An application has been received by Urban & Environmental Management Inc. onbehalf 1746391 Ontario Inc. to amend the Town of Fort Erie Official Plan and ZoningBy-law to permit a motor speedway facility and accessory uses on 332 hectares (821acres). The subject lands are shown on Appendix "1".

The applicant has also submitted an application to amend the Regional Policy Plan.This report has been prepared in support of the September 8, 2009 joint Town andRegional Public Meeting to obtain comments from the public on the proposedAmendments.

Lll!5ii0se of the Ae,elication

The proposed "Canadian Motor Speedway complex" requires amendments to theRegional Policy Plan and to the Town of Fort Erie Official Plan and ComprehensiveZoning By-law 129-90. The complex includes:

• a 1.0 mile paved motor speedway oval and spectator grandstand (65,000seating capacity with seating expansion area of 25,000 to 35,000) with supportfacilities in the infield such as truck and RV parking, garages, first aid stations,fuel handling area, media centre, fan walk, maintenance and emergencycommand centre; and,

• a 2.5 mile paved motor speedway road course with support facilities such asgarages, concessions, merchandising,registration/meeting room, offices andpublic washrooms; and,

• a motocross/BMXlsnowmobile/rental kart centre speedway course locatingwithin the road course area; and,

• a 30 hectare (74 acre) accessory commercial complex which would includerestaurants, shopping (such as automotive related merchandising, prestigeretail, outlet mall), entertainment such as museums and galleries, movies/lMAX,rock climbing, fitness centre, themed park, mini putt, and a waterpark andmerchandising. The commercial areas also include a hotel with 100-250 suitesand an administration, merchandising and ticketing building required for productand ticket sales, operation and maintenance of the Canadian Motor Speedway;and,

• a parking and camping area on 71 hectares (175 acres) of land along thesouthwest corner of Gilmore and Laur Road; and

• a parking and camping area on 62 hectares (152 acres) of land south of BowenRoad and west of Laur Road;

• a 27 hectare (66 acre) "Innovation and Business Park" which would include avariety of motor sports-oriented businesses such as offices for trackmanagement, control tower, race support repair shops, driving schools anddriving experience, training and educational facilities related to research andtechnology including testing facilities for racing teams and manufacturers; and

INature of the Site I

The subject site is 332 hectares (821 acres) in size and is located in the agricultural area.The site is located southwest of the Bowen Road and QEW interchange. Miller Creek andFrenchman's Creek traverse the site in an east/west direction . The subject site is generallyflat and is surrounded by the following uses:

North: Bowen Road, Residential uses, Agricultural uses, wooded areasSouth: Agricultural lands, wooded areas, and residential usesEast: Queen Elizabeth Way, Auto Recycling Facility, WoodlandsWest: Livestock operation, Ridgemount Road, Quarry operation and agricultural

land

IPLANNING POLICY BACKGROUND I

Provincial Policy Statement

Approximately 79.61% of the subject lands is comprised of Prime Agricultural lands, whichare defined as specialty crop areas and Class 1, 2 and 3 soils. However, the majority of theprime agricultural land on the subject site is Class 3 soils which limits use to field cropssuch as corn, soy bean and hay without underdrainage. The remainder of the site is Class4-7 due to the shallowness of the bedrock in the area

The Provincial Policy Statement Section 2.3.5 permits the removal of land from primeagricultural areas for limited non-residential uses provided that:

1. the land does not comprise a specialty crop area;2. there is a demonstrated need within the planning horizon provided for in policy 1.1.2

for additional land to be designated to accommodate the proposed use;3. there are no reasonable alternative locations which avoid prime agricultural areas;

and4. there are no reasonable alternative locations in prime agricultural areas with lower

priority agricultural lands.

The Agricultural Impact Study submitted by Colville Consulting Inc. addresses the abovecriteria and Planning Staff will assess its findings in the future recommendation report.

Regional Policy Plan

The Regional Plan designates the property, as "Good General Agricultural Area" with"Environmental Protection", "Environmental Conservation" and "Fish Habitat" shown on theRegion's Core Natural Heritage Mapping. The proposed use is not permitted howeverPolicy 6.A.8 may permit non-agricultural uses in the Agricultural Area through a RegionalPolicy Plan Amendment. An application to amend the Regional Policy Plan to permit theCanadian Motor Speedway has been submitted and the proposal will be evaluated byRegional Planning Staff.

