1. CALL TO ORDER, ANNOUNCEMENTS AND QUESTIONS Speaker Leaf called the meeting to order and announced that President Daniel is delayed on his way from an off-campus meeting. The Senate will proceed with the meeting agenda but return to President Daniel’s announcements and question and answer time when he arrives.

President Daniel reported that he had been asked to adjudicate what he considers to be a faculty governance issue that he would like the Senate’s help with. The question is this: A professor hands back homework, exams, term paper assignments, etc. to students in a class. In the next semester or at any future time, a student takes those materials that were handed back and shows them to a student in that same class in a subsequent semester. The student in the current class copies something from this material. The student from the current semester is clearly guilty of plagiarism, but is the student from the prior semester guilty of academic dishonesty? Right now, our rules state that the student from the prior semester is guilty and should not share those materials. There are two schools of thought: Many professors encourage students to look at old exams. Others feel that when materials are given back to students this material should never be shared with anyone.

In President Daniel’s opinion, this is a faculty matter and not a decision that should be made by administration.

Cy Cantrell stated that this is an issue that should be addressed by the Academic Integrity Committee.

There was general discussion regarding this issue. Speaker Leaf asked Dr. Cantrell to have the Academic Integrity Committee review the current rules and determine what changes need to be made. President Daniel specifically requested a clear statement on what the faculty expectations are with regard to materials handed back from a previous semester. May those or may those not be shared with students in subsequent semesters?

President Daniel was asked when the State of the University address will be held and if a notification would be sent to the entire faculty. The address will be held November 3 at 1:00 p.m. in the Conference Center. It will also include brief reports from the Student Government president, the Speaker of the faculty and the president of the Staff Council. President Daniel will ask Judy Snellings to send a notice of the State of the University address out to all staff and faculty.

Kurt Beron asked President Daniel to address the negative response we received in our recent application for a Phi Beta Kappa chapter. President Daniel replied that he felt that our mission statement did work against us. This is an area where our lack of language offerings hurt us as well. Another area of concern for attaining Tier One status is gaining Association of Research Libraries status. President Daniel feels that we should be striving for ARL status and hopes that we will move aggressively toward doing what we need to do to be Phi Beta Kappa qualified as well. He acknowledged that it may take some time for us to accomplish this but we need to maintain a consistent methodical approach.

2. APPROVAL OF THE AGENDA Speaker Leaf had one additional item to add to the agenda – recommendation from the Committee on Committees regarding the membership of the Sustainability Committee. Cy Cantrell made a motion to approve the agenda as amended. Tim Redman seconded the motion. The amended agenda was approved.

3. APPROVAL OF MINUTES Cy Cantrell made a motion to approve the minutes as circulated. Mustapha Ishak-Boushaki seconded the motion. The minutes were approved.

4. SPEAKER’S REPORT Speaker Leaf reported the following: 1) Additions to Committee on Faculty Mentoring. The Senate has amended the charge

of the Committee on Faculty Mentoring to authorize and the committee to add members at their own discretion, without having to depend on the Senate appointment process. In accordance with this charge, Dr. Hlaing Minn, the Chair for this year, has notified me that the committee has added two new members: Dr. Mehrdad Nourani (ECS) and Dr. Cy Cantrell (ECS). I have interpreted the amended charge to imply that the governance secretary should send the appropriate letter of confirmation upon notification by the committee chair, rather than having to wait for Senate confirmation. I am also interpreting the charge as implying that including this action in the Speaker’s Report is an appropriate way to recognize the action in the minutes, if the Senate agrees.

2) John Wiorkowski has resigned as chair and member of the Academic Calendar Committee. The Committee on Committees is considering recommending a replacement as member and as chair, but according to the charge the chair does not have to be a faculty member, and Dr. Wiorkowski’s appointment was as

administrative representative, not as faculty representative, so we are not really required to deal with this either. But we will try to be helpful.

3) The Academic Council had a fairly extended discussion of remarks attributed to Bruce Gnade in an article on UTD’s progress toward “Tier One” status that appeared in the first issue of the new UTD Magazine. The article discusses the importance of research, and then asks what it is. By way of an answer, Dr. Gnade, as VP for Research, is paraphrased as saying in part that research “is not an English professor looking into the finer points of Chaucerian prose.” (p. 20).

Many members of the Arts and Humanities faculty have taken exception to this. Among those bringing this to our attention was Dr. Jessica Murphy, Assistant Professor of Literary Studies. We asked Dr. Murphy to participate in the Council’s discussion.

The reactions reflect three main concerns. First, it seems to suggest a break from UTD’s historic and often repeated position that we want to be a research university across the board, not something like an engineering school with other divisions merely in a service role. Second, that it might imply that research in the humanities was not taken seriously in the Office of Sponsored Projects. And third, that research in the humanities, even though faculty may engage in it, was simply not valued. A fourth issue is that there is actually almost no such thing as “Chaucerian prose.” Chaucer was a poet. A university should know this.

The discussion was wide ranging. One aspect was that while UTD does not in fact have the attitude toward research in the humanities that the article suggests such an attitude is often attributed to us. It is also what some of those in the community around us would actually like us to have, and this, in turn, actually can affect our becoming what we want to be. Provost Wildenthal noted that one of the criteria for a “Tier One” university under the initiative is to have a Phi Beta Kappa chapter. When we applied for admission, however, we were turned down quite flatly and firmly. The reason was their perception that we have substantially this same attitude. Their evidence was not the article, of course, but rather our mission statement, which can read as reflecting much the same emphasis.

The result of the discussion was that the Council agreed on three major initiatives. First, there should be more faculty interaction with, and involvement in, the work of the news and information office. When articles are published paraphrasing or quoting faculty or officials, the articles should be regularly referred back to those individuals to check the attributions. Speaker Leaf would convey this concern to President Daniel. Second, the next issue should have a very substantial article on research in the Humanities at UTD. Dr. Redman and Dr. Murphy will take the initiative in writing it. And third, we would revisit the UTD mission statement with a view toward revising it to make our conception of our self clearer. This last will be a long-term undertaking. Changing a mission statement involves going through many levels of approval. We will have to think of how to organize it. Given these commitments and the firmness of the basic policy and intellectual agreement underlying them, the Council did not think it was necessary at this time to place the item on the Senate agenda for further discussion.

4) The Academic Integrity Committee will meet with Dean Fitch on Friday, October 22. Among other things, the meeting will discuss the content of an annual report to the Senate.

5) All other items are on the Council agenda.

5. FAC REPORT David Cordell gave a report of the September meeting. Speaker Leaf was unable to attend this meeting and Richard Scotch attended in his absence.

The FAC was addressed by Steve Collins, the Associate Vice Chancellor for Governmental Relations, who spoke about issues in the upcoming legislative session.

The state is looking at a $12 to $21 billion shortfall. There is $8-$9 billion in the Rainy Day Fund. Higher education is being asked to cut an additional 10% from next year’s budgets. The UT System employs approximately 88,000 people, including 17,000 professors.

Sandra Woodley, the Vice Chancellor for Strategic Initiatives, presented some of the types of institutional research that her office is conducting. This includes a lot of modeling with benchmark comparisons. Ms. Woodley emphasized that the benchmarks are not aspirational; they are based on other institutions that are similar.

Texas A&M has done a type of faculty productivity research by counting the number of students in each professor’s course. The results were posted online then quickly removed because this particular study did not do a thorough job of evaluation. However, there was a sense that all of our institutions need to address this with some concise way of evaluating exactly what is faculty productivity.

