NEW BRUNSWICK CATTLE PRODUCERS
ORDER 2012-4Pursuant to New Brunswick Regulation 2001-46, the NewBrunswick Cattle Producers makes the following order:
1. This order may be cited as the “Definition Order”.
2. In all orders of the Board unless otherwise stated,“Act” means the Natural Products Act, c.N-1.2, S.N.B.;
“Board” means the New Brunswick Cattle Producers a bodycorporate under the Cattle Plan and Levies Regulation -Natural Products Act;
“Cattle” means live bulls, cows, steers, heifers and calves ofthe bovine species that are marketed for the production ofmeat. The expression includes beef breeding stock, vealcalves, cull cows, and dairy cattle marketed for meat;
“Livestock dealer” means a person who(i) as principal is engaged in the business of buying andselling cattle not raised on the premises of the principal oran agent transacting such business on behalf of the prin-cipal,(ii) an operator of a feedlot operation on which cattle arefed or pastured,(iii) an operator of an auction barn selling cattle,(iv) operates a meat processing plant;
“Market” means to buy, sell, and offer to sell;
“Meat Processing Plant” means the premises where cattle areprocessed and includes an abattoir;
“Person” means an individual, corporation, partnership orcooperative;
“Plan” means the Cattle Plan and Levies Regulation - Natu-ral Products Act.
3. In this order(a) a word in the singular includes the plural, and a word inthe plural includes the singular; and(b) where a word is defined, other parts of speech and tensesof the same word shall have corresponding meanings.
4. Board Order 2012-1 is hereby repealed.5. This Order shall come into force on September 14, 2012.Dated this 14th day September, 2012.

« Commercialiser » signifie acheter, vendre ou mettre envente;« Établissement de transformation de la viande » désignetout endroit où les bovins sont transformés, y compris unabattoir;« Personne » désigne un particulier, une corporation, une so-ciété en nom collectif, une association sans personnalité mo-rale ou une coopérative;« Plan » désigne le Règlement concernant le Plan et les re-devances relatifs aux bovins - Loi sur les produits naturels.

NEW BRUNSWICK CATTLE PRODUCERS
ORDER 2012-5Pursuant to New Brunswick Regulation 2001-46, the NewBrunswick Cattle Producers makes the following order:
1. This order may be cited as the “Livestock Dealer LicensingOrder”.2. Subject to section 3 no person shall commence or continuein the marketing of cattle as a livestock dealer in NewBrunswick unless he or she first registers with the Board andhas obtained a license authorizing such person to engage in themarketing of cattle. This includes any person from outside ofNew Brunswick coming into New Brunswick to purchasecattle.
3. Section 2 does not apply to(a) a person who,
(i) purchases cattle for his or her own consumption orthe consumption of his or her family if no more thanfour cattle are purchased by such person in any year,(ii) only purchases cattle from a New Brunswick Auc-tion Barn licensed by the Board;
(b) a 4-H Club conducting no more than two cattle sales inany one year.
4. Every application for a license shall include the names andaddresses of all representatives of the applicant and shall desig-nate one of the persons to act as its representative in conductingbusiness with the Board.5. The license fee shall be as follows:
Each license issued by the Board shall expire on August 31st ofeach year and may be renewed annually in accordance with thepractices and procedures of the Board.6. Persons licensed pursuant to this order shall not buy from,or sell to, any person engaged in the marketing of the regulatedproduct who is required to have a license pursuant to this orderunless that person possesses a valid license issued by the Board.
7. (a) The Board may suspend or cancel a license for suchperiod as it considers proper where, after a hearing in ac-cordance with paragraph (b), it is satisfied that the personholding the license has failed to meet a requirement of theAct, the Plan or an order of the Board made thereunder;(b) The Board shall not suspend or cancel a license until ithas afforded the person holding the license an opportunityto show cause why the license should not be suspended orcancelled;(c) The Board may reinstate a license that has been sus-pended or cancelled.

