1 THE RENAISSANCE COMMUNITY ASSOCIATION RULES AND REGULATIONS (Amended January 2017) PREAMBLE The purpose of the Rules and Regulations is to establish basic standards of conduct required of members, residents and guests of the Renaissance Community Association (hereinafter referred to as the “Renaissance Association”) The Articles of Incorporation, Bylaws, Declarations of Covenants, Conditions and Restrictions (hereinafter referred to as “CC&Rs”) and Rules and Regulations for both the Seven Hills Master Association (hereinafter referred to as the “Master Association”) and the Renaissance Association are the governing documents for the Renaissance community. These documents and their proper implementation by the Board of Directors, working with a property management company, provide the basis on which the Renaissance Association can maintain, protect and enhance the community. The rules, policies and procedures contained in the CC&Rs and the Rules and Regulations of the Renaissance Association may be more restrictive than those reflected in the CC&Rs of the Master Association but in no case can they be less restrictive. PREAMBLE

These documents and their proper implementation by the Board of Directors, working with a property management company, provide the basis on which the Renaissance Association can maintain, protect and enhance the community. ARTICLE 1

GOVERNING DOCUMENTS AND ADMINISTRATION

1. ARTICLES AND BY LAWS The Renaissance Association is a not-for-profit corporation organized under Chapters 81 and 116 of the Nevada Revised Statutes. The filing of Articles of Incorporation with the Nevada Secretary of State establishes the Association as a legal entity with all the rights and privileges attendant to a not-for-profit corporation. The Bylaws of the Renaissance Association are to be managed by a duly elected Board of Directors and further, set forth the powers and duties of the Board.

2. DECLARATION Prior to the purchase of any property within the community, the Developer

recorded a Declaration of CC&Rs and Grants of Easements against all of the properties within the community. The purpose of the Declaration is to maintain, protect and enhance the community including all of the common areas and properties within the community. Each member of the Renaissance Association is bound by the CC&Rs contained in both the Renaissance Association and Master Association Declarations.

3. RULES AND REGULATIONS The Board of Directors for the Renaissance Association is

charged with the responsibility to adopt reasonable Rules and Regulations governing the use of the common areas, facilities and reasonable use restrictions relating to single family residences found within the community. These Rules and Regulations, as well as the other governing documents, govern the conduct of the members, residents and guests. Each member and resident is responsible for the conduct of their minor children, guests, invitees and tenants during their use of the common areas, facilities and use restrictions applying to member’s single family residence within the community. The Rules and Regulations for the Renaissance Association

are adopted and, from time to time, amended and repealed by the Board of Directors; unlike the Declaration, Articles of Incorporation and Bylaws, which require a vote of the membership for amendment. The Rules and Regulations are based upon provisions found in the Declaration, Articles of Incorporation and Bylaws. The purpose of the Rules and Regulations as hereinafter set forth is to protect, maintain and enhance property values within the community; to promote the safety and well being of the residents and their guests and invitees; and to provide the maximum enjoyment for each resident in the use of his/her personal and real property. The Rules and Regulations may be periodically amended by the Board of Directors. The previous amendment was in January 2015.

4. MANAGEMENT In as much as the Association is a not-for-profit Corporation governed by a

volunteer Board of Directors, the governing documents provide for daily regulation of the community by a management company. The Management Company assigns a Community Manager who reports to and is responsible solely to the Board of Directors. The Community Manager does not make or change Renaissance Association policies; as such authority is exclusively reserved to the Board of Directors. The Community Manager’s duty is to assist the Board of Directors in their commitment to maintain, protect and enhance the Community.

Another important function of the Community Manager is to help identify and report potential violations of the Association’s governing documents to the Board of Directors and assist the Board in its duty to comply with its responsibilities found in the governing documents and applicable statutes. The governing documents and their proper implementation by the Board of Directors, working with its Community Manager, provide the basis upon which the Renaissance Association can maintain, protect and enhance the Community. Accordingly, it is essential that all complaints be submitted in writing on the proper form in care of the Community Manager and directed to the Board of Directors.

5. ENFORCEMENT AND PENALTY Enforcement of the governing documents of the Renaissance

Association shall be in accordance with the governing documents and Nevada Revised Statute 116.

6. SANCTIONS FOR VIOLATIONS OF THE GOVERNING DOCUMENTS

In accordance with NRS116.31031- Power of executive board to impose fines and other sanctions for violations of governing documents:

1. Except as otherwise provided in this section, if a unit’s owner or a tenant or an invitee of a unit’s owner or a tenant violates any provision of the governing documents of an association, the executive board may, if the governing documents so provide:

(a) Prohibit, for a reasonable time, the unit’s owner or the tenant or the invitee of the unit’s owner or the tenant from:

(1) Voting on matters related to the common-interest community. (2) Using the common elements. The provisions of this subparagraph do not prohibit the unit’s owner or the tenant or the invitee of the unit’s owner or the tenant from using any vehicular or pedestrian ingress or egress to go to or from the unit, including any area used for parking.

