The Shaker Heights Board of Education met in regular session on Tuesday, June 22, 1999, at 4:07 p.m. in the large conference room of the Administration Building, 15600 Parkland Drive, Shaker Heights, Ohio. Members present: Mr. Steven S. Kaufman, Ms. Freda J. Levenson, Mrs. Nancy R. Moore, Mrs. Carol J. Ribar, Rev. Marvin A. McMickle. President Rev. Marvin A. McMickle presided. Upon the presentation of the minutes of the May 11, 1999, Regular Meeting, Mrs. Ribar moved, seconded by Mrs. Moore, to approve the minutes as presented. Upon the recommendation of Superintendent Dr. Mark Freeman, Ms. Levenson moved, secondedby Mrs. Moore, that the Board of Education approve the following resolution authorizing annualmembership in the Ohio High School Athletic Association for the 1999-2000 School Year:

BE IT RESOLVED, that the Shaker Heights Board of Education understands the obligationsrequired to be a member of the Ohio High School Athletic Association and that all the rules andregulations of the Ohio High School Athletic Association will govern the conduct of the school’sinterscholastic program.

Effective July 1, 1999, themonthly medical premiums will increase 18% for a twelve-month period ending June 30, 2000,and the monthly dental premiums will remain unchanged.

During discussion by Board members the following questions and comments were made: ABoard member asked if there was an opportunity to decrease costs by changing to anothercompany. A Board member asked if our coverage has been openly bid. A Board member askedif group purchasing agreements have been considered. Mr. Wilson explained current coverageand the efforts that have been made to reduce costs, within the limits of the collective bargainingagreements. He also explained the medical coverage trends. Dr. Freeman explained howcollective bargaining agreements affect the ability of a group purchasing cooperative to worksuccessfully.

Upon the recommendation of Mr. Daniel L. Wilson, Treasurer, Mrs. Moore moved, seconded byMs. Levenson, that the Board of Education adopt the following resolution to grant theSuperintendent and Treasurer authority for special education placements.

WHEREAS, special education placement disputes arise from time to time over the course ofthe school year; and

WHEREAS, such disputes involve confidential, personally identifiable information concerningthe affected student; and

WHEREAS, the resolution of such disputes must be handled on a case-by-case basis given theunique, individual needs of the affected student; and

WHEREAS, the Board of Education believes it is in the best interest of the School District andthe affected student to provide a mechanism for an expeditious, confidential, and reasonable settlementof a placement dispute, provided the cost to the Board of any out-of-District placement is equal to orless than the cost of directly providing a comparable education to the student; and

WHEREAS, in addition to special education placement disputes, the Superintendent andTreasurer are called upon to make out-of-District placement decisions which are uncontested by thestudent’s parent(s) and the District; and

WHEREAS, the Board of Education believes it is in the best interest of the School District andthe affected student to provide a mechanism for an expeditious and confidential process by which toimplement those uncontested placement decisions, where the cost to the Board of the out-of-District

placement is equal to or less than the cost of directly providing a comparable education to the student;and

WHEREAS, any such uncontested placement involving a special education student would beconsistent with the IEP team’s recommendations for said student.

NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Shaker HeightsCity School District that the Superintendent and Treasurer are authorized to take any and all acts andactions necessary on behalf of the Board of Education to resolve special education placement disputesin a manner reflecting the best interests of the School District and the concerns of the affected student.

BE IT FURTHER RESOLVED that this authority extends to the Superintendent andTreasurer entering into release and waiver agreements with the affected student’s parents or guardiansspecifying the terms and conditions of an expeditious, confidential, and reasonable settlement of anysuch placement dispute.

BE IT FURTHER RESOLVED that the authority granted herein extends only to thosesituations in which the cost to the Board of Education in resolving the dispute, as determined by theSuperintendent and Treasurer, is equal to or less than the cost of directly providing a comparableeducation to the affected student.

BE IT FURTHER RESOLVED that any release and waiver entered into with the affectedstudent’s parents or guardians will be maintained in the student’s file as a confidential education record,subject to disclosure to third parties only as required by applicable federal and state law.

BE IT FURTHER RESOLVED that the Superintendent and Treasurer have authority toeffectuate and implement uncontested out-of-District placements which are consistent with thestudent’s individual education plan and in which the cost to the Board of Education is equal to or lessthan the cost of directly providing a comparable education to the affected student in the District.

BE IT FURTHER RESOLVED that all formal actions of this Board of Education concerningor relating to the adoption of this Resolution were adopted in an open meeting of this Board ofEducation in compliance with the law.

WHEREAS, the Budget Commission of Cuyahoga County, Ohio, has certified its actionthereon to this Board, and what part thereof is without, and what part within, the ten milltax limitation;

THEREFORE, BE IT RESOLVED, by the Board of Education of the Shaker HeightsSchool District, Cuyahoga County, Ohio that the amounts and rates as determined by theBudget Commission in its certification, be and the same are hereby accepted; and

BE IT FURTHER RESOLVED, that there be and is hereby levied on the tax duplicate ofsaid School District the rate of tax necessary to be levied within and without the ten milllimitation as follows:
