1 REFORM UPDATE

1.1. Since June 1, 2016, have there been any changes in government regulation or in practice that have had an impact on either the time or cost required to export and/or import? Sejak 1 Juni 2016, telah ada perubahan dalam peraturan pemerintah yang memiliki dampak baik pada waktu atau biaya yang diperlukan untuk ekspor dan / atau impor?

Ya, ada sejumlah peraturan baru yang telah berdampak baik terhadap waktu dan biaya dalam proses ekspor dan impor selama tahun 2016, yaitu :

1) Peraturan Direktur Jenderal Bea Cukai Nomor PER-16/BC/2016 tentang Petunjuk Pelaksanaan Pengeluaran Barang Impor untuk Dipakai.

1) Mengatur pelayanan impor hanya didasarkan pada 1 (satu) dokumen impor (PIB) yang dibuat dalam modul Importir/PPJK disampaikan secara elektronik dan telah mengakomodir proses single submission.

1) Proses lebih cepat dan lebih efisien

2) Peraturan Direktur Jenderal Bea dan Cukai Nomor PER-12/BC/2016 tentang Pemeriksaan Fisik Barang Impor

2) Mengatur pemeriksaan fisik barang impor agar dapat dilakukan segera dan importir tidak menunda pelaksanaan pemeriksaan fisik.

2) Pemeriksaan fisik lebih cepat sehingga mengurangi dwelling time

3) a) Peraturan Menteri Keuangan No.86/PMK.04/2016 tentang Perubahan Kedua atas Peraturan Menteri Keuangan No. 214/PMK.04/2008 tentang Pemungutan Bea Keluar. b) Peraturan Direktur Jenderal Bea dan Cukai No. PER-29/BC/2016 tentang Perubahan atas Perdirjen Bea dan Cukai No. PER-32/BC/2014 tentang Tata Laksana Kepabeanan di Bidang Ekspor.

3) Menetapkan pemeriksaan fisik secara selektif berdasarkan manajemen risiko untuk barang ekspor yang terkena Bea Keluar

3) Mempermudah dan mempercepat pelayanan barang ekspor yang terkena bea antara lain HS 15

4) a) Peraturan Menteri Keuangan No. 40/PMK.04/2016 tentang Pembayaran dan/atau Penyetoran Penerimaan Negara dalam Rangka Kepabeanan dan Cukai Secara Elektronik. b) Peraturan Direktur Jenderal Bea dan Cukai No. PER-33/BC/2016 tentang Tata Cara Pembayaran dan/atau Penyetoran Penerimaan Negara Dalam Rangka Kepabeanan dan Cukai Secara Elektronik.

4) Menerapkan pengelolaan pembayaran dan/atau penyetoran penerimaan negara secara elektronik dengan sistem Modul Penerimaan Negara Generasi Kedua (MPN G2).

4) Mempermudah, mempercepat dan meningkatkan transparansi

5) a) Hasil Rakor PP INSW dengan Pelindo I, II, III, dan IV dan Kementerian Perhubungan b) Peraturan Dirjen Perhubungan Laut Nomor UM.008/41/10/DJPL-16 tentang Pelayanan Publik Bidang Lalu Lintas Angkutan Laut dengan Sistem Online Integrasi Aplikasi Inaportnet dengan INSW, aplikasi Tracking Container Badan Usaha Pelabuhan yaitu PT. Pelabuhan Indonesia I, II, III dan IV (Persero) untuk diintegrasikan ke aplikasi Inaportnet untuk monitor dwelling time juga untuk menjadi dasar analisis proses logistik nasional.

5) Mulai 6 Februari 2017 Dashboard Dwelling Time telah meliputi 5 (lima) pelabuhan utama, yaitu: 1) Pelabuhan Tanjung Priok Jakarta, 2) Tanjung Perak Surabaya, 3) Tanjung Emas Semarang, 4) Belawan, Medan, 5) Soekarno Hatta, Makassar berlaku mulai 6 Februari 2017.

5) Memudahkan monitoring dan analisa dwelling time untuk perbaikan

6) Rapim PP INSW 6) Mulai 9 Februari 2017 telah berlaku Proses pemantauan (tracking) dokumen PIB/PEB tidak memerlukan USER ID, hanya nomor AJU. Sementara untuk mengecek (tracking) perizinan, persyaratan yang harus dipenuhi adalah memiliki NPWP dan No. Ijin

6) Peningkatan transparansi dan akuntabilitas pelayanan ekspor-impor

7) Surat Edaran Dirjen Perhubungan Laut Kementerian Perhubungan Nomor UM.002/87/17/ DJPL-16 tentang Acuan Standar Pelayanan (Service Level Standard/SLS) Menggunkan Inaportnet Untuk Pelayanan Kapal dan Barang di Pelabuhan

7) Untuk melancarkan operasional pelayanan kapal dan barang di Pelabuhan, SLS diukur berdasarkan satuan waktu (menit, jam, hari) dengan rincian sebagai berikut : SLS untuk Kapal Masuk adalah : a. Batas waktu setelah dokumen

kelengkapam earta kedatangan kapal disetujui sampai dikeluarkannya Pemberitahuan Kedatangan Kapal (PKK) adalah 30 (tiga puluh) menit;

b. Batas waktu setelah dokumen kelengkapan warta kedatangan

d. Batas waktu setalah rapat penetapan penyandaraan kapal diputuskan sampai dikerluarkannya Penetapan Penyandaran Kapal (PKK) adalah 10 (sepuluh) menit;

e. Batas waktu setelah dokumen kelengkapan permohonan olah gerak disetujui sampai dikeluarkannya Surat Persetujuan Olah Gerak (SPOG) adalah 10 (sepuluh) menit.

SLS untuk kapal keluar adalah: a. Batas waktu setelah dokumen

kelengkapan warta keberangkatan kapal disetujui sampai dikeluarkannya Laporan Keberangkatan Kapal (LKK) adalah 30 (tiga puluh) menit;

b. Batas waktu setelah permohonan melakukan pembayaran PNBP Jasa Labuh menggunakan kode billing dari inaportnet serta setlah dokumen kelengkapan Laporan Kedatangan dan Keberangkatan Kapal (LK3) adalah 20 (dua puluh) menit;

c. Batas waktu setelah dokumen permohonan berlayar disetujui,

SPK Pandu dikeluarkannya oleh Pelindo, LKK dan LK3 dikeluarkan sampai dengan dikeluarkannya Surat Persetujuan Berlayar (SPB) adalah 30 (tiga puluh) menit.

8) Peraturan Direksi PT. Pelabuhan Pelindo Tanjung Priok No.HK.568/13/9/I/PTP-16 tentang Pedoman Penerapan E-Service Portal di Lingkungan PT. Pelabuhan Tanjung Priok, berlaku 13 September 2016.

10) Saat ini Aplikasi Inapornet telah diterapkan secara penuh di 4 (empat) Pelabuhan Utama: a) Pelabuhan Makassar mulai tanggal 01 Juni 2016, b)Pelabuhan Belawan mulai tanggal 01 Juli 2016; c)Pelabuhan Tanjung Perak mulai tanggal 02 November 2016 (pelaksanaan bertahap); d)Pelabuhan Tanjung Priok mulai tanggal 11 November 2016 (pelaksanaan bertahap).
