    Schubert (1987) defines curriculum as the contents of a subject, concepts andtasks to be acquired, planned activities, the desired learning outcomes andexperiences,productofcultureandanagendatoreformsociety.

    Pratt(1980)definescurriculumasawrittendocumentthatsystematicallydescribesgoalsplanned,objectives,content,learningactivities,evaluationproceduresandsoforth.

    Goodlad and Su (1992) define curriculum as a plan that consists of learningopportunities for a specific time frame and place, a tool that aims to bring aboutbehaviour changes in students as a result of planned activities and includes alllearningexperiencesreceivedbystudentswiththeguidanceoftheschool.

    Cronbleth (1992) defines curriculum as answering three questions: whatknowledge,skillsandvaluesaremostworthwhile?Whyaretheymostworthwhile?Howshouldtheyoungacquirethem?

    Grundy(1987) definescurriculumasaprogrammeofactivities (by teachersandpupils)designedsothatpupilswillattainsofaraspossiblecertaineducationalandotherschoolingendsorobjectives.

    Hass(1987)providesabroaderdefinition,statingthatacurriculumincludesallofthe experiences that individual learners have in a program of education whosepurposeistoachievebroadgoalsandrelatedspecificobjectives,whichisplannedin termsofa frameworkof theoryand researchorpastandpresentprofessionalpractice.

    OtherDefinitions:Definition1:Curriculum issuch permanentsubjectsasgrammar, reading, logic,rhetoric, mathematics, and the greatest books of the Western world that bestembodyessentialknowledge.

    TheParadigm(fromTransmissionaltoTransactional)Shiftofeducationinthe Philippines is the transfer of teaching concepts from the Traditionalbookish and direct learning approach Teaching into a 21st CenturyTeachingfocusedondevelopingthelearnersHOTS(higherorderthinkingskills).

    TheseHOTS is thedemonstrationof the learnerscritical thinkingability,and to go beyond the four walls of the classroom by applying theirlearning into the 7 domains Identified by the Department of Education(DepEd).

    In the traditional way of teaching, the learners are only developing thelowerpartoftheDomainofLearning,whichareidentifiedasLOTS(lowerorderthinkingskills).This isthememorizationintensiveclass,wherethelearnersareforcedtomemorizealonglistofitems,inordertobeabletoanswerintheObjectiveTypequizzesandExams.

    Example: Using the LOTS, students would simply answer the question,Whoisthefirstastronaut?,andthenaselectionofa,b,c,dfromwhichthestudentswillchoosefrom.TheseistheMechanicaltypeoflearning,wherestudents would simply do the same thing (memorize) and be able toanswer the same type of exam or questioning method in a heartbeatwithout even knowing the deeper part of it or cant even explain theanswer.

    These types of questions, enables the learners to think critically andexplainhis/heranswerandtodemonstrateactivelyinamannerthattheirunderstanding will show the deep knowledge they have learned in theclassroom.

    HOTS(higherorderthinkingskills)are:

    Analysis,Synthesis,Evaluation

    With all these in mind, the Department of Education realized (at last!)thataParadigmshift isneeded inorder to change thesystem from thetraditionalwaysintothesocalled21stcenturygloballystandardteacher.

    Educationexpertsaround thecountry, includingmyMentorandDeanofthe College of Education, Dr. June P. Salana, worked tirelessly togetherwithnumerousexpertsnationwideinordertoidentifythesalientpointsordomains needed in line with the vision of transforming the FilipinoTeacherintoagloballycompetitiveone.

    Along with the Commission on Higher education (CHED), TeacherEducation Institutes (TEIs), Philippine Regulatory Commission (PRC),DepartmentofEducation(DepEd)andtheCivilServiceCommission(CSC)in partnership with the different academic institution, the NationalCompetencyBasedTeacherStandards(NCBTS)wasborn.

    Hence, the Curriculum change is the product of many years ofdevelopment,thisisnottheideaoftheDepEdSecretaryorthethousandsof teachers around the country. As mentioned by Dr. Isagani Cruz in2001,thisisthePeoplePowerModelofCurricularChange,thisistheresultoftheSocialChangethathappenedtothecountryandtheneedforeducation to be the Main Effort in bringing Competitiveness andinnovativenessamongthepeopleinthe21stcentury.

