TWU ACTION STOPS UNDERPAYMENTMessage received from Alan W Dale

I retired from working with Armaguard Murarrie on the 20 /10/14 but the company had short paid me by 190 hours holiday pay. Thanks to the efforts of Steve Mathews the union delegate I am going to be paid the money that was short, I would like to thank Steve for his dedication to the workers and hope that you can pass on my thanks to him and let him know how much he is appreciated by all at Armaguard and by me personally. Thank you in advance.

KEEP UP THE GOOD WORKFrom Sam Spann

Hi. Happy and Safe Christmas to All. I wish to advise that I have retired (11/08/2014) and therefore have to resign from the TWU. I would like to thank you for all your help and keep up the good work.

WORKERS UNITEDFor every TWU member who took the fight up to the Newman Government this is your victory to share.

JANUARY 31 2015 will be remembered for its significance for many years to come. Significant for the fact that the most successful electoral victory in the state’s history that saw Newman sweep to power in 2012 was decimated in less than 3 years. Significant in that the first female Premier in the history of our country was elected from opposition.

What many people may not remember in years to come, but something for which we should all be immensely proud is that for every day that Newman was in power, it was unions who took up the fight.

Every day that laws were passed stripping rights away from workers, every day that funding to Health and Education initiatives was cut and community groups gagged it was Unions, spurred on by the injustice being faced

by members across the State that were working to hold the Newman Government accountable.

For every TWU member who took the fight up to the Newman Government this is your victory to share.

THE FIGHT GOES ONThe fight does not end here. We now need to hold the new government to account to make sure that the commitments that were made in opposition - the introduction of Portable Long Service Leave, harsher penalties for those who assault Bus Drivers, accredited training for Heavy Vehicle Drivers, the retention of the Road Safety Remuneration Tribunal - are delivered for you and your mates.

Having secured commitments prior to the election the next

phase for your Transport Workers’ Union to lead a delegation of drivers to meet with the new Minister for Transport to discuss the priorities you and your mates have identified as key with Portable Long Service Leave and improving safety on our buses and increasing penalties for those who assault Public Transport Drivers at the top of the list.

MAY DAY 2015Every year the TWU celebration for May is getting bigger and better. With over 120 years of industrial wins to celebrate the defeat of the anti-worker government on January 31 provides an even sweeter reason to celebrate this year.

Spanning across the weekend of Saturday May 2 - Sunday May 3 right across Queensland

Labour Day is packed full of fun activities for the whole family with free rides, food & drinks for you and your mates and families to enjoy to celebrate the huge achievements of Unions in fighting for workers rights during Australia’s history.

Every year the TWU contingent has grown in every regional centre and here in Brisbane so we encourage you all to save the date and bring the family down to celebrate your union and the fantastic history of the whole Labour movement. ► Don’t miss out on Labour Day this year - save the date and bring the whole family! ON 30 JANUARY 2015 TWU members at Hymix took the power back from the company in their fight for a fair EBA, staging a 24 hour stoppage under protected action.

Workers at Hymix have had enough and TWU members and Delegates have lead the charge in making sure the company knows it. They have had enough of getting paid less than their workmates in NSW, having no RDOs, the company repeatedly ignoring their concerns of fatigue and the company’s lack of respect for their families’ living wage and their important time with their families.

TWU members converged on the bosses’ office in Southport on the Gold Coast on 30 January, staging a monumental stoppage out the front, TWU barbie and TV news cameras in tow.

since 2006 and Hanson drivers in QLD have RDOs – where are ours?

‘Hymix close our plants over Christmas for three weeks using up our annual leave, then we only have one week off for the rest of the year. We work six days – up to 60 hours - every week. We get up at 3am, start work at 4 at Coomera to be either in Brisbane or Northern NSW by 5am. Without a break you get fatigued.’

Hymix did not like the stoppage and the inconvenience to their operations, and locked the workers out for three days. Hymix then didn’t like the fact the media asked for answers on why they had locked the workers out, hiring an expensive consulting company from Sydney.

The company then threw another tantrum and declared

‘What the company don’t realise is that these guys are as tough as them - in fact they are tougher,’ TWU QLD Secretary Peter Biagini said.

In response to the lockouts and standing strong together for a fair EBA workers held another 24 hour stoppage with a mass rally at Windsor.

‘Being at those stoppages you could see the real solidarity and strength that these guys have and that is what gets results,’ Peter said.

It’s all about our families ‘It’s all about our families,’ said Daniel Sua (Hymix Wacol).

‘We are trying to catch up with work and bills, and some of the boys are under a lot of strain to make ends meet. But the boys are standing strong and keen on

getting done what has to be done to get our work family balance back and a better wage for our families.

‘What we are fighting for is not out of reach: our RDOs and our raise.

‘We have a heavy workload and no home and work life balance. With only one week of leave left all year after the compulsory Christmas shutdown you’re working 60 hours a week all year with no time to recover. You’re tired at work and at home. We want balance. We have to think who this is affecting.

‘Stay focused and think about bigger picture at the end not just for us but for our families. That is why we’re really doing this.

‘With RDOs the company would benefit too with less people sick, workers focused and ready to go.

TOUGHER THAN THE COMPANY: HYMIX MEMBERS Show these guys a substandard EBA and they will show you a series of rolling stoppages. TWU Hymix members are fighting for their families and they mean business.

‘Our first stoppage in Southport was like a street party,’ Greg Inglefield (Coomera) said.

‘We all enjoyed ourselves, made our point and it went really well. There are highs and lows in a tough campaign like this - some of the family men are feeling the pressure but we are strong in standing together and we are as tough as the company.

‘Our sticking point is RDOs. Hymix in NSW have had RDOs

they would take everything off the table - which did not phase anyone considering the substandard agreement they had offered workers in the first place.

They liked it even less when our members forged on with their fight and held a two hour protected action for a meeting to discuss their EBA.

The company really started to lose it at this point, locking workers out for another three days.

We are strong standing together and we are as tough as the company.

- Greg Inglefield, Coomera

‘We are very happy with how the TWU has backed us on our action we put in place. Now let’s hang in there and stick together - the fight is not over.’

