KATZ: That’s for them. That’s not --that’s not going to make it any louder. MR. ELRICH: Okay. I’ll pretend I nevertouched that. I didn’t play with the thing --microphone. Okay. So what are we doing? This isour fifth -- MR. KATZ: Yes, you got it right. MR. ELRICH: Yay. I got it right -- firsttime. Fifth listening session. And what we’ve beendoing, we’ve been going around the county and we’reasking people to tell us what kind of issues you runinto if you’re trying to start a business. ELRICH: Okay. So yelling is not myforte. So we are trying to listen to people. We’veheard -- I certainly heard during the campaign andwe’ve probably heard for years on the Council thatwe’re a difficult place to do business and we dothings that other people don’t do. We’ve neveractually asked the question of what are those things. So we decided what we would do -- and I’veasked Sidney to join me on this -- is we’re goingaround and we’re asking people who either operatebusinesses or tried to start businesses in MontgomeryCounty what do you encounter here that’s differentthan anyplace else? What do you encounter hereparticularly if it’s worse than anyplace else? If you’re in construction and you’rerenovating a building and it’s a building made, youknow, that was built in the 60s, 70s, 80s, 90s, doesMontgomery County require things that other

jurisdictions don’t require? In other words, wouldyou have to fix something or repair something inMontgomery County that if you were in the district ofFairfax or Frederick they wouldn’t make you do? We’re trying to understand if we’reregulating the environment in a way that other peoplearen’t regulating their environments. And our goalis pretty straightforward. As we learn about thisstuff, by the end of the year, we’ll issue a reportthat leads us to creating legislative changes orchanges in policies and that will bring us in linewith outside jurisdictions. So if it’s not something we can doprocedurally, it’s something we have to dolegislatively, we’ll do that. If there are codeissues that are different here than otherjurisdictions, we’ll look at changing the buildingcodes so we bring ourselves in line with the codes insurrounding jurisdictions. So I don’t expect anybody to love us butat the end of the day I don’t want you to think we’reany worse than anybody else. That would be the barfor normal for us. And that would be a good place toget to. So we’re looking at doing, you know, changesalso as they come up. So is this a good example?

MR. KATZ: This is it. This is the oldone; this is the new one. MR. ELRICH: So we heard people talk abouthow difficult it is to do contracts in MontgomeryCounty so here’s the form that people dealt withbefore. It looks like this. Ash Shetty, who’s inthe back of the room, was at a listening session.He’s the Director of Procurement. He said, maybe itshould look like this. And so this is what we’reputting out now. So we’re not going to wait. Forthings we can change that don’t require change inregulation or the law we’ll change them as quickly aspossible. Things that we have to do that are morerelated to law or regulation, we’ll change them as wecan change them. But easy stuff like this, we’ll doroutinely. So we look forward to your comments. Ifyou don’t make comments and you don’t want to make acomment publicly then you can make a comment inwriting. And if you don’t want to be identified, youdon’t have to be identified. We’ve had people raisethe issue of not wanting to be identified withcertain complaints because of concerns that you mighthave difficulty in the future with people in thecounty. We want to make sure that you don’t feel

that way. We don’t want anybody not talking to usbecause they’re afraid to talk to us. So I just wantto make sure I put that out on the table. Mr. Katz. MR. KATZ: Thank you very much. Before Ibegin I wanted to announce that my colleague,Councilmember Tom Hucker is in the back of the room.This is his jurisdiction. He’s the councilmemberfrom this area. And before we even begin anythingelse, could we get a round of applause for Kefa Cafe;is that the way you say it? Kefa Café. Marc and Ibecame friendly because he would in my office and eatmy cookies. Let me tell you. I would be there allthe time. I tell everybody I’d turn vegetarian andeat nothing but cake and cookies. But Marc already touched on the idea thatwe heard about the procurement and we start workingon that and I actually applaud Ash and his team fordoing this. The other thing that we talked about orthat we heard during some of these sessions was wasabout -- a landscaper told us of the issues that he’shaving and that he would -- the zone that he shouldbe allowed in and he’s not. And Tom and I -- Tom hasalready drafted this and I’m a co-sponsor -- hasdrafted some legislation -- not that it’s passed yet.