    AsMentionedintheCurriculumDevelopmentbookbyDr.JuneP.Salanaand Dr. Rolando A. Bernales, the curriculum development of today hasshifted fromLearnerArtisan relationship into EmploymentOriented(knowledgebased)Curriculum.

    The latest trend is to Empower the teachers, the frontliners ineducation, the deliverers of knowledge,and facilitators of learning in theprocessofdevelopingacurriculum,thatwouldreflecttheCompetencies,teachers and students alike should possess and reflective of the SocialDimensionofeducation.ThatlearningshouldnotbelimitedtoFractionor

    Poem writing but rather adopting it to the real life applications andexperiencesthatthelearnermayorhasexperienced.

    According to the Framework Thiswill allow teachers to selfassesstheirownperformanceagainsttheCompetencyStandardsinorderto identify areas of strength as well as areas that need to bedevelopedfurtherinorderforthemtofunctionmoreeffectivelyasfacilitatorsoflearning.

    Domain1.SocialRegardforLearning(SRFL)

    TheSRFLdomainfocusesontheidealthatteachersserveaspositiveandpowerful role models of the value in the pursuit of different efforts tolearn. The teachers action, statements, and different types of socialinteractionswithstudentsexemplifythisideal.

    Domain2.LearningEnvironment(LE)

    Thisdomainfocusesonimportanceofprovidingasocial,psychologicalandphysical environment within which all students, regardless of theirindividual differences in learning, can engage in the different learningactivitiesandworktowardsattaininghighstandardsoflearning

    Domain3.DiversityofLearners(DOL)

    The DOL domain emphasizes the ideal that teachers can facilitate thelearningprocessevenwithdiverselearners,byrecognizingandrespectingindividual differences and by using knowledge about their differences todesign diverse sets of learning activities to ensure that all learners canattainthedesiredlearninggoals.

    SECTION 1. Short Title. This Act shall be known as the"Philippine Teachers Professionalization Act of 1994."

    Sec. 2.Statement of Policy. The State recognizes the vitalrole of teachers in nationbuilding and development through aresponsible and literate citizenry.Towards this end, the Stateshall ensure and promote quality education by propersupervision and regulation of the licensure examination andprofessionalization of the practice of the teachingprofession.cralaw

    Sec. 3.Objectives. This Act has the herein objectives:

    (a) The promotion, development and professionalization ofteachers and the teaching profession andchan robles virtual law library

    (b) The supervision and regulation of the licensureexamination.

    Sec. 4. Definition of Terms. For purposes of this Act, thefollowing terms shall mean:chanroblesvirtualawlibrary

    (a) "Teaching" refers to the profession concerned primarilywith classroom instruction, at the elementary and secondarylevels in accordance with the curriculum prescribed by theDepartment of Education, Culture and Sports, whether onparttime or fulltime basis in the private or public schools.chan robles virtual law library

    (b) "Teachers" refers to all persons engaged in teaching atthe elementary and secondary levels, whether on fulltime orparttime basis, including industrial arts or vocationalteachers and all other persons performing supervisory and/oradministrative functions in all schools in the aforesaid levelsand qualified to practice teaching under this Act.(c)"Board" refers to the Board for Professional Teachers dulyestablished and constituted under this Act.

    (d) "Commission" refers to the Professional RegulationCommission.

    ARTICLE IIBOARD FOR PROFESSIONAL TEACHERS

    Sec. 5. Creation and Composition of the Board. There is

    hereby created under this Act a Board for ProfessionalTeachers, hereinafter called the Board, a collegial body underthe general supervision and administrative control of theProfessional Regulation Commission, hereinafter referred to asthe Commission, composed of five (5) members who shall beappointed by the President of the Philippines from among therecommendees chosen by the Commission.The recommendeesshall be chosen from the list of nominees selected by theaccredited association of teachers, who duly possess all thequalifications prescribed in Section 8 of this Act.

    The chairman and the voicechairman of the Board shall beappointed from these five (5) members by the President:Provided, That the members of the first Board appointed underthis Act shall be automatically registered as professionalteachers and issued with the certificate of registration andprofessional license upon payment of the fees for examination,registration, and other fees prescribed by the Commission.