(b) Impose a fine against the unit’s owner or the tenant or the invitee of the unit’s owner or the tenant for each violation, except that:

(1) A fine may not be imposed for a violation that is the subject of a construction penalty pursuant to NRS 116.310305; and (2) A fine may not be imposed against a unit’s owner or a tenant or invitee of a unit’s owner or a tenant for a violation of the governing documents which involves a vehicle and which is committed by a person who is delivering goods to, or performing services for, the unit’s owner or tenant or invitee of the unit’s owner or the tenant.

2. The executive board may not impose a fine pursuant to subsection 1 against a unit’s owner for a violation of any provision of the governing documents of an association committed by an invitee of the unit’s owner or the tenant unless the unit’s owner:

(a) Participated in or authorized the violation; (b) Had prior notice of the violation; or (c) Had an opportunity to stop the violation and failed to do so.

7. AMENDMENTS These Rules and Regulations may be amended at a regular or a special meeting of the members of the Renaissance Association. The Board of Directors or any member of the Renaissance Association may propose amendments. All amendments require the vote of a majority of the Board.

ARTICLE 2

RESIDENTIAL USE

Property use shall be in accordance with the Rules, Policies and Procedures contained in the CC&Rs, the Bylaws, and Architectural Guidelines. Each residential property shall be used for single-family residential purposes only. For corresponding rule, see Renaissance CC&Rs, Section 9.2.

ARTICLE 3

LEASES AND TENANTS

1. WRITTEN LEASES All residential leases pertaining to real property found within the Renaissance Community shall be in writing and for a term of not less than Twelve (12) months.

2. LEASE OF ENTIRE PROPERTY No owner shall lease less than his/her entire residential

property within the Renaissance Community.

3. LEASES SUBJECT TO GOVERNING DOCUMENTS All residential lease agreements shall be subject in all respects to the provisions of the Association’s governing documents. Said leases shall reflect that any failure by the lessee to comply with the terms of such documents shall constitute default under provisions of the lease agreement.

4. OWNER RESPONSIBILITY Owners are responsible for the action of their tenant(s) with respect

to full compliance with all governing documents.

5. COMPLIANCE REQUIREMENTS Any owner leasing his/her property shall comply with the

following:

Owners shall provide the management company with a complete copy of the signed lease agreement prior to tenants occupying the property. AND

Gatehouse security protocols require that the lessee must provide a complete copy of a signed lease agreement to the gatehouse officer for access to the community.

The tenant’s name will not be entered into the neighborhood access/ entry system until a copy of the lease agreement and a completed Resident Information Form, with the proper vehicle documentation, has been provided to the Gatehouse. Vehicle Entry Bar Codes may then be issued to the tenants to be used to enter Renaissance via the resident lane.

The owner shall provide the tenant(s) with copies of BOTH the CC&Rs and Rules and Regulations for BOTH the Renaissance and Master Associations. Additional copies of the above may be obtained at www.rpmginc.com. or by contacting the management office.

The Association is not responsible for providing electronic or remote devices to the tenants of owners for entry into the community. The owner shall provide such devices to the tenants at his/her cost.

ARTICLE 4

EXTERIOR ALTERATIONS

1. ARCHITECTURAL COMMITTEE APPROVAL REQUIREMENTS

ALL EXTERIOR IMPROVEMENTS AND ALTERATIONS MUST be submitted to and approved in writing by the Renaissance Architectural Review Committees prior to the commencement of ANY landscaping, painting, construction or other similar work or modifications being performed to the exterior of any Renaissance property; AND MUST COMPLY WITH BOTH the Architectural Guidelines of the Renaissance Homeowners Association AND the Architectural Guidelines of the Seven Hills Master Homeowners Association. The Board reserves the right to require the homeowner to fully restore the property to its original state if work is begun without formal written approval from all required parties as stated in the CC&Rs and the Architectural Guidelines of the Renaissance Association. If such approvals are not granted and the homeowner proceeds with unauthorized exterior modifications, the Renaissance Association, at its discretion, may hire a licensed contractor(s) to perform any necessary work to restore the property and attach the cost of such work to the homeowner’s HOA account.

2. ARCHITECTURAL COMMITTEE SUBMITTAL REQUIREMENTS Architectural submittals are to include a completed Architectural Change Form, Neighbor Awareness Form and complete plans and specifications showing the nature, kind, shape, height, color and materials to be used.

ARTICLE 5

EXTERIOR MAINTENANCE AND REPAIR

1. WINDOW COVERINGS Window coverings seen from the exterior of the home must be tasteful

and neat in appearance, be harmonious to the exterior color palette of the Renaissance Community and may only include blinds, shutters, curtains, shades and draperies. All full-size windows found in the swing (single) garage of some models must have window coverings.

2. EXTERIOR MAINTENANCE Residents are responsible for maintaining the exteriors of their

property and any improvements thereon. At no time shall any portion of the property fall into disrepair due to general neglect or lack of maintenance as to exterior paint, necessary roof repairs, et cetera that would detract from the aesthetics and property value of the neighborhood. All exterior lighting and address signage shall be visible and operable at all times.

3. LANDSCAPE MAINTENANCE Each owner shall, at his/her expense, maintain all landscaping

on his/her property in a healthy and attractive condition and shall maintain all automatic irrigation systems to operate effectively as designed and intended. All landscape lighting, if any, shall also be well maintained. Weeds shall be controlled and maintained on a regular basis. The Board of Directors reserves the right to determine the definition of a “weed” and specific explanations can be given at a homeowner’s request. Each owner shall ensure that sidewalks, streets, common areas and other properties in close proximity to his/her property are unobstructed by any plants, trees, landscaping or other objects/materials.