I mean, we have to go through the process. But wepassed -- we drafted some legislation to take care ofthat if we can. So we’ve heard that one. And then the other night when we were inWheaton, we heard about the parking concern aboutduring the construction and what not for thebusinesses in Wheaton and how they were concernedabout us raising the prices for parking there whilethis was going on and all that sort of thing. AndCouncilmember Nancy Navarro, whose district that islocated in, had already started working on that butwe took care of that as well. We’ve already saidduring this time of turmoil for those businesseswe’re not going to -- we changed the parkingregulations. So we are hearing things as we goalong. The -- we also have many, many differentdepartments who are here today. And I think thatthat speaks well not only of the county but they toowant to hear directly from everybody. I also wantedto point out that Joy Nurmi, who’s representing GabeAlbornoz, who’s councilmember-at-large, is here aswell. And so we’re very pleased that they’re joiningus tonight. And what we’re going to do is we’re going

And so I’ll tell you when you have abouttwo and half minutes left so you can finish up yourstatement. tonight. Some of them didn’t really want to write.Some of them don’t believe anything will happen. I’mglad to hear changes are happening already so I’lltake that back. And some of them were afraid ofretribution. A lot of this comes back to what one ofour members, Julie Veradi (ph), said in the Source ofthe Spring interview that was just published thisweek. A lot of this has to do with the culture andthe feeling of Montgomery County versus, for example.Prince George’s County. And she described it in thearticle as the stark difference between her dealingswith Price George’s, where she’s about to open, andMontgomery County was that Prince George’s County --everybody she dealt with felt warm and embracing. And she said this even though some of thethings were more expensive -- she had to jump througha few more hoops. The way that she was handled andthe way everything happened, it was like when you’re-- when you’re interested with folks -- or whenyou’re interacting with folks you don’t feel likeit’s us versus them. You feel like even thoughMontgomery County’s more transparent and the newwebsite for DPS is great. But when you talk tosomebody, she said you get the attitude of, well,

you’re bothering me. I got that same attitude from one of ourmembers who owns a yoga studio who went through awhole lot of hassles in terms of how far is it fromthe end of this wall to the fire escape and is itmore than 100? He had four people who measured itunder 100 but nobody from DPS came out to measure it.They insisted. So he finally said, okay, I’m goingto put a bookcase in the corner then nobody can standback there. Okay, that was fine. But it took threemonths to get to that process and every time he wentback in it was like, oh, it’s you again. So a lot of this I think has to do withthe fact that businesses at least feel like we’re notnecessarily wanted here. I’ve heard similar things-- we had one member who recently just boughtproperty in Frederick County. He said they rolledout the red carpet when he walked in there. Themayor, the economic development person was there.And from those folks down to the guy in the parkinglot where he had to park next door said, you know,answered their questions before they had thequestions sometimes. So I think that’s something that, youknow, if we could get to a culture where we’re

rolling out the red carpet, where we understand thatbusiness is not the enemy; business is here to reallysupport everything else we want to do in thiscommunity, it would help. I only had three minutes so I’m not goingto go through the litany of examples that I have butI will send them to you in writing. MR. KATZ: Please. MS. REDDICKER: At a recent ribboncutting, though -- until you cut me off here -- I’lltell you about the owner of one of the franchisesthat has several coffee shops in the area, several --multi-jurisdictional. Said that there’s no otherplace that he’s had to lose part of his seating areabecause he had to put in a second bathroom. MR. KATZ: Thirty seconds. MS. REDDICKER: Okay. Anyway, those arethe kinds of stories that it just seems like we gotoo far. Our members want to abide by the law. Theywant to do what’s right. They want to be an asset tothe community. And we just need a little bit betterattitude from the folks who are working in the countyto be helpful and say we want you here. Let us helpyou get to yes. So thank you for listening. MR. I am a small business owner locatedin Montgomery County as well as the interim executivedirector for the Maryland Black Chamber of Commerce.We have hundreds of members across the state ofMaryland. The most of our members are actuallylocated in Montgomery County. And what we do for our members is weconnect them other businesses. We -- and to othercorporations. We educate them on how to do businessin the state of Maryland -- all the countiesincluding Montgomery County as we know it today. Andwe also advocate for our members. So CountyExecutive Elrich and Councilmember Katz, I’d like to