Existing Official Plan

The Town's Official Plan designates the majority of the subject site as "Agricultural" and theremainder of the site is designated "Extractive Industrial". In view of the existingdesignation, an amendment to the Town's Existing Official Plan is required. In consideringamendments to the Official Plan Council shall have regard to the criteria detailed in Section11 (8) of the Official Plan. Staff will examine these criteria in a future recommendationreport.

New Council Adopted Official Plan Designation

The Town's New Council Adopted Official Plan designates the site Agricultural,Extractive Industrial, Environmental Protection and Environmental Conservation. In view

of these designations an amendment is required to permit the proposed MotorSpeedway and associated uses.

Schedule C Natural Heritage Features Map shows Woodlands over 2 hectares, LocallySignificant Natural Area, Provincially Significant Wetland, Environmental SensitiveArea, and Corridors on the property.

Schedule D Cultural Heritage Archeological Zones of Potential identifies the subject site ashaving archeological potential. An Archeological Assessment has been submitted as partof the applicat ion.

Staff will examine the relevant policies of the New Counicl Adopted Official Plan in thefuture recommendation report.

Current Zoning

The majority of the subject property is zoned "Agricultural (A) Zone", "Hazard (H) Zone",and "Extractive Industrial (EI) Zone". An application to amend the Town of Fort Erie ZoningBy-law has been submitted to permit the proposed use.

ISTUDIES

SERVICING AND STORMWATER MANAGEMENT

The application proposes to extend both water and sewer services to the subject site. Thesanitary sewer system design includes a holding tank facility to mitigate peak sewagedischarge rates on a 24 hour basis during major race events.

To address storm drainage the Stormwater Management Report concluded that postdevelopment flows will be handled on site via stormwater management system (ponds,Miller Creek, storm sewers etc.)

AGRICULTURAL IMPACT STUDY

As previously noted the Agricultural Impact Study assessed the agricultural resources, theagricultural policies, land uses, cropping patterns in the study area, agriculturalinvestments , and the potential conflicts with surrounding agricultural operations.

The study determines that:

• The majority of the subject site consists of CLI Class 3 soils, which is the lowestpriority of all the prime agricultural land.

• The site does not posses a climate suitable for specialty crops and it is not in aUnique Agricultural Area.

• The study area contains three livestock operations , fifteen hobby farms, onegreenhouse, and nine retired farm operations.

• Agriculture in this area appears to be in decline as there are nine retired farmingoperations.

• There is very little investment in agriculture within the boundaries of the subject site.• The alternative site would not be a suitable location for the proposed development

as a result of its small land base, the number of sensitive receptors in closeproximity to the site and site servicing costs.

• A number of impacts could result such as traffic, littering, trespassing, vandalism,the disruption of farm operations, and noise.

• The recommended mitigation measure will assist in minimizing the potentialconflicts.

ENVIRONMENTAL IMPACT STUDY

The Environmental Impact Study evaluates the natural heritage features on and adjacentto the subject site and assesses the impact the proposed development will have on thefeatures and functions of the natural heritage areas. The study concludes that the subjectsite has been designed to avoid and/or minimize the impacts on the identified naturalheritage features.

However, the realignment of Miller Creek will result in the alteration, disruption and/ordestruction of fish habitat and the study recommends a number of mitigative measures toaddress surface hydrology and hydrogeology, sediment and erosion control, tree saving onthe site, the enhancement of fish and riparian habitat, the enhancement of the naturalheritage features on site, the amount of litter on and off the site, ecological monitoring andnatural heritage education.

NOISE

The Detailed Noise Control Study examines typical daily operation scenarios anddetermined that the most prevailing operational scenario involves 6 cars to runsimultaneously either on the oval track or the Road Course and the results are detailedbelow:

The noise levels will increase by 4 dBA at all receptors for driver training days where up to15 cars may use the oval or road course, by 8dBA for event days where up to 43 cars mayuse the oval track and 40 may use the road course and by 6dBA for practice days beforethe main event where 20 to 25 cars may practice on the oval or road course.

