2. Kesemuanya kawasan tanah yang terletak di Sarikei yang dikenali sebagaiSebahagian daripada Lot 60 Block 62 Sarikei Land District mengandungi keluasankira-kira 900 meter persegi, seperti yang digariskan dengan lebih khusus lagi dalampelan (Cetakan bernombor 15/AQ/6D/22/2012) dan dipinggirkan dengan dakwatmerah, adalah dikehendaki bagi suatu maksud awam iaitu untuk pembinaan tabika(Tabika KEMAS Rumah Lingga, Selangan, Sarikei). Butir-butir selanjutnya berkenaantanah itu boleh didapati dari pejabat Penguasa Tanah dan Survei, Bahagian Sarikei,Sarikei.

3. Oleh sebab tanah yang tersebut di atas dikehendaki oleh Kerajaan, makaKerajaan kenalah mengambil alih tanah tersebut. Berikutan dengan itu, segala hakadat bumiputera ke atas tanah itu akan diambil alih oleh Kerajaan tertakluk kepadapembayaran pampasan mengikut seksyen 5(3) Kanun Tanah.

4. Mulai tarikh berkuatkuasanya Arahan ini, segala hak adat bumiputera keatas tanah tersebut tidak lagi wujud dan tanah tersebut hendaklah kembali kepadaKerajaan bagi maksud awam yang tersebut di atas.

5. Barang siapa yang mempunyai apa-apa tuntutan yang sah mengikut hak adatbumiputera ke atas tanah tersebut atau mana-mana bahagian daripadanya dan yanghak mereka itu terjejas disebabkan Arahan ini hendaklah, dalam tempoh enampuluh (60) hari dari tarikh penyiaran Arahan ini dalam sebuah akhbar yang beredardi Sarawak, mengemukakan tuntutannya, berserta bukti sebagai menyokong tuntutannyaitu, kepada Penguasa, Jabatan Tanah dan Survei, Bahagian Sarikei, Sarikei dalamborang yang ditetapkan oleh Penguasa dan yang boleh didapati dari pejabatnyadi Jabatan tersebut. THE LAND (NATIVE CUSTOMARY RIGHTS) (NO. 92) 2014 DIRECTION

(Made under section 5(3) and (4))

In exercise of the powers conferred by section 5(3) and (4) of the LandCode [Cap. 81], the Minister of Resource Planning and Environment has madethe following direction:

1. This Direction may be cited as the Land (Native Customary Rights) (No.92) 2014 Direction, and shall come into force on the 25th day of November,2014.

2. All that area of land situated at Sarikei known as Part of Lot 60 Block62 Sarikei Land District, containing an area of approximately 900 square metres,as more particularly delineated on the plan (Print No. 15/AQ/6D/22/2012) andedged thereon in red, is required for public purpose, namely for the constructionof tabika (“Tabika KEMAS Rumah Lingga, Selangan, Sarikei”). Further detailsregarding the land can be obtained from the office of the Superintendent ofLands and Surveys, Sarikei Division, Sarikei.

3. As the aforesaid land is required by the Government, the Government hasto acquire it. In consequence thereof, all native customary rights over such landshall be taken over by the Government subject to the payment of compensationunder section 5(3) of the Land Code.

4. As from the date of coming into force of this Direction, all native customaryrights over the said land shall cease to subsist and the said land shall revertback to the Government for the aforesaid public purpose.

5. Any person having any lawful claim to native customary rights over thesaid land or any part thereof and whose rights are affected by this Direction shallwithin sixty (60) days from the date of publication of this Direction in a newspapercirculated in Sarawak, submit his claim, together with evidence in support thereof,to the Superintendent, Lands and Surveys Department, Sarikei Division, Sarikeiin a form prescribed by the Superintendent and obtainable from his office in thesaid Department. Compensation will be paid to those claimants with proven nativecustomary rights over the said land or any part thereof in accordance with theprovisions of the Land Code.