And after the first event that Iattended, Judy Stevenson said, well Drena, what doyou think about the initiative? And my honest answerwas I have a healthy dose of skepticism. Why? It’sbecause the businesses in Montgomery County have beengoing through these challenges in the county muchlonger than this administration. But after being able to talk to both ofyou and having an extended conversation with ChiefProcurement Officer Ash Shetty, I can honestly saytoday that I am very optimistic that we will havepositive changes in this county and wanted to let youknow this evening that the Maryland Black Chamber ofCommerce supports your efforts and we are here tohelp you and to make sure this initiative is madepossible. So as -- my name is SusanPeterkin. I’m a small business owner here indowntown Silver Spring, Jaha Hair Studio. I havebeen here in Silver Spring for 22 years. So concernPurple Line construction is coming. We have no senseof financial assistance that will be given. We havegotten technical assistance and we appreciate and wethank everyone from [inaudible] who helped us to gettechnical assistance. But we can have all the marketing,technical assistance but if the streets are closed,if the parking -- there’s no parking, if all thesudden the contractors who are doing the work, youknow, blocking the streets or the water is turned offor something get interrupted, which has beenhappening to us for the past five years with thebuilding of the library and other buildings around us-- you know, a very small block -- it impacted ourbusiness. And something as humongous as the Purple

Line it would be on a larger scale. So, you know, the continuous projects and,you know, we have survived but how do we survive? Weneed a plan. You know, we need some commitment fromthe county. You know, we need financial assistancebecause even though we are going to -- you know, I’ma small business owner. That’s all I know how to doto get in there, get in the trenches and do what Ineed to do. But I can do everything that I need to dobut if there’s no one coming into my business, how doI survive? How do I feed my family? How do I pay mymortgage? We are -- and on Bonifant Street, I say weare not even small businesses; we are mom and popbusinesses like directly -- the money we make everyweek pays our bills. How do we survive? We needfinancial assistance. MR. KATZ: Thank you very much. I didwant to say that we’ve been joined by my colleagueWill Jawando -- County Councilmember Will Jawando aswell. And thank you for sharing with that. Youknow, that’s my background was that I was a smallbusiness owner and I was a part-time mayor at thesame time. And believe me, I love small businesses

and I understand there’s good days and bad days init. And if you don’t have business that day thenit’s a bad day. I mean, you can’t -- you can’tsurvive unless you’re ringing that register. Next is Mike Houston. And I apologizewhen I mess up everybody’s name because I’m not goodat this. But go ahead, please. MR. HOUSTON: I’ve got an easy one. Myname’s Mike Houston. I’m the general manager of theTakoma Park Silver Spring Food Co-op. I’ve beeninvolved in food businesses in Montgomery County forthe last seven years previously working as the storemanager at Dawsons Market in Rockville. Operating business in Montgomery Countyoffers population density, access to diverse base andworkforce and a higher than average household incomethan other parts of the county -- country. However,there are regulatory hurtles that while well-meaningcan create undue hardships. HHS regulations in thecounty hold that anyone that wants to sample or sellfood to the public outside of their licensed facilitymust complete a temporary food service license andpay a fee. These forms can either be turned inphysically to HHS in Rockville or faxed; there’s no

online option. The option to fill out the permitinformation online and process payment online wouldbe a huge help to businesses planning offsite events.Sometimes invitations to participate in festivals andsummer events come with short notice causingbusinesses to incur a late fee with their HHS permit.An online application would be very welcome for thoseof us in East County for whom a trip to Rockville isdifficult but who want the certainty that ourapplication was received and reviewed before theevent. The typical fee for a one-day event is$70. A local vendor coming to a co-op event tosample, such as our Earth Day celebration, must alsopay $70 on top of the product that they give away.When the co-op sells at an offsite community event,our first $70 in profit go to pay for that permitwhich is true of all the food businesses who attendthe same event. Perhaps one fee for each eventinstead of per business could be implemented. Food service facilities are alreadyrequired to have a food service manager present atall times meaning most businesses have several peoplewho’ve undergone the proper training. If businesseshad a food service manager present at offsite events

perhaps their knowledge and training could reduce theneed for inspections and therefore lessen the cost.This change in regulation could incentivize morebusinesses to get their staff members food servicesafety training increasing knowledge and awarenessthroughout the county. I appreciate your willingness to holdthese sessions for the business community and lookforward to doing business in the county for many moreyears to come. MR. KATZ: And we look forward to seeingyou. to -- a children’s facility -- and within six weekswe went from 600 kids to 20 kids. They shut me down. I have a place in Silver Spring. I have aplace in Gaithersburg and it just seems like everytime I turn around, Silver Spring -- we lost $120,000before they could do a common-sense change of thetraffic pattern for that bridge. It almost put meout of business. I employ mostly young people at mygymnastics facility. A lot of them it’s their firsttime working. I can’t afford to train peopleanymore. I have to hire people -- I mean, theminimum wage for a first-time kid coming who knowsnothing and sometimes don’t even know how to use abroom. And I’ve got to pay them such wages. Theonly thing that’s keeping me in business is prayer.I just don’t know anymore. I just -- I am sofrustrated and every time the county comes out toinspect me, every time, it’s a different thing. Like if they come out and do a fireinspection, oh you need to change this. The next guycomes out, you need to change that back. It’s neverconsistent. And when you try to talk to them, theyact like you’ve done something wrong. I want towork. I want to employ people. I want to teach