Below is the Ministry of the Environment's Standards for Stationary Noise. The consultanthas classified the majority of the property Class 2 Area.

Based on the above information, the noise consultant concludes that there will be a noiseimpact with or without attenuation on the 6 residences surrounding the Speedway Facility.However, when looking at the noise impact on the majority of the residences to the souththe report concludes that:

• Unattenuated sound levels will be significant for daytime and evening events;• There is a need to provide effective noise barriers, and/or other noise control

measures; and• With the incorporation of noise control measures, as detailed in the study, it is

possible to be consistent with the MOE standards during the daytime for all theidentified operational scenarios. During the evening there will still be significant tovery significant noise impacts during the major 'event days'.

The noise study also examined the existing noise from traffic in the area and the noisefrom mechanical equipment on RV, trailers and mobile homes.

The Region is responsible for reviewing noise and vibration impacts from race events. TheRegion has recently requested that a peer review be conducted on the Detailed NoiseControl Study.

TRAFFIC

The Traffic Impact Assessment examined the traffic impact associated with a major/featurerace event at the Canadian Motor Speedway. The report determines that in 2012(estimated project opening), in 2017 and in 2022 capacity deficiencies and unacceptableoperating conditions will result at a number of key intersections.

The Preliminary Traffic Impact Assessment recommends nine traffic signal control andintersection improvements. In addition , a number of roadways in and around the subjectproperty will be upgraded to either three or five lanes.

The Traffic Impact Assessment concluded that "the recommended infrastructure and trafficcontrol improvements can effectively mitigate the traffic impacts arising from amajor/feature race event at the proposed development. Theses physical improvements willneed to be supplemented with a special events traffic management plan to manage peakinbound and outbound traffic flows. The goal is to ensure the facility can discharge withinthree hours following the completion of a majorlfeature race event."

PARKING

On site parking facilities will include both public and VIP parking areas. The proposalincludes a grass parking lot south of Bowen Road west of Laur Road designed toaccommodate 12,200 vehicles, a grass parking lot south of Gilmore Road to accommodate10,200 vehicles, and a grass parking area north of Bertie Street to accommodate 3,700vehicles. A VIP and motorcoach parking area is to be located at the southeast corner ofBridge Street and Laur Road, which would accommodate 1,000 vehicles.

ECONOMIC IMPACT STUDY

The Economic Impact Study concluded that a new 65,000 seat capacity speedway facilitythat hosts 3 major race weekends and 5 minor race events per year will create economicbenefits from a Regional perspective ranging from $195.8 million to $217.8 million and$163.6 million to $183.0 million from a Provincial perspective. The economic benefitestimates include direct, indirect and induced impacts. The indirect impacts are the resultof the local economy respending the direct expenses and induced impacts are thoseresulting from the spending of employee earnings.

In addition, it is estimated to support 900-1350 new jobs Provincially and 850-1075Regionally.

The construction phase of the development will also generate a one time economic benefitand will generate a total direct, indirect and induced impact of $295 million. It will support2,400 jobs and $90 million in labour.

ARCHEOLOGICAL ASSESSMENT

A Phase 1 Archeological Assessment determined that there were no sites registered withinthe limits of the subject property but 32 sites have been registered within a one kilometerradius. The study recommended that a Phase 2 assessment be conducted on the subjectsite.

OTHER STUDIES

The applicant is currently working on a market impact analysis study to be submitted toboth the Town and the Region in the near future.

All costs associated with processing the application and the development of the property isthe responsibility of the owner.

IPolicies Affecting Proposal I

Notification of the September 8, 2009 Public Meeting was provided in accordance with therequirements of the Planning Act by placing a Notice in the August 8, 2009 edition of TheTimes newspaper. In addition, property owners within 120 metres were mailed a Notice ofMeeting on August 7,2009.

Land use policies for the subject lands are contained in the Official Plan as well as theapplicable Regional and Provincial Regulations.

IComments from Relevant Departments/Community and Corporate Partners

The application for Official Plan and Zoning By-law Amendment were circulated to relevantDepartments/Community and Corporate Partners on May 5,2009.