Members who have signed up to the TWU’s Members Support Fund have access to assistance to help them meet their financial commitments, to when they have taken protected action and are doing it tough financially as a result of the company’s lockouts, on the basis that they have joined the Members Support Fund prior to

negotiations commencing. All the way through the

guys at Hymix have had the full support of the entire TWU community - with messages of support flooding in from fellow TWU members on social media and TWU members joining Hymix workers at rallies.

TWU Organiser Rob Fitzpatrick said that these guys have what it takes to win this dispute.

‘If everyone in the yards was on board as TWU with the guys who have lead the charge and gone on protected action

the company would have been forced to cave in and the fight would have been over on day one,’ he said.

‘Our guys are too smart to throw away their right to a pay rise and RDO’s for a $200 gift voucher.’

Hymix workers have the continued and unbending support of their TWU as we continue to fight for a fair deal for workers and their families. ► If you work for Hymix there is still time to get on board for a better deal and fight for a fair EBA with a real pay rise and RDOs. TOUGHER THAN THE COMPANY: HYMIX MEMBERS In the year 2015 how can this company not have a national standard to give all of us doing the same job the same pay and conditions? NSW drivers are getting around $4,500 per year more than us to do exactly the same job. We need very strong union membership here to get the EBA we want and as long as we have that we can win.

Bus drivers make their safety message loud and clear

TWU Bus Drivers have made their message loud and clear on bus safety, making their mark in the community and the media.

The week before the QLD election, bus drivers took Delegate training at TWU HQ, discussing key industry issues and training in building union strength and effective yard structures; with a view to Delegates taking charge of promoting their members’ agenda in their yards.

Day One of training culminated in a mass protest march by Bus Drivers on the (now former) Assistant Minister for Transport Steve Minnikin.

Bus Drivers turned up en masse with three TV stations, and made their point.

Drivers were vocal on key safety issues such as the former Premier Campbell Newman’s plan to open QLD bus tenders to overseas operators and slash safety and working conditions.

This capped off a series of successful rallies by Bus Drivers doing the grand tour of (now former) MPs who don’t answer their meeting requests: turning up in person with a large delegation of their mates and the media.

The TWU released results of the first statewide QLD Bus Safety Survey at the rally on 30 January, where Bus Drivers across QLD had their say.

TWU Bus Drivers saw the Newman LNP government out with a loud and clear message that bus safety must be at the top of the agenda.

Bus protest at Minnikin’s office, 30 January 2015

GREYHOUND national EBA negotiations are stalling due to Greyhound Australia’s refusal to apply back pay. There has been no increase in wages since 2013.The original offer of 1% per annum has now been increased to 2.75% as a direct result of negotiations by Representatives. However the removal of a $2 per hour mine allowance for Mackay based workers has created a stalling point.

► Greyhound Drivers: You can get a better deal by signing up your workmates. Call Bob Giddens at your TWU on 0422 418 417 for more information.

AFTER SEVEN MONTHS of negotiations between Qantas and your member led negotiating committee the Qantas agreement was voted up.

While the gains delivered are modest and include a period of frozen wages, the commitments to job security deliver real guarantees for support and protection on the tarmac and in the catering centres for TWU Qantas members.

‘After the issues around the last agreement it has been a big job working to negotiate a new agreement,’ Lead Brisbane Delegate Grant Mitchell said. ‘It was really important to make sure that all the issues that the boys wanted addressed were dealt with properly.’

‘It’s no secret that the wage freeze element of the agreement was controversial,’ Grant said, ‘That is why we were really happy to have an additional inclusion in the agreement that if another division receives an increase during the life of our agreement then we will open negotiations to apply these increases to those covered by our agreement.’

With ballots opening on February 1 and running for a week, over 70% of respondents voted in favour of the new agreement which included additional commitments from the company which were dependent on the agreement being voted up.

These additional commitments related to the transition to retirement, consultative committees, and the process in the event another division receives a pay increase during the wage freeze period.

‘It was a fine effort from our National negotiators as always with a strong outcome for members,’ Grant said. ‘The next focus is to continue building strength across the company to make sure that

when we go to negotiate the next agreement we can continue from our strong bargaining position.’► Want to know more about what is included in this agreement? Contact your delegate or talk to your local organiser on 1800 804 533.

Qantas members standing strong

The new agreement will: Cover the next three years up to 31 December 2017 Roll over all existing terms and conditions Maintain the prohibition on compulsory redundancies Provide two pay increases of 3% payable on 1 January 2016

and 1 January 2017 Incorporate Qantas company wide 18 month wage freeze

from 7 July 2014 to 31 December 2015With the agreement being voted up additional commitments to be delivered to Qantas workers include that: Qantas international workers will continue to work under

existing terms and conditions for the life of the agreement if a new international entity is created.

Two additional consultative meetings at a national level each year and to provide a more flexible approach to delegate release for training purposes

If another division of the Qantas Group receives a wage increase during the wage freeze period, negotiations will take place to apply any wages increases to workers covered by this agreement.

Qantas has agreed to allow workers to take Long Service Leave in shorter blocks - in seven or eight-day blocks depending on employee shift patterns.

A committee of managers, TWU delegates, and TWU officials will meet to help a better transition to retirement and part time work.

Receiving over 70% in favour the new Qantas Agreement was voted up in early 2015.

One of these things is not like the other…THIS IS THE THOUGHT that was going through the minds of TWU organisers across the South-East corner during a recent blitz of JJ Richards yards when they came across a flyer that looked remarkably similar to one produced in house by your TWU Communications Team.

‘Over the past three years we have applied significant amounts of pressure to JJ Richards as a company, and in every yard across the state, to improve wages and conditions for drivers,’ Waste Coordinator Craig Williams said. ‘We do this because we genuinely want to see the rates for the JJ’s drivers increased but also to make sure that the low rates don’t permeate out and bring the whole industry down when contracts are open for tender.’

‘We’ve had a lot of success over the years with community support and member sign ups but we’ve also seen the extreme opposition from the company to union involvement with the company stooping to some pretty ridiculous lows,’ Craig said.

