you to ldquosharerdquo information this doesnrsquot give you the right to do so in a manner that violates NMREC regulations MLS rules andor the REALTORreg Code of Ethics And recall in the event of a NMREC regulation viola-tion the qualifying broker also may be liable as NMREC regulations provide
Just because a social media site permits to to ldquosharerdquo information you must keep in mind NMREC regulations MLS rules
and the REALTORreg Code of Ethics
that the qualifying broker is responsible for supervising all real estate related activ-ities performed by the bro-kerage on behalf of others including but not limited to advertising rdquo

Contributions are not deductible for income tax purposes Contributions to RPAC are voluntary and are used for political purposes You may refuse to con-tribute without reprisal and the National Association of REALTORSreg or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed 70 of each contribution is used by your state PAC to support state and local political candidates Until your state PAC reaches its RPAC goal 30 is sent to National RPAC to support federal candidates and is charged against your limits under 2 USC 441a after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates

RANM January Meetings
Each year the National As-sociation of REALTORSreg sets fundraising and par-ticipation goals for all 50 states (and Puerto Rico) and rewards those that meet the goals In 2015 RANM achieved the highest recognition possible - The Presidentrsquos Cup - but fell short in 2016 as we did not achieve the required mini-mum 20 percent on ldquoCalls for Actionrdquo (we did attain ldquoTriple Crownrdquo status) It is RANMrsquos mission to again attain The Presidentrsquos Cup
To do so requiresbull RPAC-NM raise $175000bull 37 percent of our members contribute $15 or morebull one percent of the members contribute $1000 or more (Major Investors) andbull 10 percent of our Major In- vestors become Presidentrsquos Circle Members
There also are advocacy goals
bull reaching a minimum average response rate of 20 percent on NAR Calls for Action
bull hosting a voter regis- tration drivebull increasing the number of REALTORreg Party Mobile Alerts subscrib- ers andbull meeting Broker In- volvement goals
All the goals are achievable but it will take effort As RANMrsquos membership con-tinues to increase so does the number needed to reach the 37 percent participation goal RANMrsquos membership for 2017 has been pegged at 6122 meaning we need 2266 contributors to reach goal
After three months RPAC-NMrsquos fundraising is at about 62 percent of goal and participation is about 34 percent Not bad for the first quarter but getting the ball past the goal line is the hard part The next few
months are crucial in get-ting RANM closer to goal as wersquore hoping to avoid the stress of last-minute efforts
RPAC DistributionOf the $175000 RPAC-NM is being asked to collect in 2017 $37219
will go to NAR and will be used among other things for contributions to Con-gressional candidates (US House of Representatives US Senate)
After NAR gets its alloca-tion from RPAC-NM the balance is divided among the state organization and local boards The state provides contributions to candidates in executive non-federal statewide races and legislative races Mem-ber Boards can use their money for local races
The next big statewide election is in 2018 as New Mexico will elect a new
GovernorLt Governor with races for Attorney General Secretary of State Treasurer Auditor Com-missioner of Public Lands and numerous Legislative seats
Because of involvement in the political process NAR and RANM are major play-ers in helping pass or defeat legislation that impacts our membership

There is no projected start date for GSE legislation
It is essential for REAL-TORSreg to highlight NARrsquos positions on these issues to ensure Members of Con-gress do not enact proposals that would disrupt real estate markets around the nation
RANM members will be visiting with New Mexicorsquos Congressional delegation next month during NAR Legislative Meetings to make sure they know where the REALTORSreg stand on these and other issues

