ENVIRONMENT PROTECTION ACT 1993 Vary the Approval of Category B Containers

I, STEPHEN RICHARD SMITH, Senior Adviser, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 69 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Vary the Approval of Category B Containers Vary the approval of Category B Containers, subject to the conditions in subclauses (i) and (ii) below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; (d) the name of the holders of these approvals. (i) Subsection 69 (3) Arrangements The holders of these approvals must ensure that the empty containers which belong to their respective class of containers

hereby approved as Category B Containers are collected from collection depots approved under section 69 of the Act by the party named in Column 5 of Schedule 1 of this Notice; and

(ii) Approved Refund Markings (a) The holders of these approvals must ensure that each container which belongs to their respective class of containers hereby

approved as Category B Containers bears the refund marking approved by the Authority in respect of that class of containers.

(b) The refund marking that appears on each container that belongs to the class of containers that is hereby approved, must be a minimum 1.5 mm for the smallest letter in the statement and a minimum 3 mm for the numeric (‘5’) in the statement.

(c) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

ESSENTIAL SERVICES COMMISSION ACT 2002 Price Determination

NOTICE is hereby given that: 1. On 16 March 2005 the Essential Services Commission

made a price determination under the Essential Services Commission Act 2002, as authorised by section 33 (1) (c) of the Gas Act 1997, varying a price determination made on 1 July 2004 concerning prices for the provision of retail market administrator services in the gas market in South Australia.

2. The price determination, as varied, regulates price-fixing factors and conditions relating to prices that may be charged for the provision of retail market administrator services in the gas market in South Australia.

3. The price determination as varied, was made pursuant to the direction issued by the Minister for Energy on 16 June 2004. This direction required the Commission to ensure that the retail market administrator (REMCo) issued a single market share charge that was the same for each delivery point for which a retailer is responsible. The direction from the Minister for Energy did not relate to registration fees or annual service charges.

4. The price determination, as varied, permits a retail market administrator to charge up to the ‘price caps’ set out in the determination without the prior approval of the Commission.

5. The price determination, as varied, also sets out how these price caps change over time.

6. The variations to the price determination take effect from the date of publication of this notice in the South Australian Government Gazette.

7. A copy of the price determination and statement of reasons may be inspected or obtained from the Essential Services Commission, 8th Floor, 50 Pirie Street, Adelaide and is also available at www.escosa.sa.gov.au.

FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, William Ritter, (the ‘exemption holder’) is exempted from Regulations 4 and 5 of the Fisheries (Vessel Monitoring Scheme) Regulations 2003, insofar as he is permitted to undertake fishing activity pursuant to the licence using a tender boat that is registered and endorsed on the licence, without having an operational VMS fitted on the registered boat, provided that the boat is one of two registered boats endorsed on the licence, and the other registered boat does have an operational VMS unit fitted to it in accordance with the Regulations (the ‘exempted activity’). This exemption is granted subject to the conditions set out in the Schedule, and has effect from 24 March 2005 until 31 May 2005, unless this notice is varied or revoked earlier.

SCHEDULE 1. The exempted activity may only be undertaken when fishing pursuant to Northern Zone Rock Lobster Fishery Licence No. N077. 2. Prior to conducting the exempted activity, the exemption holder must contact the PIRSA Fisheries Compliance Unit on 1800 065 522 and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related questions.

3. Where the number of ‘other exemption holders’ exceeds three, all of the ‘other exemption holders’ on board the boat are each restricted to taking no more than 10 King George whiting in any one day.

SCHEDULE 3 1. The principal exemption holder, its employees or agents must not take any fish during the chartered fishing trip. 2. RADIATION PROTECTION AND CONTROL ACT 1982 Notice by Delegate of the Minister for Environment and

Conservation PURSUANT to section 44 of the Radiation Protection and Control Act 1982, I, Keith Baldry, Director of the Radiation Protection Division of the Environment Protection Authority, being a person to whom the powers of the Minister under that section have been delegated under the Act, exempt any person who has been authorised to conduct in vivo research involving the use of ionising radiation on a human being at The Queen Elizabeth Hospital and the Lyell McEwin Health Service (‘the Hospital’) from Regulation 45 of the Radiation Protection and Control (Ionising Radiation) Regulations 2000, subject to the conditions appearing in the Schedule.

THE SCHEDULE 1. Such person shall only be exempted if the Ethics of Human

Research Committee (‘the Committee’) of the Hospital has considered and approved such research, and the exemption is limited to the extent specifically approved by the Committee.

2. Such person so exempted shall have provided the following written details to the Committee for consideration at the time of making an application for approval of such research:

(a) full details of the research that the applicant intends to undertake;

(b) the reasons why it is necessary to expose a person to ionising radiation for the purposes of the research;

(c) the number of persons who may be exposed to ionising radiation in the course of research;

(d) the extent to which the persons may be exposed; (e) the possible benefits of the research to the community; (f) the steps the applicant intends to take to monitor the

levels of ionising radiation to which persons may be exposed; and

(g) the precautions that the applicant will be taking to keep such exposure to a minimum.

