Ed Cook, Deputy Building Inspector The Pledge of Allegiance to the Flag was led by Charlotte Madigan, Town Clerk * * * Chief Nulty spoke of the loss of Mary Miggins. He discussed the importance of her work and her dedication to her job. She was a wife, a mother and a grandmother. Chief Nulty spoke of her loss to the community because of her dedication. Chief Nulty introduced Michael A. Boysa, James K. Kelly and Christopher J. Tiemey as new Police Officers. Charlott e Madigan swore in the new Police Officers. Th e Town Board spoke of the process of hiring these officers and wished them well. ANNOUNCEMENTS Supervisor Kleiner announced that three (3) recreation proposals and sixteen (16 ) pool proposals were received. A t this time the Town Board and other department heads are working through the proposals. H e mentioned that he spoke with staff members from the Nyack Center, Martin L. King Center and other centers as to what these centers faced during the building process. Last week Congressman Engel and other state representatives had a meeting about Indian's Point evacuation plan. Th e meeting took place before FEMA came out and said they have outstanding issues with the evacuation plan. Electe d Officials say the metropolitan area is closer to Indian Point then any other power plant and the Elected Officials wish the State would take that into consideration. PUBLIC PORTION Eileen Larkin, Palisades questioned Rockland Psychiatric Center property spoke on housing, zone changes and the Recreation Center. Wil l the Pearl River Theatre be a burden on the Town? Nat Wasserstein, Pearl River, Pearl River Chamber of Commerce spoke regarding the Pearl River Theatre as to the development and merits. Wil l this burden the decision of the Rockland Psychiatric Center proposal. Adam Lipson, Pearl River also spoke regarding price and the cost of refurbishing and has concerns regarding the retaining rights to this building, 49 year lease and the effect it will have in the future of Town (if the entire structure should be given to the Town). Trish Moran, Pearl River spoke about an editorial page correction in the Our Town newspaper, (density, conditions and Rockland Psychiatric Center process). FEBRUARY 24, 2003

The Regular Town Board Meeting was opened at 7:37 P.M. Superviso r Kleiner presided. Th e Town Clerk called the Roll. Presen t were:

* * * Chief Nulty spoke of the loss of Mary Miggins. He discussed the importance of her work and her dedication to her job. She was a wife, a mother and a grandmother. Chief Nulty spoke of her loss to the community because of her dedication.

Chief Nulty introduced Michael A. Boysa, James K. Kelly and Christopher J. Tiemey as new Police Officers. Charlott e Madigan swore in the new Police Officers. Th e Town Board spoke of the process of hiring these officers and wished them well.

Supervisor Kleiner announced that three (3) recreation proposals and sixteen (16) pool proposals were received. A t this time the Town Board and other department heads are working through the proposals. H e mentioned that he spoke with staff members from the Nyack Center, Martin L. responded that there would be a public meeting not a public hearing before any development starts. Greg McGee, Pear l Rive r spoke about the need for a recreation center, h e i s in favo r of movie theatre and leeiy about a 6,000 seat stadium. Brian Miller , Pearl River , questioned whether the Theatre would be fo r movies or stage with lin e shows which would bring in people for the restaurants. Howeve r costs would be substantially different fo r a live Theatre. Andrew Wiley, Pear l River , questioned when breakdowns of the STEJ proposal ar e availabl e for public viewing . Stu Comery, Pear l River , read letter from the Hockey Association regarding lac k of ice space and the need to move forward in obtainin g more ice/property/time and agains t a 6,000-seat stadium. Donald Brenner, Orangeburg spoke about the Pear l Rive r Theatre and on 2/14/03 a t the proposa l opening all materia l was not opened (price proposals) and 12/20/0 2 lette r requesting exempt of certain documents . H e questioned i f all proposal s included all information , whic h was requested. Betsy Brenner, Orangeburg , spoke about the People's Counse l Meeting regarding the Pearl Rive r Theatre structure was in excellent condition, only cosmetic (paint , some wallboard) needs to be done and bathrooms need to be handicap accessible. Janet Hoffman, Blauvelt , spoke about the railroad and noise situations and that Ramapo has a TIP number to call regarding drug abuse problems and this i s needed in Orangetown a s wel l a s nationwide.

(RIVER) FREIGHT RAIL LINE WITfflN ROCKLAN D COUNTY , AN D URGIN G THE FEDERAL RAILROAD ADMINISTRATION TO MAKE FINAL THEIR PROPOSE D RULEMAKIN G ON THE

USE OF LOCOMOTIVE HORNS A T fflGITWAY RAIL GRADE CROSSINGS S O THAT COMMUNITIES MAY ESTABLISH QUIET ZONES A S PERMITTE D IN THE RULEMAKING.

WHEREAS, CSX Railroad and Norfolk Southern Railroad acquired Conrail i n 1999 ; and

WHEREAS, freigh t rail traffi c on CSX' s West Shore (River) Line since the takeove r has dramatically and quickly increased more than 200% - from 1 7 to 52 trains per day; and

WHEREAS, federal and state regulations currently require all train s to sound their horns up to 1 mil e before approaching and at each grade crossing; an d

WHEREAS, resident s in th e Town of Orangetown hav e been adversel y affected by the overwhelming noise pollution resulting from th e increased number of train hom s soundin g a t and before grade crossings in thei r communities; and

WHEREAS, CSX is expected to increase it s freight rail traffi c on the West Shore (River) Line; and

WHEREAS, a Quiet Zone i n thi s rai l conido r will allo w fo r the effective elimination o f train hom s an d thus provide much neede d relief to the thousands o f residents deeply affected by current freigh t train operations; and

WHEREAS, the supplemental safet y measures tha t wil l b e installed as part of the Quiet Zone will virtually eliminate any safety risk to motorist s and pedestrians currently associated with railroad grade crossings; and

WHEREAS, the Town of Orangetown, expresses its desire and intent to cooperate fully with the state and federal rai l authoritie s an d with th e CSX Coiporation t o effectively establish a train hor n Quie t Zone on the West Shore (River) Line.

THEREFORE, BE IT RESOLVED:

That the Town o f Orangetown hereb y urges the Federal Railroa d Administration t o finalize , implement and adopt the Proposed Rulemaking on th e us e of Locomotive Horns a t Highway Rail Grad e Crossings so that communities may legally establish Quie t Zones, according to the Rule, with the support and guidance of FRA; an d

That the Town hereb y calls upo n th e United States Department of Transportation, the Federal Railroa d Administration, the New Yor k State Department of Transportation an d its Freight and Economic Development Division, an d our state and federal electe d representatives to suppor t Rockland County's Quiet Zone effort and urge the CSX Corporation t o cooperate with Rockland County in establishing a Quiet Zone on the West Shore (River) Line.