Other topics to be addressed by the Strategic Initiatives Office in the future will be the cost of a degree, tuition affordability, financial aid trends compared to other states, and funding adequacy of institutions.

Regent Robert Stillwell addressed the group. He seemed to have the University’s interest at heart. He was easy to talk with and genuinely interested. The topic of having a faculty regent was brought up. Regent Stillwell was amenable to this idea and it will be addressed again in the future.

Senator Kirk Watson also spoke. He is very worried about higher education because the state budget shortfall is so large. A two-thirds vote is required to touch the rainy day fund, and the state is currently running a deficit which is larger than this fund. The criminal background check issue was discussed again. Each campus will write its own policy that is specific to their campus but will still be consistent with the policy at the System level.

6. STUDENT GOVERNMENT LIAISON REPORT Ms. Bielawski reported that Student Government will be sponsoring a series of Town Hall meetings with each Dean so that students can find out what is going on in their schools. They continue to discuss ways to hold down textbook costs. President Daniel praised the Student Government for its work in the past. He cited the new Student Services Building and the consolidation of all student services in a central location as an example of a suggestion from student government that was put into action.

7. CRIMINAL BACKGROUND CHECK POLICY Speaker Leaf reported that the draft policy was approved by the Senate and went to the HOP Committee for review. The HOP Committee had some concerns and the same concerns arose at the Faculty Advisory Council meeting. These are addressed in section eight of the draft and concern the idea that self-reporting, which is required now under Regents’ rules, includes reports of charges as well as convictions. The rest of the policy now only deals with convictions. The discussion at the System level is to take charges out of the self-reporting requirement as well. Speaker Leaf agreed at the Academic Council meeting to rewrite this section to remove the need for self-reporting of charges.

An issue that was not involved in the Academic Council discussion was how this affects applicants versus current employees. The revised draft before the Senate leaves in self-reporting for applicants but includes language specifying these be serious matters. The section regarding current employees is worded only to ask for self-reporting of criminal convictions.

The other major issue in the draft previously approved dealt with self-reporting records. In the previous version these records were, following Regents’ rules, treated as personnel records and maintained according to those records retention schedules. The revised version states that these are merged with other reports for criminal convictions and handled under that policy. Tim Redman made a motion to approve the revised policy. Simon Fass seconded. The motion carried. Ms. King will now send this to OGC.

8. CEP PROPOSALS (A) UNDERGRADUATE CATALOG COPY CHANGES

Cy Cantrell presented this proposal. This is information for the 2011 catalog. Dr. Cantrell distributed a revised version of the information from what was distributed in the agenda packet. The amended information is attached to these minutes.

In the revision the language has been cleaned up regarding eligibility for the Fast Track option. This still requires school-level approval and in some cases approval of the Graduate Dean.

The second change is in respect to the approvals required for grade changes. It was not clear why a grade change made in a relatively short period of time after the end of the semester required the approval of the Undergraduate Dean. The current wording requires the signature of the Undergraduate Dean for all grade changes. This language has been changed so that only really late grade changes require the approval of the Undergraduate Dean.

Cy Cantrell made a motion to approve these amendments. Simeon Ntafos seconded the motion. The motion carried.

(B) NEW PROGRAM REQUEST – MS IN MARKETING Dr. Cantrell asked if anyone from the School of Management would like to address this. Dr. Murthi presented this proposal. He stated that this degree is primarily for students who know they want to specialize in marketing. There is high interest in the industry for this type of program and they have already received offers for internship positions from

many local corporations. Cy Cantrell made a motion to approve this degree proposal. B.P.S. Murthi seconded. The motion carried.

(C) ACADEMIC CALENDAR PROPOSAL Dean Piñeres presented this proposal. She reported that for the past few years we have averaged 24-48 hours between the time grades were due and the beginning of the next semester. Consequently, the Registrar’s office does not always receive grades in a timely manner. Financial Aid can’t run their reports until all grades are in, which holds up refunds from the Bursar’s office. This short time frame also causes problems when students fail a prerequisite course and have to be pulled from a higher level class. The current calendar was developed based on a very strict interpretation of Coordinating Board rules. The calendars of all the major universities in the state have been reviewed and the proposed calendar is in line with what they are doing. It has also been reviewed and approved by the Coordinating Board. Dean Piñeres stated that the new calendar also meets the demands of the students, who would like more time between semesters. The new calendar maintains the scheduling of spring break to match with UT Austin’s schedule. Cy Cantrell made a motion to approve the proposal. Jessica Murphy seconded. A question was raised asking if the mid-term grade due dates could be moved. Dean Pineres replied that this was not possible as it would not allow enough time to address issues with students who needed to withdraw from a class. Grace Bielawski noted that the student body feels that it is critical to have the calendar set up with reading days occurring during the week and not on weekends. After further discussion the motion carried.

9. DISCUSSION ON COST CONTAINMENT PRINCIPLES President Daniel stated that in his upcoming State of the University Address, he will be addressing the financial challenges facing UT Dallas as a result of the 5% state budget reduction this year, and proposed 10% (additional) cut next year. While the challenges are not overwhelming they are still significant and will require some additional actions that will focus heavily on administrative expenses. He presented the following cost containment principles and asked the faculty to discuss and give a response in the next month.

• Preserve and strengthen educational and student experience (no delay in anyone’s time to graduation; key courses available; strong emphasis on quality of instruction and instructional support; this is our No. 1 priority)

• Continue improvement of graduation rates (strengthen student success in first-year courses, especially math, physics, chemistry, biology, and rhetoric)

• Continue strong financial aid policies (no major reduction in financial aid offered to students as this would impede access at a time when access is more important than ever)

• Continue on course for Tier One (we’ve built momentum and need to continue acting in the way that we have planned, expanding enrollment and the size of the faculty, adding new degree programs, expanding research, and building excellence at a nationally competitive level)

• Improve administrative efficiency (find ways to save money on core administrative overhead costs)

• Consider eliminating activities that do not score highly in their relationship to principles articulated above, that is, “nice to have” but not “mission critical” activities, including community engagement programs, non-critical internal programs, small enrollment elective courses that are not part of a major growth plan, etc.

• Develop new sources of revenue, such as gifts, corporate or community support

Speaker Leaf stated that he did not see these issues as big expense items. His opinion is that maintenance and upkeep is a bigger issue and raised the question of deferred maintenance and how best to cycle maintenance to minimize long-term costs. President Daniel replied that he thinks the biggest cost of the University is the top priority – the faculty and courses are the single biggest costs of the University. It may be necessary to eliminate some low-enrollment elective courses. Dr. Chandrasakaren noted that it was important for us to maintain flexibility and not to automatically eliminate all low-enrollment courses. President Daniel was asked if our per capita costs are increasing because we are hiring more established faculty in our push to attain Tier One status. He acknowledged that might be one reason for an increase in the cost and stated that one of our strategies in the future may be to focus on more entry-level faculty as a way to continue to grow but in an immediately less-costly way. He feels that our costs are going up as well because we are recruiting in a more nationally competitive way.

Dr. Jamison stated that we have tried to be as conservative as possible throughout the budget process, but as we move forward we will need to find ways to cut costs in streamlining processes while “beefing up” the academic side.

President Daniel expressed concern that the legislature may move financial resources from graduate programs to incentivize undergraduate programs in some identified key areas. This would have a significant negative impact on UTD.

