1. BiddingEach animal will be sold to the highest bidder. The auctioneer in charge willsettle any disputes as to bids, and his decision shall be final.
2. TermsTerms of the sale are cash or check or approved credit. Settlement must bemade to the clerk at the conclusion of the auction.
3. Purchaser’s RiskEach animal becomes the risk of the purchaser as soon as sold, but will not bedelivered until settlement has been made.
4. Certificate of RegistryWhen full settlement has been made, a certificate of registration will be fur-nished and transferred to the purchaser. Give full name and address to the sec-retary when making payments so the Certificates of Registry will be trans-ferred properly.
5. HealthAll animals are eligible for interstate shipment except as otherwise noted. Thecattle have been tested for tuberculosis and brucellosis within 30 days of saledate. A certificate will be furnished. Cattle have not been tested for any otherdiseases and therefore it is the responsibility of the prospective purchaser torequest any other tests on individual animals from each consignor well inadvance of the sale in order to obtain a negative test result for a given disease.Sellers may voluntarily test their cattle for other diseases should they berequested but have no obligation to do so. There is no implied guarantee forrefund or replacement of cattle that may test positive for any disease other thantuberculosis or brucellosis after the sale.
6. AnnouncementsAnnouncements from the auction box take precedence over printed matter inthis catalog. All cattle will be sold by lot numbers, as announced by auctioneer.
7. Breeding Guarantee(A) All animals are guaranteed to be breeders with the exception of: (a) injuryor disease occurring after sale, (b) negligence or willful misconduct on the partof the purchaser.(B) Any female is considered a breeder if she is pregnant at the time of this saleand/or she has a calf at side.(C) Any bull which either: (1) produces viable semen; (2) settles 1/3 or more ofthe healthy cows he serves; (3) is the sire of 20 or more animals; or (4) settlescows by natural service, and passes a fertility test made by a competent veteri-narian during any six month period trial, shall be considered a breeder.(D) Buyer must notify seller within one year of any breeding problem found inan animal.
8. Embryo Transfer GuaranteeAll donor cows that have been worked successfully in embryo transfer areguaranteed to produce good embryos with the exception of other guaranteesstated in the footnotes of this catalog or announced from the auction block. It isunderstood that these guarantees are valid only if: (1) a qualified person orpersons do the transfer; (2) donor cow is managed properly in embryo transfer(i.e. not over conditioned and/or overworked); (3) injury or disease does notoccur after the sale and (4) the purchaser is not negligent or willfully mistreatsthe donor cow.
9. Options and Privileges for Return or Adjustment(A) All claims for adjustment or return must be made in writing within sixmonths of the sale date.(B) Any animal that has not proven itself a breeder within the time limits speci-fied above, if in healthy condition, may be returned to seller at buyer’sexpense. The seller reserves the right and privilege of trying for a period of sixmonths to prove the animal a breeder. If proven a breeder, an animal will bereturned at buyer’s expense. Should the animal fail to breed, the seller, at hisoption, may either return the purchase price or make replacement of the ani-mal with another of equal value.(C) Any animal returned must have a veterinarian’s certificate that it is free ofBangs and tuberculosis.
10. Rights and Obligations(A) The above terms and conditions of sale shall constitute a contract betweenthe buyers and sellers of each animal and shall be equally binding upon both.(B) Animals resold following the purchase in this sale shall constitute a sepa-rate transaction, and the rights and obligations of the two parties connectedthereto are not covered by the terms and conditions of this sale.(C) All persons who attend the sale do so at their own risk and the owners norany person connected with the management of the sale assume any liability,legal or otherwise, for any accidents which may occur.
