    Traffic (Compliance and Enforcement)

    Regulations 2011I, the Governor in and over the State of Tasmania and its Dependencies in

    the Commonwealth of Australia, acting with the advice of the Executive

    Council, make the following regulations under theTraffic Act 1925.

    1. Short title

    These regulations may be cited as theTraffic (Compliance and Enforcement)

    Regulations 2011.

    2. Commencement

    These regulations take effect on 30 November 2011.

    3. Interpretation

    In these regulations ActmeansTraffic Act 1925.

    4. Prescribed offences for section 9(3) of the Act

    For section 9(3) of the Act, the following offences are prescribed:(a) a parking offence;

    (b) an offence under Vehicle and Traffic (Driver Licensing and Vehicle regulation

    65(4) of the Registration) Regulations 2010.

    5. Prescribed offences for section 43H of the Act

    For the purposes ofsection 43H(6A) of the Act, the following are prescribed

    offences:

    (a) a parking offence;(b) a speeding offence;

    (c) an offence under regulation 10(9) or Vehicle and Traffic (Driver Licensing and(11) of the Vehicle Registration) Regulations 2010.

    6. Prescribed offences for Part IVB of the Act

    For Part IVB of the Act

    (a) the offences specified in column 2 ofPart 2 ofSchedule 1 are prescribed; and

    (b) the description of the prescribed offences is specified for the offence incolumn 3 ofPart 2 of the Schedule for illustrative purposes only; and

    (c) the penalty and demerit points applicable to each of the prescribed offencesare as respectively specified for the offence in columns 4 and 5 ofPart 2 of theSchedule.

    7. Specified offences for section 54(1AA) of the Act

    For section 54(1AA) of the Act, the following offences are specified:

    (a) a parking offence;

    (b) a red light offence, or speeding offence, detected by means of a photographicdetection device;

    (c) an offence under Vehicle and Traffic Act 1999 section 27(1) of the ;

    (d) an offence under Vehicle and Traffic (Driver Licensing and Vehicle regulation65(4) of the Registration) Regulations 2010.

    8. Prescribed authorities for section 59 of the Act

    The following authorities are prescribed authorities for the purposes of section

    59(1A)(b) of the Act:

    (a) Aurora Energy Pty Ltd;

    (b) Forestry Tasmania;

    (c)Tasmania Water and Sewerage Corporation (North-Western Region) PtyLimited;

    (d)Tasmania Water and Sewerage Corporation (Northern Region) Pty Limited;

    (e)Tasmanian Water and Sewerage Corporation (Southern Region) Pty Limited;

    (f)Telstra Corporation Limited;

    (g) the department responsible for the administration of the Environmental

    Management and Pollution Control Act 1994;

    (h) the department responsible for the administration of the Nature ConservationAct 2002;

    SCHEDULE 1 -Traffic infringement notice offences

    Regulation 6

    PART 1 -Interpretation

    1. In this Schedule DLVR means the Vehicle and Traffic (Driver Licensing and

    Vehicle Registration) Regulations 2010; LHCIR means the Luxury Hire Car

    Industry Regulations 2008; MALC means the Motor Accidents (Liabilities and

    Compensation) Act 1973; PTA means the Passenger Transport Act 1997; PTR

    means the Passenger Transport Regulations 2000; RR means the Road Rules

    2009 (known as the Road Rules); TA means theTraffic Act 1925; TIR means the

    Taxi Industry Regulations 2008; TLHCIA means theTaxi and Luxury Hire Car

    Industries Act 1995; VOR means the Vehicle and Traffic (Vehicle Operations)

    Regulations 2001; VSR means the Vehicle and Traffic (Vehicle Standards)

    Regulations 2001 (known as the

    Vehicle Standards); VT means the

    Vehicle and Traffic Act 1999.