10. DISCUSSION ON NOTIFICATION POLICY FOR ORAL EXAMINATIONS Speaker Leaf noted that the Council had asked President Daniel to discuss the change in policy for notification by email of oral examinations for dissertations. President Daniel reported that over a long time he has received many complaints regarding too many mass emails and the fact that anyone could send a mass email with no filters. He decided that we needed some type of control over mass emailing and did not see the need to email every faculty member about every Ph.D. exam and asked for alternative ways to send notifications of these exams to be developed. He also noted that there is nothing in the new guidelines to prevent the schools from developing their own email list and sending notification of the exams to their faculty. Speaker Leaf reported that he has not received any complaints about the amount of mass emails being sent but has received several complaints regarding the fact that mass notifications regarding oral examinations are no longer being sent. Dr. Cantrell pointed out that one problem in just emailing notification in a single school is that this does not address joint-appointment faculty who may be working and supervising interdisciplinary

students. He feels this is taking another step towards compartmentalization and away from an interdisciplinary focus. It was suggested that Dr. Cunningham’s office create an email list with a subscription option. This would allow everyone who wants to see the notices to receive this information and those who do not want these emails can opt-out. Announcements of the oral examinations would still be posted in other areas as well.

President Daniel asked that the Information Resources Planning and Policy Committee meet with the staff in the Office of Communications to review this problem and report back to the Senate in a couple of months. An announcement of this meeting should be sent to the Senate as well so that anyone who is interested in attending may do so. Another item for discussion in this meeting will be how does the Office of Communications receive and channel suggestions for better communication?

GUIDING PRINCIPLES FOR COST MANAGEMENT (Taken from President David Daniel’s State of the University Address given November 3, 2010)

It appears certain that the State of Texas will cut funding to higher education in the upcoming biennium, which begins September 1, 2011, a little less than a year from now.

While Texas has been less affected by the economic downturn than other states, there’s no escaping the impact of state funding reductions. We have one of the very best government affairs representatives in Texas, Vice President Amanda Rockow, who is hard at work. But the forces at play are largely out of our control, and we must plan accordingly.

The state reduced our general revenue appropriation 5 percent this biennium and asked us to plan for an additional 10 percent reduction next biennium, for a total of 15 percent. We do not know what the final reduction will be, come September 1 of next year. There is a very real possibility that it could be more.

We do not know how the state will handle funding of enrollment growth. The worst case for us would be for the state to lock in funding at current levels and not recalibrate for enrollment growth before making cuts. In addition, for this current period, the State Legislature used federal stimulus money to fund some recurring appropriations. These funds may not be replaced.

In summary, we anticipate major reductions in state funding for the biennium that begins September 1, 2011. Some of this reduction in state funding will be offset by increases in income from research and tuition, but those are unlikely to balance the losses.

These are guiding principles that I suggest as we plan for budget reductions:

• Preserve and strengthen our students’ educational experience with no delay in anyone’s time to graduation, and preservation and enhancement of the quality of instruction.

• Improve retention and graduation rates. • No major reduction in financial aid and continued emphasis on diversity. • Continue on course for Tier One:

o Strategically expand enrollment and the size of the faculty. o Strategically add new degree programs. o Expand research. o Build excellence at a nationally competitive level.

• Value the educational pipeline and teacher preparation programs that feed quality students to our institution.

• Improve administrative efficiency in all areas of the University including business and academic processes.

• Preserve a capacity to innovate. • Consider eliminating activities that do not score highly in relation to principles articulated

above, that is, nice to have, but not mission-critical. • Develop new sources of revenue, including gifts, corporate or community support, and

auxiliary services.

To quote Fortune Magazine writer Geoff Colvin, from Andrew Winston’s book Green Recovery: “It’s hard to be upbeat in a recession, but it truly is an opportunity. Marathoners and Tour de France racers will tell you that a race’s hardest parts, the uphill stages, are where the lead changes hands. When this recession ends, when the road levels off and the world seems full of

promise once more, your position in the competitive pack will depend on how skillfully you manage right now.”

So, how do we find the best position in a race that will be difficult for all? We must act now and look to make reductions on our own, so that we will be as nimble as possible, and capable of responding to the opportunities that will arise despite the difficult times. Toward that end, I am directing my administrative leadership team to identify an additional $4 million in cost savings this fiscal year from state-appropriated accounts, which is about 4 percent of our state funding for operations, consistent with our guiding principles. These reductions will be recurring and carry over to next fiscal year. Additional reductions may be necessary for the fiscal year beginning on September 1, 2011.

One area for consideration is consolidation of administrative operations where there is some overlap of activities. By combining such operations, we can be more efficient. There are opportunities for collaboration between academic units, as well, such as faculty members from one school teaching a critical course in another school. But first and foremost, we will examine administrative costs in our administrative and academic units and seek reductions there.

Dr. Calvin Jamison and the business affairs team have already launched several initiatives that are focused on seeking efficiencies, including the lean University initiative and a broad-based review of cost management alternatives. I am grateful for these efforts and ideas, and hope for more. Please share your suggestions and ideas with me on how we can be more efficient while preserving the quality of the most important thing that we do, which is to educate our students.

In particular, UT Dallas is going to redouble its lean University initiative, which seeks cost-saving efficiencies in administrative processes, and broaden it to a “lean and green” initiative that focuses not only on lean process but sustainability, as well.

We’re going to make a concentrated effort to reduce electricity, natural gas, and water costs by at least 10 percent. I have challenged our Information Resources team to figure out how we can turn off more computers and computer monitors when they are not in use. Unplug your cell phone rechargers, laptop rechargers, and anything else that draws power when not in use.

We need to take a careful look at everything. Does an office need four printers when one printer would draw less power and, at larger scale, operate more efficiently? When we purchase vehicles, is fuel efficiency a top priority? Do we really need so many paper copies — can’t we be more efficient by using electronic copies? Can’t we better control lighting and thermostats and save energy? Surely we can travel less, making greater use of the telecommunications tools available today. And maybe when we do travel, we can get by with fewer travelers. These lean and green steps will save money, reduce our carbon footprint, and make us better and stronger.

QUESTIONS FOR SENATE COST CONTAINMENT DISCUSSIONS 1. Can we formulate a policy or recommendation to the effect that we should prefer to hire

faculty at entry level positions except in cases where a senior level appointment is clearly necessary as a foundation for our plans for long-term growth?

2. Can we, either in relation to the first priority, also establish a policy or recommendation to the effect that we should also seek to hire faculty in areas where cutbacks in other major university systems, or at other major campuses, have created short-term situations in which highly reputed faculty may be available who we might not be able to make competitive offers to under more normal circumstances?

3. Is there any way we could recommend, consistent with holding down instructional costs, to get more senior faculty back into undergraduate instruction?

4. What can we do, or recommend, to provide faculty with facts on the use of university equipment and infrastructure that might lead them to make decisions that save money and energy—such as telling them the facts of energy consumption by lighting or the pros and cons of leaving computers on when they are not in use, or when you leave the campus?

5. A few years ago we had a rash of thefts of LCD projectors from classrooms. I don’t know if this problem has been solved. If it has not, is there anything we can do or recommend for faculty to do to try to attack it?

Drop-out rates are going to be prominent again in political discussions of higher education, following a somewhat disingenuous report issued last month by the American Institute for Research. A key paragraph in their news release about the report is:

In Finishing the First Lap: The Cost of First Year Student Attrition in America’s Four Year Colleges and Universities, AIR researchers analyzed 2003-2008 data from the federal Integrated Postsecondary Education Data System (IPEDS) and found that the 30 percent of first-year college students who failed to return to campus for a second year accounted for $6.2 billion in state appropriations for colleges and universities and more than $1.4 billion in student grants from the states. Additionally, the federal government provided $1.5 billion in grants to these students. The study did not examine community colleges, where first-year dropout rates are even higher.