children and I want -- I want to pay my taxes and Iwant to do the right thing. But every time I turnaround it’s something different. And it just -- I -- I just don’t know howmuch longer with everything that’s going on. Myrent’s going up. My labor cost is going up. I can’traise my rates for gymnastics to even break even.Every year from the last six years we have made lessand less money and have more and more kids. So itjust -- it just seems like we don’t get any relief.And that bridge -- MR. ELRICH: Which bridge? MS. HOPE: The Brookfield Bridge that theyclosed for six months. the small business. We have a combined commercialdistrict of Takoma Park, Maryland and the Takomaneighborhood of Washington, D.C. And I’ve collecteddata from our businesses that they wanted me to sharewith you this evening. The first thing, the permitting processwhich I think ties into the previous speaker here.Our small businesses have found long delays forapprovals which have led to months of paying rent bythe small businesses without any income coming in.We have inconsistencies with permittingrepresentatives. And they feel that there’s beenpunitive and expensive change process -- processesand there’s an inability to expediate. From a permitting requirement standpoint,our businesses are finding that the requirements areexcessive for small businesses. Our businesses areall small, locally owned, independent businesses.The requirements don’t take into account thelimitations with our small historic commercial stockand -- or the small operations of these businesses.And I’m going to be providing you with detailedexamples -- MR. In addition, our businesses are feeling the weight ofthe cumulative impact of county requirements. Sorelated to the $15 minimum, the earned sick and safeleave law, required county certifications like theallergy awareness class which requires staff to have-- be out of the building, the office or the shop.And obviously, increased property taxes which we’reall feeling. These combined have a cumulative effecton our small businesses with no -- nothing to turnto. And what we’ve seen on the D.C. side ofour commercial district, there’s small businessgrants and many of them. We’ve got two examples thatI’ve printed out information for you. There’s theGreat Streets Grants in D.C. which has given up to$50,000 to some of our small businesses on CarrollStreet Northwest. So a block over they have accessto $50,000 as a small retailer, as a small restaurantthat Carroll Avenue does not have access to. The other is a more recently releasedgrant called the Robust Retail Grant -- $10,000 grantand the idea is helping the retail business pivot.It’s a tough time for retail. I don’t need to tellyou that. This $10,000 could just be the infusionthat gets them to change their business up to be more

Long Branch that are paying out-of-pocket every nightto have off-duty police police their property becauseotherwise there’d be chaos. So this is -- multiplerequests on that one. A homeless facility is something that --another thing she requested. Having worked in thisarea myself, I’ll add that it seems to me that havinga dedicated homeless outreach person might be morerealistic in the short term and more affordable butwould be very useful for that and similarneighborhoods near us. The -- the final point that Ada wanted tobring up was just to request as much marketing andpromotional support from the county as the county cando particularly during the construction period whichis the same as Bonifant Street. We also hear a lotof that from Bonifant. I feel like it’s an us versus them type of mentalitywhen it comes to either county politics, media. Everybody seems to be coming down onbusiness owners and everybody needs to realize we’recommunity members also and we want to try to do theright thing by our businesses and by the community.A lot of us also compete across jurisdictions. Soany time you pass legislation that impacts us as aMontgomery County business, you have to think aboutthe fact that we’re competing with other people inother jurisdictions that may have less restrictionsor may have more latitude to do different things thatwe can’t do in the county. So please keep that inmind as you think about policies to implement in thefuture. The only thing I’d ask from the BlackBusiness Council perspective is help us -- let usknow how we can help you get the word out about ourreally great local black businesses. And help usfind ways to educate black businesses. And lastly,there’s so many entrepreneurs and great businessowners and a lot of corporate experience in thecounty. If there’s a way for us to link thatexperience with business owners that need mentorshipand coaching, it would be great if we could find a