Agency Comments

Agency comments have been summarized below. Full copies of the comments areattached as Appendix 3.

Niagara Peninsula Conservation Authority (NPCA) Comments

The NPCA has concerns with the racetrack bridge crossing overthe Provincially SignificantWetland and the long term/cumulative effects of the track on the PSW proposed to formthe infield of the road circuit. The Environmental Impact Study (EIS) does not adequatelyaddress long term or cumulative impacts from the development of the motor speedway andits associated campground facilities. The NPCA also has concerns relating to the noiseimpacts on wildlife.

The NPCA reviewed Stormwater Management and has no objection to the proposal to treatall stormwater runoff however has requested additional design details.

The NPCA also reviews the EIS on behalf of the Region based on their applicableenvironmental policies and they have noted some concerns with the bridge span, impactson the core natural heritage system, and the realignment of Miller's Creek.

Ministry of Transportation Comments

The Ministry has requested a revised detailed Stormwater Management Report and TrafficImpact Study be submitted for review and approval and should be based on the detailedinformation requested and the Ministry's guidelines.

No objections to the Zoning and Official Plan Amendment however there are manyoutstanding concerns that will have to be addressed prior to final approval such as ingressand egress routes for the public and for emergency equipment, information on how theywill provide adequate firefighting water supply , details regarding onsite fire protection oremergency services equipment and a public safety plan.

Environmental Advisory Committee Comments

The Committee acknowledges that the development has generally attempted to workaround natural heritage vegetative features from a design perspective but has seriousconcerns about impact on wildlife (faunal species) in general, particularly regarding theimpact of noise on wildlife. Examples include noise impacts on breeding birds, easternmilk snake, flying squirrels and other wildlife . To this end the Committee recommendsthat the NPCA have the EIS peer-reviewed with respect to the development's impactson wildlife (faunal species).

The Committee would also like to see a bio-inventory of the creek portion west of theQEW completed prior to its relocation and a woodland management plan.

The Committee also has concerns regarding the proposed span bridge over the wetlandand the impact of significant run-off from a development of this magnitude to the creeksand groundwater, because of the broad landscape disturbance.

Public Comments

The letters received from the public are summarized below. The original letters have beenattached as Appendix 4.

Michael and Bridget Racey -1640 Sunset Drive

The Racey's have recently built a new home on 5.2 acres of land adjacent to the subjectproperty. They object to the proposed development as it will result in:

• Loss of property enjoyment• Noise impacts• Vibration damage• Traffic• Odour and Pollution• Adverse affect on health

Richard and Carol Jukosky-2242 Gilmore Road

The Jukosky's have a thoroughbred race horse farm located directly across from thecampground and parking lot along Gilmore Road. They object to the proposeddevelopment as will result in:

• Increased noise levels not only on the track but from the campers.• A loss of vegetation as a result of road improvements.• Increased traffic• The destruction of a bird nesting haven• Impacts from the campground and parking area for 13, 950 vehicles on our

horses, our home and us.• Loss of their main income as a result of not being able to keep horses on their

property.• Trespassing and vandalism will become an issue.• Tailgate parties at the camping and parking area.• Loss of personal security• Loss in property value

Ralph Suk-2440 Sunset Drive

Mr. Suk had some posed some questions to UEM Consulting relating to the localbenefits of the project. He also had some concerns and questions regarding thefollowing:

Informal Public Meeting

An Informal Public Meeting was held by the applicant's development team on June 4,2009in the Lesuireplex Banquet Hall. The main issues raised were noise, dust, vibration,pollution/air quality, traffic, carbon factors for greenhouse operations, destruction offarmland, tree removal and impacts of the relocation of Miller Creek. A number of positive

comments were also received which include job creation, community building, allow youngpeople to stay in the community, increase in tax base, and economic benefits and spin offs.A copy of the comment sheets and correspondence have been attached as Appendix 5.

Planning Staff will address the issues raised at the informal and formal Public Meeting inthe future recommendation report to Council.

IAlternatives

The Agricultural Impact Study submitted with the application examined alternative sitesbased on the following specific criteria:

• Must be close to a 400 series highway;• Must be visible from the highway;• Must be close to municipal services;• Must have adequate area upon which the development can be situated; and• Must minimize the number of neighbouring sensitive receptors.