    Sec. 6.Duties and Function of the Board. The Board shallhave the following duties and functions:

    (a) Promulgate, administer and enforce rules and regulationsnecessary for carrying out the provisions of this Act inaccordance with the charter of the Professional RegulationCommissionchan robles virtual law library

    (b) Determine and fix the frequency, dates, and places ofexamination, appoint supervisors, proctors, and otherpersonnel as needed who shall be entitled to a daily allowanceto be fixed by the Board for every examination day actuallyattended, use buildings and facilities of public or privateschools for examination purposes(c)Issue, suspend, or revoke the certificate of registration forthe practice of the teaching profession

    (d)Prescribe and collect examination and other fees as it maydeem proper

    (e) Prescribe and/or adopt a code of ethical and professionalstandards for the practice of the teaching profession.Suchethical standards, rules and regulations to take effect sixty(60) days after its publication in the Official Gazette or in any

    (f)Administer oaths in connection with the administration ofthis Act

    (g) Supervise and regulate the registration, licensure andpractice of professional teachers in the Philippines

    (h)Adopt an official seal of the Boardcralaw

    (i) Look into the conditions affecting the practice of theteaching profession and whenever necessary, adopt suchmeasures as may be deemed proper for the enhancement andmaintenance of high professional and ethical standards of theprofession

    (j)Ensure that all educational institutions offering elementaryand secondary education comply with the essentialrequirements for curricula, faculty and facilities for theelementary and secondary levels

    (k) Investigate such violations of this Act, the rules and thecode of ethical and professional standards for professionalteachers as it may come to the knowledge of the Board, andfor this purpose, to issue subpoena and subpoena duces tecumto secure the appearance of witnesses and the production ofdocuments in connection therewith and

    (l) Discharge such other powers, duties and functions as theBoard may deem necessary for the practice of the teachingprofession and the upgrading, enhancement, development andgrowth of education in the Philippines.

    Sec. 7.Term of Office. The members of the Board shall holdoffice for a term of three (3) years from the date they assumeoffice:Provided, That the first appointees to the Board underthis Act shall hold office according to the following terms:one(1) member shall serve for one (1) year one (1) member for two(2) years the chairman, vicechairman, and one (1) member forthree (3) years. Vacancies shall be served for the unexpiredterm only.No person who has served for two (2) consecutiveterms shall be eligible for reappointment.Appointment to fillan unexpired term shall be considered an appointment to a

    complete term.

    The chairman or any member shall take his oath of office priorto the performance of his duties.

    Sec. 8.Qualification of Board Members. Each Board membermust at the time of his appointment:

    (a)Be a citizen and resident of the Philippineschan robles virtual law library

    (b)Be at least thirtyfive (35) years of age, of proven integrity,and possessed of high moral values in his personal as well asprofessional conduct and has not been convicted of anyoffense involving moral turpitude(c)Be a holder of the degree of Bachelor of Arts or Bachelor ofScience in Education and preferably a holder of a master's ordoctorate degree in education, or their equivalents, from auniversity, school, college, academy or institute dulyconstituted, recognized and/or accredited by the Philippinegovernment

    (d) Be a professional teacher with a valid certificate ofregistration and valid professional license, save thosemembers who shall compose the first Board for ProfessionalTeachers

    (e)Has been a professional teacher in the active practice of theteaching profession for at least ten (10) years in theelementary and secondary level and

    (f) Not be an official or member of the faculty of, nor havepecuniary interest in any university, college, school, orinstitution conferring a bachelor's degree in education or itsequivalents for at least three (3) years prior to hisappointment, and neither connected with a review center orwith any group or association where review classes or lecturesin preparation for the licensure examination are offered orconducted.

    Provided, however,That, the membership to the Board shall beevenly distributed to cover all levels of education, includingequitable representation of the different fields of

    Sec. 9. Compensation of the Board. The chairman, vicechairman, and members of the Board shall receivecompensation comparable to the compensation received byexisting regulatory boards under the Professional RegulationCommission, computed on the basis of the number ofexaminees/candidates.

    Sec. 10. Supervision of the Board and Custodian of itsRecords. The Board shall be under the supervision andcontrol of the Commission.All records, including applicationsfor examination, examination papers and results, minutes ofdeliberation, administrative cases and investigative cases andinvestigations involving professional teachers shall be kept bythe Commission.