being a chef as well, I’d like to, you know, thepossibility to open more restaurants. And if they’rethe size of the one that I’m currently running, youknow, I’m going to have to find something with twobathrooms for everyone that I want to serve beer andwine with. Overall we just see it as kind of apotential loss as well because being right in theheart of Silver Spring -- we’re right on FentonStreet right by the Fillmore -- you know, not beingable to sell beer and wine, you know, it’s kind of adisadvantage for us in our location as well if weever look to sell. So we would like to see ifthere’s a way that we can change that ruling so thatsmall restaurants, especially mom and poprestaurants, could benefit in the future. MR. retribution. I talked with a non-profit businessmanager just yesterday about a problem. And I said,call Hucker’s office, call Hans’ office. They willhelp you. She said, I don’t know if it’s worth it,maybe it will be worse. I have to deal with DPSessentially forever. This is a very, very severeproblem. I called Hucker’s office. I think he’shere. MR. KATZ: Here’s here somewhere. MS. BRENT: I called Hans office. Theywere both very helpful. One of them called DPS on asituation that I was little bit involved in justbecause I cared. They heard one thing from DPS whichis entirely different than the business owner hadheard. It’s really, really a problem. People haveheard the threats that they will shut you down if youdon’t do this even though last year or in the lastten years no one has said that you have to do this. There are three things that I hear mostoften from business owners and I know a lot of themin downtown Silver Spring. The two biggest problems-- liquor monopoly, DPS. The solution, frankly, forthose that can afford is Prince George’s County. MR. KATZ: Thank you. We’re sorry that

anchor, as an asset in the community. Here we’ve not just seen from the countythe struggle and the issues with permitting and thekind of bureaucratic issues but we’ve even seen itfrom the residents who are -- who kind of have ananti-business sentiment. There’s not a lot of --there’s not a lot of joint or collective discussionabout what the community is. And I definitely feel, and again this isfrom my personal experience, not from the citydirectly. But I definitely feel like that comes fromsomewhere. And if you have permitting folks comingthrough and saying we’ll shut you down in a punitiveway and people who are not receptive to thechallenges, my question is are we equipped capacity-wise to actually help businesses grow. Because whatI’ve done for 15 years is help businesses grow. I’veliterally created millionaires. And for me I don’tsee that same pathway here. And I’ve not been here long enough to seeany hardcore barriers. But every contact I have witha business is, one, the fearful nature and, second,when I’ve looked for resources. So the city ofTakoma Park is small. So we are looking to thecounty for resources. The biggest difference in D.C.

is what our Old Town Business Association justbrought up. The difference in those grants -- D.C.wants you to start a business. They want thosebusinesses to grow and we see it right in Takoma parkwith Busboys and Poets and that’s their fifthlocation, you know? Again it’s in D.C. but that’s a-- that was a small business that has now expanded toa way that we all know Busboys and Poets, you know,and it’s the preferred. Developers literally lookfor them when they -- literally look for them whenthey’re building new locations. The last thing I’ll say is about thePurple Line. So I’ve worked on the H StreetLightrail and one of the major challenges that we sawthere was that construction. Construction has thepotential to completely decimate a small businesscorridor. We’ve seen it and then there’s turnoverand gentrification. I am specifically interested in NewHampshire Avenue corridor. Those businesses havebeen there for generations. They are immigrant runbusinesses. They are our international businessesand they deserve the same treatment as othercommercial corridors. And that’s financial

Before I provide my comments, Ijust wanted to thank you for actually embarking onthis. I’ve never been a part of something like thiswhere we’re actually asked for feedback, so I’m happyto be here. And I’m very hopeful that the outcomewill be that we -- you have more understanding of thebusinesses, more respect and that we’re more -- thatwe are engaged more. Before I provide my specific comments, Iwant to tell you a little bit about myself to providethe right context to what I have to say. So I’velived in Montgomery County for over 14 years. I’mthe owner of Signarama Silver Spring and I justcelebrated my ninth year in business. I’m involvedin the county and I where many hats. On the civic side, I’m a former PTA co-president, NAACP Parent Council chair. I’ve servedon the Silver Spring Citizen’s Advisory Board fornearly five years and was a former chair of theCommercial and Economic Development Committee for

three years. On the business side, I’m an active memberof the Maryland Black Chamber of Commerce and theGreater Silver Spring Chamber of Commerce. I alsoserve as one of the two business Purple Line CATrepresentatives for the Lyttonsville sector. So Isay all of this to exemplify that I know the countyand I’m involved on all fronts and can speak as bothan engaged resident and business owner. In general as a resident, I feel that thecounty does a good job in engaging the community andproactively reaches out to the community to getfeedback. I feel respected when I’m wearing thathat. When I’m wearing my business hat, that’s notthe case. In fact, my overall feeling is that ouropinions and insights are not respected nor included,at least not without a fight. I -- for example, how I’ve experiencedthis firsthand is I was active in all four. Theminimum wage increase -- the initial legislation ascrafted had very unrealistic time frame and did nottake small businesses into account at all. It wasonly after many meetings, testimony and back andforth that a more sound approach was put forth. The Lyttonsville Section Plan -- the