Brokers be aware that the rules that apply to the advertising of property that is not listed with your brokerage apply to social media sites that permit the user to ldquosharerdquo or otherwise disseminate information from another userrsquos social media pagepost or from a third-party source Such ldquosharingrdquo is the equivalent of copying another brokeragersquos listing and placing it in your print or website advertise-ment
Strangely nowhere in the NM Real Estate Brokers Act nor the NMREC regulations does it explicitly state that a broker cannot advertise a property listed with another broker without the permission of the listing broker or the seller (pro-vided NMREC advertising rules are followed) So where is this prohibition
To begin Standard of Practice 12-4 from the REALTORSreg Code of Ethics provides that ldquoRE-ALTORSreg shall not offer for salelease or advertise property without authorityrdquo Furthermore MLSs as a matter of local discretion may prohibit participants from advertising specific
properties which are list-ed with other participants (unless the participant has obtained permission from the listing participant)
In the listing agreement the seller grants the list-ing broker the authority to advertise the property The listing agreement also may authorize the listing broker to permit other brokerages to advertise the property conditionally or uncondi-tionally
The placing of a listed prop-erty on a social media site does not give every other brokerage permission to share that listing unless the posting includes language conveying such permission
Such language must be clear as to what permis-sion is given For instance a listing that appears on a social media site that states ldquoCooperating brokers have permission to share this listing on their social media pagerdquo grants the cooperating broker permission to post on hisher social media page only
In contrast a broker that states ldquoThis listing may be shared by any cooperating brokerrdquo places no limitation on how the listing is adver-tised by a cooperating bro-ker which means that the cooperating broker is free to place an advertisement
using any medium though this may not have been the intent of the listing broker or the understanding of the seller
In short just because a social media site permits you to ldquosharerdquo information this doesnrsquot give you the right to do so in a manner that violates NMREC regulations MLS rules andor the REALTORreg Code of Ethics And recall in the event of a NMREC regulation viola-tion the qualifying broker also may be liable as NMREC regulations provide

To do so requiresbull RPAC-NM raise $175000bull 37 percent of our members contribute $15 or morebull one percent of the members contribute $1000 or more (Major Investors) andbull 10 percent of our Major In- vestors become Presidentrsquos Circle Members
There also are advocacy goals
bull reaching a minimum average response rate of 20 percent on NAR Calls for Action
bull hosting a voter regis- tration drivebull increasing the number of REALTORreg Party Mobile Alerts subscrib- ers andbull meeting Broker In- volvement goals
All the goals are achievable but it will take effort As RANMrsquos membership con-tinues to increase so does the number needed to reach the 37 percent participation goal RANMrsquos membership for 2017 has been pegged at 6122 meaning we need 2266 contributors to reach goal
After three months RPAC-NMrsquos fundraising is at about 62 percent of goal and participation is about 34 percent Not bad for the first quarter but getting the ball past the goal line is the hard part The next few
months are crucial in get-ting RANM closer to goal as wersquore hoping to avoid the stress of last-minute efforts
RPAC DistributionOf the $175000 RPAC-NM is being asked to collect in 2017 $37219
will go to NAR and will be used among other things for contributions to Con-gressional candidates (US House of Representatives US Senate)
After NAR gets its alloca-tion from RPAC-NM the balance is divided among the state organization and local boards The state provides contributions to candidates in executive non-federal statewide races and legislative races Mem-ber Boards can use their money for local races
The next big statewide election is in 2018 as New Mexico will elect a new
GovernorLt Governor with races for Attorney General Secretary of State Treasurer Auditor Com-missioner of Public Lands and numerous Legislative seats
Because of involvement in the political process NAR and RANM are major play-ers in helping pass or defeat legislation that impacts our membership

Wersquore Off and RunningOver the past couple of years I started a notebook with thoughts for guid-ing RANM forward and increasing our membership participation at all levels
Those ideas included my theme of Showing New Mexico since as REAL-TORSreg we show so much about what we love about our communities
Another idea was REAL-TORSreg Back New Mexico Children which is the program to provide at least 500 backpacks and school supplies to our New Mexico elementary students across the state We are working on details and logistics of this statewide community project Stay tuned for how you can be involved
We will also be pursuing and we are hoping your association will jump on board in increasing our RPAC partici-pation level with FUNraisers Your associa-tion can request a grant from NAR to put on a FUNraiser
such as a tethered balloon ride a motorcycle rally ride a night at the Isotopes or Ruidoso Downs a horse-back ride through Chaco Canyon - you get the idea
First quarter has been filled with accomplishments including RANM involve-ment in the 60-day legis-lative session our January Leadership Legislative and Business Meetings training for Professional Standards Committee members and Ombudsmen negotiations on the possible sale of the RANM property prepara-tions for NAR Legislative meeting activities and more