Texas was one of the states specifically named as suffering major “losses” from this, and there has already been discussion of the report at the state level. I read the report quickly. It only looked at students who failed to return after the first year, and the “costs” were the aggregate of support funding that such students had received. There was no tracking of students who went to other institutions, or and no time depth to track students who came back to their first institutions. So even if we would agree that scholarship money given to first year students who do not graduate is wasted, these figures necessarily overestimate the actual amounts substantially.

Nevertheless, setting aside the erroneous inferences and not worrying about political perception as an important fact in its own right, there are two senses in which students who do not finish their degrees are a problem for us. First, if they do get scholarship support we have to ask whether that support might have been better used by giving it to someone else. Second, if we drive away students who actually are capable and who would like to stay, then we are graduating fewer students with the same effort that would be involved in graduating more students. In this case, we should ask if there is something about the way we have structured the curriculum or support services that is either positively discouraging insufficiently supportive. We have

identified the calculus and basic chemistry courses as major hurdles and the students seem to be making heavy use of the GEMS program developed in response to this. Are there others such pinch-points? What about class scheduling? Is our advising all it can be? Can we get more input from Student Government?

BYLAWS

• Preamble.

• Purpose. The purpose of the School of Arts and Humanities Bylaws (“Bylaws”) is to provide guidance to the faculty regarding their various duties and responsibilities and to provide information to the University Administration on the administration, operation and organization of the School of Arts and Humanities (“A&H”) at the University of Texas at Dallas (“UT Dallas”).

• Terminology. The following terminology shall be used throughout the Bylaws and is defined as follows:

• Faculty. The A&H Faculty shall consist of all persons appointed at least half time for a term of at least nine (9) months during the current academic year to one of the following positions:

• Full, Associate, or Assistant Professor(tenured/tenure-track)

• Senior Lecturer I, II, or III and Part-time Senior Lecturer (non-tenure track)

• Full, Associate, or Assistant Visiting Professor (non-tenure track)

• Full, Associate, or Assistant Lecturer Professor (non-tenure track)

• Full, Associate, or Assistant Clinical Professor (non-tenure track)

• Senior Lecturer. Per the UTDallas Faculty Senate General Standards and Procedures: Peer Review of Non-Tenure Track Faculty (“Faculty Senate”) at UTDallas, “Senior Lecturer” will be understood to be a person employed on at least a renewable annual contract with a teaching requirement of 24 workload points in organized courses or a person appointed as a Senior Lecturer at least half time or with administrative duties. Senior Lecturers may be hired for up to a three (3) year contract term. This policy does not apply to ordinary “Lecturers,” who are hired to teach specific courses on a course-by-course basis

• Senior Lecturer I. Term used for teachers who will augment and complement regular teaching faculty and whose teaching experience and qualifications must meet the SACS requirements for all courses taught. Senior Lecturer I is generally an initial appointment.

• Senior Lecturer II. Term used for teachers who will augment and complement regular teaching faculty and whose teaching experience and qualifications must meet the SACS requirements for all courses taught. Senior Lectuer II signifies a record of excellence relative to their assignments.

• Senior Lecturer III. Term used for teachers who will augment and complement the regular teaching faculty and whose teaching experience and qualifications demonstrate extraordinary service and performance. Senior Lecturer III faculty must meet the SACS requirements for all courses taught.

• Part-time Senior Lecturer. Term used for teachers who will augment and complement regular teaching faculty and whose teaching experience and qualifications must meet the SACS requirements for all courses taught.

• Full, Associate or Assistant Visiting Professor. A non-tenure track temporary appointment of persons either visiting from other institutions where they hold similar ranks or who are brought to A&H on a trial basis. Such appointments are limited to two (2) years.

• Full, Associate, or Assistant Lecturer Professor. A non-tenure track appointment used when a qualified person from business, industry, government, private practice, or another institution of higher education may be teaching a course or participating in the teaching of a course in A&H. Appointment shall not exceed the term of one (1) academic year. If A&H deems

the position beneficial, the lecturer faculty member may be offered reappointment to an lecturer faculty position in accordance with the Texas Education Code Section 51.943.

• Full, Associate, or Assistant Clinical Professor. A renewable non-tenure track position.. Appointment shall not exceed the term of three (3) years. If A&H deems the position beneficial, the clinical faculty member may be offered reappointment to a clinical faculty position in accordance with the Texas Education Code Section 51.943.

• Rules of Order. All meetings within A&H shall be conducted according to Robert’s Rules of Order.

• Voting Faculty. The voting faculty shall consist of all tenure and tenure track faculty, the Dean and the Associate Deans, and ten percent (20%) of the non-tenure track faculty (“NTTF”), excluding Visiting Faculty..

The Dean shall only vote in matters where there is a tie of the voting faculty.

The number of non-tenure track voting faculty shall be determined rounded to the nearest integer of the total number of tenure and non-tenure track faculty who, at the start of the fall semester, are appointed at least half time and for a term of at least nine months. The non-tenure track faculty shall meet prior to the first faculty meeting each school year to elect as many representatives as are allowed in the Voting Faculty within any school year.

All non-voting faculty may attend all A&H faculty meetings and participate in discussions, except when the faculty meets in executive session or when matters subject to privacy protection are under consideration.

Non-tenure track voting faculty may not vote on or serve on any committee established regarding any matter pertaining to the appointment or promotion of tenure-track faculty.

2.0 FACULTY

2.1 Faculty. The term faculty is fully defined in Section 1.2.1 above,

2.2.4 Such other procedures and policies as may be from time to time necessary or desirable for the governance of A&H.

2.3 Maintenance of High Academic Standards Required. All faculty assume responsibility for the maintenance of high standards of scholarship and teaching, for the conscientious performance of their assigned duties, for observance of the regulations and policies established by the Regents of the University of Texas System and to the public. All faculty share the obligation to treat students and colleagues with courtesy and dignity, while individual members of the voting faculty accept additional responsibility for the conduct of the affairs of A&H and UT Dallas by service to UT Dallas, the discipline and profession of which they are members.

2.4 Meetings and Voting

2.4.1 Faculty Meetings. The A&H faculty will generally meet on the second Wednesday afternoon in August, October, November, February, March, and April of each school year. All faculty are invited to attend. In the event student associations are formed to represent undergraduate students and graduate students, each such student association may have one (1) representative attend faculty meetings in conformity with Section 1.2.3 above.

2.4.2 Faculty Tenure Voting Meetings. In conformity with the policies and procedures in the university policy memorandum 75-III 22-3, the Dean convenes an above-rank subunit of the faculty for the purpose of reviewing and voting on a recommendation for tenure and/or promotion of individual members of the regular faculty.

2.4.3 Extraordinary Faculty Meetings. Extraordinary meetings of the faculty may be called by the Dean, acting on his/her own initiative or in response to a request or requests from a regular faculty member or members.

2.4.4 Quorum. A quorum in all the above meetings consists of a simple majority of the voting faculty.

2.4.5 Agenda. A written agenda for each faculty meeting will be sent to all faculty members from the office of the Dean at least one week in advance of each meeting. The agenda includes but is not limited to approval of the minutes of the previous meeting as submitted and/or amended, reports from the Dean and the Associate Deans, and new business.

Items may be submitted for the agenda in writing to the Dean’s office ten (10) days prior to any faculty meeting by any faculty member. Items so placed on the agenda would be considered under the category of new business.