initial plan included creating a floating mixed-usezone which would have decimated the viable BrookvilleRoad district that is home to over 475 businessesemploying approximately 3000 people. It was onlyafter debate, petitions, testimony and engagementthat this was rescinded. Again, a fight. Paid Sick Leave Act -- again, similar tothe minimum wage, there was no consideration forsmall business in the original bill. Once moredebate, testimony, another fight. Closing the Lyttonsville Bridge due to thePurple Line construction -- this was truly a greatexample of how many businesses almost went out ofbusiness and some are still struggling. In anutshell a workaround was agreed that would be ahardship for both residents and businesses butwithout loss of life or livelihood. A last-minutechange to the agreement put businesses at risk ofgoing out of business. And again, we had to be --fight to be understood and heard and had to take itall the way to the county executive. when you run for office again and you tell me thatthe percentages went up? And most businesses andsmall businesses go day by day. I’m in the construction managementengineering consulting business -- professionalservices, prime contracts. There’s craneseverywhere. I guarantee you the majority of them arenot from here and they’re making billions, millions -- Purple Line. You know, we tried to get in on allthese projects. And that’s very disappointing. AndI’ve paid taxes in this neighborhood 50 plus years. And so we really need to have some measureof how what we’re doing tonight, you know, it takespeople gas, time, effort. They had to close down tocome to attend these things. And so how do youmeasure it? How do -- what -- you know, this is verynice when you all go home. But what should weexpect? You come back in three months, give us areport saying that, you know, the outcomes from whatwe said, that the people who need to add a bathroomdon’t have to add it now or, you know, they’re goingto get more information on road closures. So how dowe measure you and, you know, what do we know thatthey’re a success going forward?

