Whereas, asthma, COPD, lung disease, and cardiovascular diseases all cause serious morbidity 1 and mortality for Floridians, 2 3 Whereas, poor air quality affects: quality of life and exacerbations in each of these conditions, 4 5 Whereas, exacerbations in these conditions result in lost days of work, excess illness, excess 6 Emergency Department visits and excess hospitalizations. 7 8 Whereas, the growth of our state's population now approaches 21 million people, plus over 113 9 million visitors per year, 10 11 Whereas, the increased population and tourism add vehicle miles and emissions on our state's 12 highways and in urban areas. 13 14 Whereas, our state is among the largest of the state's which currently do not require vehicle 15 inspections for emissions or better emission standards, polices which could help to protect air 16 quality particularly near truck routes and heavy traffic areas 17 https://www.idmv.com/vehicle-inspection-requirements-state/ 18 19 RESOLVED, that our FMA will support collaboration with interested organizations to examine 20 evidence based policies to determine the potential benefits of improved emission standards and 21 polices in Florida. 22 23 RESOLVED, that our FMA will ask the Board of Governors to examine polices aimed at protecting 24 the respiratory and cardiovascular health of all Floridians in concert with our state's health and 25 environmental agencies and policy makers. 26

Resolution 17-113 Change the American Board of Medical Specialties Maintenance of Certification Process
South Florida Caucus 1 Whereas, the current American Board of Medical Specialties (ABMS) maintenance of 2 certification (MOC) process has never been proven to provide a clearly measurable 3 public health benefit; and 4 5 Whereas, the MOC process has never been proven to provide a clearly measurable 6 improvement in healthcare financing that would benefit patients; and 7 8 Whereas, many organizations including hospitals, health insurance companies, and 9 academic institutions require board certification by the ABMS for full participation; and 10 11 Whereas, the MOC process has been required for those physicians who have completed 12 their training more recently while not impacting the board certification status of older 13 physicians; and 14 15 Whereas, the number of minority and women medical school graduates and practicing 16 physicians has been increasing over this same time period; and 17 18 Whereas, this has resulted in a disparate impact of the burdens imposed by the ABMS 19 and its MOC process on more recent medical school graduates and practicing 20 physicians; therefore be it 21 22 RESOLVED, that the Florida Medical Association (FMA) calls upon all organizations and 23 institutions, whether public or private, and all government agencies to immediately 24 suspend any and all MOC-related requirements; and 25 26 RESOLVED, that the FMA calls upon the ABMS to immediately suspend the current MOC 27 process. Resolution 17-114 Reaffirming The Commitment Of The Florida Medical Association to End Maintenance of Certification

Whereas, the Florida Medical Association (FMA ) gave assurances to the practicing physicians of the 1 State of Florida that this organization was unwavering in its commitment to seek legislation to protect 2 physicians from the unproven mandates of Maintenance of Certification (MOC); and, 3 4 Whereas, in 2014, the FMA House of Delegates passed resolution 14-201 which said, in part: 5 “ RESOLVED, That the FMA opposes any efforts to require Maintenance of Certification (MOC) 6 program as a condition of medical licensure, or as a pre- requisite for hospital/staff privileges, 7 employment in State of Florida/county medical facilities, reimbursement from 3rd parties, or issuance of 8 malpractice insurance; and be it further” ; and, 9 10 Whereas, in May of 2016, the FMA Board of Governor’s passed the following substitute resolution in lieu 11 of 15-101 and 15-105 which said: 12 “That the FMA seek legislation to improve the efficiency of the health care markets and eliminate 13 unnecessary administrative and regulatory requirements, health care providers shall not be required, by 14 any public or private entity to comply with Maintenance of Certification requirements after 15 achieving initial board certification, other than the continuing medical education (CME) requirements 16 set by the health care provider’s licensing board.”; and, 17 18 Whereas, during the 2017 legislative session, the FMA endorsed substitution amendments to the anti-19 MOC bill in the Florida Senate ( SB 1354 ) which went against its stated policy, and these amendments 20 deleted the original language of the bill which would have banned MOC for medical licensure, hospital 21 staff membership and participation in insurance company contracts, ; and, 22 23 Whereas, these FMA-supported amendments to SB 1354 allowed for an increase in the authority of the 24 Florida State Board of Medicine by mandating, that it, the Board of Medicine, allow for the creation of 25 multiple physician “certifying” entities in the State of Florida; and, 26 27 Whereas, these FMA-supported amendments to SB 1354 stated that the newly created “certifying” 28 entities would be prohibited from mandating MOC, but hospitals, insurance companies were not 29 explicitly prohibited from using MOC against physicians; and, 30 31 Whereas, these FMA-supported amendments to SB 1354 allowed that a physician must receive formal 32 recognition as a specialist from a specialty board of the American Board of Specialty Medicine or other 33 recognizing agencies ( i.e. “certifying" entities) in order to be recognized as “board certified” ; and, 34 35 Whereas, these FMA-supported amendments to SB 1354 allowed that an osteopathic physician must 36 complete requirements for certification through the American Osteopathic Association or the 37 Accreditation council on Graduate Medical Education in order to be recognized as “board certified”; 38 and, 39 40 41

