TPC AMENDMENTS TO THE TIP AND RTP
Summary
• Program $668K allocated by the Texas Department of Transportation to the Gulf Coast
Center as Small Urban allocations of Federal Transit Administration Section 5339, Bus and
Bus Facilities, for fiscal years 2018 and 2019 in the Texas City/La Marque and Lake
Jackson/Angleton urbanized areas. Transportation Development Credits (TDCs) will be
used as the local match.
• Program $1.98M of Surface Transportation Block Grant (STBG) funding and 60,000 TDCs
for the Houston-Galveston Area Council’s FY 2021 Livable Centers Studies.
• Advance two Category-2 funded FM 1488 4-lane widening projects from FY 2023 of the
Ten-Year Plan into FY 2021 of the TIP.
• Program the IH-10 eastbound entrance ramp construction project into FY 2021 of the TIP
with Category-11 District Discretionary funding.
• Program four 2018 Call-for-Projects Transportation Alternative Set-Aside (TASA) funded
awards at various locations.
• Program the 2018 Call-for-Projects City of Sugar Land ITS Upgrade project with $1.9M of
Congestion Mitigate/Air Quality (CMAQ) funding.
• Program the 2018 Call-for-Projects FY 2020 Regional Transit Fare Collection System
project with $2.3M of CMAQ funding in the TIP. Program the $17.7M balance in FY 2023
of the Ten-Year Plan for future projects.
• Transfer $2.7M of FY 2022 Metro Vanpool Program CMAQ and STBG funding to cover a
gap in funding available to reimburse eligible expenses in the past year.
Action Requested
Staff requests recommendation of Resolutions 2020-11 and 2020-12 to the Transportation Policy
Council.

AUTHORIZING AMENDMENTS OF THE 2045 REGIONAL TRANSPORTATION PLAN
(RTP) AND THE 2019-2022 TRANSPORTATION IMPROVEMENT PROGRAM (TIP)
FOR THE HOUSTON-GALVESTON TRANSPORTATION MANAGEMENT AREA
WHEREAS, the 2045 Regional Transportation Plan was adopted by the Transportation Policy
Council on April 5, 2019; and
WHEREAS, the 2019-2022 Transportation Improvement Program for the Houston-Galveston
Transportation Management Area was adopted by the Transportation Policy Council on May 25,
2018; and
WHEREAS, the proposed revisions to the 2019-2022 Transportation Improvement Program are
consistent with the 2045 Regional Transportation Plan and its finding of conformance with the
State Implementation Plan for air quality; and
WHEREAS, the proposed revisions to the 2019-2022 Transportation Improvement Program are
consistent with the federal fiscal constraint requirements established for the Transportation
Improvement Program and are consistent with the financially constrained 2045 Regional
Transportation Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE TRANSPORTATION POLICY COUNCIL
(TPC) FOR THE HOUSTON-GALVESTON TRANSPORTATION MANAGEMENT AREA
THAT THE 2045 REGIONAL TRANSPORTATION PLAN AND THE 2019–2022
TRANSPORTATION IMPROVEMENT PROGRAM BE AMENDED TO REFLECT THE
REVISIONS IDENTIFIED IN THE TABLE OF JANUARY 2020 TPC AMENDMENTS.
BE IT FURTHER RESOLVED THAT FEDERAL FUNDS AUTHORIZED BY THE TPC
FROM THE CONGESTION MITIGATION AND AIR QUALITY (CMAQ) AND SURFACE
TRANSPORTATION BLOCK GRANT (STBG) PROGRAMS REPRESENT A LIMITING
AMOUNT. ANY COST OVERRUNS ON PHASES OF WORK AUTHORIZED BY THE TPC
OR COSTS INCURRED ON PHASES OF WORK NOT AUTHORIZED BY THE TPC SHALL
BE THE RESPONSIBILITY OF THE PROJECT SPONSOR. IN NO CASE, SHALL
FEDERAL PARTICIPATION UNDER THE CMAQ AND STBG PROGRAMS BE
INCREASED WITHOUT CONSULTATION AND THE EXPRESS APPROVAL OF THE
TPC.