doing is developing a local preference forpurchasing. So we’re going to go from not having alocal preference to having a local preference. Mostof the surrounding jurisdictions preference localbusinesses. We’re going to do the same thing --preference the local businesses. We realize that if we spend a little moreon a local business and that money stays inMontgomery County, it’s worth more than spending alittle les son something and wind up with all thatmoney going to Virginia or to Pennsylvania. So I’m abig believer in spending local and so we’re going todevelop legislation that people will be able to see.So along with simplifying the contracting process,we’re going to make sure you actually have a betterchance of getting a contract in Montgomery County.It is a problem. I agree. MR. KATZ: I can tell you we’re not doingthis to do nothing. I mean, we wouldn’t -- we’redoing six of these. And this is the fifth one of thesix. and everybody else in general. And many times I get a better life for thepublic is to have a better business so they enjoygoing there. And many times you have a betterbusiness because the public enjoys going there. Sothis goes hand and glove and we’re going to getthere. After we go through the list, if you’re noton the list -- UNKNOWN: I have a follow up question onMr. Elrich’s comment on local preferences. Is that acharter amendment to the legislation or is thissomething that can be done? MR. ELRICH: No, just a new legislation.We’ve got a minority set aside but that doesn’treally do the job. UNKNOWN: You’d never hit the mark. MR. ELRICH: No, even if you did hit themark. If the mark is below the percentage ofminority population of the county. So missing --making that mark doesn’t mean necessarily you’regetting a fair share of business. So I don’t want tohave a minimal standard. Three years ago we didn’t have to pay for fireinspection. Now we have to pay to have them come outand we have to pay for them to come out again. please? MS. MAROON: Yeah. So I was saying thereare three things that the county can do to help smallbusinesses. One is access to capital. One is accessto customers which, if there’s going to be a localpreferences, then I have only two points to make.But the third is infrastructure because right nowthere isn’t a lot of infrastructure in the county tohelp food businesses grow. And we hit a ceiling. Idon’t manufacture my product here because I can’t. Imanufacture it out of state and employ a lot ofpeople in that state. And so I think that if we hadinfrastructure here, we’re able to support and keepthose dollars here. Those are my three points that I wanted tomake. I feel like listening to the other businessowners here, a lot of these ideas don’t apply just tofood. But one thing that is specific to food is whatMike said about the sampling license which $75 tojust let people try your product -- they might buyit, they might not -- is a big hindrance. I wasvery interested in a co-packing facility and into theincubator kitchen. We thought we were on the road toget that and then I didn’t do it. I fully intend todo more than one incubator kitchen and we’re workingon one project, possibly two, that’ll have anincubator kitchen, incubator restaurants and atraining facility for people. I’m trying to work outa deal where I may get a building that has a kitchenalready that’s an institutional kitchen that I wouldalso make into an incubator kitchen. And I do want to build a co-packingfacility because we would be able to serve not onlylocal manufacturers in the county but localmanufacturers in the region. So I know that thestudy was done. us is yoga, you know, and daily classes. People comeand get their wellness on. I’ve got so much stuff. Three and a halfyears I’ve been at this. We just celebrated our two-year anniversary. We struggle every day. A yearhalf to open a yoga studio. If you want to hear ourexperience, NPR did a whole story on our experienceand how crazy it was. Probably 50 grand in the holewith county stuff that we didn’t have to do. Youguys made us get compliant, you know, to our code onstaircases you never checked -- 20 grand there. downtown but I also have to deal with competitorsdown there. So my really business depends on peoplecoming from East-West Highway and feeling comfortablewith coming under that bridge to my business. Idon’t have a lot of beefy, burly guys who typicallycome to yoga studios. They’re usually people thatare a little more timid about their security. And sothat’s a real issue for me. And so I really rely onthese apartment -- tons of -- I mean, that’s why weset up in Silver Spring is because of demographics.Right? But they don’t feel comfortable coming underthat bridge. And I’ve tried to work with the county alot. Just three weeks -- invited over to a meetingat Progress Place. I was told that my views don’tmatch up with the county’s. I was told that I don’thave the same vision as the county. I just want toback up and say my wife’s a social worker for theD.C. government. She runs the ACE program. Threeminutes? Okay. And when I started to look, people told methat I shouldn’t do anything with Americanpharmaceutical companies. I should rather work withthe Chinese companies. But I chose to partner -- tryand partner with American pharmaceuticals because Ifelt that there are more regulations and possiblybetter products produced by the pharmaceuticalcompanies compared to what we have in China. So my question is what I’ve discovered isthere are no discounts, there are no kind of liketariffs given for people like myself who want to buyin bulk and export back to other countries which Ithink is a great business for America because youguys are getting -- especially in this -- so I don’tknow if it’s something you can do on the local level-- MR. I’ve been here going on 23 years this year.I’m originally from Liberia. I have an IT consultingbusiness in the county that I have opened up back in2006 but just went into it full-time in 2015. Just a little background. I’m a formerPTA president of Piney Branch Elementary School.I’ve, you know, been account executive for a fewthings. I’m also a part of Montgomery County BlackBusiness Council and [inaudible]. So one of thethings that I’ve seen is that as a small businessowner, one of my goals is to grow the business and tobe able to hire locally. As a Liberian being an African I know Ihave the African Advisory Council that advise thecounty executive that the goal of that council is to

try to work and ensure that the African communityreceive, you know, an equal share of what’s going onin the county. And one of the things that I intendto do is to try to -- because there are a lot ofyoung Liberians and Sierra Leonians and other folksthat [inaudible] are in the community that canbenefit from employment. There’s a school right downtown in SilverSpring here called [inaudible]. I met them back whenI was doing some networking. And during that timewhat I did was -- when I learned what they weredoing, which is getting people who didn’t have any ITbackgrounds -- background or either had a little bitof experience but wanted to transition into IT didnot have the money to go and pay for a school. Theywere taken through this rigorous process. And onceyou get accepted, you get a full training and it’sall free. I refer a few people to it. And I one ofthe things that I know that they are willing to if Iwere to say, hey I’m going to go ahead and give thisperson employment after they get training, thatperson has a better chance of going through theprogram. I actually took two individuals back, Ithink, 2014 on a project that I had from that program

and kind of trained them -- some wiring things anddifferent networking stuff. But I would like to grow. I would like todo more business with the county. I’m a part of thelocal small business, the Montgomery County LocalSmall Business -- I forgot the acronym. At the endof the day I have not gotten anything from there. SoI know that the governor of Maryland, they passedsome legislation to make it easy for small businessesto be able to work with procurement. And I will ask if there is any way -- Iknow someone mentioned having a focus group that cantry to communicate with small businesses to see howbest you -- you know, and leverage getting them somecontracts. If anything can be done to ensure thatsmall businesses like mine can do businesses with thecounty -- because one of the things when I checkedabout two years ago, there was the CATs contract thatcame out. I missed the deadline to apply for itwhile a lot of companies on there were big. I knowthey would struggle to get them to cooperate withlocal businesses. So if there’s any way that, you know, forIT company coming up -- one or two-man shop -- to beable to have these opportunities of growth, I think