    Sec. 11.Secretariat and Support Services. The ProfessionalRegulation Commission, through its chairman, shall providethe secretariat and other support services to implementeffectively the provisions of this Act.cralaw

    Sec. 12.Removal of a Board Member. The chairman or anymember of the Board may be removed by the President of thePhilippines upon recommendation of the Commission forneglect of duty, incompetence, unprofessional, unethical,immoral or dishonorable conduct, commission or toleration ofirregularities in the examination, after having been given theopportunity to defend himself in a proper administrativeinvestigation.

    In the course of investigation, the President may preventivelysuspend the respondent.

    ARTICLE IIIEXAMINATION AND REGISTRATION

    Sec. 13. Examination, Registration and License Required. Except as otherwise specifically allowed under the provisionsof this Act, all applicants for registration as professionalteachers shall be required to undergo a written examination

    which shall be given at least once a year in such places anddates as the Board may determine upon approval by theCommission. A valid certificate of registration and a validprofessional license from the Commission are required beforeany person is allowed to practice as a professional teacher inthe Philippines, except as otherwise allowed under this Act.

    Sec. 14. Scope of Examination. The examinations for theelementary and secondary school teachers shall beseparate.The examination for teachers in the elementary levelshall consist of two (2) parts, namely: professional educationand general education. The examination for teachers in thesecondary level shall consist of three (3) parts,namely:professional education, general education, and field ofspecialization.

    Sec. 15. Qualification Requirements of Applicants. Noapplicant shall be admitted to take the examination unless, onthe date of filing of the application, he shall have compliedwith the following requirements:

    (a)A citizen of the Philippines or an alien whose country hasreciprocity with the Philippines in the practice of the teachingprofessionchan robles virtual law library

    (b)At least eighteen (18) years of age(c) In good health and of good reputation with high moralvalues

    (d)Has not been convicted by final judgment by a court for anoffense involving moral turpitude

    (e)A graduate of a school, college or university recognized bythe government and possesses the minimum educationalqualifications, as follows:

    (1) For teachers in preschool, a bachelor's degree in earlychildhood education (BECED) or its equivalentchan robles virtual law library

    (2)For teachers in the elementary grades, a bachelor's degreein elementary education (BSEED) or its equivalent(3)For teachers in the secondary grades, a bachelor's degree ineducation or its equivalent with a major and minor, or a

    bachelor's degree in arts and sciences with at least ten (10)units in professional education and

    (4)For teachers of vocational and twoyear technical courses, abachelor's degree in the field of specialization or itsequivalent, with at least eighteen (18) units in professionaleducation.

    Sec. 16. Report of the Results of the Examination. TheBoard shall, within one hundred twenty (120) days after theexamination, report the ratings obtained by each candidate tothe Professional Regulation Commission for approval andappropriate action.

    Sec. 17. Issuance of Certificate of Registration andProfessional License. The registration of a professionalteacher commences from the date his name is enrolled in theroster of professional teachers.

    Every registrant who has satisfactorily met all therequirements specified in this Act shall, upon payment of theregistration fee, be issued a certificate of registration as aprofessional teacher bearing the full name of the registrantwith serial number and date of issuance signed by thechairman of the Commission and the chairman, vicechairman,and members of the Board, stamped with the official seal, asevidence that the person named therein is entitled to practicethe profession with all the rights and privileges appurtenantthereto. The certificate shall remain in full force and effectuntil withdrawn, suspended and/or revoked in accordancewith law.cralaw

    A professional license signed by the chairman of theCommission and bearing the registration number and date ofissuance thereof and the month of expiry or renewability shalllikewise be issued to every registrant who has paid the annualregistration fees for three (3) consecutive years. This licenseshall serve as evidence that the licensee can lawfully practicehis profession until the expiration of its validity.

    Sec. 18. Oath Before Practice. Every registrant shall be

    required to take his professional oath before practicing as aprofessional teacher.

    Sec. 19. Periodic Merit Examination of Teachers. Toencourage continuing professional growth and developmentand to provide additional basis for merit promotion, inaddition to their performance rating, teachers may take anoral and written examination at least once in five (5) years asbasis for merit promotion. In taking this examination, no feeshall be required.