Only one other potential site was identified in Niagara Falls. This site only met 3 out of the5 criteria and the Agricultural Impact Study concluded that the alternative site would not bea suitable location for the proposed development as a result of its small land base, thenumber of sensitive receptors in close proximity to the site and site servicing costs.

The Fire Department has no objections to the application for an official plan and zoning by­law amendment to permit a Canadian Speedway facility , but does provide the followingcomments as in my letter of January 2, 2008:

Assuming all zoning issues are cleared, there are many outstanding concerns that willrequire answers before final approvals are granted:

1. Access and egress routes for the public.2. Access and egress to and from the site [or emergency equipment.3. Provide information on how they will provide an adequate firefighting water supply, as

this area is not serviced at present.4 . Detail any on site fire protection or emergency services equipment and requirements .

• Sprinkler systems, high flow water supplies , etc• Potential emergency services building/operational area

5 . A Public Safety Plan for the management of a large crowd will be necessary to addressall and any actions required in the event of an emergency. The plants) will be requiredto detail the response to any of the various events that could be held there from racingto concerts or more.

There are many other issues that will be addressed during the site and building planphases , but the above are integral to the initial planning.

A detailed storm-water management report should be submitted to the ministry for review and approved. Amongother things the report should include a grading plan, a table showing the water levels and peak flows at allstream crossings of the QEW.

The detalled report should also show the stage storage and discharge curves for each of the ponds.

TrafficA detailed traffic impact study should be provided with analysis of the existing traffic, full build out traffic, andanalysis of the 5 & 10 year horizons after ' build-out'. The recommendations of the report appear insufficient asthe scope of the proposed fa cility has the potential to significanrly alter traffic patterns and trigger significantroad network and geometric improvements.

The report should comprehensively assess, evaluate and report the extent ofth e network and geometricimprovements required as a result of the development.

Conservation Authority staff have reviewed the above noted application for Zoning By-law and Official Planamendment and offer the following comments and observations.

The applications propose to re-zone and re-designate the lands to Special Policy Area with associated sitespecific zoning to enable development of a motor speedway facility . The proposal includes a 1.6km pavedoval racetrack with grandstand and support facilities; a 4km paved road course with support facilities; amotocross/BMX/snowmobile/rental kart centre course; a commercial complex, a recreation and campingarea; and a research and technology park . The site is comprised of 332 hal 821ac of land. A concurrentRegional Policy Plan Amendment (RPPA 3-2009) has been filed as well.

The NPCA's review responsibilities relate to: Natural Hazards under the Provincial Policy Statement;wetlands and watercourses under Ontario Regulation 155/06; impact on watercourses including fisheriesreview in accordance with our Department of Fisheries and Oceans (DFO) Level II Agreement; and stormwater management and natural heritage review on behalf of the Region of Niagara in accordance with theexisting Memorandum of Understanding (MOU). The Authority's review responsibilities are administeredthrough our "Regulation of Development. Interference with Wetlands and Alterat ions to Shorelines andWatercourses" (0. Reg. 155/06) . Reference is also made to the March 2008 Fort Erie Creeks WatershedPlan commissioned by the NPCA. The following comments are made in this context.

1) Environmental Review Comments:

Subsequentto our reviewof the Environmental ImpactStudyprepared by Colville Consulting (February 2009) and a recentsite inspection, the following comments are offered.

The NPCA has concernswith respect to the proposed race track bridge crossingover the ProvinciallySignificantWetland andits non- conformanceto our regulation and policy. NPCA staff do not concurwith the reportsreference to these lands as a"hedgerow"and "not characteristic of a wetland". Additional concerns relateto the negative long term/cumulative effectsofthe track on the PSW proposed to form the "infield" of the road circuit. The EIS does not adequately address long term orcumulative impacts from the development of the motor speedway and its associatedcampgrounds and facilities.

