TillS MATTER came before the Court on the Joint Unopposed Motion tbr Entry of
Stipulated Judgment (the "Motion") of the City of Las Cruces ("City") ~md Jornada Wa~er
Company, Inc. ("Jomada"), collectively the "Partics". The Court having considered the Motion
and being otherwise duly advised, FINDS that tho Motion is well taken and should be granted.
IT IS THEREFORE ORDERED that:
A. The City is granted the relief sought in the Petition for Condemnation, which is to
be granted fee simple title to the real properly, title to the personal property, and ownership and
possession of the Water Ulilily Assets, as referenced i~ the Petition for Condemnation and
sought to be acquired by the City free of all liens and encumbrances, and a determination that the
just compensation owed to Jornada for thc Water Utility Assels is as stipulated by the Parties to
be $16,400,000.
B. The Agr~ment for Purchase and Sale of Water Utility Assets of Jornada Watcr
Ct~mpany, and Providing tbr Customer Conversion with Exhibits "A" through "G", which
Agreement has been approved by the Parties and xvas attached as Exhibit ’T’ to the Motion, and
which Agreement identifi~ the Water Utility Assets to be acquirvd and ptuchas~d by the City, is