3. In considering whether or not to approve an application of research by a person seeking exemption under this notice, the Committee shall have regard to:

(a) the levels of ionising radiation to which any person may be exposed;

(b) the number of persons who may be exposed; (c) the steps to be taken by the applicant to monitor

radiation levels; (d) the steps to be taken by the applicant to keep such

exposure to a minimum; (e) the purpose of the research; (f) the possible benefits of the research to the community; (g) the risk, if any, to the health of the community that

may be caused by the research; (h) the general objective as specified in section 23 of the

Radiation Protection and Control Act 1982; and (i) the National Health and Medical Research Council’s

statement ‘Administration of Ionising Radiation to Human Subjects in Medical Research (1984)’, published as Appendix XXXIX to the Report of the 98th Session of the Council, October 1984, and as sub-sequently amended from time to time.

4. At any meeting of the Committee that has approved an application for research, by a person seeking exemption under this notice, Dr Leighton Reginald Barnden, Hospital Radiation Safety Officer, or another medical physicist who has the appropriate knowledge and experience to perform the necessary dosimetric calculations, shall have been present either as a member of, or as an adviser to, the Committee.

5. The Hospital shall notify the Radiation Protection Division of the Environment Protection Authority in writing of its approval of any such application. Such notification shall be made within 7 days of the approval being given and shall contain full details of the research to be undertaken.

6. Any research undertaken by a person exempted under this notice shall be conducted so as to ensure that estimates of the effective dose to any individual subject in any one year shall not exceed the following values:

(a) in the case of a person whose age is less than 2 years—0.1 millisievert;

MARINERS are advised to exercise extreme caution as restrictions on access through the Murray Mouth dredging Exclusion Zone will be temporarily lifted during daylight hours from 8 a.m. on Saturday, 26 March 2005 until 5.30 p.m. on Monday, 28 March 2005. Boat operators should be aware of the possibility of varying water depths, strong tidal currents, waves, shifting sandbars and shallow water. Existing channels may shift or close in the course of a single day making return passage impossible. Dangerous conditions may prevail. Dredging of the Murray Mouth area has been undertaken to protect the Coorong ecosystem and NOT to facilitate navigation. The dredges have been moved to one side of the dredged area for this period and must be avoided. Dredging may have caused parts of the area to have different depths and may have created steeply shelved sections. Mariners are further advised that anchoring is prohibited in the area, and will be strictly enforced, non-compliance will result in a prosecution, in accordance with Harbors and Navigation Act Regulations 1994. Point Boston Amendment Report— Draft for Public Consultation

NOTICE is hereby given that the District Council of Lower Eyre Peninsula has prepared a draft Plan Amendment Report to amend its current Development Plan as it affects the area known as Point Boston including sections 109, 110 and 111, Hundred of Lincoln, plus the adjacent coastal reserve. The Plan Amendment Report will amend the Development Plan by the following means: • Zoning: the Rural Residential (Point Boston) Zone will be

repealed and replaced with a new Mixed Use (Point Boston) Zone. The new Mixed Use (Point Boston) Zone will contain objectives and principles of development control applying only to Point Boston, focusing on natural resource conservation in balance with appropriate forms of residential and aquaculture development exhibiting a high degree of environmentally sustainable development principles.

identified significant coastal features where new residential policies areas are proposed and realigned to correspond with the boundary of the coastal reserve at the tip of section 109. Zones Map LEP/24 will be amended as a consequence of these amendments.

• Structure Plan: the Point Boston Structure Plan will be repealed and replaced with a new Structure Plan that reflects the preferred distribution of land uses and roads, and identifies those parts of the peninsula to be protected from development, such as significant stands of native vegetation, the coastal dunes and the coastline.

The draft Plan Amendment Report and statement will be available for public inspection and purchase during normal office hours at the Council Offices, Railway Terrace, Cummins and 38 Washington Street, Port Lincoln from Thursday, 24 March 2005 to Friday, 27 May 2005. A copy of the Plan Amendment Report can be purchased from the council in a hard copy form for $20 each or a CD version for $10 each. Written submissions regarding the draft amendment will be accepted by the District Council of Lower Eyre Peninsula until Friday, 27 May 2005. The written submission should also clearly indicate whether you will wish to speak at the public hearing regarding your submission. All submissions should be addressed to the Chief Executive Officer of the District Council of Lower Eyre Peninsula, P.O. Box 41, Cummins, S.A. 5631. Copies of all submissions received will be available for inspection by interested persons at Railway Terrace, Cummins and 38 Washington Street, Port Lincoln from Monday, 30 May 2005 until the date of public hearings. Public hearings will be held in the Council Chamber, Railway Terrace, Cummins at 9 a.m. on Friday, 10 June 2005. The public hearing may not be held if no submission indicates an interest in speaking at the public hearing. Dated 24 March 2005.