b) un cercle 4-H qui effectue au plus deux ventes de bo-vins au cours d’une seule année.
4. Une demande de licence doit contenir le nom et l’adressede tous les représentants du demandeur et désigner une per-sonne pour agir à titre de représentant auprès de l’Office.
5. Le droit de licence est établi comme suit :
Toute licence délivrée par l’Office expire le 31 août de chaqueannée et peut être renouvelée annuellement en conformité avecles pratiques et procédures de l’Office. 6. Aucune personne titulaire d’une licence délivrée en vertudu présent arrêté ne peut acheter ni vendre d’animaux à une per-sonne s’occupant de la commercialisation d’un produit régle-menté pour lequel une licence est exigée conformément au pré-sent arrêté, à moins que cette personne possède une licencevalide délivrée par l’Office. 7. a) L’Office peut annuler ou suspendre une licence pour
une durée qu’il considère appropriée s’il est convaincu,après l’audience visée à l’alinéa b), que la personne titu-laire de la licence ne se conforme pas à une exigence de laLoi, du Plan ou d’un arrêté pris par l’Office;b) L’Office ne procède pas à la suspension ou à l’annula-tion de la licence sans offrir à la personne titulaire la possi-bilité de faire valoir les motifs pour lesquels la licence nedevrait pas être suspendu ou annulée;c) L’Office peut rétablir une licence qui a été suspendueou annulée.

2. (a) Every person who purchases cattle, including purebredcattle, must deduct a checkoff levy of $3.00 (plus HST) percattle marketed within the Province and send the checkofflevy to the Board. Cattle is marketed within the Provinceregardless of whether its destination is within or outside theboundaries of the Province of New Brunswick provided itis produced or purchased and transported within the bound-aries of the Province;(b) The checkoff levy must be deducted at point of saleand remitted to the Board by the 15th day of the month fol-lowing the purchase date of the cattle and in accordancewith Section 3.
3. (a) NB Cattle Producers shall provide to the purchaser ofcattle a Dealer Field Report receipt book which must beused for all cattle marketed. At point of sale, each seller ofcattle must receive his copy of the Dealer Field ReportReceipt;(b) The Dealer Field Report receipt book is a three partprenumbered form book. One part remains in the book forthe purchaser’s records, one part is the receipt for the sellerand one part is to be returned to the Board with the MonthlyLevy Report for Dealers and Abattoirs. Checkoff levy ratesfor other provinces are provided by the Board and must beused when cattle are purchased outside of NB. The receiptsshall include the following information:
(i) Licensed Livestock Dealer name, address and li-cense number,(ii) Seller name and address,(iii) CCIA tag numbers,(iv) Date of purchase, total number of head of cattlepurchased, total checkoff, HST due on total checkoff/levy for a grand total due to the Board of the totalcheckoff and HST,(v) Indication is required if cattle are purchased outof province using the checkoff levy for the province oforigin for the cattle purchased in compliance with theNational Checkoff federal legislation, and(vi) Signed by both the purchaser and the seller;

3. a) Éleveurs de bovins du NB doit remettre à l’acheteur debovins un livret de reçus/rapport du négociant, lequel serautilisé pour chaque bovin commercialisé. Une copie dureçu du Rapport du négociant doit être remise à tout ven-deur de bovin au point de vente;b) Le livret de reçus/rapport du négociant est un livret deformulaires prénumérotés. Une copie demeure dans le li-vret dans les dossiers de l’acheter, une copie est le reçu duvendeur et une autre copie doit être remise à l’Office avecle rapport mensuel sur les redevances pour les négociantset les abattoirs. L’Office fournit les taux de redevancespour d’autres provinces, ces taux doivent être utilisésquand des bovins sont achetés à l’extérieur du NB. Les re-çus doivent inclure les renseignements suivants :
(i) Le nom, l’adresse et le numéro de licence du né-gociant d’animaux,(ii) Le nom et l’adresse du vendeur,(iii) Les numéros d’étiquette de l’ACIB,(iv) La date d’achat, le nombre de têtes de bétailachetées, la redevance totale, la TVH à être versée surla redevance totale; le grand total sur la redevance et laTVH seront remis à l’Office,(v) Une preuve est requise si le bovin est acheté àl’extérieur de la province, en utilisant la redevancepour la province d’origine pour les bovins achetés envertu des lois fédérales sur les redevances, et(vi) Signée par l’acheteur et le vendeur;
