DEVELOPMENT REGULATIONS 2008

COMPLYING DEVELOPMENT—REGULATION 8A AND SCHEDULE 4 Areas Determined by the Minister for the Purposes of

Schedule 4—Complying Development, Clause 2B—New Dwellings

Preamble It is necessary to advise that pursuant to Schedule 4, Clause 2B (1) of the Development Regulations 2008, I, John Rau, being the Minister administering the Development Act 1993, revoke existing determined areas within the Roxby Downs (MC) Development Plan dated 8 March 2012 and determine additional areas within the Roxby Downs Municipal Council Development Plan as identified in this notice.

NOTICE PURSUANT to Schedule 4, Clause 2B (1), of the Development Regulations 2008, I, John Rau, being the Minister administering the Development Act 1993, have revoked all the determined areas as gazetted on the 27 November 2009 within the Roxby Downs (MC) Development Plan dated 8 March 2012 that Schedule 4—Complying Development, Clause 2 (B)—New dwellings currently applies to. FISHERIES MANAGEMENT ACT 2007: SECTION 79

TAKE note that the notice made under Section 79 of the Fisheries Management Act 2007, dated 12 January 2012 and published in the South Australian Government Gazette dated 19 January 2012, on page 222, being the fourth notice on that page, referring to the West Coast Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing, pursuant to a West Coast Prawn Fishery licence to use prawn trawl nets in the waters specified in Schedule 1, under the conditions specified in Schedule 2, during the period specified in Schedule 3.

SCHEDULE 1 The waters of the West Coast Prawn Fishery adjacent to Venus Bay.

SCHEDULE 2 1. Each licence holder must ensure that a representative sample of the catch (a ‘bucket count’) is taken at least three times per night during the fishing activity. 2. Each ‘bucket count’ sample must be accurately weighed to 7 kg where possible and the total number of prawns contained in the bucket must be recorded on the daily catch and effort return. 3. Fishing must cease if one of the following limits is reached: (a) The average catch per vessel, per night (for all three

vessels) drops below 300 kg for two consecutive nights; (b) The average prawn ‘bucket count’ for all three vessels

exceeds 240 prawns per bucket on any single fishing night in the Venus Bay area.

4. The fleet must nominate a licence holder to provide a daily update by telephone or SMS message to the PIRSA Fisheries Manager, to report the average prawn catch per vessel and the average prawn ‘bucket count’ information. 5. No fishing activity may be undertaken between 0630 hours and 2000 hours on any day during the period of this notice.

ENVIRONMENT PROTECTION ACT 1993 Approval of Category B Containers

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Approval of Category B Containers Approve as Category B Containers, subject to the conditions in subclauses 1, 2, 3 and 4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; and (d) the name of the holders of these approvals. (1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for

containers of that class. The Authority specifies the following refund markings for Category B containers: (i) ‘10c refund at collection depots when sold in SA’, or (ii) ‘10c refund at SA/NT collection depots in State/Territory of purchase’. (2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to

containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale;

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Constitution (Legislative Council Casual Vacancy) Proclamation 2012 under section 13 of the Constitution Act 1934

Preamble 1 A seat of a member of the Legislative Council has become vacant by virtue of the

resignation of the Honourable Robert Kenneth Sneath, MLC.

2 A person must be chosen to occupy the vacant seat by an assembly of the members of both Houses of Parliament.

3 It is necessary to make provision in relation to the constitution and proceedings of that assembly.

1—Short title This proclamation may be cited as the Constitution (Legislative Council Casual Vacancy) Proclamation 2012.

2—Commencement This proclamation comes into operation on the day on which it is made.

3—Provisions relating to the assembly of members The following provisions apply in relation to the constitution and proceedings of an assembly of the members of both Houses of Parliament to choose a person to occupy the vacant seat in the Legislative Council caused by the resignation of the Honourable Robert Kenneth Sneath, MLC:

(a) the assembly will meet at 10:00 am on Wednesday, 17 October 2012 at the Legislative Council Chamber;

(b) the Honourable John Mario Gazzola, MLC, is appointed to preside over the assembly;

(c) Janice Maxine Davis is appointed to be clerk of the assembly;

(d) the following rules are to be observed at the assembly and applied as the method by which the decision of the assembly will be evidenced:

(i) the presiding officer will take the chair;

(ii) the clerk of the assembly will read this proclamation;

(iii) the presiding officer will invite nominations for the vacant seat from the members of the assembly;

(iv) nominations will first be made without debate;

(v) a nomination will not be accepted by the presiding officer unless—

(vii) when members have concluded their remarks, a ballot will be taken if necessary;

(viii) the presiding officer will announce to the assembly the name of the person chosen to occupy the vacant seat;

(ix) the President of the Legislative Council must be informed in writing of the decision of the assembly and notice of the decision must be published in the Gazette.