2.4.6 Faculty Meeting Chair and Parliamentarian. The Dean will chair faculty meetings unless he/she selects a faculty member to chair a meeting in his/her absence. The voting faculty may elect a Parliamentarian to serve as authority on all matters pertaining to meeting conduct under Robert’s Rules of Order at the beginning of each school year. Should any so elected Parliamentarian be absent from a faculty meeting, one of the Associate Deans may serve as Parliamentarian for said faculty meeting.

2.4.7 Faculty Meeting Motions. Motions can be placed before the faculty only by A&H voting faculty. All motions must be seconded by a faculty member, may be discussed by all faculty, and will be voted upon only by voting faculty. All motions may be proposed for amendment under Robert’s Rules of Order during discussion by faculty.

2.4.8 Voting Methods; No Proxy Voting Permitted. All motions, either original or as amended, may be voted upon by voice, show of hands, or secret ballot. If no request is made by faculty, voting shall be by voice vote. No proxy votes are permitted.

Discussion of a motion can be ended, if a call to put the previous question is made and seconded and if two-thirds of the voting faculty so decides.

2.4.9 Faculty Meeting Minutes. Minutes will be kept of all faculty meetings and these minutes will record discussion of issues and action taken by the faculty. These minutes will be distributed to the faculty by the Dean’s office with the agenda for the next meeting.

Minutes of the previous faculty meeting will be approved as submitted and/or amended at the start of the next regular faculty meeting.

The Dean may appoint a secretary (either from the faculty or from the Dean’s staff) to record the minutes of the meetings.

3.0 administrative officers

3.1 Dean.

The Dean of the school is appointed by and serves at the pleasure of the president of the university. The Dean is a tenured member of the faculty, with the rank of full professor. The Dean reports directly to the provost of the university.

The Dean has final responsibility for administration of the school, including preparation and execution of the budget; approval of all personnel actions; scheduling of courses and assignment of duties to members of the faculty; leadership of the faculty on issues of educational policy and programs; appointment, discipline, and removal of staff and administrators within the school; recommendation to the provost of ad hoc committees for review of tenure and promotion cases; annual review of the performance of faculty; and representation of the interests of A&H both within UT Dallas and externally.

The Dean may delegate responsibilities to other officers of the school. Initial appointment of the three principal officers, the Associate Deans, requires approval by majority vote at a regular meeting of the faculty before it becomes effective. When these positions become vacant, the Dean notifies the faculty of their pendency, and any member may indicate interest in appointment.

3.2Associate Dean for Graduate Studies

The Associate Dean for Graduate Studies is a tenured member of the faculty, who reports directly to the Dean and assumes the following special responsibilities:

(1) organization of the course schedule each semester, with the assistance of the program

coordinators and the administrative committee,

(2) Initial selection and regular oversight of part-time lecturers,

(3) preparation of the arts and humanities section of the university’s graduate catalog,

(4) representation of the interests of the graduate program both within the university and

externally,

(5) administration of the graduate program, including admission of students as well as

general oversight of advising and student progress through their degree plans,

(6) the appointment, assignment, and general training of teaching assistants, and

(7) leadership in maintaining high academic standards and in developing the intellectual and

artistic quality of the graduate program.

3.3 Associate Dean for Undergraduate Studies

The Associate Dean for Undergraduate Studies is generally a tenured member of the faculty, who reports directly to the Dean and assumes the following special responsibilities:

(1) administration of the undergraduate programs, including oversight of both lower- and

upper-division advising and instruction as well as student progress through their degree plans,

(2) preparation of the arts and humanities section of the university’s undergraduate catalog,

(3) representation of the interests of the undergraduate programs both within the university

and externally, and

(4) leadership in maintaining high academic standards and in developing the intellectual and

artistic quality of the undergraduate programs.

The Associate Dean for the Arts is generally a tenured member of the faculty, who reports directly to the Dean and assumes the following special responsibilities:

(1) administration of the Arts and Performance Office as well as oversight of staff and

student employees attached to the program,

(2) oversight of Art and Performance spaces and equipment,

(3) initial planning, specific arrangements, and the general administration of the school’s Art

and Performance events, and

(4) liaison with producers and coordinators of Art and Performance events both within the

university and externally.

3.5 Other Officers

With the advice and consent of the school’s executive committee, the Dean may appoint additional administrative officers deemed useful to the management of the school.

4.0 STANDING AND SPECIAL COMMITTEES

4.1 Executive Committee

The Executive Committee consists of the Dean, the Associate Deans of graduate and undergraduate studies, eight (8) tenured or tenure-track faculty members, two (2) from each of the four (4) general sections of the school (Art & Performance / Aesthetic Studies, Literary Studies, Historical Studies / History of Ideas, and Arts & Technology), and one (1) representative of the Graduate Student Association.

The faculty representatives are chosen by open nomination and paper ballot (at the first faculty meeting of the year) for two-year nonrenewable terms, with membership staggered so that four sitting members leave the committee and four new members join it each year. A person nominated for the committee must consent to the nomination either orally, if

present, or in writing, if not.

At the first meeting during which this committee is elected, the person in each section of the school receiving the most votes is elected for two years, and the person with the second most votes, for one year. If three or more non-tenured faculty members receive the most votes, the two receiving the highest totals are elected, and the tenured faculty members receiving the next highest totals are elected to make up the remainder of the committee.

The committee is chaired by the Dean and meets at least monthly during the regular academic year. It serves as the principal advisory body for both the faculty and the Dean in their educational mission.

The committee assumes the duties of the school’s previous budget and planning, nominating, and development committees. Thus its responsibilities include:

(1) advising the Dean on strategic planning and general budgetary issues for the school,

(2) considering proposals from section meetings regarding curricular matters and, when

appropriate, assisting in the preparation of motions on academic policy or curricular

matters for full deliberation and vote in faculty meetings,

(3) considering proposals from section meetings regarding personnel and hiring and, when

necessary, recommending priorities among such proposals,

(4) proposing the membership of search committees as well as other school committees

for which this document does not provide election,

(5) developing public-relations and fundraising programs for the school, in particular

identifying appropriate programmatic grant proposals,

(6) identifying and recommending new members of the school’s advisory board, and

(7) developing guidelines for the administration of any school-wide research programs or

research awards.

In their final year of service on the committee, the representatives of the four (4) sections of A&H also act as section coordinators. The coordinator calls and conducts section meetings:

(1) to consider the organization and quality of the curriculum and, when appropriate, prepare proposals for changes for further consideration by the executive committee and the full faculty, and

(2) to consider the section’s hiring needs and propose faculty positions to the Dean and executive committee.

Extraordinary meetings of the section may be called by the Dean or coordinator, acting on their own initiative or in response to a request or requests from a regular faculty member or members.

Non-tenure track faculty members are invited to attend section meetings and participate in all deliberations.All non-tenure track faculty who have been employed at least three years in A&H will be allowed to vote on undergraduate curricular proposals.

4.2 Administrative Committee

The Administrative Committee consists of the Dean and the three (3) Associate Deans.

The committee is chaired by the Dean and meets regularly at his or her discretion to advise and assist the Dean in both long-range planning and the day-to-day administration of the school’s activities.

The committee also assumes the following responsibilities:

(1) review of the scheduling of undergraduate and graduate

courses to ensure proper balance in curricular offerings and effective course scheduling,

(2) oversight of the application of the guidelines for all school-wide core courses,

(3) review of and advice concerning the school’s sections in the biennial university catalog, and

(4) consideration of space, equipment, and facilities in order to establish priorities for the school in each of these areas.