ARTICLE 6

GARAGES

1. GARAGES AND DRIVEWAYS

No owner shall use a garage for any purpose that prevents automotive storage unless his doing so would not result in additional vehicles being stored outside the garage.

Vehicles that exceed the number of garage bays for the property are permitted to be parked in the driveway.

Owners or residents regularly parking vehicles overnight on the driveway may be required to provide proof that the garages are being used for parking of vehicles in accordance with the governing documents.

2. GARAGE DOORS Garage doors shall be kept closed except for those periods reasonably necessary for entry or exit, loading or unloading, cleaning, removing trash or other similar residential household purposes.

ARTICLE 7

VEHICLES AND PARKING

The safety of residents and guests of Renaissance is of major importance to the Board of Directors. Parking in areas that present the least impediment to traffic flow and adherence to traffic control signs can significantly assist in enhancing safety. Therefore residents and their guest must adhere to the following:

3. VEHICLE OPERATION Vehicle operators within Renaissance must at all times obey the posted speed limit of fifteen (15) miles per hour and all other traffic control signs and operate his/her vehicle in a safe manner at all times.

4. VEHICLE REGISTRATION AND INSURANCE All vehicles operated within Renaissance must

be legally registered and insured in accordance with a state MVA. Go-carts, motor scooters and other specialty vehicles that are not licensed or insured are precluded from operating on any street, common area or sidewalk within Renaissance. Electric golf cars are excluded from this subsection. Off-road, unlicensed, uninsured, inoperable, disabled and/or unregistered vehicles are not permitted to be parked on streets or driveways. Such vehicles shall be stored entirely within the garage of the home or removed from Renaissance.

5. VEHICLES GARAGED/PARKED/KEPT IN RENAISSANCE Any vehicle garaged/parked/kept

in Renaissance or any vehicle for which a resident barcode is issued must be included in the Resident’s Information Form at the Gatehouse along with a copy of the motor vehicle registration documents. Any vehicle that has been sold, traded or otherwise is no longer owned or titled by the Renaissance resident must be removed from the Resident’s Information Form and the barcode de-activated.

6. VEHICLE RESIDENT ACCESS BARCODES

Resident vehicle barcodes will be issued only to Renaissance resident’s vehicles.

Residents must fully complete the Resident Information Form; and return this form to the Front Gatehouse between 9:30am and 3:30pm Monday through Thursday along with a copy of the vehicle registration documents and a check for the Resident Access Bar Code(s)-

$7.00 each made out to the RENAISSANCE COMMUNITY ASSOCIATION

The barcodes MUST be installed by the Gatehouse supervisor to the specific vehicle for which it is assigned on Monday through Thursday between 9:30am and 3:30pm

Resident Vehicles without barcodes will have to use the Guest access lane to enter Renaissance

7. VEHICLE REPAIRS Repairing and restoration of vehicles is not permitted unless such repairs

are conducted within the garage of the residence and do not cause disturbance to others. Emergency repairs to a vehicle are permitted to facilitate removal from Renaissance or move a vehicle into an enclosed garage. However, such emergency repairs in no case shall exceed twelve (12) hours to perform.

8. GARAGE AND DRIVEWAY PARKING

Only after parking as many vehicles as the garages of the residence are designed for and may accommodate, may any owner or resident park a vehicle on the driveway overnight (from 12 Midnight to 6 AM).

All garage and driveway parking spaces shall be fully utilized and no resident shall park, store or keep any vehicle on any street within the community.

Homeowners who own vehicles in excess of the total number of parking spaces available within their garage and driveway must make alternative arrangements for the storage of said vehicles.

9. GUEST PARKING

Residents must make every effort to provide off-street overnight parking for guests. After all parking spaces in garage and driveway are properly utilized in compliance with Section 4, a guest is permitted on-street overnight parking up to three (3) nights within any thirty day (30) period.

Overnight guest street parking for extended periods may only be authorized by the Board of Directors. This may be done by contacting the Management Company who will forward the request to the Board. The request must be made in sufficient time to process prior to exceeding the time limit of three (3) days within any thirty-day (30) period.

Short-term guest street parking of multiple vehicles for up to twelve (12) hours at a resident’s social event is permitted

A visitor pass must be displayed from the rear view mirror at all times within the Renaissance community. A visitor pass does not constitute an on street overnight parking pass.

10. PROHIBITED PARKING Vehicle parking is strictly prohibited in or about any of the following areas: fire lanes marked by red-painted curbs; within fifteen (15) feet of a fire hydrant, intersection or community mailbox; in any manner that blocks a sidewalk, a yard or vacant lots. All vehicles parked in the street shall be parked in such a fashion so as to: not have any portion of the tires rest on the sidewalk or curbing; be positioned so that the body length of the vehicle is parallel to and within eighteen (18) inches of the curb; and that the front of the vehicle faces the same direction as the flow of traffic on the side of the street on which the vehicle is parked. Parking in any red zone blocking any driveway or sidewalk may result in immediate towing without notice.

