The TGCSA Board and Staff are committed to serving our members which consists of 165 retail companies
that operate over 1300 grocery and convenience stores. Also the association includes over 40 wholesalers and distributors; 200 suppliers and manufacturers all of which employee thousands of people throughout the great state of Tennessee that have a major impact on the Tennessee economy.
Our association continues to stay focused on Tennessee State legislation. Jarron and his staff are persistent to make sure our voice and interests are represented on the hill.
Every year the TGCSA has its challenges. 2011-2012 will have as well. This year’s staff and board will engage in strategic planning of our future. As your chairman I request your input of how we can better serve our membership and collaborate to ensure the growth of our businesses. As I mentioned in June, we are at our best when all get involved with our ideas, talents and resources.
At this year’s convention we announced 3 committees – Past Chairman, Legislative, and Convention. Please call the TGCSA office for information on sitting on one of these committees. We
need you! Most of you have mentioned you would like to be a part of shaping focus groups. Please email me and let me know where your interest lies. ([email protected]).
We have enjoyed successful conventions in Sevierville the last two years. I am excited to announce that we will be moving back to downtown Nashville in 2012. Our board and committees will continue to utilize your ideas and input in making changes that best fit your needs.

It is my honor and privilege to serve as your chairman of the Tennessee Grocers Education Foundation for the 2011-
2012 term. The number of friendships and relationships I have built during my term on the board and in the association are very special.
The impact of our organization’s work is felt far beyond just the food industry. We’re helping to mold our family members, co-workers, and employees into college educated citizens that are capable in competing in today’s work force. One of my favorite quotes is “Don’t take away hope from someone, it may be all they have.” Our mission and focus have assisted thousands of students with their dreams.. and hope. Nationally, the TGEF is recognized as one of the top food
industry foundations and it’s something we can all be proud of.
Many of you know the story: the TGEF began with a simple golf tournament in which raised a few hundred dollars. Today, our foundation has blossomed into a charity with over $1.5 million in assets that provide ongoing scholarships to the students in our state’s industry. The assets of our organization are continuing to grow and it is your board’s responsibility to manage the funds in order to continue our service to the kids now and in the future.
Through the support and vision of our association statewide, it will continue to be vibrant, healthy and strong. I encourage you to get involved with the TGEF if you haven’t already. It’s easy to help provide this important service: you can start a tax-deductible scholarship in your company’s name, serve as a committee member in one of our golf tournaments, volunteer at a golf tournament, or at the convention best bagger contest. Don’t delay, help today.
Grocer, we will recognize the 2011-2012 scholarship winners. This year 146 awards worth $164,250 have been distributed to these outstanding students. This isn’t possible without our members who have supported endowments and piggyback awards. It also isn’t possible without our convention silent auction and our annual golf events that have the contributions of players, sponsors and committee members.
The TGEF has already raised over $75,000 at the East and Middle Tennessee golf events this year. Plan to join us October 26th in Tunica, Mississippi for the west event at Tunica National and October 27th at The Willows for a clay target shooting event. In an effort to cope with the void left by the federal government’s failure to curb illegal immigration, Tennessee has joined
enacted “get tough” immigration-related legislation aimed at stricter enforcement of immigration laws within their state borders by requiring public and private employers to enroll and participate in the E-Verify program to verify the employment eligibility of newly hired employees.1
Signed into law by Governor Haslam on June 7, 2011, the Tennessee Lawful Employment Act (“the Act”) requires all employers in Tennessee to demonstrate that they are hiring and maintaining a legal workforce either by:

The requirement that employers enroll and participate in E-Verify or request and maintain an identity / employment authorization document does not appear to make a distinction between in-state and out-of-state employers, and it is unclear whether the Act requires an employer with operations in multiple states to utilize E-Verify to confirm the employment eligibility of all of the employer’s workers or only the employees in Tennessee. Arguably, if the E-Verify provisions of the Act were limited to newly hired employees in Tennessee only, the Act could potentially provide an unfair competitive advantage to employers located outside of Tennessee by incentivizing those employers to relocate their business(es) to a state