When organisers recently attended JJ’s yards it became apparent that ‘Australia’s Worst Employer’ (JJ Richards has been awarded this awful and yet highly accurate award for 2 years in a row*) had taken their opposition to unions to previously unimaginable lows.

‘Due to the pressure the TWU, together with TWU members, have put on JJ Richards they finally delivered a pay increase for workers in January this year so we put out a flyer to make sure the guys realised exactly why they were getting more dollars in the pay packet,’ Craig said. ‘The next thing we know the company has imitated our flyer - using exactly the same design, colours and template - to make out that the pay increase had come from the goodness of their hearts.’

IMITATION HIGHEST FORM OF FLATTERY RIGHT?

‘If I’ve learnt anything as a Union organiser over the last 20 years it is that bosses never hand over anything they don’t have to,’ Craig said.

While JJ’s has delivered a pay increase and continues to sit above the award minimum they are still behind the industry average by almost a $1 an hour.

‘If JJ’s spent as much of their energy focusing on improving conditions for drivers as they do fighting the union and making themselves look like fools copying our designs they could lift their rates to the industry average and get on with running their business,’ Craig said. ‘I’ve been told that imitation is the sincerest form of flattery but to be honest I’d rather a union agreement

and the security that brings the drivers any day of the week.’

*Australia’s Worst Employer award is an award given out by the Transport Workers’ Union - Queensland Branch to an employer who shows exceptionally poor standards in regards to the wages, conditions and treatment of their staff. ► Want to get a better deal for you and your mates at JJ’s? Take a stand - Join your Union and get what you deserve!

YOUR TWU was front and centre in securing an interim pay increase for Toowoomba Regional Council members.

‘Negotiations with council have been ongoing and we’ve seen other unions come to some meetings and miss others but I was committed to fighting to secure a good deal for our members,’ Toowoomba Regional Organiser Brendan Bogle said. ‘We were demanding more than 1.5% but we were happy to be able to secure an interim

increase while we continue to fight for the substantive elements of the agreement.’

Negotiations will continue with your TWU continuing to be the constant in the room, taking up the fight of TWU members for a better deal for them and their families.

Your TWU Delivered “Council recognises and acknowledges that the last pay increase Field Based staff received was on 1 August 2013. As such,

Council has made a decision to pay current staff employed under the terms and conditions of the Field Based Agreement a one off lump sum ‘goodwill’ payment of 1.5% of employees’ base salary for the period from 1 October 2014 to 28 February 2015.” ► Want to know more about the Toowoomba Regional Council EBA Negotiations? TWU Cabin Crew at VARA are now up for the fight which will be the deal maker or deal breaker on your pay.

VARA has refused to grant Cabin Crew even a 3 % pay rise in EBA negotiations. In fact the company as we go to press has threatened to take away your level 6 and 7 pay rate and cut pay rates so they only go up to level 5 but it takes longer to get to level 5.

VARA want you to work longer for less. This is as far as you can get from the

respect and recognition that you deserve as Crew.

You as Crew can win this. All you need to do now is sign the pledge to vote for protected action, in the form of your VARA Protected Action Survey.

The survey is confidential and only the union will see your details, the company will not.

You need over 50% of crew to sign this in order for your TWU to help you take the next step.

VARA IS STRONG2015 has only just started and already you have clocked up a win at VARA.

Due to the strength of TWU VARA members and TWU Delegates’ pressure and persistence, the company agreed to rectify

and back pay significant underpayments: on salaries for personnel on certain grades, and on grooming allowances.

Congratulations to all VARA members on your victory and on showing management you will stand together and do what it takes until you get an outcome.

LONG TERM TWU Member Frank Black was earlier this year re-elected unopposed to the role of Owner-Driver representative on the Australian Trucking Association.

The ATA is the peak body that represents trucking operators whose members include major logistics companies, transport industry associations and businesses with leading expertise in truck technology.

Given the make up of the organisation and the influence it has in regards to decision making for the industry the role of Owner Driver representative is extraordinarily important.

‘This role allows me to sit down with industry players and press them to make trucking safer. On the ATA I will influence the debate to ensure truck drivers stop getting squeezed for time, money and conditions,’ Frank said.

Frank has been a truck driver for 30 years and has been the ATA owner driver representative for 10 years.

Having been a staunch advocate for the intorduction and now retention of the Road

Frank RE-ELECTED

Safety Remuneration Tribunal - Safe Rates - Frank has a strong record for standing up for safety in the industry.

‘I know the other representatives on the ATA board don’t always agree with what I

have to say but after 10 years I think there is an understanding that I’m always going to advocate for improving safety for the driver,’ Frank said. ‘I’ll never apologise for standing up for what is right.’

This role allows me to sit down with industry players and press them to make trucking safer.

WHEN TROPICAL CYCLONE MARCIA crossed the Central coastline of Queensland the communities of Rockhampton and Yeppoon were hardest hit and in need of support to get back on their feet.

‘Sita got the contract to pick up the curb side hard waste like your washing machines and fridges - anything that had been damaged from the Cyclone,’ Jody said. ‘I was basically in town to help clean up the joint and help Rockhampton get back on its feet after the Natural Disaster.’

In town for 4 weeks, starting in Rockhampton Regional Council and then moving on to the Livingstone Shire Council Jody’s diary primarily consisted of CLEAN - EAT - SLEEP - REPEAT.

‘It was a really intense experience taking away people’s worldly possessions after having been devastated by the natural disaster,’ Jody said. ‘It was important to remember that what we were picking up wasn’t rubbish, but it was important to get rid of the damaged items quickly so there wasn’t a daily reminder sitting on the streets of what they had gone through.

‘I lost my Mum at the end of January

GIVING BACK

just before the Cyclone hit and it’s a loss our whole family is still coming to terms with,’ Jody said. ‘Being able to help these communities out in their time of need is something I think my Mum would have been really proud of and she was always in

my thoughts as I was working each day to help people dealing with the disaster.’