    Sec. 20.Failure to Pass the Merit Examination. If a teacherfails to pass the merit examination, he or she shall be allowedto take the examination for a second time.Should he or shefail to pass the merit examination for the second time, then heor she shall be required to take a DECS accredited refreshercourse or program before being allowed to retake theexamination.

    Failure of any permanent teacher to pass the meritexamination shall not, however, be used as a ground forhis/her dismissal or demotion.

    Sec. 21. Incentives. Teachers who pass the meritexamination shall:

    (a)Be awarded a diploma of merit by the Boardchan robles virtual law library

    (b)Earn merit points for purposes of promotion in salary or toa higher position or grade level(c) Be placed in the priority list for government scholarshipand

    (d) Enjoy such other benefits as may be promulgated by theBoard.

    Similar incentives shall be given to teachers who makeinventions, develop new methods of teaching, write a book orbooks and create works of artistic merit.

    Sec. 22. Integration of the Teaching Profession. The

    teaching profession shall be integrated into one nationalorganization which shall be recognized by the Board and theCommission as the one and only integrated and accreditedassociation of professional teachers. Upon registration withthe Board, every professional teacher shall be encouraged tobecome a member of the integrated nationalorganization.Those who have been registered with the Boardbut are not members of the said integrated organization shallbe allowed to register as members of the said integratedorganization within three (3) years after the effectivity of thisAct. Membership in the integrated organization shall not be abar to membership in other associations of the teachingprofession.The professional teachers shall receive the benefitsand privileges appurtenant to their membership in the saidintegrated and accredited organization of professional teachersonly upon payment of the required membership fees and dues.

    Sec. 23. Revocation of the Certificate of Registration,Suspension from the Practice of the Teaching Profession, andCancellation of Temporary or Special Permit. The Boardshall have the power, after due notice and hearing, to suspendor revoke the certificate of registration of any registrant, toreprimand or to cancel the temporary/special permit of aholder thereof who is exempt from registration, for any of thefollowing causes:

    (a)Conviction for any criminal offense by a court of competentjurisdictionchan robles virtual law library

    (b)Immoral, unprofessional or dishonorable conduct(c)Declaration by a court of competent jurisdiction for beingmentally unsound or insane

    (d) Malpractice, gross incompetence, gross negligence orserious ignorance of the practice of the teaching profession

    (e) The use of or perpetration of any fraud or deceit inobtaining a certificate of registration, professional license orspecial/temporary permit

    (f)Chronic inebriety or habitual use of drugscralaw

    (g)Violation of any of the provisions of this Act, the rules and

    regulations and other policies of the Board and theCommission, and the code of ethical and professionalstandards for professional teachers and

    (h)Unjustified or willful failure to attend seminars, workshops,conferences and the like or the continuing education programprescribed by the Board and the Commission.

    The decision of the Board to revoke or suspend a certificatemay be appealed to the regional trial court of the place wherethe Board holds office within fifteen (15) days from receipt ofthe said decision or of the denial of the motion forreconsideration filed in due time.

    Sec. 24.Registration by Reciprocity. No teacher of a foreignnationality shall be admitted to the examination, or be given acertificate of registration or be entitled to any of the rightsand privileges provided under this Act unless the country orstate of which he is a subject permits Filipino professionalteachers to practice within its territorial limits on the samebasis as subjects or citizens of said country orstate: Provided, that the requirements of certification ofteachers with said foreign state or country are substantiallythe same as those required and contemplated under thisAct:Provided, further,That the laws of such state or countrygrant the same privilege to Filipino professional teachers onthe same basis as the subject or citizens of such foreigncountry or state.

    Sec. 25. Roster of Professional Teachers. A roster ofprofessional teachers containing the names and addresses ofprofessional teachers, date of registration or issuance ofcertificate, and other data which in the opinion of the Boardmay appear pertinent shall be maintained.Copies of the rostershall be provided by the Commission to the Board, theDepartment of Education, Culture and Sports, and theintegrated and accredited organization of professionalteachers.

    Sec. 26.Registration and Exception. Two (2) years after the

    effectivity of this Act, no person shall engage in teachingand/or act as a professional teacher as defined in this Act,whether in the preschool, elementary or secondary level,unless he is a duly registered professional teacher, and aholder of a valid certificate of registration and a validprofessional license or a holder of a valid special/temporarypermit.