11. VEHICLE OIL AND OTHER SUBSTANCES LEAKS Vehicle oil and other substances that

have stained streets or driveways shall be immediately removed. Failure to remove such stains and substances may subject the member to fines and penalties including the cost incurred to restore the affected area to its original condition.

12. RECREATIONAL AND COMMERCIAL VEHICLES Boats, watercraft, trailers, tractors, trucks

exceeding ¾ ton, commercial vehicles, (vehicles with commercial markings or signage, including “wraps,” vehicles with ladders, racks or other exposed tools, and other vehicles that are presented as a commercial vehicle) motor homes, fifth wheels, vans converted to a motor home, off-road vehicles, and all non-licensed or unregistered vehicles are prohibited from parking on any street or any residential property except within the garage or any area completely out of the public view, except:

Commercial delivery vehicles including moving vans or trailers and service vehicles may utilize street parking during active loading, unloading or while providing service.

Recreational or commercial vehicles may only utilize the street for active loading and unloading while attended. Under no circumstances may any recreational or commercial vehicle be parked on the street while unattended or parked overnight on the street at any time.

13. ENFORCEMENT Traffic control within the Renaissance community including enforcement of speeding, unauthorized parking, and failure to observe stop signs will be vigorously enforced by roving safety patrols and RADAR Speed/Camera Signs. Texting or cell phone usage (other than hands free) while driving within the community is prohibited; and will be cited. Those cited for alleged violations will be sent a notice of a scheduled hearing before the Renaissance Board of Directors to provide a reasonable opportunity to contest the alleged violation prior to any potential fine being imposed. Those cited may also provide a written waiver of their right to a hearing, pay the fine in advance or receive notice that a fine has been imposed after the hearing takes place should the Board uphold the validity of the alleged violation. Vehicles parked in violation of this section may be towed and the responsible owner of the vehicle will be subject to a fine pursuant to the governing documents. All costs associated with towing shall be the responsibility of the vehicle owner.

ARTICLE 8

NUISANCES

1. NUISANCES No owner shall permit any activity or conduct on his/her property, which shall

cause or create a nuisance.

2. ODORS No odors shall be permitted to arise from any unit so as to render any unit offensive or adversely affect the sense of smell or to the detriment of the Common Elements or any other unit.

3. HORNS, WHISTLES AND SOUND DEVICES Without limiting the generality of the foregoing

provision, no loud music, horns, whistles, bells, or other sound devices, except devices used exclusively for security purposes, shall be located, used or placed upon any unit.

4. INSECTS AND DISEASES No owner shall permit anything or condition to exist upon any unit,

which shall induce, breed or harbor noxious plants or infectious insect diseases.

ARTICLE 9

UNSIGHTLY ARTICLES

1. STORAGE No items, storage, or other unsightly materials as determined by the Board of Directors shall be stored anywhere on the property that are visible from the private street, common areas, or another unit in the community.

2. TOYS SPORTING EQUIPMENT, GARDEN TOOLS, AND DEBRIS Each homeowner shall

keep his/her residential property free of debris, detritus, and other items including, but not limited to, animal feces, boxes, trash, and exterior clotheslines. Items such as toys, bicycles, scooters, buckets, et cetera must be properly stored out of sight when not in use. Hoses are permitted if neatly stored.

3. CLOTHING, LAUNDRY, AND OTHER ITEMS No clothing, laundry, or other items are to be

hung from or on any portion of the property visible to others. No items shall be allowed to extend from or hang over windows, walls or fences.

4. SPORTING EQUIPMENT No sporting equipment shall be stored where visible from the street

or the common area. (Note: see Article 13, Item 2 concerning prohibition of basketball hoops.)

5. TENTS, TRAILERS, AND TEMPORARY BUILDINGS No tent, shack, trailer, or other

temporary building improvement, or structure shall be placed anywhere within the community.

6. NEWSPAPERS Exterior accumulation of newspapers in excess of two (2) days is prohibited.

ARTICLE 10

PETS

1. NUMBERS OF PETS Owners may keep household pets, but no more than two (2) domestic dogs or two (2) cats or one (1) dog and one (1) cat if they are not kept, bred or maintained for commercial purposes.

2. LIVESTOCK & EXOTIC PETS All exotic pets, fowl, livestock, reptiles and other animal breeds

or species normally found in the wild are prohibited. Only commonly recognized household pets shall be kept or maintained on any unit or any portion thereof; no animal shall be kept, bred or maintained for any commercial purpose; and no animals or fowl, including household pets, which after notice and a hearing are determined by the Board of Directors to be dangerous, may be kept or maintained anywhere within the community.

3. LEASH REQUIREMENTS The owner of any animal shall not, at any time, allow the animal to

be at-large or unleashed in any common area, including sidewalks and streets; or on an unfenced portion of a lot. The owner shall at all times have full and complete control over such animals.

4. ANIMAL WASTE

Animal waste is prohibited on the streets, sidewalks or other common area.

The owner of an animal shall immediately remove animal waste if it is discharged.

Owners must ensure that their pets do not trespass on any other residential property; nor allow their animals to discharge waste on any other’s residential property.

Residents shall remove animal waste from his/her property within three (3) days.