Acknowledging the level of devastation newly elected Premier Annastacia Palaszczuk noted that ‘It’s important that we transition very quickly into the recovery phase where it is safe to do so,’ while thanking the many volunteers and workers who were on the ground helping with the recovery effort.

‘Something I’m really proud of, particularly from a Health and Safety perspective, is that when you combine Rockhampton and Yepoon there were about 45,000 houses and over 90,000 people and there was not one single injury or incident during the 4 week collection period,’ Jody said. ‘The process was largely reliant on manual handling but it was

fantastic to get to through that process and not add to anybody’s woes with an injury.’ ► Were you affected by the recent Natural Disasters? Let us know your story at [email protected].

FOLLOWING THE SUCCESS of the VOTE NO campaign in late 2014, early 2015 saw your member led negotiating committee convening, bringing delegates from across the country together, to formulate the framework for a whole of crew survey to gauge what crew wanted to see in their next agreement.

Running for a period of 3 weeks the “What Crew Want” survey was the first opportunity that all crew had the opportunity to identify what they want to see in the next agreement and the inconsistencies that need to be rectified to bring equity to Virgin Australia cabin crew.

‘We worked hard to make sure that the survey really reflected all the things that people had been telling us through this process,’ Brisbane delegate Ebanie Jayeh said. ‘It was really important to show TWU members but importantly non-members that this is an inclusive process where everyone’s voice is heard.’

What are we fighting for? While the final results from the survey were still being collated at the time of going to print initial reports showed there was consensus regarding the outcome for the campaign: Achieve a better future for VAA Cabin

Crew. To achieve an EBA for VAA cabin crew

that improves wages and conditions and quality of life for TWU members and their families.

Build and maintain workplace power Build power and capacity with

community support for safe, secure aviation jobs.

‘We’ve had some wins as a result of the delegate meetings with VA so we’re excited to see how effective the strength of numbers is in achieving outcomes,’ Ebanie said. ‘If anything though it’s just made us hungrier to secure a good EBA for all crew.

With a calendar of meetings locked in your member-led negotiating committee is well on the way to securing a deal to deliver real benefits to VA members and their families.

‘Securing a good deal is the first goal but ultimately the real win for members will be maintaining and building on the strength we have achieved to make sure we can enforce everything in the EBA,’ Ebanie said.

FROM STRENGTH TO STRENGTHCabin crew members are going from strength to strength and gaining confidence as they continue to fight for a better deal for all crew.

Celebrate the wins!As a result of recent member led meetings and the pressure crew have put on management by joining the TWU – VA management agreed to your TWU negotiating team’s demands that the EBA: Provide a classification and tiering

system that better recognises the the service, skill, and contribution of cabin crew with details still to be discussed and agreed;

Provide a % salary increase for every increment, every year of the EBA unlike the defeated proposals from 2014 (the amount is % subject to negotiation);

Addressing sign-off is important – and have agreed to consider options to increase it from 15 mins;

NQ roundup‘Consultation procedures in your union agreement are there for you to use,’ Tom said.

‘By making sure the consultation procedures or guidelines in your agreement are always followed you’ll keep management on their toes and they will be clear that you know your rights.

‘In every union agreement under the Workplace Consultation Clause the company must consult with you in the event of a major workplace change before the change occurs.

‘Your TWU can confirm instances where his has been successfully enforced in workers’ favour.’

Non union worksites/worksites which do not yet have an agreement‘There is great potential to build union power to lock in and improve your pay and conditions at your non union worksites; worksites that operate under the Award or which do not yet have a certified agreement,’ Tom said.

‘If a union rep presents at your yard plase keep an open mind to have a discussion around strengthening your workplace.’

‘This is particularly relevant to us in North QLD with the makeup of our local industry sectors and the dependence of many people and their families on penalty rates in these sectors.

‘Our penalty rates are under scrutiny as well as your base hourly rate and the minimum award rate thanks to the LNP IR team of Eric Abetz who is on a relentless quest to lower your wages as workers. It needs to be at the forefront of our minds to support others to disarm this bomb: especially with many of our family members in North QLD working in the hospitality sector where workers rely on penalty rates to compensate for the time taken from their families.

‘It is now more important than ever to act as a collective union of workers together with the same common values of a living wage, time with your families and a fair go.

‘We need to be especially vigilant here in the North where unemployment is extremely high - to be vigilant in our workplaces to make sure we all get a fair go and the best way to achieve this is with strength in numbers being union.

As 2015 is underway NQ Official Tom Pfund talked about the importance of consultation procedures, workers who do not yet have a certified agreement for their yard and the federal LNP government’s attack on penalty rates for North Queensland workers.

Thank you ‘Finally a big thankyou goes out to all North QLD Toll Delegates in our area for the work you have done to keep your yards united; and to all of our NQ delegates and members.

‘Thank you for your efforts and what you have achieved in the past year. Let’s keep it going in 2015!’

It is now more important than ever to act as a collective union of workers together.

Penalty rates under attack ‘We are under attack more than ever before by the federal LNP government when it comes to our rights at work such as penalty rates,’ Tom said.

SAFE RATES UPDATE

AS 2015 gets well underway the Road Safety Remuneration Tribunal has moved on from a CIT focus in 2014 to tackling the Waste industry this year in its third work program.

TWU CIT and Waste Industry Coordinator Craig Williams has been working hard to make sure that QLD members’ concerns on the ground are at the top of the Tribunal’s agenda and are addressed in the RSRT.

‘We went to the RSRT hearing regarding CIT representing our members and taking the information delegates had given us regarding their issues in the industry,’ Craig said.

‘They see their job getting riskier because of second tier companies undercutting larger companies like Armaguard and taking shortcuts to save costs - which is undermining companies doing things safely.

‘We also pointed out that the job requires proper licensing and experience.

‘The Tribunal has taken submissions from all over Australia and the outcome is pending. Hopefully we will end up with a rate that represents what our CIT members do including their experience, licensing and the danger they face at work.’

2015: Focus on Waste IndustryCraig is busy now moving forward to make sure QLD waste workers concerns now top the agenda with the RSRT’s third work program focusing on waste in 2015.