    Upon approval of the application and payment of theprescribed fees, the certificate of registration and professionallicense as a professional teacher shall be issued withoutexamination as required in this Act to a qualified applicant,who at the time of the approval of this Act, is:

    (a)A holder of a certificate of eligibility as a teacher issued bythe Civil Service Commission and the Department ofEducation, Culture and Sports orcralawchan robles virtual law library

    (b) A registered professional teacher with the National Boardfor Teachers under the Department of Education, Culture andSports (DECS) pursuant to Presidential Decree No. 1006 or(c)Not qualified under paragraphs one and two but with any ofthe following qualifications. to wit:

    (1) An elementary or secondary teacher for five (5) years ingood standing and a holder of Bachelor of Science inEducation or its equivalent orchan robles virtual law library

    (2)An elementary or secondary teacher for three (3) years ingood standing and a holder of a master's degree in educationor its equivalent.

    Provided, That they shall be given two (2) years from theorganization of the Board for professional teachers withinwhich to register and be included in the roster of professionalteachers: Provided, further,That those incumbent teacherswho are not qualified to register without examination underthis Act or who, albeit qualified, were unable to register withinthe twoyear period shall be issued a fiveyear temporary orspecial permit from the time the Board is organized withinwhich to register after passing the examination and complyingwith the requirements provided this Act and be included in theroster of professional teachers: Provided, furthermore, That

    those who have failed the licensure examination forprofessional teachers shall be eligible as parateachers and assuch, shall be issued by the Board a special or temporarypermit, and shall be assigned by the Department of Education,Culture and Sports (DECS) to schools as it may determineunder the circumstances.

    ARTICLE IVPROVISIONS RELATIVE TO THE PRACTICE OF THE TEACHING

    PROFESSIONSec. 27. Inhibition Against the Practice of the TeachingProfession. Except as otherwise allowed under this Act, noperson shall practice or offer to practice the teachingprofession in the Philippines or be appointed as teacher to anyposition calling for a teaching position without havingpreviously obtained a valid certificate of registration and avalid professional license from the Commission.

    Sec. 28.Penal Provisions. The following shall be punishableby a fine of not less than Five thousand pesos (P5,000.00) normore than Twenty thousand pesos (P20,000.00) orimprisonment of nor less than six (6) months nor more thanfive (5) years, or both, at the discretion of the court:cralaw

    (a) Any person who practices the teaching profession in thePhilippines without being certified in accordance with theprovisions of this Actchan robles virtual law library

    (b)Any person who represents or attempts to use as his owncertificate of registration that of another(c)Any person who gives any false, or fraudulent evidence ofany kind to the Board or any member thereof in obtaining acertificate of registration as teacher

    (d)Any person who impersonates any registrant of the same ordifferent name

    (e)Any person who uses a revoked or suspended certificate ofregistration

    (f) Any person who, in connection with his name, otherwiseassumes, uses or advertises any title or description tending toconvey or conveys the impression that he is a teacher without

    holding a valid certificate and

    (g)Any person who violates or who abets the violation of anyof the provisions of this Act.

    The penalty of fine or imprisonment or both, as provided inthis section, shall also apply to any school official who shallcause or be responsible for the commission of any of theaboveenumerated acts.

    Sec. 29.Appropriations. Such sums as may be necessary tocarry out the provisions of this Act shall be included in the1996 General Appropriations Act and thereafter.

    Sec. 30. Implementing Guidelines. The Board shallformulate and adopt the necessary guidelines for the effectiveimplementation of the provisions of this Act within sixty (60)days of its approval.cralaw

    The Board shall submit to both Committees on Education,Arts, and Culture and the Committees on Civil Service andProfessional Regulation of the Senate and House ofRepresentatives, copies of the implementing rules andguidelines within thirty (30) days after its promulgation.

    Any violation of this section shall render the official/sconcerned liable underRepublicActNo.6713,otherwiseknownasthe"CodeofConductandEthicalStandardsforPublicOfficialsandEmployees" [http://www.chanrobles.com/republicactno6713.htm] andother pertinent administrative and/or penal laws.