5. LICENSE AND VACCINATION All pets must be properly licensed, vaccinated and wear identification tags.

6. BARKING No resident may own, keep, harbor or possess any animal which, by unreasonably loud, unnecessary, or frequent barking, yelping, howling or other noise, causes unreasonable annoyance or disturbance to the neighborhood or to any person of ordinary sensitivity in the vicinity.

7. LIABILITY Members, residents and guests shall indemnify and hold the Renaissance

Association, other members, residents and guests, harmless from any and all damage and/or injury incurred by an animal owned by or under the control of a member, resident or guest.

8. ENFORCEMENT

Any violation of the above should be reported to the City of Henderson Animal Control at the time the infraction occurs and will be considered a violation of the CC&Rs governing the community.

City of Henderson Animal Control may be reached at (702) 267-4970 from 8:00 A.M. to 4:00 P.M. Emergencies or after hours the phone number is (702) 267-4900.

The Board of Directors shall retain the right, after notice and hearing, to request removal of animals from Renaissance that it finds constitutes a continuing reasonable nuisance to property owners.

ARTICLE 11

TRASH

1. COVERED TRASH Trash must be properly tied in suitable heavy-duty trash bags or placed in

closed garbage containers.

2. SANITARY CONTAINERS Containers are to be maintained in a sanitary condition so that no odors arise and should not create litter or obstruct any person in any way.

3. TRASH PICK UP TIMES Trash and recycling containers shall be placed out only after 7:00

PM on Thursday and must be stored before 6:00 AM on Saturdays. (Not to exceed twelve hours before or after scheduled pick-up time in accordance with the CC & R’s). The trash pick-up for Renaissance is scheduled for FRIDAY between the hours of 7:00 AM and 6:00 PM. The containers should be placed, on the street with the wheels in the curb, as per Republic Services. If possible, due to the very large size of the containers and in order to keep our sidewalks and streets clutter-free, please place your trash containers out no earlier than Friday morning and take them in as soon as practical after they are emptied on Friday.

4. PLACEMENT OF CONTAINERS Containers are to be placed on the street with the wheels in the curb (including in the red fire zones, keeping the sidewalks clear)

ARTICLE 12

CONSTRUCTION

The following applies to any contractor, employee agent or invitee working within the Renaissance community.

1. HOMEOWNER RESPONSIBILITY Homeowners may be found responsible for any and all actions of their contractors, employees, sub-contractors or agents, including any fines that may be imposed as a result of a violation of governing documents, including rules contained in this section by the homeowner’s invitee provided that: the homeowner participated in the violation; or had prior knowledge of the violation; or had an opportunity to stop the violation and failed to do so.

2. OBSERVANCE OF SPEED LIMITS Observance of all posted speed limits is required.

3. ALCOHOL, DRUGS, AND FIREARMS Consumption of alcoholic beverages, illegal drugs or

possession of firearms is prohibited.

4. START AND END TIMES There shall be no exterior construction prior to 7:00 A.M. or later than 6:00 P.M.

5. VEHICLE REGISTRATION All construction vehicles must have current vehicle registration and

insurance.

6. DEBRIS Mud, gravel or any other debris is not allowed on any street or sidewalk. Contractors shall prevent debris from blowing onto adjoining properties. Upon completion of any portion of any work, contractors shall promptly remove any equipment, materials or debris from the site.

7. DELIVERED MATERIALS Any materials delivered to a residence or used in construction must

be removed from the street and from the front of the unit by 6:00 P.M. of any day. No materials may be left in the street or in front of a unit overnight. Powder or dust residue resulting from rock or other material must be thoroughly hosed off the street, sidewalk or driveway.

8. MACHINERY AND EQUIPMENT

Machinery or equipment, to include dumpsters, used during approved remodeling or construction may be temporarily parked on a residential property with specific approval by the Board of Directors to include a reasonable amount of time. On street placement of machinery or equipment, to include dumpsters, is permitted only between the hours of 7:00 A.M. and 6:00 P.M. At no time may any machinery, equipment or any debris be

placed or parked in or along the same side of the street where there are designated red fire zones. No construction machinery or equipment may remain on the streets between 6:00 P.M. and 7:00 A.M.

Machinery or equipment customarily used in connection with a hobby or in the maintenance of a private residence is permitted provided such machinery or equipment does not constitute a nuisance and is stored out of sight.

9. PROHIBITED VEHICLE AREAS Construction workers and/or vehicles are prohibited from

crossing any common elements or private property without permission. Vehicles are only to be operated on streets or in the driveway of the resident for whom such contractor is performing services.

10. NOISE Loud playing of radios or creation of other nuisances is prohibited.

11. ENFORCEMENT Any contractor, employee or agent who receives a violation notice and fails

to correct the problem may be barred from the property until such time as the infraction is corrected or reasonable reassurance is provided that the infraction will not recur.

ARTICLE 13

OTHER

1. ADJOINING STRUCTURES An adjoining structure is a wall or fence placed on the property

line dividing two (2) or more residential lots. No owner of any property having an adjoining structure shall affix an object or device of any kind to such structure without the prior written consent of the owner of the adjacent property and the Renaissance Association provided that all parties comply fully with architectural standards, guidelines and receive architectural approval. The maintenance and repair shall be the joint responsibility and obligation of the owners of lots so divided by the common structure. Should the act or omission to act of a particular owner or such owner’s family, guests or invitees damage the common structure, the repair of such damage shall be the sole responsibility and obligation of such owner. In cases where an adjoining structure constructed as part of the original construction encroaches into either an adjoining residential property where such encroachment is due to shifting, settling, and errors in original construction or similar cause, an easement of encroachment shall exist.