‘What we’re doing now with waste is putting forward our drivers’ firsthand concerns which represent the widespread problems across the industry.

‘For example our member who is an owner driver for a major waste company is now going bankrupt and cannot afford to maintain his vehicle or insurances - however he’s being pushed by the company to do the job regardless.

‘With the race to the bottom in costs pay and conditions there is pressure on companies to the extent that some can’t even maintain their vehicles - for example TPI which resulted in a person being killed in SA. Their vehicles were grounded Australia wide due to safety concerns re maintenance. In one QLD yard alone there were six vehicles defective and found to need work that put them off the road for one week.

‘There’s pressure on drivers to work long hours with second tier companies like JJ RIchards and Wastetrans doing second rate jobs at cheaper rates.

QLD Waste workers are taking a lead role in working with your TWU to drive the program forward this year in the RSRT as the Tribunal focuses on Waste.

Safe RatesYour TWU fought for Safe Rates for 20 years so that all truck drivers – both employee and owner drivers - are paid for every km, every hour and every cost.

In 2012 through the former Labor Government your TWU succeeded in getting the Australian Road Safety Remuneration Tribunal (RSRT) established: which is working towards Safe Rates across your various industry sectors including to date: general transport, Oil and Gas, Cash in Transit and this year, Waste.

Real progress is being made by the RSRT with the third work program underway this year.

The Liberal government under Tony Abbott launched an enquiry into the RSRT and the government has had the results for over one year. Why have they not released them?

Because they now know what you as Transport Workers have known all along: that the RSRT is backed by evidence as necessary to stop road deaths through proper pay and safety standards nationally legislated in the Transport Industry.

Your TWU is fighting to retain the RSRT.

Fatigue is a safety issue. ‘We have done mapping

which shows us that where there is a high incidence of accidents for a particular yard drivers are working longer hours.

‘Currently we are mapping all the waste sites in QLD to find out where the issues are in each

yard. For example at JJ Richards workers’ top issues are bullying, long hours and pressure to get the company’s productivity targets met.’► Got questions? Call your Organiser or Waste Industry Coordinator Craig Williams at your TWU on 3890 3066

Are you a HSR or Deputy HSR?

GOLD COAST EMPLOYERS are a special breed and your TWU is working with members to pull them into line.

Employers like the Southport bus company who make drivers work seven days straight with as little as five hours sleep each night.

Or the Currumbin trucking company who employ the bulk of their workforce as casuals to keep them from accessing any of the rights of permanent employees and to keep the company covered if they want to get rid of drivers.

And the Arundel freight company who thinks workers won’t notice they’re not getting their meal allowances or Superannuation; with members reporting one Superannuation payment in twelve months. This company can add to its resume intimidating a worker for having safety concerns about a load of dangerous goods

he was carrying, and directing a worker to drive a truck which he had safety concerns about then giving him a written warning for refusing. The QLD Transport Dept found defects on two of their trucks.

Your safety as a TWU member is not negotiable.► As a TWU member you are better off than non union workers. If you have issues at work, a dodgy boss or questions on your work rights you don’t need to go through Fair Work – instead you can call your TWU Delegate, Organiser or your TWU HQ on 1800 804 533.

Did you know that as a HSR or Deputy HSR: You legally have the right to training and

your employer must comply You have the right to choose your

TWU WOMEN marked International Women’s Day 2015 in March, with TWU Delegates taking part in IWD events including the Queensland Trucking Association IWD Breakfast (pictured).

Women in Transport spoke about their experiences and inspiration in the industry - including Narelle Dobson (Principal Engineer-Qld TMR), who has made it to the top of the transport industry as a pioneer in her field engineering some of Queensland’s major roads while bringing up four children. Narelle was your TWU’s pick for quote of the day, courtesy of Facebook COO Sheryl Sandberg: “I want every little girl who’s told she’s bossy to be told instead she has leadership skills.”

The Aviation Supply Chain Hub Organising Campaign, a template campaign in line with the Nationally agreed 2035 vision to establish 70% density in transport yards across Australia is growing from strength to strength. WORKERS at Cairns Airport have come together since the beginning of the campaign from all sectors and committed to taking a stand for a fair go in aviation. The campaign is working to ensure that their aviation jobs are: Full time, permanent jobs so we can

provide for our families Provide proper training and conditions

so we can stay safe on the job‘This has been a fantastic organising

experience to be a part of,’ Local Organiser Russell Vieritz said. ‘While we are aware that this is the test case everyone who has been involved has committed to giving it their all and we’re already seeing real results.’

Recent weeks has seen an Airport wide survey developed and rolled out with delegates taking a lead role in the process.

‘It’s been great to have so many resources in the area, Far North Queensland can get

forgotten by the South East Corner,’ Bluey Williams said. ‘This organising campaign is great because it’s really highlighting the similar issues we face even if we work for different companies and the ways we can organise to get some changes.’

The most recent phone conference was joined by 9 activists - including 2 female members - from 6 different companies. These activists discussed what activity

they had been engaged in which included gathering non-member contacts and recruiting new members with the activists endorsing the 4 weeks of on the ground activity that was planned for late March and through April.► Work at the Cairns Airport and want to get more involved? Race to the bottom“There are now a lot more competitor companies than there used to be including many small companies that never existed before,” Agnes said.

“They are pushing costs down to undercut on rates and get contracts - which impacts on what they are paying their drivers.

“In turn that impacts us because Toll can’t compete with the lower rates being tendered.

“The lower the rates companies are charging the less they can pay their drivers.”

Job security and a living wage“We don’t get guaranteed a rate like an employee driver does,” Agnes said. “If there is no work we don’t get paid.

“There may be no guarantee you’re going to get any work the next day.

“This also impacts on your ability to do the job if you have a family to look after.

“There’s no job security. If you work in the ad hoc fleet, you have to take the jobs you get to make ends meet and you can never guarantee where or when you’ll be working the next day.

In the distribution fleet runs are set but in our ad hoc fleet no jobs are guaranteed.

“In our industry companies can make or break you by controlling your hours or lack of and this industry is rife with bullying and discrimination.