    Sec. 31. Transitory Provision. All incumbent teachers inboth the public and private sector not otherwise certified asprofessional teachers by virtue of this Act, shall be given (5)years temporary certificates from the time the Board forProfessional Teachers is organized within which to qualify asrequired by this Act and be included in the roster ofprofessionals.

    Sec. 32.Separability Clause. If,for any reason, any sectionor provision of this Act or the application of such section orprovision to any person or circumstance is declaredunconstitutional or invalid, no other section or provision ofthis Act shall be affected thereby.

    Sec. 33. Repealing Clause. All laws, presidential decrees,executive orders, rules and regulations or parts thereofinconsistent with the provisions of this Act are herebyrepealed or modified accordingly.

    Sec. 34.Effectivity Clause. This Act shall take effect afterfifteen (15) days following its complete publication in theOfficial Gazette or in two (2) newspapers of general circulation.

    History

    The promulgation of Presidential Decree No. 1006 on September 22, 1976 formallyorganized the National Board for Teachers (NBT). Directly under the supervision ofthe Civil Service Commission, the NBT was the first board to exercise regulatoryexercise over the teaching profession.

    On December 16, 1994 the regulation and licensing of teachers was transferred to

    the PRC through the enactment of Republic Act No. 7836, otherwise known asThe Philippine Teachers Professionalization Act of 1994. The law provided forthe professionalization of teaching under the aegis of the PRC.

    Pursuant to the law, the first Board for Professional Teachers (BPT) wasconstituted on September 19, 1995 with the appointment of Dr. Nilo L. Rosas asChairman, Dr. Aurelio O. Elevazo as ViceChairman and Dr. Lucila F. Tibigar, Dr. FeA. Hidalgo and Dr. Martha A. Mogol as Members.

    On August 1996, the Board and the PRC administered the Licensure Examinationfor Teachers (LET) for the first time to 97,560 examinees. In 1997, 101,348examinees took the LET, a record in the history of professional regulation. In 1998,a total of 115,499 took the LET, and in 1999, 123,025.

    In 1996, the Board also administered the first licensure examination for schoolsuperintendents, the results of which were released five (5) days after theexamination date.

    Today, teachers constitute more than half a million, comprising one of the largestoccupational groups in the country.

    Board Composition

    Qualification of Board MembersEach member of the Board shall, at the time of his appointment:1. A citizen and resident of the Philippines;2. At least thirtyfive (35) years of age, of proven integrity, and possessed of

    high moral values in his personal as well as professional conduct and has notbeen convicted of any offense involving moral turpitude;

    3. Be a holder of the degree of Bachelor of Arts or Bachelor of Science inEducation and preferably a holder of a masters or doctorate degree ineducation, or their equivalents, from a university, school, college, academyor institute duly recognized and/ or accredited by the Philippine government

    4. Be a professional teacher with a valid certificate of registration and validprofessional license, save those members who shall compose the first Boardfor Professional Teachers;

    5. Has been a professional teacher in the active practice of teaching professionfor at least ten (10) years in the elementary and secondary level; and

    6. Not be an official member of the faculty of, nor have pecuniary interest inany university, college, school, or institution conferring a bachelors degreein education or its equivalents for at least three (3) years prior to hisappointment, and neither connected with a review center or with any groupor association where review classes or lectures in preparation for thelicensure examination are offered or conducted. Provided, however, That,the membership to the Board shall be evenly distributed to cover all levels ofeducation, including equitable representation of the different fields ofspecialization.

    Statement of Policy. The state recognizes the vital role of teachers in nationbuilding and development through a responsible and literate citizenry. Towardsthis end the State shall ensure and promote quality education by proper

    Definition of Terms. For purposes of this Act, the following terms shall mean:1. Teaching refers to the profession concerned primarily with classroom

    instruction at the elementary and secondary levels in accordance with thecurriculum prescribed by the Department of Education, Culture and Sports,whether on parttime or fulltime basis in the private or public schools.

    2. Teachers refers to all persons engaged in teaching at the elementary andsecondary levels, whether on fulltime or parttime basis, including industrialarts or vocational teachers and all other persons performing supervisory and/or administrative functions in all schools in the aforesaid levels and qualifiedto practice teaching under this Act.

    3. Board refers to the Board for Professional Teachers duly established andconstituted under this Act.

    4. Commission refers to the Professional Regulation Commission.