2. BASKETBALL HOOPS No basketball hoops shall be allowed in any portion of Renaissance.

3. OPERATING A BUSINESS No business of any kind shall be operated from any residential property without the prior written consent of the Board of Directors.

4. CHANGES IN GRADE OR DRAINAGE No owner shall make a change in the established

grade or elevation of any residential property or in any way modify or interfere with the

established drainage patterns. The terms “established grade or elevation” and “established drainage patterns” shall mean the grade or elevation and the drainage pattern of the residential property at the time of conveyance of the lot from the declarant to an owner.

5. FIREWORKS Only fireworks labeled as “Safe and Sane” are legal for use on private property

for one week of the year, from June 28 until 11:59 p.m. on July 4. Safe and Sane fireworks can only be used on private property and cannot be used on the street or sidewalk, or on public property such as parks, schools, or federal land.

Illegal Fireworks: Fireworks that fly through the air, explode, or rotate on the ground are illegal throughout Clark County, including the City of Henderson.

6. GARAGE SALES No garage sales auctions or similar activities shall be conducted within the

Renaissance Community.

7. HOBBY RESTRICTIONS The pursuit of hobbies and their attendant equipment or other activities which may be deemed inherently unsafe or tend to cause disorderly and unsightly conditions, shall not be undertaken in any part of Renaissance.

8. HOLIDAY DECORATIONS All holiday decorations, lights, et cetera shall not be displayed

earlier than thirty (30) days prior to the beginning of any holiday and must be removed within fourteen (14) days after the end of the holiday. All decorations must be reasonable and not be a nuisance or unsightly.

9. SATELLITE DISHES AND ANTENNAS No satellite dish, television or radio antenna shall be

erected or maintained on any residential property without prior approval from the Architectural Review Committee. Notwithstanding the foregoing, neither the Architectural Committee nor the Board of Directors shall impose or enforce any restrictions on antennas which are inconsistent with the requirements set forth in Section 207 of the Telecommunications Act of 1996 (47 U.S.C. Section 303 et. Seq.), any regulations issued pursuant thereto, and/or any successor statute. The Architectural committee shall consider the location of the antenna and measures, such as paint and/or screening, to assure the antenna blends with the background and/or colors of the building on which it is located.

10. SIGNS

No sign of any nature,(including, but not limited to, ”keep out”, “no parking”, no trespassing”, etc.) except signs required by legal proceedings, or the prohibition of which is precluded by law, and signs advertising a residential property for sale or rent or noticing security protection shall be displayed to the public view on or from any residential property. Revisions to the Master Association Architectural Guidelines, which were effective September 1, 2006, mandate specific stipulations regarding political signs (24 inches X 36 inches maximum) as well as For Sale, For Lease/Rent and Open House signs that are permitted in the community. Signs must conform to the color, size and specific design as depicted in the Master Association Architectural Guidelines, Section 2.6.8. Homeowners may display signage, as stated above, meeting the specific Master

Association Guidelines criteria without obtaining Architectural Review Committee (ARC) approval.

No signs of any kind are permitted to be displayed in the window(s) of a residence.

Political signs may not be displayed earlier than 60 days prior to an Election and must be removed within ten (10) days after an election. No more than one political sign for each candidate may be displayed and each political sign may not exceed 24 inches by 36 inches in size.

Notwithstanding other provisions within this section, no sign, poster, billboard, advertising device or other display or any kind shall be displayed without the approval of the ARC. Enforcement of these guidelines shall be in accordance with Section XXI of the Master Association Rules and Regulations. Master Association R&Rs, XVI. Renaissance Association CC&Rs, Article IX, Section 9.12

11. WILDLIFE FEEDING- Feeding of pigeons, coyotes or any other wildlife is prohibited.

12. DRONES – Any operation of drones within the Renaissance Community must be in compliance

with current local, state and federal regulations.

ARTICLE 14

GATEHOUSE

PLEASE CALL THE GATEHOUSE ANYTIME YOU EXPECT ANY GUESTS OR VENDORS The incorporation of a guarded gatehouse at the entrance to the Renaissance community property requires the establishment of basic procedural protocols to be observed and practiced by the security company personnel and Renaissance community residents, vendors, and guests. The primary objective of the Gatehouse Security Office is to control and monitor access to the Renaissance property. The Gatehouse Security Officer will:

Allow residents and their authorized invitees access to the community.

Deny access to unauthorized persons.

Report potential safety hazards.

Assist visitors and serve as concerned public relation representatives.

The Gatehouse Officer-in-Charge is responsible for:

Training and supervision of all Gatehouse Security Officers

Updating the Renaissance Gatehouse Resident Information List

Assisting residents in resolving issues involving Gatehouse personnel and procedures.