“Some of our drivers are working 14 hour days, some are working very few. It can be a struggle for some drivers to earn a living wage - then you’ve got your own costs and overheads. We have to pay tax, maintenance, registration and fuel just to start - all the costs that go towards running your vehicle. For me these costs work out as two days pay each week. That means if you’re working a five day week you would be working almost half of that for nothing. If you work it out as hourly rate on average mine works out at $17 per hour.

“If you work for a smaller companies

doing jobs for less you’re going to get paid less and you still have the same overheads. I get regular services but you can see why a lot of drivers can’t afford to and the van isn’t attended to until it breaks down.”

Chicken coops, washing machines and monster sized TVs“These are just some of the things we end up with to deliver and unload,” Agnes said.

“You’d be surprised what people can buy on the net and we end up with it all! 44 gallon drums, hot water systems, air conditioners - the chicken coop was my favourite.

“One colleague got a washing machine to deliver, which was an authority to leave so there was no one there to help unload. She refused to take it on safety grounds.”

Unlike baggage handlers in the aviation industry, courier drivers have no enforceable OHS provisions in terms of limits on the weight they can safely lift. So if it is in the van - they’ve got to get it out.

“If you bring up these kinds of safety concerns to the company you can be knocked back with the line ‘if you want to do a man’s job do the job’,” Agnes said.

“To that I say both men and women should not have to lift unsafe loads - nobody should.

“Why don’t we have the same safety procedures for lifting as baggage handlers for example?

I know that we are never going to be guaranteed realistically that we won’t have items to transport over a certain weight but

when we do we need procedures to do it safely.”

Time to take the power back Agnes says the only way to fix the industry is for owner drivers from all companies to get together and take a whole of industry approach.

“If we don’t take the upper hand the companies will and they already are,” she said.

“One company has bought a fleet of vans and are now trying to flog them off to employee drivers to make them change into owner drivers pay off the van at $300 per week. By the time they have finished the van will have cost them $75,000 (5 years time). That is before their running expenses.

“They are also moving towards making their drivers use an app on their smartphones instead of scanners. They are that cheap. They shove all costs on the drivers.

“Other companies make their drivers wait unpaid at jobs when freight is not ready. This could be up to a three hour wait unpaid in which you can’t do any other jobs.

“What I say to any of these drivers reading this - do not put up with it. Let’s get together and make this industry fairer for all of us. We need to take the power back. The best and fastest way to do it is through a whole of industry approach, with all of us on board on our own owner driver committee.”

What can we do about it? Your TWU is pushing a case for minimum rates for owner drivers through the Road Safety Remuneration Tribunal.► Positions are now open for Owner Drivers in the Courier industry to step up as members of the committee. Please call Billy Berka on 0407 695 750 to indicate your interest or find out more.

TOUGH INDUSTRY NEEDS SOLIDARITY ACROSS ALL COMPANIES TO GET A FAIR DEALOn the Move talks to Delegate Agnes Green, a Courier Owner Driver who knows this tough industry inside out after eighteen years in it. Here’s the scoop in Agnes’s own words:

In our industry companies can make or break you by controlling your hours or lack of and this industry is rife with bullying and discrimination.

WITH OUR RIGHTS at work again under attack from the Abbott Government and employers, March 4 of this year saw people from across the community and across the country, coming together to say enough is enough.

With Abbott Government policies attacking our living standards hundreds of thousands of workers took to the streets to protest: cutting wages, conditions and our rights at work, slashing Medicare and hiking up the cost to see a doctor, introducing $100,000 university degrees, cutting the ABC and our public services, cutting the pension and superannuation, implementing harsh changes to unemployment benefits, and cutting community services that support our most vulnerable.

The action day also coincided with training for delegates from Australia Post and Star Track so when the lunch break rolled around participants opted for lunch on the go so they could take part in the rally.

‘It was great to be able to experience the Rally and join with members of other unions committed to standing up for our rights,’ Star Track Darra delegate Glen Summers said. ‘Being the shy type I was reluctant to get a photo with the new Premier but was pretty stoked when it made the next day’s paper.’► You can continue to stand up for your rights by joining your TWU at the next Rally - check out the www.facebook/TWUQLD!

THANK YOU to all TWU Women who told us about your issues at work in your first statewide QLD Women in Transport Survey. Survey results represent Women in Transport across all sectors of the transport industry from Aviation to General Transport, Waste and the Courier industry.

Your top issues at work were, in order of importance:

You said that you want the right to work and care for your family and the security of knowing your work will continue.

You ranked balancing work and family as your top issue however you have reported that employers are not even providing adequate notice for changing rosters let alone family friendly hours.

You said you want job security - but two thirds of you feel your job security is under threat.

Employers are not providing family friendly work rosters or guarantees of any kind on your hours or job security unless they

have to. As long as there is no EBA forcing them to make you permanent they will get away for keeping you casual for as long as they can.

This means the bosses get the flexibility without the responsibility: while you have the responsibility of caring for your family with no guarantee of hours to meet family commitments like school pickups, and no permanent guarantee of work.

Union strength is the keyUltimately what we are fighting for are work arrangements where you could have time with

your family and the money to take care of them with a permanent position that gave you job security and workable hours. We are realistic that this is a huge campaign and it is unlikely that we are going to achieve these things overnight – but the only way we are going to achieve these things is if we get organised now.

The fact is these things are not going to be handed out by the bosses or the government.

The only way you can get conditions like this is through union strength in your workplace and an EBA that you as TWU women have a say in.

The key factor is strength in numbers with these industrial

issues. Moving forward into the future the aim is for your TWU to help you to organise around these issues to address them in your workplace.

What next?TWU Women can call your TWU to register your expression of interest in opportunities for training to address these and other issues in your workplace.

Call us to get us to come to your workplace and help you organise around your key issues. ► Call Tanie or Sarah at your TWU on 1800 804 533 to register your interest or email [email protected]

GOT A JOKE TO TELL?