It’s important for our industry to band together for common causes and also be in a position to support legislators who support TGCSA. The TGCSA Political Action Committee needs your support and a recently passed state law allows for corporate contributions, so you are now allowed to write corporate checks as well as personal checks to TGCSA PAC.TGCSA PAC allows our members to be heard at the Tennessee General Assembly. There are hundreds of PACs operating
in Tennessee, many representing industries urging lawmakers to pass laws or keep laws on the books that would adversely impact the grocery, convenience store and food industry. We need you to participate in the political process and defend our
legislative interests while also proactively seeking legislation that benefits our industry and our customers.
1 According to the National Conference of State Legislatures, in the first quarter of 2011, state legislators in the 50 states and Puerto Rico introduced 1,538 bills and resolutions relating to immigration. This number surpassed the first quarter of 2010, when 1,180 bills were introduced.
2 E-Verify is an Internet-based system operated by the U.S. Department of Homeland Security that allows employers to verify the employment eligibility of their employees, regardless of citizenship. Based on the information provided by the employee on his or her Form I-9, E-Verify checks this information electronically against records contained in DHS and Social Security Administration (SSA) databases. E-Verify is currently voluntary for all employers with very limited exceptions.

that does not require enrollment and participation in E-Verify.
It is also unclear from the language of the Act whether employees working outside of Tennessee are counted as part of the total number of employees for purposes of determining the law’s effective date for private employers. For example, if a Tennessee employer has 600 employees, but only 150 employees work in Tennessee, would the employer be phased in and subject to the Act on January 1, 2012 or July 1, 2013?
For employers without Internet access, the Act allows such employers to enter into a Memorandum of Understanding with the Tennessee Department of Labor and Workforce Development and permits this agency to enroll the employer in the E-Verify program and conduct employment verification checks of newly hired employees through E-Verify on behalf of the employer. An employer who has requested this service from the Tennessee Department of Labor and Workforce Development, but has not received assistance will not be in violation of the Act. Alternatively, the Act allows employers to utilize the services of a third party agent to conduct the E-verification process for newly hired employees.
Under the Act, employers must maintain a record of results generated by E-Verify for three years from the date of hire or one year from the date of termination, whichever is later. Employers who elect to verify the employment eligibility of newly hired employees by requesting an identity and employment authorization document, rather than enroll in E-Verify, must retain this documentation for three years after the
documentation is received or for one year after the employee (or non-employee, whichever is the case) stops providing services or labor, whichever is earlier.
Any lawful resident of Tennessee or any employee of a federal agency may file a complaint alleging a violation of the employment verification provisions of the Act. If there is satisfactory evidence of a violation, the Commissioner of the Tennessee Department of Labor and Workforce Development will conduct an investigation and issue an initial order, which will include:

An employer who is a first-time offender will be issued a warning if the employer complies with all remedial action requested by the Tennessee Department of Labor and Workforce Development and did not knowingly violate the employment verification provisions of the Act.
An employer who has been found to have violated the employment verification provisions of the Act will be assessed $500 for the first violation, $1,000 for a
second violation and $2,500 for a third or subsequent violation. In addition to these civil penalties, first-time offenders will also be assessed an additional $500 for each employee or non-employee who was not verified through the E-Verify program or for whom an identity / employment authorization document was not requested. For second and third violations, employers will be fined an additional $1,000 or $2,500, respectively, for each employee or non-employee.
An employer who fails to submit evidence of compliance with the employment verification provisions of the Act, within 60 days of a final order, will have its business license suspended until the employer remedies the violation. The Tennessee Department of Labor and Workforce Development will also post a publicly available list on its website of any employer against whom a final order has been issued.
Lastly, the Act authorizes the Commissioner of the Tennessee Department of Labor and Workforce Development to promulgate rules and regulations to put into effect and enforce the employment verification provisions of the Act.
As the immigration landscape becomes increasingly enforcement-driven, employers must align their worksite compliance strategy with the various state immigration laws currently in effect in the state(s) in which they operate. Between the U.S. Department of Homeland Security’s increased enforcement initiatives and the one-two punch of new state and local immigration laws, employers in Tennessee will face the daunting task of trying to comply with a growing patchwork of policies and federal, state and local laws aimed at curbing illegal immigration.