In order to facilitate timely access and to minimize traffic backups at the gate, each resident shall call ahead to the gatehouse any time they expect guests and/or vendors. A pass will be prepared in anticipation of the guest/vendor. Anytime there has not been a call-ahead to the gate, the gatehouse personnel shall attempt contact at the primary number listed for each resident. If there is no response and there is a backup at the gate, the guest or vendor will be asked to pull around until contact can be made by the gatehouse. The Gatehouse maintains a Gatehouse Resident Information List for all Renaissance residents. This list is used to verify authorized access to the community and should be kept current. The Gatehouse Security Officers are not authorized to accept verbal changes to any information on the Renaissance Gatehouse Resident Information list. Changes can be made only by filling out the Resident Information Form available at the Gatehouse. Any verbal information and/or communication with the Security Officers shall require verification as follows:

Verification is accomplished when the Security Officer initiates a telephone call to the homeowner or resident based upon data on file from the Gatehouse Resident Information List, or;

Face-to-face or incoming call requests: verification will be accomplished by:

Confirming resident name, address and password as contained in the Gatehouse Resident Information List or;

Verifying the inbound caller ID telephone number with the Gatehouse Resident Information List.

It is important to note that the Gatehouse Security Officers are NOT Community Security personnel. If emergency services are required, residents must initiate contact with the police, fire or other assistance as necessary. Section A-1 RESIDENTS

1. All resident vehicles information shall be provided to the Renaissance Community Association so that it can be incorporated into the database or Resident Information List. This information is absolutely essential in order to determine the basis for authorized entry to the community. Gathering this information can be accomplished by the homeowner completing the Resident Information Form that is available at the Gatehouse.

2. Residents shall use the resident’s lane, upon entering the community at the Gatehouse.

Residents shall possess a bar code in all the vehicles belonging to them in order to gain access to the property.

3. Residents shall drive slowly (not more than five (5) MPH) as they approach the gate in order to

allow the security personnel to make eye contact and acknowledgement.

4. If a person claims to be a resident and no verification or password is available on the Gatehouse Resident Information List, or otherwise, the individual’s authorized entry cannot be verified access may be denied.

Section A-2 NEW RESIDENTS Objective: To control and monitor new resident’s access to the Renaissance property. As stated previously in Section A-1, all residents, including new residents, must complete and submit a Resident Information Form. Procedures:

1. New residents will be asked to present appropriate documentation, a complete, signed lease or Title/Sale Deed, demonstrating property ownership

2. If necessary paperwork is presented and access is granted, the new resident will be given a

Resident Information Form, which needs to be completed and returned to the Gatehouse personnel within forty-eight (48) hours.

3. If sufficient paperwork cannot be presented during normal business hours, the new resident (and

their guests, including movers or other invitees) may be denied access to the community unless special approval is granted by a member of the Board of Directors, thus resulting in a temporary pass being issued to those so authorized.

Section A-3 GUESTS Objective: To control and monitor guests’ access to the Renaissance property. No guest may be allowed access without being issued a current pass. Guests gaining access must have been verified by any of the following procedures. Procedures:

1. On a daily basis the security personnel will maintain an authorized guest list known as a Daily Call-Down log. (Residents must be verified by using their password to add or delete a guest from the Daily Call-down log.)

2. If the guest’s name appears on the Call-Down log, they will be issued a pass and allowed access.

3. If the guest’s name does not appear on the Call-Down log, the resident’s permanent guest list profile will be checked. If the guest’s name appears, a pass will be issued and access will be allowed.

4. If the guest’s name does not appear on the resident’s permanent guest list, the resident will be

contacted for verification. (A maximum of two telephone calls will be made to contact the resident) Note: the resident’s password is required for verification. If the guest is verified by the resident, a pass will be issued and access allowed. If the resident is not available for verification, the guest will be denied access.

5. If a guest disputes the access denial, they will be directed by security personnel to pull around

the Security Post so as not to impede normal traffic to the gate.

6. Passes are issued daily. Upon request by a resident a weekly pass may be issued.

7. Parking restrictions apply to all guests and visitors. A Visitor Pass does not constitute an on street overnight parking pass.

Residents must make every effort to provide off-street overnight parking for guest. After all parking spaces in garage and driveway are properly utilized in compliance with Section 4, a guest is permitted on-street overnight parking for up to three (3) nights within any thirty day (30) period.

Overnight guest street parking for extended periods may only be authorized by the Board of Directors. This may be done by contacting the Management Company who will forward the request to the Board. The request must be made in sufficient time to process prior to exceeding the time limit of three (3) consecutive days within any thirty-day (30) period.

Short-term guest street parking of multiply vehicles for up to twelve (12) hours at a resident’ social event is permitted.

A visitor pass must be displayed from the rear view mirror at all times within the Renaissance community and readable through the vehicle glass.

Section A-4 VENDORS Objective: To control and monitor vendor access to the Renaissance property. Before a vendor may enter the community his/her pass must be verified with the authorizing resident through one of the following steps. Procedures:

1. Security personnel will verify the vendor’s name, nature of their business and resident address.

2. If the vendor’s name appears on the Gatehouse Resident Information List or Call-Down log, a

pass will be issued and access allowed.

3. If the vendor’s name does not appear on the Gatehouse Resident Information List or Call-Down log, the resident’s permanent vendor list will be checked on their profile. If the vendor’s name appears on the resident’s permanent vendor list, a pass will be issued and access allowed.