With respect to noise, NPCA staff do not concur with the reports conclusionsrespecting the impact on wildlife, especially thelong term/cumulative impact. The SS Wilson Associates Noise Study submittedwith the application does not address naturaheritage impact, other than to reference the wetlands and woodlots as "noise buffers". Wildlife species have varying toleranceto noise levels which should be evaluated and appropriately addressed in the report. It would be beneficial for theEnvironmental Consultant and Noise Study Consultantto collaborate in this respect. With respectto Species at Risk, theMNR provided a list of species at risk known to have occurredwithin a certaindistance of the development. More clarity isrequired regarding whether attempts were made to locate these species specifically.

2) Storm Water Management Review:

The following comments pertain to the NPCA's review of the 'Functional Stormwater Management Repot! ­Canadian Motor Speedway Development' (dated February 2009) , by Philips Engineering , as submitted insupport of the race track development proposal.

Based on our review, the NPCA offers the following comments:

1) The NPCA has no objection to the proposal to attenuate all post development peak stormwaterflows to pre-development levels for up to and including the 100 year return period design stormevent prior to discharge from the site.

2) The NPCA has no objection to the proposal to treat all stormwater runoff to an Enhancedstandard prior to discharge into the adjacent watercourses.

3) The NPCA will require that all stormwater runoff from the 25mm design storm event becaptured and detained for a period of 24 hours in order to mit igate the impacts of erosion in thereceiving watercourses.

4) The NPCA has no objection the concept of relocating Miller Creek. The NPCA will require thatthe detailed design incorporate the principals of Natural Channel Design. Prior to thewatercourse relocation, the NPCA will require that permits be obtained pursuant to theConservation Authority's Act and the federal Fisheries Act. As a note, it is our understandingthat this portion of Miller Creek is a Municipal Dra in as defined in the Drainage Act. Thedeveloper should contact the Drainage Superintendant for the Town of Fort Erie directly foradditional advice respecting any proposed watercourse alteration.

5) The NPCA has no objection to the proposal to relocate the Miller Creek regulatory 100 yearfloodplain. Prior to the floodplain relocation, the NPCA will require that approval be obtainedfrom this office.

6) From a hydrogeological perspective, the NPCA notes that the Philips SWM report has identifiedthis site as being located within an area characterized as having 'shallow intrinsic susceptibility'as a result of limited soil cover over bedrock. The NPCA further notes that the area isdes ignated as being a 'High Recharge Zone' . As such , the NPCA will require that the sitedesign adequately address the issues associated with these hydrogeological classifications toensure no negative impact on the water table. This may requ ire completion of a separatehydrogeological study. Given that this may impact the site layout (ie : land use), thisinvestigation work should be completed prior to any formal approval of the ZBA/OPAlRPPA

7) Prior to construction, the NPCA will require that detailed grading , storm servicing , stormwatermanagement, construction sediment control , and landscape drawings be circulated to thisoffice for review and approval.

3) Regional Niagara Natural Heritage Comments:

In accordance with the Memorandum of Understanding between the Region and the Niagara PeninsulaConservation Authority (NPCA), Regional staff has reviewed the proposed applications and has providedthe following Provincial and Regional comments from a natural heritage perspective (Regional Policy Plan).

The speedway lands contain a number of environmental features which may constrain the amount ofavailable space for the proposed development. The Region's Core Natural Heritage Map shows anEnvironmental Protection Area, Environmental Conservation Area, and Fish Habitat on the property with aPotential Natural Heritage Corridor located to the immediate south of the site's southerly propertyboundary. The Environmental Conservation Area represents a woodlot which also contains anEnvironmental Protection Area identified as a Provincially Significant Wetland. In addition, Miller Creekidentified as fish habitat bisects the eastern half of the speedway property.

Environmental Protection Area

Within an Environmental Protection Areas (PSW) (Policy 7.8.1.10) development and site alteration shallnot be permitted except for the following:

a) forest , fish and wildlife management;b) conservat ion and flood or erosion control projects where it has been demonstrated that they are

necessary in the public interest and other alternatives are not available; andc) small scale, passive recreational uses and accessory uses such as trails, boardwalks, footbridges,

fences, docks and picnic facilities that will have no significant negative impact on natural features orecological functions of the Core Natural Heritage System.

With respect to the proposed bridge span for the road course over the Provincially Significant Wetland , it isevident that neither Provincial nor Regional policy would support this. The bridge's construction may entailthe placement of pilings in or adjacent to the PSW and may involve a change in grading.