At their March meeting the New Mexico Real Estate Commission approved changes to Section 1661198 Broker Duties Disclosure of the Real Estate Rules that govern all New Mexico real estate licensees
The entire section has been reorganized and now includes a ldquoBroker Obligations to Other Brokersrdquo section as follows
BROKER OBLIGATIONS TO OTHER BROKERS
Brokers owe the following professional obligations to other brokers however brokers are not required to provide to one another a list of these broker obligations
A honesty reasonable care and ethical and professional conductB timely presentation of offers or counter-offers and responses thereto unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesC active participation in assisting the party to whom the broker is directly providing real estate services in complying with the terms and conditions of the contract and with the closing of the transaction unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesD compliance with local state and federal fair housing and anti-discrimination laws the New Mexico real estate license law and the Real Estate Commission rules the New Mexico Uniform Owner-Resident Relations Act and other applicable local state and federal laws and regulationsE written disclosure of any adverse material facts actually known by the broker about the property or the transaction or about the financial ability of the parties to the transaction to complete the transaction ad- verse material facts requiring disclosure do not include any information covered by federal fair housing laws or the New Mexico Human Rights ActF written disclosure of any potential conflict of interest that the broker has in the transaction including but not limited to any material interest the broker has in the transaction or any relationship of a business per- sonal or family nature that the broker has with a party to the transactionG non-interference with a purchase agreement or any express written agreement that another broker has with a buyer seller landlord (owner) or tenant

Tax Reform - NAR Issue Summary
The new leaders of Congressrsquos tax-writing committees Ways and Means Chairman Kevin Brady (R-TX) and Fi-nance Chairman Senator Orrin Hatch (R-UT) have each expressed a strong desire to accomplish tax reform And now that President Trump has taken office and has made it clear that he shares the goal of modernizing the tax code we are facing the possibility of big changes being enacted to the tax law than we have seen in a long time
The path forward to tax reform is still quite cloudy howev-er with policymakers of all stripes expressing a willingness to simplify the tax law and to broaden the base and lower the tax rate a very real possibility exists that common ground on tax reform can be found
Along with this possibility is the danger that the tax incentives for owning a home (such as the elimination or reduction of the Mortgage Interest Deduction) could be diminished for the majority of Americans and that vital provisions for commercial real estate (such as elimination of 1031 Exchanges) could be repealed or limited in order to ldquopay forrdquo lowering the tax rates

At their March meeting the New Mexico Real Estate Commission approved changes to Section 1661198 Broker Duties Disclosure of the Real Estate Rules that govern all New Mexico real estate licensees
The entire section has been reorganized and now includes a ldquoBroker Obligations to Other Brokersrdquo section as follows
BROKER OBLIGATIONS TO OTHER BROKERS
Brokers owe the following professional obligations to other brokers however brokers are not required to provide to one another a list of these broker obligations
A honesty reasonable care and ethical and professional conductB timely presentation of offers or counter-offers and responses thereto unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesC active participation in assisting the party to whom the broker is directly providing real estate services in complying with the terms and conditions of the contract and with the closing of the transaction unless otherwise agreed to in writing by the party to whom the broker is directly providing real estate servicesD compliance with local state and federal fair housing and anti-discrimination laws the New Mexico real estate license law and the Real Estate Commission rules the New Mexico Uniform Owner-Resident Relations Act and other applicable local state and federal laws and regulationsE written disclosure of any adverse material facts actually known by the broker about the property or the transaction or about the financial ability of the parties to the transaction to complete the transaction ad- verse material facts requiring disclosure do not include any information covered by federal fair housing laws or the New Mexico Human Rights ActF written disclosure of any potential conflict of interest that the broker has in the transaction including but not limited to any material interest the broker has in the transaction or any relationship of a business per- sonal or family nature that the broker has with a party to the transactionG non-interference with a purchase agreement or any express written agreement that another broker has with a buyer seller landlord (owner) or tenant