Part 1—Preliminary 1—Short title

These regulations may be cited as the Motor Vehicles Variation Regulations 2012.

2—Commencement These regulations come into operation on the day on which they are made.

3—Variation provisions In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Motor Vehicles Regulations 2010 4—Insertion of regulation 44A

After regulation 44 insert:

44A—Use of photographs by Registrar under section 77BA(2)(e) of Act

(1) Photographs to which section 77BA of the Act applies may be used by the Registrar to conduct comparisons using a facial recognition system—

(a) to assist in determining whether the quality of the photographs is adequate for the photographs to be included in the register of licences; or

(b) to assist in determining whether a person’s photograph has been taken and recorded using more than 1 identity; or

(c) to assist in determining whether a person who is applying for, or has applied for, the issue or renewal of a licence or learner's permit already holds a licence or learner's permit; or

(d) to assist in determining whether a person who is applying for, or has applied for, the issue of a duplicate licence or learner's permit has already been issued a duplicate licence or learner's permit; or

(e) for any other purpose connected with the administration or enforcement of the Act.

(2) In this regulation—

facial recognition system means a computer software application that uses biometric technology to identify a person or verify a person's identity by comparison of digital images of human faces using various facial features (such as a person's eyes, nose and mouth) as points of comparison;

register of licences means the register of licences under section 73 of the Act.

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.

This Poll of Electors is a condition of the Amalgamation Agreement between the former District Council of Mount Pleasant and The Barossa Council. The voters roll to conduct this poll will close at 5 p.m. on Wednesday, 31 October 2012. The poll will be conducted entirely by post with the return of ballot material to reach the Returning Officer no later than 5 p.m. on Wednesday, 5 December 2012.

LIGHT REGIONAL COUNCIL DEVELOPMENT ACT 1993

Freeling (West) Residential Development Plan Amendment— Draft for Public Consultation

NOTICE is hereby given that the Light Regional Council has prepared a draft Freeling (West) Residential Development Plan Amendment (DPA). The DPA proposes to amend the Light Regional Council Development Plan by rezoning approximately 110 hectares of land on the western periphery of the Freeling Township for residential development aligned with the growth forecast in the State Government’s 30 year Plan for Greater Adelaide. The areas covered by the DPA are: • Site 1: Approximately 80 hectares of broad acre land

currently zoned Primary Industry. This site is located north of Templers Road at the north-western extremity of the Freeling Township and is comprised of 17 parcels of land.

• Site 2: Approximately 30 hectares of land currently zoned Rural Living and Primary Industry. This site is located towards the south-western extremity of the township and is comprised of 28 parcels of land.

The DPA includes appropriate planning policies and mapping to achieve the following: • Rezoning to incorporate the area affected from Primary

Industry Zone and Rural Living Zone to Residential (Freeling) Zone, with additional policies to support the key outcomes sought in terms of land use, density, access, open space distribution and stormwater management.

• The creation of a new policy area (to be named Residential (Freeling West) Policy Area 28)) over the area affected,

featuring detail of the desired character and policies relevant to this location ensuring high quality design outcomes.

• Introduction of a Concept Plan to guide future development of the area and its integration with the balance of the Freeling Township.

From 12 October 2012 to 7 December 2012 the draft will be available for public inspection and purchase during office hours (9 a.m. to 5 p.m.) at Council’s Offices, 93 Main Street, Kapunda, or 12 Hanson Street, Freeling. The draft Development Plan Amendment is also available for review at Council’s library and its website at www.light.sa.gov.au. A printed copy of the DPA can also be purchased from the Council Office (a $45 fee applies per copy). Written submissions regarding the draft amendment will be accepted by Council until 5 p.m. on Monday, 10 December 2012. Written submissions should also clearly indicate whether you wish to speak at the public hearing on your submission.