4.3 Faculty Personnel Review Committee

With the advice and consent of the A&H Executive Committee, the Dean appoints eight (8) tenured professors, one (1) full and one (1) Associate professor from each of the four (4) sections of the school, to the Faculty Personnel Review Committee. They serve for two-year nonrenewable terms, with membership staggered so that four sitting members leave the committee and four new members join it each year. Members of the executive and administrative committees may not serve simultaneously on this committee.

The Dean chairs the committee, and its tasks are those specified in the university’s policy memorandum 75-III. 22-3:

Annually the full professors on the FPRC (or if the Dean prefers, a meeting of all the school’s full professors) will consider the files of all Associate professors to determine whether or not to recommend the appointment of ad hoc committees to review them for promotion to full professorships.

The committee shall not consider the teaching evaluations (organized by the committee on effective teaching) of Non-Tenure Track Faculty (“NTTF”), which review process is addressed in Section 5 below.

The committee proposes the membership for all ad hoc committees undertaking reviews for reappointment, tenure, and/or promotion of tenured and tenure-track faculty members.

Meeting separately from the Dean, the FPRC reviews all applications for Special Faculty Development Assignments (“SFDA”) and then makes its recommendations to the Dean. The criteria for the committee’s evaluations and recommendations are in written form and open to the faculty after the decision process is complete.

4.4 School Peer Review Committee

The school peer review committee (“SPRC”) consists of eight (8) tenured faculty members, two (2) from each of the four (4) sections of the school, elected by open nomination and paper

ballot (at the first faculty meeting of the year) for two-year terms, with membership staggered so that four sitting members leave the committee and four new members join it each year.

At the first meeting during which this committee is elected, the person in each section of the school receiving the most votes is elected for two years, and the person with the second most votes, for one year.

Mandated by the university’s policy memorandum 78-III.21-16, this committee is separate from the faculty personnel review committee (required by policy memorandum 75-III.22-3 on promotion, reappointment, and tenure) or the school’s executive committee, although membership may overlap.

Consistent with the policy memorandum, the committee participates each year in the periodic performance evaluations of faculty members. Meeting independently, it reviews the files as well as the Dean’s initial reports and then sends its assessment and recommendation to the Dean. When a full professor is under review, the committee will consist only of full professors.

4.5 Graduate Studies Committee

With the advice and consent of the school’s executive committee, the Dean appoints eight (8) tenured and tenure-track faculty members, two (2) from each of the four (4) sections of the school, to the graduate studies committee (GSC). They serve for three-year terms, with membership staggered so that two-three sitting members leave the committee and two-three new members join it each year. In addition, there is one elected student representative from the graduate program.

The Associate Dean for Graduate Studies chairs the committee, which is responsible for:

(1) oversight of all graduate programs for conformity with regulations established by the

university and by the school faculty,

(2) advising the Associate Dean of graduate studies on admission, discipline, and dismissal

of graduate students,

(3) approval of student proposals for membership on portfolio, casebook, and dissertation

committees,

(4) advising the Associate Dean on the appointment, assignment, and training of teaching

assistants;

(5) recommendations to the faculty for improvements in the structure, operation, courses,

and development of the graduate program.

4.6 Committee on Effective Teaching

The committee on effective teaching, mandated by the university policy memorandum 96-III.21-70, consists of six (6) tenured faculty members, one (1) from each of the four (4) sections of the school plus the Associate Deans for graduate and undergraduate studies. With the approval of a majority of the executive committee, the Dean appoints the four faculty members for four-year nonrenewable terms, with membership staggered so that one sitting member leaves the committee and one new member joins it each year. Of these four members, the one serving longest will serve as chair.

The committee is to promote excellence in teaching across the school, and in compliance with the policy memorandum and earlier practice, it:

(1) gathers comprehensive data on teaching responsibilities and prepares an annual report

to the Dean on teaching effectiveness,

(2) develops and administers a procedure for evaluation of teaching, one using written objective standards that include course evaluations, teaching load contributions, the diversity of courses taught, course development and administration, as well as graduate supervision and service on honors, portfolio, casebook, and dissertation committees,

(3) develops mechanisms for faculty members to comment on their evaluations and to

provide information they feel is pertinent to the process of teaching evaluation,

(4) consults with graduate and undergraduate students on teaching and classroom issues,

and

(5) constitutes, along with one representative each from the graduate and undergraduate

students, a special committee to consider nominations and make recommendations for the school’s teaching awards to the Dean.

4.7 Library and Teaching Resources Committee

The library and teaching resources committee consists of the Associate Dean for graduate studies, the school’s representative to the university library committee, the curator of the Center for Visual Resources, and four regular faculty members. The faculty members, one (1) from each of the four (4) sections of the school, are appointed by the Dean with the advice and consent of the Executive Committee to serve three-year nonrenewable terms, staggered so that one sitting member will leave the committee and one new member will join it each year.

The Associate Dean chairs the committee and receives its recommendations on policies and procedures for the expenditure of funds allocated to the school for acquisition of books, periodicals, slides, video and sound recordings, and other materials used in the faculty’s research and teaching.

4.8 Special Committees. From time to time there may exist a need for Special Committees. The Dean shall appoint faculty to said special committees which may consist of tenured, tenure-track, and non-tenure track faculty depending on the purpose of each of said special committees. When the service of each of said special committees has been completed, said special committee shall be disbanded unless it is determined by a two-thirds vote of the voting faculty at a regular faculty meeting that said special committee should become a regular standing committee. At that faculty meeting, the continued purposes of said committee shall be determined.

5.0 STANDARDS AND PROCEDURES FOR REVIEW OF NON-TENURE TRACK FACULTY

5.1 Promotion Review Request. Non-tenure track faculty (“NTTF”) may be reviewed for promotion each time their employment contract term is up for renewal at UTDallas. For example, in the event the employment contract term is nine (9) months, the NTTF employee may request promotion review after nine (9) months. By way of further example, in the event the NTTF employment contract is a two (2) years term, said employee may request promotion review after two (2) years. In this manner, any NTTF may request and may have the opportunity to receive promotion after the terms and criteria of the employment review process have been completed.

5.2 Promotion Request Outside Current Category. Promotion may be within or outside a current NTTF category. For example, a Senior Lecturer II may request promotion review to a Senior Lecturer III position or the same Senior Lecturer II may request

promotion to an alternate NTTF position, including without limitation Full, Associate or Assistant Clinical Professor or Full, Associate, or Assistant Visiting Professor.

5.3 Promotion Review Faculty Committee. A Promotion Review Faculty Committee (“PRFC”), appointed by the Dean for each NTTF member requesting review, will review the credentials of said NTTF member.

5.3.1 Committee Composition. The special faculty committee will consist of three (3) faculty members. The composition of each three (3) member special committee may consist of either tenured or tenure-track faculty within A&H, tenured or tenure-track faculty within UTDallas, and higher ranked NTTF within the area of study being reviewed.

5.3.2 Committee Selection Process. Each NTTF member requesting review will submit five (5) names of possible committee members to the Dean. Within ten (10) days after submission, the Dean will appoint two (2) committee members from the list so submitted in addition to at least one (1) tenured or tenure-track faculty member whose name may or may not be on the list submitted by the NTTF member. Further, at least one (1) committee member must be a NTTF member of higher rank than the NTTF member under promotion review.