Environmental Conservation Area and Lands Adjacent to an Environmental Protection and EnvironmentalConservation Area

Development and site alteration may be permitted within an Environmental Conservation Area (Policy7.8.1.11), or on lands adjacent to an Environmental Protection Area and Environmental ConservationArea , if it has been demonstrated that there will be no significant negative impact on the Core NaturalHeritage System component or adjacent lands. As discussed herein under the "1) Environmental ReviewComments" section , the NPCA has concerns with the proposals conformity to these polices .

Potential Natural Heritage Corridor

Where development or site alteration is proposed in or near a Potential Natural Heritage Corridor, (Policy7:8 .1 .12) the Corridor shall be considered in the development review process. Development should belocated, designed and constructed to maintain and, where possible enhance the ecological functions of theCorridor .

Fish Habitat

Miller's Creek has been identified as a Critical (Type I) fish habitat which the applicant has requested torealign. Development and site alteration may be permitted on lands adjacent to fish habitat (Policy7.8 .1.15) provided there is no net loss of the productive capac ity of fish habitat as determined by theDepartment of Fisheries and Oceans or it's designate. The NPCA will ensure conformance of the re­alignment proposal through our permit process.

A naturally vegetated buffer zone, a minimum 30 metres in width as measured from the stable top of bank,shall be required adjacent to Critical Fish Habitat. A narrower buffer may be considered where anEnvironmental Impact Study (EIS) has demonstrated that it will not harm fish or fish habitat, but in no caseshall the buffer adjacent to Critical Fish Habitat be less than 15 metres. The vegetative buffer shall bezoned and designated to proh ibit development and site alteration .

4) Summary:

Conservation Authority staff recognize the unique nature of th is proposed development and the challenges posedby the scale involved . The proposed realignment of Miller Creek with natural channel design and plannednaturalized enhancement of the buffer corridor are significant positive contributions to the natural heritagefeature. However, as stated herein , the NPCA has serious concerns with respect to the proposed race track bridgecrossing over the Provincially Significant Wetland and its non-conformance to our regulation/policy. NPCA staff do not concuwith the EIS reports reference to these lands as a "hedgerow "and "notcharacteristic of a wetland'. Encroachment of thetrack within and adjacent to the PSW is not consistent with Provincial Policy. Additional concems relate to the negative longterm/cumulative effects on the PSW. The EIS consistently refers to "no netnegative impact' on the natural features.However, the Provincial Policy Statement clearly sets out a standard of "no negative impacf'. It is this standard that thedevelopment is held to during our review. The EIS and recommended mitigation measures do not adequately address longterm or cumulative impacts from the development of the motor speedway and its associated campgrounds and facilities interms of "no negative impact". With respect to noise, NPCA staff do not concur with the reports conclusions respecting theimpact on wildlife, especially the long term/cumulative impact.

The NPCA recommend that the proponent amend the layout of the road circuit portion to avoid the wetland features. Wewould encourage further consultation with the proponent and his consultants to resolve the issues noted herein in order tomove forward with a more compatible development proposal.

On. with our three children. We purchased our rural property of approximately 5.2 acres of land andbuilt our new home on it only four years ago. We chose this location because itis rural, peaceful,convenient and the ideal location for us to reside.

Now, only tour years after building our dream home we have come to lind out that there is apossibility of a Canadian Motor Speedway Facility to be built on all of the property surrounding ourproperty. Our home would be right in the middle of this facility and the thought of that is quitedisturbing.