I wanted to say thank you very much for the Compton Family Scholarship. I will be starting school in the fall and I am looking forward to the learning experience I have ahead of me. I am planning on becoming a Nurse and graduating from Austin Peay with a BSN. I have many goals set and I can’t wait to start working toward them. With the help of the Compton Family Scholarship, I will be able to achieve my goals.
I also wanted to say that I enjoy working at the Cross Plains H.G. Hills. I know that most teenagers only see this as their “short-first job”, but I take my job seriously. Even though it is my first job, it is a job that I enjoy and will one day tell my kids about. I have worked at “The Hills” for almost two years and I have seen the store go through several changes: going from the Piggly Wiggly to the H.G. Hills, different employees, different schedules-but I have stuck with my job because I liked it and being there has really taught me what a job is truly all about.
I will take my first job experience from H.G. Hills and apply it to every job I take. I have learned a lot from working there and I enjoy it. Thank you for giving me the Compton Family Scholarship, and I’m so glad that our store is a part of the Tennessee Grocers Education Foundation so that I got the opportunity to apply for it. Since 1982, the Tennessee grocery industry has had strong interest in supporting education by granting scholarships to high school graduates and college students to help with tuition and other college expenses. TGCSA members and member’s children are eligible for scholarships through the education foundation each year.
TGCSA has awarded over $2.8 million through TGEF since its founding in 1985. TGCSA and TGEF awarded this year 146 scholarships worth a total of $164,250. Students were recognized at the TGCSA annual convention June 11 at the Sevierville Events Center and Wilderness at the Smokies Resort.
Each year scholarships ranging from $500 to $1,800 are awarded to graduating high school seniors, college students and graduate students who are employees or children of full-time employees.
Congratulations to this year’s recipients. With less than one of every four applicants receiving a scholarship, these students are truly the best of the best.

2011 TGCSA Convention and Expo HighlightsAnother great networking opportunity for Tennessee food industry retailers and suppliers.
On June 9-11, 2011 over 600 retail and food industry executives and professionals came together at the Tennessee Grocers and Convenience Store Association 33rd annual convention held at the Sevierville Events Center and Wilderness at the Smok-ies Resort in Sevierville, Tennessee. The event was themed “Bringing the Pieces Together“, and it lived up to expectations for networking, showcasing new products and targeted education sessions. This event is unique and the only one in the state that hosts all segments of the food industry in
Tennessee.Participants at the three-day conven-
tion had the opportunity to attend industry targeted education sessions and converse with exhibitors at the World of Food & Fuel Expo. The education sessions were a huge success that required additional seating because of outstanding attendance. One retailer stated, “Had I known how great these sessions would be, I would have had 20 or 30 more managers here. I will know better for next year.” The attendance of so many prominent players within Tennes-
see’s food industry made for a convention that was full of enthusiasm and excitement.
The convention kicked off with an indus-try overview: Building Sales in an Age of New Realities presented by Michael Sanso-lo followed by a Convention Awards Dinner hosted by Food City that recognized and spotlighted companies that went above and beyond to make the convention a success.
Afterward attendees had a blast at the Casino Party hosted by Pepsi Beverages Company. They enjoyed cocktails while mingling and trying their luck at the casino