APPROVING THE AWARD OF TRANSPORTATION DEVELOPMENT CREDITS (TDCs) TO THE
PROJECTS IDENTIFIED IN TABLE 1 AND AUTHORIZING RELATED AMENDMENTS TO THE
2045 REGIONAL TRANSPORTATION PLAN (RTP), AND TO THE 2019-2022 TRANSPORTATION
IMPROVEMENT PROGRAM (TIP) FOR THE HOUSTON-GALVESTON TRANSPORTATION
MANAGEMENT AREA.
WHEREAS, Texas Administrative Code, Title 43 Subchapter H, identifies the purpose, goals, and
administrative requirements for the Transportation Development Credit Program in the State of Texas,
including the sub-allocation of credits to Metropolitan Planning Organizations (MPOs); and
WHEREAS, the Texas Department of Transportation has documented the current balance of credits
allocated to H-GAC, the MPO for the Houston-Galveston Transportation Management Area; and
WHEREAS, Texas Administrative Code, Title 43 §5.106, establishes requirements for the award of
transportation development credits by MPOs; and
WHEREAS, the Houston-Galveston Area Council has established a documented process for the evaluation
of applications and the award of credits; and
WHEREAS, the Houston-Galveston Area Council is in receipt of requests for credits; and
WHEREAS, the award of credits for these purposes is consistent with the Policy governing the
consideration of requests for credits adopted by the Policy Council on September 27, 2013.
NOW, THEREFORE, BE IT RESOLVED BY THE TRANSPORTATION POLICY COUNCIL (TPC)
FOR THE HOUSTON-GALVESTON TRANSPORTATION MANAGEMENT AREA THAT
TRANSPORTATION DEVELOPMENT CREDITS BE MADE AVAILABLE TO THE PROJECT
LISTED IN TABLE 1 IN THE AMOUNT SHOWN, AND THAT THE TRANSPORTATION
DIRECTOR IS DIRECTED TO ENTER INTO ANY NECESSARY PROJECT AGREEMENTS.

The Regional Fare Collection System (RFCS) is being developed by the Metropolitan Transit Authority of Harris County (METRO) utilizing local funds. The useof local funds reduces the amount of federal transit funding that would need to be requested to implement a similar project. The federal funds being utilizedleverage METRO's local funding to expand the availability of the regional fare collection system to cover additional transit agencies in our region.

Livable Centers Studies Cycle 6The Houston-Gaveston Area Council (H-GAC) is requesting 300,000 as local match for project management relating to the management of the Livable Centers Program Cycle 6.
H-GAC's Livable Centers Program works with local communities to identify specific recommendations, such as pedestrian and bicycle facilities, that can help facilitate the creation of Livable Centers. Through the study process the local community identifies a vision for the study area. The studies contain an implementation plan to realize this vision. To date, H-GAC has worked in partnership with local sponsors to complete 29 Livable Centers planning studies in the 8-county Transportation Management Area (TMA) with the average cost per study being $200,000 –$250.000.

RE: METRO Vanpool Program Gap Funding for Federal Highway
Administration (FHWA) Agreements CSJ 0912-00-553 & CSJ 0912-00-546
Dear Mr. Clark:
The Harris County Metropolitan Transit Authority of Harris County, Texas
(METRO) Vanpool Program has been programmed in the Transportation
Improvement Program since 1997 and has received FHW A funding in every
fiscal year since.
There are two (2) agreements with TxDOT; the first is the Surface Transportation
Program (STP) and the second is the Congestion Mitigation in Air Quality
(CMAQ). The previous STP agreement exhausted all grant funds after the last
grant reimbursement in October 2018. The previous CMAQ agreement provided
grant reimbursement up until the expiration of the agreement in December 2018.
During the past year, a series of unforeseen delays in implementing the next
sequence of approved agreements created a substantial gap in the funding
available to reimburse eligible expenses of the METRO V anpool Program. The
current agreements were fully executed with FHW A obligation occurring in
September 2019. METRO continued to operate the program throughout this
period of eleven (11) months to sustain this vital service to the region.
Approximately $3,500,000 in reimbursements would have been sought for this
gap period under the new agreements.
In consultation with TxDOT, METRO was advised that approved funding within
the TIP may be added to the prior agreements during their remaining
authorization under the FHWA Federal Project Authorization and Agreement.
FHW A rules provide flexibility by permitting States to make transfers among
certain apportioned highway programs. Under 23 U.S.C. 126, a State may transfer
up to 50 percent of its funding under any apportioned program to any other
apportioned program.
METRO respectfully requests H-GAC's agreement allowing TxDOT to transfer
the maximum amount of 50 percent of the previous contract amounts from a

future funding year and allocate those funds to the previous contracts as allowed
under the FHWA Federal Project Authorization and Agreement (23 U.S.C. 126).
This approval will increase the Federal share ofCSJ 0912-00-553 by $1,200,000
($2,400,000 x .5) and will increase the Federal share of CSJ 0912-00-546 by
$1,500,000 ($3,000,000 x .5) for a total of $2,700,000. This increase will cover a
portion of the funding gap that exists between expiration of the prior agreements
and the authorization of the new agreements.