5.4 Evaluation Procedure. The evaluation procedure administered by the special faculty committee shall consist of three (3) elements: (a) peer-reviewed research and academic achievement; (b) teaching effectiveness; and (c) university citizenship. Contracts will specify the duties of NTTF in terms of the proportion of effort expected under each of these categories.

5.4.1 Peer-Reviewed Research and Academic Achievement. Peer-reviewed research and academic achievement are not required of NTTF as part of their normal assigned responsibilities at UTDallas. However, NTTF have the same standing to seek funding for, and to pursue, independent funded research as other faculty. Even though this element is not required, if present, it may be noted in peer reviews.

Evidence of research and academic achievements can include publication in peer-reviewed journals; monographs which contribute to advancing knowledge or its utilization in the resolution of societal problems; development of widely adopted clinical or educational techniques or programs which advance the quality of life; presentations at professional gatherings; literary publications, performances, and visual and other artistic contributions in regional and national exhibitions.

The lack of any peer-reviewed research and academic achievement shall not be considered in preventing any NTTF from receiving promotion as this element is not a required element for promotion of NTTF under the Faculty Senate.

5.4.2 Teaching Effectiveness. Teaching effectiveness is not to be measured solely in terms of teaching in organized courses. It also includes the ability and willingness to develop new courses and to teach a wide variety of courses. The PRFC should consider the importance of such courses taught to instructional programs, the willingness to teach evening or Saturday courses, and the development of innovative teaching methods. Teaching also extends to curriculum development and student advisement. To this end, the PRFC shall review the following in determiningg teacher effectiveness:

5.4.2.2 Teaching Portfolio consisting of:

• Course syllabi for up to the three (3) most current years

• Examples of teaching materials

• Student evaluations from the three (3) most current years

• Written statements and/or letters by faculty and/or students

• All other materials selected by the NTTF under review

5.4.2.3 Teaching narrative statement by NTTF member between 1-3 pages in length.

5.4.2.4 PRFC reports of classroom observation. Specifically, at least two (2) of the three (3) PRFC members will conduct independent classroom observations for the duration of at least thirty (30) minutes and up to one (1) hour in length for each observation. The proposed classroom observation form is attached to these Bylaws as Appendix 1.

5.4.2.5 Upon completion of the in-class observation, the NTTF member may request and the observer must provide an oral review of fifteen (15) to thirty (30) minutes in length at the mutual convenience of the NTTF member and observer, which shall occur in no event more than five (5) days after the classroom observation.

5.4.3 University Citizenship. Administrative duties, service on committees, research, professional service, and clinical or outside professional service that enhances instructional skills may be areas considered by the PRFC.

5.5 Written Recommendation by PRFC. The PRFC shall make its written recommendation to the Dean within 45 days of the committee appointment date, but in no event later than March 31 in the year the NTTF member requests promotion review.

5.6 Faculty Vote. After the special faculty committee recommendation report is submitted to the Dean on or before March 31 in any school year, the voting faculty shall vote on the written recommendation at the April faculty meeting of the same school year.

5.7 Dean’s Written Recommendation. The Dean shall make his/her written recommendation report to the Provost of UT Dallas based on the teaching portfolio, written recommendation report of the special faculty committee and the faculty vote.

5.8 Dean’s Review of Current Faculty. Prior to approval of these Bylaws, the Dean shall retain the right to determine, in the Dean’s sole discretion, whether currently hired NTTF shall be promoted to a higher ranked NTTF position. After these Bylaws have been approved by the A&H Voting Faculty and approved by the Academic Senate, all further promotions by NTTF shall adhere to the processes as set forth in this Section 5 of the A&H Bylaws.

6.0 STANDARDS AND PROCEDURES FOR INITIAL APPOINTMENT OF NON-TENURE TRACK FACULTY

6.1 Special Committee. The Dean shall appoint a Special Committee to consider the appointment of any NTTF required for the teaching, administrative and service needs of A&H.

6.2 Special Committee Composition. The Special Committee so established shall consist of at least three (3) faculty members and may consist of up to five (5) faculty members as follows: one (1) – two (2) tenured/tenure-track faculty members in the track the NTTF member will be serving within; one (1) Associate Dean; and one (1) – two (2) NTTF members of higher rank, if available, already serving within the track.

6.3 Procedure. The Special Committee shall review all applications according to the needs of A&H and the track. Upon review completion, the Special Committee shall make its recommendations to the Dean and the Dean shall make his/her recommendations to the Provost for the hire of NTTF. The Dean and/or the Provost shall be responsible for determining whether the SACS requirements have been met for the proposed teaching assignment(s) of all NTTF.

7.0 REVISION AND AMENDMENT OF GOVERNANCE PROCEDURES

These Bylaws may be revised or amended via motions placed on the agenda of regular faculty meetings by the procedures outlined above and carried by a simple majority vote of voting faculty members.

Such revisions or amendments shall be approved by the Dean and the academic senate and, if so approved, shall be incorporated into these Bylaws.

Copies of these Bylaws as accepted by the faculty and approved by the Dean and as subsequently revised or amended and approved are made available to the faculty by the Dean’s office.

DRAFT U T DALLAS POLICY ON FINANCIAL EXIGENCY

PREAMBLE

Rule 31003, Section 1, of the Regents' Rules and Regulations (http://www.utsystem.edu/bor/rules.htm#A4) establishes U T System policy concerning the Abandonment of Academic Positions or Programs. Section 1 calls for the President of the University to determine institutional procedures for an in-depth review to inform and guide decisions on these matters “with full and meaningful faculty input.” Section 2 concerns elimination for “Academic Reasons.” Section 3 concerns elimination due to institutional financial exigency. This document establishes U. T. Dallas policy and procedures relating to Section 3.

GENERAL POLICY ON INTERPRETATION OF REGENT’S RULES Regents Rule 31003, abandonment of academic positions or programs must be interpreted in the light of Rule 40101 which gives faculty a “major role” in regard to “general academic policies and welfare” and related matters and in the light of the further provisions that assign these faculty responsibilities to the faculty governance organization and require that the organization and procedures of the governance organization be set out in the university Handbook of Operating Procedures and subject to governance review and approval. The University of Texas at Dallas recognizes the importance of tenure as a fundamental safeguard for academic freedom, an encouragement for faculty to engage in research at the frontiers of knowledge, and as the basis of attracting and retaining the very best possible faculty members. The aim of this policy is to assure that the University’s response to an institutional financial exigency does everything possible to preserve this commitment to tenure while also providing the strongest possible foundation for rapid recovery and future growth. The term “faculty committee” as used in Regents Rules section 31003 shall be understood here as meaning the Academic Senate of the University of Texas at Dallas, the regular committees of the Senate, or the Exigency Committee and appeals committees to be established in accordance with this policy. . It does not include committees that the Senate does not constitute or approve.[d2] The term “faculty” as used in Regents Rules 31003 to designate those eligible to be appointed as faculty on the Exigency Committee and appeals panels shall be understood here as meaning individuals holding tenure-track, tenured, and emeritus positions with the titles of Assistant Professor, Associate Professor, and Professor with primary assignments in teaching, research, and advising. It shall also include individuals holding yearly or longer-term renewable non-tenure track position with the titles of Senior Lecturer and Clinical Professor with primary assignments in teaching, research and advising. It shall not include faculty holding administrative appointments at the level of dean or above. For purposes of this policy the position of Associate Provost shall be regarded as an administrative appointment at the level of dean or above.