games to win some great prizes.Friday began with an Opening Break-
fast sponsored by Cherokee Distributing. While enjoying breakfast, guests heard from Julius Johnson, Commissioner of the Tennessee Department of Agriculture, sponsored by Houchens Food Group, Inc.
The first session on Friday was the retailer round table that featured retail participants Steve Smith, President & CEO of Food City; Steve Poe, Vice President of Rocky Top Markets; Ken Pink, President & COO of E.W. James & Sons Supermarkets. The session was moderated by Michael Sansolo. The panel discussed economic challenges, a new generation of employ-ees and management, what great vendors do to help retailers, government regula-tion, hiring practices and current events
including flooding and tornadoes and the role of food stores during these disasters.
The 2011 convention was packed with five outstanding education opportunities. Employment and Labor Law, USDA Busi-ness and Industry Guaranteed Loan Pro-gram and Rural Development Energy Pro-gram, Health Care Reform and Overview, Getting to Great: Mapping Management Practices That Drive Great Store Perfor-mance and Social Media for Retailers.
After top notch education sessions, at-tendees had lunch sponsored by Tennessee Education Lottery and Alliance Marketing. During the luncheon Bob Kesling the “Voice of the Vols” spoke. He was sponsored by Kroger and Coca-Cola.
The doors to the World of Food & Fuel Expo were open two days so retailers could hit the floor. The exhibitors anxiously awaited the opportunity to showcase the latest and best products to grocery and convenience store associates from across the state of Tennessee. We appreciate the over 100 companies that exhibited at the World of Food & Fuel Expo and the hun-dreds of attendees that set up and worked the 137 booths. Tennessee Education Lot-
tery won the Best Single Booth Award, Elm Hill Meats/Wampler’s Sausage won the Best Multiple Booth Award and Vietti Foods Inc. won the Best Theme Booth Award. A big congratulations to these winners and a thank you to all the com-panies who participated and supported TGCSA through their booth exhibits.
The Chairman’s Dinner was the cen-terpiece of the convention. It began with Sara Lee hosting a reception. Guests had a delightful dinner sponsored by Purity Dairies and Associated Wholesale Grocers.
This evening honored 2010-11 TGCSA chairman Steve Poe, Rocky Top Markets for his service and leadership. Poe spoke to guests about the association’s accom-plishments this past year. Steve and his wife Beverly were presented with a por-trait generously sponsored by Mayfield Dairy Farms. Gary Buchanan, United Grocery Outlet/Bargain Barn Inc., was presented with the Chairman’s gavel and recognized as the 2011-12 TGCSA chair-man of the board.

Saturday morning began with a buf-fet breakfast sponsored by H.T. Hackney that all TGCSA scholarship recipients are invited to attend. Following breakfast those scholarship recipients were recog-nized at the TGEF Awards program.
TGCSA awarded 146 scholarships worth $164,250 to its members through Tennessee Grocers Education Founda-tion. Mickey Blazer of Food City was also honored at the awards ceremony as he was inducted into the Hall of Eagles. Blazer served as the East Tennessee Golf Chairman for the last three years. In those three years the tournament has raised over $136,000 for scholarships.
Later in the day on the expo show floor, Alexis Jeup of Publix Supermarkets won the Best Bagger Contest sponsored by Bunzl, Dr. Pepper and Hobart Sales & Service. Jeup will receive a $750 schol-arship from TGCSA, $250 cash prize from National Grocers Association, a trophy and a trip to compete in the national best bagger contest.
The 33rd annual TGCSA Convention and World of Food & Fuel Expo was suc-cessful at “Bringing the Pieces Togeth-er”. From retail grocers and convenience store owners to wholesalers and ven-dors, the TGCSA convention brings the industry together for the good of the in-dustry. REDUCING MISREDEMPTION AND FRAUD IN THE COUPON INDUSTRY
Coupon misredemption and fraud continues to be a serious problem affecting the entire industry value chain: retailers, clearinghouses, agents and manufacturers. The problem results in financial losses for all industry participants, causes friction in business relationships and raises questions about the integrity of the coupon industry. Clearly, reducing misredemption benefits every participant in the coupon industry.
It’s difficult to quantify the magnitude of losses due to coupon misredemption because no objective measurements exist. However, most industry analysts estimate that the amount is in the tens of millions of dollars annually (which compares to an overall industry size of