Whereas, these FMA-supported amendments to SB 1354 defined criteria for re-certification by the 42 newly approved “certifying” entities which included minimal number of CME’s, and participation in 43 ongoing practice improvement programs which, as defined, appears to be another form of MOC.; and, 44 45 Whereas, the amended changes to Senate Bill 1354 did not reflect the will of the House of Delegates or 46 the Board of Governors of the FMA and the entire anti-MOC legislative effort failed; and 47 48 RESOLVED, the FMA reaffirms its policy that the Florida Medical Association opposes any efforts to 49 require Maintenance of Certification (MOC) as a condition of medical licensure, or as a pre-requisite for 50 hospital/staff privileges, employment in State of Florida/county medical facilities, reimbursement from 51 3rd parties, or issuance of malpractice insurance. 52 53 RESOLVED, the FMA reaffirms it’s policy that “health care providers shall not be required, by any public 54 or private entity to comply with Maintenance of Certification requirements after achieving initial board 55 certification, other than the continuing medical education (CME) requirements set by the health care 56 provider’s licensing board.” 57 58 RESOLVED the FMA will actively support legislation that advances their stated policy on Maintenance of 59 Certification and will actively oppose legislation that does not prohibit the use of MOC for hospital 60 medical staff privileges, medical licensure, or third party contracting or reimbursement. 61 62 RESOLVED, the FMA will oppose legislation that grants any state/private agency the authority to create 63 additional “certifying" entities, which could include hospitals and insurance companies, and the FMA will 64 not apply to become a “certifying” entity 65 Fiscal Note:

Whereas, before 1990, a physician could hold himself or herself as board-certified for life after the 1 successful completion of a secure comprehensive examination administered by a recognized certifying 2 agency; and 3 4 Whereas, after 1990, a physician could not hold himself or herself as board-certified without the 5 completion of time-limited ‘re-certification’ examinations every 10 years, preceded by the mandatory 6 completion of tedious, poor quality “preparatory” modules; and 7 8 Whereas, after 2014, a physician could not hold himself or herself as board-certified without the 9 participation in maintenance of certification programs every 2 years; and 10 11 Whereas, in 2014, the proposed requirements by the ABIM/ABSM for a physician to be able to hold 12 himself or herself as board-certified was initial board certification, in addition to, a secure 13 comprehensive time-limited re-certification examination every 10 years, in addition to, the maintenance 14 of certification every 2 years through participation in the trademarked MOC program; and 15 16 Whereas, the ultimate acquiescence of the ABIM/ABSM to remove the every 10 year re-certification 17 examination requirement came about only after the determined push back from physicians aided by 18 their state medical societies, including our FMA; and 19 20 Whereas, in May of 2016, the FMA Board of Governor’s passed the following substitute resolution in lieu 21 of 15-101 and 15-105 which said: 22 “That the FMA seek legislation to improve the efficiency of the health care markets and eliminate 23 unnecessary administrative and regulatory requirements, health care providers shall not be required, by 24 any public or private entity to comply with Maintenance of Certification requirements after 25 achieving initial board certification, other than the continuing medical education (CME) requirements 26 set by the health care provider’s licensing board.”; and, 27 28 Whereas, as was witnessed in the 2017 legislative session, the American Board of Specialty Medicine 29 (ABSM) and American Osteopathic Association (AOA) want to continue to determine, based on their 30 monetary interests, which physicians may hold themselves as board certified; and, 31 32 RESOLVED, that the Florida Medical Association supports legislation that defines a ‘board-certified’ 33 physician to be a physician, who upon the completion of an accredited residency/fellowship program, 34 has taken and passed an initial secure comprehensive board-certifying examination, administered by a 35 recognized certifying agency. A physician, who from that point forward, meets the CME requirements of 36 the Florida State Board of Medicine may hold himself or herself out as board-certified in the state of 37 Florida. 38