Tax Reform - NAR Issue Summary
The new leaders of Congressrsquos tax-writing committees Ways and Means Chairman Kevin Brady (R-TX) and Fi-nance Chairman Senator Orrin Hatch (R-UT) have each expressed a strong desire to accomplish tax reform And now that President Trump has taken office and has made it clear that he shares the goal of modernizing the tax code we are facing the possibility of big changes being enacted to the tax law than we have seen in a long time
The path forward to tax reform is still quite cloudy howev-er with policymakers of all stripes expressing a willingness to simplify the tax law and to broaden the base and lower the tax rate a very real possibility exists that common ground on tax reform can be found
Along with this possibility is the danger that the tax incentives for owning a home (such as the elimination or reduction of the Mortgage Interest Deduction) could be diminished for the majority of Americans and that vital provisions for commercial real estate (such as elimination of 1031 Exchanges) could be repealed or limited in order to ldquopay forrdquo lowering the tax rates
NAR acknowledges the complexity of the current tax sys-tem and seeks to assure that tax reforms support the goals of homeownership and the freedom to buy maintain and sell real estate
Tax reform legislation is likely to come into focus this year in late summer
Flood Insurance - NAR Issue Summary
America needs the National Flood Insurance Program which
bull Protects homes and businesses with over 5 million policiesbull Safeguards communi- ties across the countrybull Shields homeowners from devastating costs The average flood claim is $43000
The National Flood In-surance Program expires on September 30 NAR is working closely with federal regulators and members of Congress to strengthen the program and clear the way for a private market to take hold NAR has also issued a series of principles to improve access and afford-ability for consumers
NFIP legislation is likely to move in late spring this year
Government Sponsored Enterprises Reform (Fan-nie Mae and Freddie Mac)
- NAR Issue Summary
Fannie Mae and Freddie Mac play a key role in the secondary mortgage market which is crucial in providing capital for mortgage lend-ing Without the GSEs and FHA-insured loans there would be almost no capi-tal available for mortgage lending This would severely restrict if not curtail home sales and any supporting an-cillary home sales services
There is no projected start date for GSE legislation
It is essential for REAL-TORSreg to highlight NARrsquos positions on these issues to ensure Members of Con-gress do not enact proposals that would disrupt real estate markets around the nation
RANM members will be visiting with New Mexicorsquos Congressional delegation next month during NAR Legislative Meetings to make sure they know where the REALTORSreg stand on these and other issues

Brokers be aware that the rules that apply to the advertising of property that is not listed with your brokerage apply to social media sites that permit the user to ldquosharerdquo or otherwise disseminate information from another userrsquos social media pagepost or from a third-party source Such ldquosharingrdquo is the equivalent of copying another brokeragersquos listing and placing it in your print or website advertise-ment
Strangely nowhere in the NM Real Estate Brokers Act nor the NMREC regulations does it explicitly state that a broker cannot advertise a property listed with another broker without the permission of the listing broker or the seller (pro-vided NMREC advertising rules are followed) So where is this prohibition
To begin Standard of Practice 12-4 from the REALTORSreg Code of Ethics provides that ldquoRE-ALTORSreg shall not offer for salelease or advertise property without authorityrdquo Furthermore MLSs as a matter of local discretion may prohibit participants from advertising specific
properties which are list-ed with other participants (unless the participant has obtained permission from the listing participant)
In the listing agreement the seller grants the list-ing broker the authority to advertise the property The listing agreement also may authorize the listing broker to permit other brokerages to advertise the property conditionally or uncondi-tionally
The placing of a listed prop-erty on a social media site does not give every other brokerage permission to share that listing unless the posting includes language conveying such permission
Such language must be clear as to what permis-sion is given For instance a listing that appears on a social media site that states ldquoCooperating brokers have permission to share this listing on their social media pagerdquo grants the cooperating broker permission to post on hisher social media page only
In contrast a broker that states ldquoThis listing may be shared by any cooperating brokerrdquo places no limitation on how the listing is adver-tised by a cooperating bro-ker which means that the cooperating broker is free to place an advertisement
using any medium though this may not have been the intent of the listing broker or the understanding of the seller
In short just because a social media site permits you to ldquosharerdquo information this doesnrsquot give you the right to do so in a manner that violates NMREC regulations MLS rules andor the REALTORreg Code of Ethics And recall in the event of a NMREC regulation viola-tion the qualifying broker also may be liable as NMREC regulations provide

Contributions are not deductible for income tax purposes Contributions to RPAC are voluntary and are used for political purposes You may refuse to con-tribute without reprisal and the National Association of REALTORSreg or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed 70 of each contribution is used by your state PAC to support state and local political candidates Until your state PAC reaches its RPAC goal 30 is sent to National RPAC to support federal candidates and is charged against your limits under 2 USC 441a after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates

RANM January Meetings
Each year the National As-sociation of REALTORSreg sets fundraising and par-ticipation goals for all 50 states (and Puerto Rico) and rewards those that meet the goals In 2015 RANM achieved the highest recognition possible - The Presidentrsquos Cup - but fell short in 2016 as we did not achieve the required mini-mum 20 percent on ldquoCalls for Actionrdquo (we did attain ldquoTriple Crownrdquo status) It is RANMrsquos mission to again attain The Presidentrsquos Cup
To do so requiresbull RPAC-NM raise $175000bull 37 percent of our members contribute $15 or morebull one percent of the members contribute $1000 or more (Major Investors) andbull 10 percent of our Major In- vestors become Presidentrsquos Circle Members
There also are advocacy goals
bull reaching a minimum average response rate of 20 percent on NAR Calls for Action
bull hosting a voter regis- tration drivebull increasing the number of REALTORreg Party Mobile Alerts subscrib- ers andbull meeting Broker In- volvement goals
All the goals are achievable but it will take effort As RANMrsquos membership con-tinues to increase so does the number needed to reach the 37 percent participation goal RANMrsquos membership for 2017 has been pegged at 6122 meaning we need 2266 contributors to reach goal
After three months RPAC-NMrsquos fundraising is at about 62 percent of goal and participation is about 34 percent Not bad for the first quarter but getting the ball past the goal line is the hard part The next few

Contributions are not deductible for income tax purposes Contributions to RPAC are voluntary and are used for political purposes You may refuse to con-tribute without reprisal and the National Association of REALTORSreg or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed 70 of each contribution is used by your state PAC to support state and local political candidates Until your state PAC reaches its RPAC goal 30 is sent to National RPAC to support federal candidates and is charged against your limits under 2 USC 441a after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates

RANM January Meetings
Each year the National As-sociation of REALTORSreg sets fundraising and par-ticipation goals for all 50 states (and Puerto Rico) and rewards those that meet the goals In 2015 RANM achieved the highest recognition possible - The Presidentrsquos Cup - but fell short in 2016 as we did not achieve the required mini-mum 20 percent on ldquoCalls for Actionrdquo (we did attain ldquoTriple Crownrdquo status) It is RANMrsquos mission to again attain The Presidentrsquos Cup
To do so requiresbull RPAC-NM raise $175000bull 37 percent of our members contribute $15 or morebull one percent of the members contribute $1000 or more (Major Investors) andbull 10 percent of our Major In- vestors become Presidentrsquos Circle Members
There also are advocacy goals
bull reaching a minimum average response rate of 20 percent on NAR Calls for Action
bull hosting a voter regis- tration drivebull increasing the number of REALTORreg Party Mobile Alerts subscrib- ers andbull meeting Broker In- volvement goals
All the goals are achievable but it will take effort As RANMrsquos membership con-tinues to increase so does the number needed to reach the 37 percent participation goal RANMrsquos membership for 2017 has been pegged at 6122 meaning we need 2266 contributors to reach goal
After three months RPAC-NMrsquos fundraising is at about 62 percent of goal and participation is about 34 percent Not bad for the first quarter but getting the ball past the goal line is the hard part The next few
months are crucial in get-ting RANM closer to goal as wersquore hoping to avoid the stress of last-minute efforts
RPAC DistributionOf the $175000 RPAC-NM is being asked to collect in 2017 $37219
will go to NAR and will be used among other things for contributions to Con-gressional candidates (US House of Representatives US Senate)
After NAR gets its alloca-tion from RPAC-NM the balance is divided among the state organization and local boards The state provides contributions to candidates in executive non-federal statewide races and legislative races Mem-ber Boards can use their money for local races
The next big statewide election is in 2018 as New Mexico will elect a new
GovernorLt Governor with races for Attorney General Secretary of State Treasurer Auditor Com-missioner of Public Lands and numerous Legislative seats
Because of involvement in the political process NAR and RANM are major play-ers in helping pass or defeat legislation that impacts our membership

Brokers be aware that the rules that apply to the advertising of property that is not listed with your brokerage apply to social media sites that permit the user to ldquosharerdquo or otherwise disseminate information from another userrsquos social media pagepost or from a third-party source Such ldquosharingrdquo is the equivalent of copying another brokeragersquos listing and placing it in your print or website advertise-ment
Strangely nowhere in the NM Real Estate Brokers Act nor the NMREC regulations does it explicitly state that a broker cannot advertise a property listed with another broker without the permission of the listing broker or the seller (pro-vided NMREC advertising rules are followed) So where is this prohibition
To begin Standard of Practice 12-4 from the REALTORSreg Code of Ethics provides that ldquoRE-ALTORSreg shall not offer for salelease or advertise property without authorityrdquo Furthermore MLSs as a matter of local discretion may prohibit participants from advertising specific
properties which are list-ed with other participants (unless the participant has obtained permission from the listing participant)
In the listing agreement the seller grants the list-ing broker the authority to advertise the property The listing agreement also may authorize the listing broker to permit other brokerages to advertise the property conditionally or uncondi-tionally
The placing of a listed prop-erty on a social media site does not give every other brokerage permission to share that listing unless the posting includes language conveying such permission
Such language must be clear as to what permis-sion is given For instance a listing that appears on a social media site that states ldquoCooperating brokers have permission to share this listing on their social media pagerdquo grants the cooperating broker permission to post on hisher social media page only
In contrast a broker that states ldquoThis listing may be shared by any cooperating brokerrdquo places no limitation on how the listing is adver-tised by a cooperating bro-ker which means that the cooperating broker is free to place an advertisement
using any medium though this may not have been the intent of the listing broker or the understanding of the seller
In short just because a social media site permits you to ldquosharerdquo information this doesnrsquot give you the right to do so in a manner that violates NMREC regulations MLS rules andor the REALTORreg Code of Ethics And recall in the event of a NMREC regulation viola-tion the qualifying broker also may be liable as NMREC regulations provide

Contributions are not deductible for income tax purposes Contributions to RPAC are voluntary and are used for political purposes You may refuse to con-tribute without reprisal and the National Association of REALTORSreg or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed 70 of each contribution is used by your state PAC to support state and local political candidates Until your state PAC reaches its RPAC goal 30 is sent to National RPAC to support federal candidates and is charged against your limits under 2 USC 441a after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates

RANM January Meetings
Each year the National As-sociation of REALTORSreg sets fundraising and par-ticipation goals for all 50 states (and Puerto Rico) and rewards those that meet the goals In 2015 RANM achieved the highest recognition possible - The Presidentrsquos Cup - but fell short in 2016 as we did not achieve the required mini-mum 20 percent on ldquoCalls for Actionrdquo (we did attain ldquoTriple Crownrdquo status) It is RANMrsquos mission to again attain The Presidentrsquos Cup
To do so requiresbull RPAC-NM raise $175000bull 37 percent of our members contribute $15 or morebull one percent of the members contribute $1000 or more (Major Investors) andbull 10 percent of our Major In- vestors become Presidentrsquos Circle Members
There also are advocacy goals
bull reaching a minimum average response rate of 20 percent on NAR Calls for Action
bull hosting a voter regis- tration drivebull increasing the number of REALTORreg Party Mobile Alerts subscrib- ers andbull meeting Broker In- volvement goals
All the goals are achievable but it will take effort As RANMrsquos membership con-tinues to increase so does the number needed to reach the 37 percent participation goal RANMrsquos membership for 2017 has been pegged at 6122 meaning we need 2266 contributors to reach goal
After three months RPAC-NMrsquos fundraising is at about 62 percent of goal and participation is about 34 percent Not bad for the first quarter but getting the ball past the goal line is the hard part The next few
months are crucial in get-ting RANM closer to goal as wersquore hoping to avoid the stress of last-minute efforts
RPAC DistributionOf the $175000 RPAC-NM is being asked to collect in 2017 $37219
will go to NAR and will be used among other things for contributions to Con-gressional candidates (US House of Representatives US Senate)
After NAR gets its alloca-tion from RPAC-NM the balance is divided among the state organization and local boards The state provides contributions to candidates in executive non-federal statewide races and legislative races Mem-ber Boards can use their money for local races
The next big statewide election is in 2018 as New Mexico will elect a new
GovernorLt Governor with races for Attorney General Secretary of State Treasurer Auditor Com-missioner of Public Lands and numerous Legislative seats
Because of involvement in the political process NAR and RANM are major play-ers in helping pass or defeat legislation that impacts our membership