Two elderly women were out driving in a large car-both could barely see over the dashboard. As they were cruising along they came to an intersection. The stoplight was red but they just went on through. The woman in the passenger seat thought to herself “I must be losing it, I could have sworn we just went through a red light.”

After a few more minutes they came to another intersection and the light was red again and again they went right though. This time the woman in the passenger seat was almost sure that the light had been red but was really concerned that she was losing it. She was getting nervous and decided to pay very close attention to the road and the next intersection to see what was going on.

At the next intersection, sure enough, the light was definitely red and they went right through and she turned to the other woman and said, “Mildred! Did you know we just ran through three red lights in a row! You could have killed us!”

Mildred turned to her and said, “Oh, am I driving?”

A professional juggler, driving to his next performance, is stopped by the police.

“What are you doing with these matches and lighter fluid in your car?” asks the police officer.

“I’m a juggler and I juggle flaming torches in my act.”

“Oh yeah? Let’s see you do it,” says the officer.

So the juggler gets out and starts juggling the blazing torchesmasterfully.

A couple driving by slows down to watch. “Wow,” says the driver to his wife. “I’m glad I quit drinking. Look at the test they’re giving now!”

A college physics professor was explaining a particularly complicated concept to his class when a pre-med student interrupted him.

“Why do we have to learn this stuff?” the frustrated student blurted out. “To save lives,” the professor responded before continuing the lecture. A few minutes later the student spoke up again. “So how does physics save

lives?” The professor stared at the student without saying a word. “Physics saves lives,” he finally continued, “because it keeps the idiots out

of medical school.”

A man and his wife were having some problems at home and were giving each other the silent treatment.

Suddenly, the man realized that the next day, he would need his wife to wake him at 5:00 AM for an early morning business flight.

Not wanting to be the first to break the silence (and LOSE), he wrote on a piece of paper,

“Please wake me at 5:00 AM .” He left it where he knew she would find

it. The next morning, the man woke up, only to discover it was 9:00 AM and he had missed his flight.

Furious, he was about to go and see why his wife hadn’t wakened him, when he noticed a piece of paper by the bed. The paper said, “It is 5:00 AM. Wake up.”

WAKE UP!

TWUQLD HISTORY by BRADLEY BOWDEN ONTHEMOVE 25

IT WOULD be fair to say that Labor’s victory in the recent election was unexpected. That the Campbell Newman government was evicted after only 3 years clearly owes much to the arrogant missteps of Newman and many of his Ministers. But it also clearly owes much to the Labor Party’s hard core supporters in both the branches and the trade unions, where unions such as the TWU were well to the fore in bringing about Newman’s removal. With Newman gone, unionists can look forward to the rapid repeal of the previous government’s legislative changes, many of which – such as shifting Labor Day from May to October and denying workplace health and safety representatives the power to direct workers away from life-threatening safety threats – always appeared petty and vindictive in nature.

With Labor back in power it is tempting, however, to overlook Labor’s deep-seated electoral problems. This would be a mistake. Of the elections held in Queensland since 1906, when a divided party scored only 29.8% of the primary vote, Labor’s result in 2015 – when it scored 37.5% of the primary vote – is the worst bar three: 1974 (when 36% was obtained), 1957 (28.9% being secured) and 2012 (when 26.6% was obtained). Of the 3 results that have been worse than 2015, one – 1957 – can be partly discounted. For in this election, while only 28.9% voted for “official” Labor another 23.4% cast their vote in favour of the Vince Gair-led “Queensland Labor” which had broken ranks with Labor on the eve of the election.

From an historical perspective, the current situation in many ways most closely resembles that experienced by Labor between 1904 and 1910. At this time, as now, union density was well down from earlier peaks due to a combination of employer hostility and adverse economic circumstances. In these circumstances the dominant figure in Labor’s parliamentary ranks, William Kidston, a Rockhampton book seller, decided that Labor could only survive by appealing to middle-class voters. This required, in Kidston’s view, a distancing of Labor from its old union base. It also demanded an abandonment of many long-held Labor demands: increased state-ownership and control, protection of union representation and support for a centralised arbitration system.

Having gained control of Labor in 1904, Kidston entered into an alliance with “progressive” middle-class politicians led by Arthur Morgan. In the de-facto coalition government established by Morgan, Kidston became Treasurer. Two years later

he became Premier as well, holding the position (with a relative brief interruption in 1907-1908) until his retirement in 1911. There is no doubt that the Kidston “Lib-Lab” governments did good things. As is now largely forgotten, Kidston initiated Queensland’s first workers compensation system. He also introduced a system of Wages Boards that gave road transport workers their first regulated employment conditions – and a reduction in working hours to 56 per week. But having come to the belief that the political future lay in an appeal to middle-class voters, Kidston found himself on a slippery slope. Having first appealed to “progressive” middle-class politicians, by 1909 Kidston was also sharing common ground with conservative interests as well. By this time, Labor’s ranks had split with Kidston forming his own party; a party that easily outpolled Labor in the 1908 election.

In 1908, with Labor’s primary vote reduced to 29.8% - a result not surpassed on the downward side until 2012 – Kidston’s political choices seemed vindicated. However, as the unions recovered, so too did the official Labor Party. Kidston, meanwhile, found himself increasingly isolated amongst his new middle-class friends, being pushed out of the Premier’s job by the arch conservative, Robert Philp, in 1910.

If there is today, unlike 1908, no suggestion of a split in Labor’s ranks, there

are nevertheless many similarities between the situation prevailing now and that found in Kidston’s time. As is evident to all but the most political ignorant, Labor is again directing its appeal increasingly to middle-class voters (for whom global warming is the biggest issue), rather than towards life’s battlers. And while there is today no alternative Labor party, we are nevertheless witnessing a plethora of new parties – KAP, PUP, One Nation – most of whom attract votes from alienated Labor voters in regional electorates.