We are writing this letter, not only to inform you of our concerns but hope that you agree with ourconcerns and do not allow this Canadian Motor Speedway Facility to be built on the propertysurrounding our home. We believe rezoning the current agricultural properties would be a great mistakefor the following reasons.LOSS OF ENJOYMENT OF NORMAL USE OF PROPERTYNOISE HARMFUL TO OUR HEALTHVIBRATIONS TO OUR HOME

We can only imagine how much noise this speedway would produce. Not just the vehicles racing buteverything else this facility plans to include. Our home was not built to be soundproof from such afacility. What damage will be done to our home caused by the continuous vibrations of vehicles racingand who will be responsible for the damages? Sit outside and enjoy a quiet day or evening with aspeedway facility surrounding our home? How could this happen?TRAFFIC - BEING ABLE TO GAIN ACCESS TO AND FROM OUR HOME

With entrances and exits for the speedway facility being at both Bowen Rd. and Gilmore Rd. howlong would we or our company have to wait in traffic for to get to and from our home with this facilitysurrounding us? it should not take us any longer to get to our home then it does you to yours. After allwe are going to our residence, not to the races.ODORS AND POLLUTION

This speedway would produce a lot of odor and pollution that we do not want to live with. We are sureyou would agree with us that there are a lot of health risks 101' our family and our pets living in thecenter of this facility.ADVERSE AFFECT ON HEALTH FOR OUR FAMILY MEMBERS AND PETS

We believe the sound levels, odors, traffic and noise would not be acceptable. This would not enhanceour way of life it would decrease our way oflife.

This is in response to the request for comment for the above mentioned project. I am the owner andresident at the address stated below, approximately 1 mile north ~i!J of the proposed speedwaydevelopment area.

Taking into consideration our community is dependent upon growth and therefore change I wonder;is this project beneficial to all ofFort Erie or just a small percentage? Would small town Fort Erie besacrificedfor this huge project?

As a property owner I am afraid of the negative impact on my current serene natural setting and howthis project may impact my daily enjoyment of it.

With this in mind I would like to raise my concerns and would like the following issues be addressed.

My concerns and questions are as follows:

I) If the proposed raceway is approved, would we be subjected to excessive exhaust noise?

2) What noise standards are in place to protect us from unwanted "noise" and would the speedwaybe bound by them?

3) Is it true that the speedway project has already lobbied the Town of Fort Erie to adopt moreliberal noise standards to accommodate the speedway?

4) How many major events are anticipated to be held annually? Will it be every weekend in thesummer?

7) Will the close proximity of the speedway negatively compromise my property value?

8) How will air quality be affected by this project - racing and from spectator transportation?

9) Is this environmentally the right thing to be doing? As a society should we not be encouragingand getting behind projects that reduce our environmental "Footprint"?

10)Is there a website or hard copy of plans open to the public for viewing?

The developers an d planners were sophisticated in advocating for the implementation ofthis project and acting as hosts for the evening.

I continue to have concerns about the impact of this initiative on the quality of life forthe residents of the Town of Fort Erie. Those concerns are:

1. lack of an air quality assessment that includes the vehicle emissions from thevehicles used at the speedway as well as the vehicles of proposed attendeescombined with the emissions of vehicles waiting at the Peace Bridge. I would expectthat any assessment also considers that Fort Erie is downwind of Nanticoke, thelargest coal fired power plant in Ontario and considered the worst polluter which isexpected to stay open longer than the original closure date of 2009. OD

2. lack of a traffic management plan that includes the impact of the Peace Bridge3. lack of clarity about the noise mitigation techniques to be applied, particularly

regarding the suggestion in the proposal that the municipal by law be changed toaccommodate the noise level. I had 3 different responses to this issue from 3 ofthe proponents - denial that it wasn't in the proposal, dismissal that this wassomething normally required and no difficulty for the municipality and lastly thatthe by law change would increase the noise requirement and better protect theresidents for the harm of noise. I would appreciate knowing what is the current bylaw in Fort Erie and how does it compare to other municipalities.

4. the business case for this project seems to lack the detail and clarity that isneeded to determine the efficacy of the investment

1. no clear and detailed identification of the cost benefit analysis to the Town ofFort Erie - how many jobs, what type of jobs, what salary level are these jobs,are these seasonal jobs?

2. What is impact of the variable of competing markets of Mosport and WatkinsGlen - both speedways within the same market area? I would expect to see ademonstration of the veracity of the attendance projections based onverifiable evidence.

5. lack of clarity about the cost to the tax payer for the infra structure to be broughtto the site - I understand that the province will be requested to participate in thiscost. I pay provincial and federal tax as well as municipal. What is the size of therequest that will go to the province? Could you tell me how this request will bemade? What is the process? Does the municipality support the request?