4. If the vendor’s name does not appear on the Gatehouse resident’s permanent vendor list, the

resident will be contacted for verification. Note: the resident’s password is required for verification. If the resident verifies the vendor, a pass will be issued and access allowed. If the resident is not available for verification, the vendor must be denied access.

5. Passes are issued daily. Weekly passes are available upon resident request. Restrictions:

Vendor/ Contractor work is permitted only on Mondays through Saturdays (except holidays) between 7:00 A.M. and 6:00 P.M. This does not apply to Realtors who have made proper arrangements IAW Section A-6 REALTORS AND HOMES FOR SALE

Vendors/ Contractors are not allowed access to the community before 6:45 A.M.; and may not begin working until 7:00 A.M. All construction work must be completed and the Vendor/ Contractor must be off property (outside the gates) by 6:00 P.M.

No vendors will be allowed on the following holidays: New Year’s Day, Easter, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day with the exception of an emergency such as broken water pipe, broken air conditioner, the loss of phone service or other similar emergency situations.

Section A-5 CONSTRUCTION VEHICLES Objective: To control and monitor construction vehicles’ access to the Renaissance property. Construction rules and regulations are set forth in Article 12 herein. It is the responsibility of the homeowner to advise security personnel of any construction companies who are authorized to provide services on behalf of the homeowner and submit details as to such activities. Procedures:

1. Security personnel will verify construction vehicle driver’s name, the nature of their business and the resident’s address.

2. The construction site listing for that address will be checked and verified. If the vendor’s name

appears on the Call-Down log, a pass will be issued and access allowed.

3. A construction vehicle is considered a vendor vehicle and will be treated as such regarding daily passes.

Section A-6 REALTORS AND HOMES FOR SALE Objective: To control and monitor access by realtors and prospective property buyers to the Renaissance community.

New listings:

1 The homeowner must notify the Gatehouse Supervisor, in writing, of the realtors name.

2 The Home “SALE” information including the Realtor will be entered in the residents profile by Gatehouse staff.

3 Only realtors with a business card with his/her name will be allowed access to a residence as a vendor.

4 The realtor may designate a sign installation company. Only approved Seven Hills signs may be displayed.

Conducting an Open House within Renaissance:

5 All Open House requests must be approved by both the homeowner and Renaissance Community Association.

6 Requests are to be made at least forty-eight (48) hours in advance by the realtor or owner to the Gatehouse OIC Monday through Thursday, between the hours of 8:30 a.m. to 3:30 p.m.

7 Only approved Seven Hills signs may be displayed. A “picture” of the approved/allowed

signs may be picked-up at the gatehouse. Signage not approved by the Seven Hills Master Association Architectural Guidelines, Section 2.6.8 and Renaissance ARC Guidelines, as well as, Article 13 of the Renaissance Community Association Rules and Regulations may be confiscated.

8 Open house signage at the Gatehouse, surrounding lawn, Seven Hills maintained lawns or

within the Renaissance community, including the property for sale, is not allowed. No balloons or flags, etc. are allowed to be attached to any signage.

9 Realtor will check in with the Gatehouse Officer on the day that the open house is scheduled

in order to provide the name and telephone number of the realtor/agent showing the property.

10 Prospective buyers may be pre-registered at the Gatehouse prior to, or, on the day of the

open house (his/her name will be listed on the Call-Down log): in which case such visitor will receive a guest pass; -OR-

Whenever each prospective buyer has arrived, the Gatehouse Officer will call individually to advise the realtor/agent of each buyer; and a guest pass may then be issued.

NOTE: In keeping with Renaissance security protocol, the realtor/agent may not allow “any” and/or “all” who show up access to the community. Furthermore, if the realtor/agent or owner conducting the Open House CANNOT be reached via telephone at the time of a prospective buyer’s arrival, access will be denied. Those allowed access to the community in accordance with this Section are authorized to ONLY visit the specific property or properties listed on the Guest Pass and are NOT authorized to roam freely throughout the community or visit additional properties without specific authorization to do so. Section A-7 DELIVERY AND SERVICE VEHICLES Objective: To control and monitor delivery and service vehicles’ access to the Renaissance property through the security gate. Procedures:

1. Only the following clearly marked vehicles will be allowed onto the property without a security pass: Fed Ex, UPS, trash vehicles, DHL, US Postal Service, street sweepers, any marked City of Henderson vehicles, school buses, emergency vehicles or marked common utility company.

2. Delivery or service vehicles such as taxis, florists, newspaper delivery vehicles, mobile pet

groomers, pool maintenance vehicles, etc. must be checked in and issued a pass in accordance with Section A-4, above. (vendor procedures)

Section A-8 PARTIES AND SPECIAL EVENTS Objective: To control and monitor guests attending a party or special event on the Renaissance property. Procedures:

1. It is the responsibility of the resident holding a party or special event to provide security personnel with a guest list 48 hours prior to party. At such time, the resident and security personnel can discuss parking arrangements.

2. All guests attending a party or special event must be issued a pass and be logged in by name

and license plate number. This provision does not permit Overnight On-Street parking. Residents and guests must comply with Article 7, Section 5: Parking Restrictions.