While as an historian (rather than a scientist) I am agnostic on global warming – there being periods both hotter and colder than now in the last 1000 years – the energy and industry policies pursued by federal and state Labor governments in recent years must nevertheless rank as the most socially inequitable seen in many a long decade. Under so-called renewable energy schemes, subsidies are given to the well-heeled to install solar panels on the roofs of their renovated houses in West End and St Lucia. Meanwhile, the battlers shiver in cold showers and go without so that they can pay the soaring power bills in their 1960s brick-units; units where the installation of solar panels is neither physically nor financially possible. In the end, however, as Kidston found out, pandering to the interests of the few at the expense of the many is not only bad policy it is also bad politics.

QUEENSLANDERS made a strong choice on 31 January to kick Campbell Newman out of his seat, kick the LNP out of office and elect a Labor government to put working people first rather than big business.

The QLD State election made Australian history with a record swing, taking Labor from just nine seats to the formation of government.

Newman and his mates tried to create a great divide in our state between wealthy and working people, attacked our public health, hospitals, community services and our kids at public schools. The LNP tried to rip the heart out of our state by sacking school nurses, closing public schools and hospitals and selling our assets.

The QLD union movement fought for the values that define us: A fair go for all, strong public health and education for all working families and our kids, investment in transport and infrastructure for our state and strong communities.

Ii is important to know that your TWU did not back a party but rather the candidates that

commit to standing up for your issues.

Your TWU represents you and your interests – at work and at home, a living wage and time with your families.

Together we have already achieved a victory for Transport Workers in QLD with MPs who have signed the TWU pledge to support Transport Workers on

key issues including Safe Rates and retaining the RSRT, fair contracts, pay and conditions for bus drivers and waste workers.

Your TWU will now hold this government to account on keeping Transport Workers’ interests at the top of their agenda and delivering for you, your mates and your family.

YOUR FUTUREWith landslide elections throwing the LNP out in QLD and in Victoria Abbott and his LNP keep a desperate hold on federal government and their anti-worker ideals.

Your penalty rates Big business want penalty rates reduced or gone - to them your time with your family, your weekends and your dinner at home are worth nothing.

The bosses now even say they don’t want Aussie workers but instead they want more 457 visas– like the restaurant owner who thinks even our kids on cheap labour cost too much.

Queenslanders give LNP the boot

Your kids’ education Under Abbott your kids’ uni education could cost up to $100,000. They fail to see anything wrong with the fact our kids will spend 20 years of their career paying back a debt the size of a good chunk of a deposit on their first home which will be put off as they can only afford to stay at home.

Your family’s healthThe LNP government is determined you will pay if you want to see the doctor. They will stop at nothing to make this happen whether through a GP tax or a more sneaky method which forces doctors to make you pay.

Doctors say preventative health will suffer most as people choose not to get diagnostic tests they can’t pay for, people don’t immunize their kids and the emergency departments get packed.

Not everybody loses out under the Libs – if you’re British royalty in the market for a knighthood or a rock dwelling hospitality boss who wants to take penalty rates away from local kids and hire 457’s, you get a great deal.

We continue the fight.

THE GLOVES are off and we’re ready for a fight. We have been busy putting together a response to a government plan to examine and change workplace laws – the Productivity Commission review. Our response has now been submitted and after hearings on the topic, a final report will be finished in November.

This review is of vital importance for every worker in Australia as it has the potential to affect how we live our lives.

Much focus has been put on possible lowering of the minimum wage and abolishing extra pay workers get for being away from their families on Sundays and bank holidays. But it will go further than that and could alter how workers bargain together for decent wages and conditions, what protections they have against unfair dismissal and how trade unions access their members, making it more difficult for employees to get independent information from unions effecting their voice at work.

These issues strike at the heart of achieving quality jobs and economic freedom for the community and individuals. They will determine whether working families can raise their children in a dignified way

rather than an environment where wages and conditions are rock bottom, casualisation is the norm and where there is constant pressure on the family budget. We all know part time casual jobs can’t pay for full time bills.

The main focus of our response is how these changes

would affect our members, so we want to hear from you. Let us know how you would be affected and what it would mean for your work, your colleagues and your family.

This process can be a positive one for us. It is galvanising workers to come together and say no to stripping away the

rights that their parents and grandparents fought long and hard for. It is pushing us to demand better conditions and not just defend what we have already. It is focusing our minds on our children because we are ready to fight to ensure we do not leave them with a harsher, poorer and less fair Australia.

The gloves are off and we’re ready!

FOR HUNDREDS OF YEARS Unions have benefited from the power of the collective. Workers from all industries, all walks of life have achieved incredible things by seizing the power of the many and using that power to affect positive change.

Right now there are about 6.5 million families in Australia and about 4.5 million children aged 0 to 14 years. There are 2.6 million coupled parents raising children and 1.5 million single parents raising families (16 per cent of which are single dads)

That’s a lot of people and a lot of power if organised right.

Introducing The Parenthood – Australia’s first organisation designed to give parents a voice on the issues that matter most to them and their families. Our mission is to advocate on behalf of Australian parents to bring about positive policy changes that improve the future for all children.

Although we do not align with any political party we’re a political organisation – we use political campaigning techniques to raise awareness around important issues, like health and education, to engage and build momentum for change and influence those who have the power to implement change.

We are a digital campaigning organisation. By generating engaging online content coupled with innovative use of sophisticated digital campaign

techniques – we build power and influence to bring about the change we want to see.

The Australian community is an incredibly diverse community, but one thing millions of us have in common is that we’re parents and for the vast majority of us all we want in life is for our children to grow up healthy, happy and

A quarrel had arisen between the Horse and the Stag, so the Horse came to a Hunter to ask his help to take revenge on the Stag. The Hunter agreed, but said: “If you desire to conquer the Stag, you must permit me to place this piece of iron between your jaws, so that I may guide you with these reins, and allow this saddle to be placed upon your back so that I may keep steady upon you as we follow after the enemy.” The Horse agreed to the conditions, and the Hunter soon saddled and bridled him. Then with the aid of the Hunter the Horse soon overcame the Stag, and said to the Hunter: “Now, get off, and remove those things from my mouth and back.”

“Not so fast, friend,” said the Hunter. “I have now got you under bit and spur, and prefer to keep you as you are at present.”Moral of the Tale: If you allow men to use you for your own purposes, they will use you for theirs.