INITIAL DECLARATION OF FINANCIAL EXIGENCY

Institutional financial exigency is a demonstrably bona fide financial crisis that adversely affects an institution as a whole and that, after considering other cost-reducing measures, including ways to cut faculty costs, requires consideration of terminating appointments held by tenured faculty. Whenever there is reason to anticipate that the University as a whole is threatened by financial exigency, the President at the earliest date possible shall inform the Faculty Senate and all potentially affected budgetary units of the problem. The President shall consult with the Senate and the concerned budgetary units to determine the nature and seriousness of the problem, the most appropriate of the possible courses of action to be taken, and the means of safeguarding faculty rights and interests, including tenure rights. In solving such a problem, the University shall make every reasonable effort to reassign affected faculty members to other suitable work and to aid them in finding other employment. On the basis of these deliberations, the President shall write an Initial Declaration of Financial Exigency, giving the extent and scope of the emergency and the general approach to be taken to respond to it.

ADVICE OF THE SENATE

The President shall submit the Initial Declaration of Financial Exigency to the Senate for advice. This process may involve amendments and may, but need not, result in a joint Senate-presidential Exigency Plan. The Exigency Plan, whether joint with the Senate or not, shall include a formula for the membership of the committee “composed of faculty and administrative personnel to make recommendations to the president as to which academic positions and/or academic programs should be eliminated as a result of the financial exigency” designated in rule 3.l, as well as the general criteria the committee should apply in making its recommendations. This committee will be called hereafter the Exigency Committee.

The size and composition of the Exigency Committee shall be specified in the Exigency Plan, provided that it has at least seven members. At least one-half of these members shall be faculty as defined above, and at least one-half of the faculty members shall be appointed from nominations submitted by the Senate. The Senate procedure for making the Senate designated appointments on the Exigency Committee shall be that the Senate will nominate at least twice as many faculty members as there are openings consigned to it, and the President shall appoint the members from among them. For faculty appointed to the remaining positions on the Exigency Committee, no Senate nomination is necessary. At least a majority of the total number of faculty will be tenured. All faculty appointees should seek to represent the university as a whole, not just programs initially slated to be reduced or just those not so slated, and at least some of them will have served on the Committee for Qualifications of Academic Personnel.

The Exigency Committee shall develop the Exigency Plan in two stages. First, it will assess current programs and recommend cuts or other actions as described in Rule 31003 Section 3.2. Second, upon receiving approval for this assessment or a modified version thereof, it will proceed to recommend positions to be eliminated as described in Rule 31003 Section 3.3 to 3.5, provided that:

For section 3.2, assessment of academic programs. The Exigency Committee will provide a written report of its analysis of programs, which shall be submitted to the President, who shall then consult with the Senate before decisions are made for specific positions to be eliminated. As stated in the Rule, “The committee will review and assess the academic programs of the institution and identify those academic positions that may be eliminated with minimum effect upon the degree programs that should be continued and upon other critical components of the institution’s mission. The review will include, but not be limited to, as relevant: (a) an examination of the course offerings, degree programs, supporting degree programs, teaching specialties, and semester credit hour production; (b) an evaluation of the quality, centrality, and funding of research activities; and/or (c) an assessment of the productivity, community service, and quality of clinical services (in relation to teaching, healthcare delivery, and scholarly activity).” The Committee shall consider and may offer advice on all avenues by which terminations of faculty members can be avoided or minimized, and, as well, by which the negative effects of any necessary terminations can be mitigated. Unless an extension is approved by the President, the Committee shall submit its recommendations in writing within 60 days after the committee receives its charge.

In section 3.3, Review Consideration. After the President reviews and responds to approves the recommendations regarding programs to be cut, the Exigency Committee next recommends specific positions to be eliminated. These recommendations should also be contained in a written report. The recommendations should be related to the Exigency Committee’s assessment of programs. If other officers of the university, such as deans or program chairs, are involved in identifying individuals whose appointments are to terminated, those recommendations and the process for obtaining them should be described in the report. The Exigency Committee will have available the personnel records of those being considered including current curriculum vitas, annual reports, promotion committee reports and recommendations, and results of periodic performance reviews. It will have access to full personnel files. Faculty whose positions would be jeopardized by the proposed actions will be provided the opportunity to contribute meaningfully to the Committee's review process. For section 3.4, Tenure Preference. The Exigency Committee should not apply an unduly narrow interpretation of the idea that two candidates should be “equally qualified” before preference is given to one with tenure over one without. Preference should be given to tenured faculty over non-tenured if they are have approximately the same qualifications, and prospects, and t experience, and service to the university over provided that their accomplishments are roughly proportional to their relative academic lifetimes. [d6]The decisions should be consistent with the general principle that greater contributions will gain greater recognition.

In section 3.5, Recommendation. According to the Rule, “upon completion of its review,” the Exigency Committee “shall promptly recommend in writing to the president those persons who may be terminated, ranked in order of priority, with the reasons for their selection. The president shall, with such consultation with institutional administrative officers as the president may deem appropriate, determine which academic positions are to be terminated because of the financial exigency and shall give the holders of these positions written notice of the decision.” The Exigency Committee’s recommendations to the President shall be made in writing. Unless an extension is approved by the President, the Committee shall complete its work in a period of time no longer than 60 days from the submission of the initial report, specified in section 3.2, identifying the programs to reduce or eliminate.

PROCEDURE FOR NOTICE AND APPEAL

A faculty member whose position has been eliminated is entitled to appeal the decision, subject to the requirements of Regents’ Rules 31003 sections 3.7 and 3.8.

The burden shall be upon the appellant to show by a preponderance of the credible evidence that:

(1) Financial exigency was not in fact the reason for the initial decision to reduce academic positions; or

(2) The decision to terminate the appellant as compared to another individual in the same discipline or teaching specialty was arbitrary and unreasonable based upon the evidence presented.

(3) Whether the criteria established in the Exigency Plan were properly and fairly applied to the individual case and that any failure to properly and fairly apply the criteria clearly disadvantaged the appellant compared to other individuals in the same discipline or teaching specialty who were considered for termiination.[d9]

The hearing shall be held before a panel consisting of full-time faculty drawn from the list of faculty in the pool approved for service on hearing tribunals in accordance with the UTD Policy on Hearing Tribunal Selection Procedures, provided that such faculty are not in the academic programs affected by the decision. At least half of the membership of such panels shall be from faculty recommended by the Senate. The size of such appeals panels shall be determined as part of the Exigency Plan. The Hearing Panel shall elect its own Chair. The hearing must be held no later than 30 days after a written request is submitted to the President's office. The employment of a tenured faculty member who is to be terminated under this policy shall end no sooner than the end of the current academic term; faculty will be allowed reasonable time to

close down laboratories, complete teaching assignments, and transfer their responsibilities. If an entire program or functionally distinct part of a program is cut, employment of all tenured faculty in that program will terminate when the program or part itself is terminated, and will not extend beyond the termination of the program. During this period of employment and for three additional years, the terminated faculty member shall have the right to first consideration among equally qualified candidates for any faculty position at U. T. Dallas for which a recruitment and hiring process is conducted and for which the faculty member in question formally applies. In addition, the considerations noted in Rule 31003, Section 2, Subsections 2.6 - 2.11 of the Regents’ Rules and Regulations will be extended to the faculty member to be terminated.

NO CONCURRENT REPLACEMENTS

If appointments are terminated, the University will not at the same time make new appointments into the same subject area or specialization except in extraordinary circumstances where a serious distortion in the academic program would otherwise result. That is, a tenured faculty member or a more senior faculty will not be terminated only in order for the University to replace him or her with a new person in the same subject area or specialization at lower pay.