that would be good for the county. MR. ELRICH: So something we’re actuallyworking on. I don’t know if you were in the roomwhen we talked about doing local preference forcontractors -- goes beyond the small business setaside who actually will preference local businesses.Unbundling contracts is meant to make contractsavailable to more people and making sure we don’tmake contracts that are so big that only largecompanies can apply for them is another thing we’relooking at. But I’ve got to say this because it’strue. I mean, I’ll be blunt. We have one goodincubator in Montgomery County that’s the biotechincubator in Germantown. The one in Rockvilleprovides virtually no business assistance. So if youknow what you’re doing and you’ve got a reasonableopportunity for success, we offer you cheap rent. Wedon’t offer you business training. We don’t offeryou marketing. So we don’t offer you anythingthat’ll make you grow. And the one under the pee pee bridge -- onthe other side of the pee pee bridge -- we aremanaging that so badly that we have HOC occupyinghalf the space in there which has nothing to do withbeing an incubator because we don’t program it rightand we haven’t thought about it right. We used tohave somebody in charge of incubators. When the previous executive changed theeconomic development stuff and set up the EconomicDevelopment Corporation, he transferred all the moneyfrom Montgomery County economic development to theEconomic Development Corporation which had no

them about commercial rent control. But I think thetruth is you folks are all toast. And I’ve said thisbefore. It would be nice if we revitalized the placeand let the people who are good enough to be therebefore, let them stay there afterwards. MR. MOHAMED: Exactly. MR. ELRICH: So that’s -- but that’s atough issue. If it was up to me, I’d just wave mymagic wand and do it. Grants are a tough thingbecause if you can’t get a loan from a bank, askingthe county to put taxpayer money at risk is a toughthing to do. So I’d like us to partner more with theSmall Business Administration. One of the things we’re talking aboutdoing is moving more of our deposits into what arecalled local banks or community banks. And if we cando that, I would extract agreements for them to makemore loans into the community because PNC doesn’tneed my money. But if we’ve got local banks thathave a reputation for helping the community, if wecan make an arrangement where they are moresupportive of the community, I’m happy to move someof our deposits in that direction. I do feel -- and I’m -- I don’t know. Ithink I was alone on this on the Council before. But

we tried to get the state to pay for the Purple Linedisruption and the state said no. The Council feels-- at least has felt in the past -- it was thestate’s responsibility. I actually think it’sMontgomery County’s responsibility -- MR. KATZ: It is. MR. ELRICH: -- because the state wouldn’thave built the Purple Line if we hadn’t asked themto. They would have been more than happy not to doit. We’re the ones that made all the noise and madeall the political mess that got them to build it.And I feel if I made the mess I kind of own it. Ijust can’t say, well it’s a state project and so myhands are clean. I know my hands aren’t clean. So Iwill be looking for ways. You know, me and -- I think Tom Hucker’sgone. But me and him both intervened on thebusinesses on George Avenue when the development wentin behind and they shut the alley and it took away --so we intervened to provide financial support forthose businesses. We’re doing the same thing inWheaton behind the new Park and Planning building. I’m willing -- I’ve got to find some moneybecause we don’t have a lot of money right now. ButI’m willing to look for some funds that we can

And so we’ve had lots of opportunitiesover the past couple of years to get feedback fromthem on what they need from the government not onlyto start their businesses but to grow and sustainthose businesses here in the county. These arebusinesses that are owned by residents. They startedtheir business here because this is where their homeis and their kids go to school and they want to stayhere. So a few key points to highlight fortonight. Again, the need for new or improved foodpreparation facilities. We talked about a kitchenincubator but as those businesses get bigger, theyneed access to larger operating -- facilities as well-- larger commercial kitchen space, cut and washfacilities and a co-packing facility which I’m reallyexcited to hear about is potentially moving forwardbecause as they expand they need to move elsewhere inthe DMV or potentially even out of state. The businesses share that they needadditional educational opportunities around two mainthings. The first, as has been shared before, isfinancing options and access to capital. And thesecond is food licensing and food safetyrequirements. Again, the need to fax or hand deliver

forms as opposed to being able to email them or dothem online is just really difficult for thesebusinesses. Having additional guidance like workshopsor print resources on licensing and food safetyrequirements and then finally evaluating those costs.And so it’s already been shared tonight about those$70 one-time licenses. But as an example, we had an event, MoCoMade Expo in February where we had 20 food businessescome together for a two-hour event. They paid thecounty government $1400 just for the ability to givebuyers samples of their products. And so these --the ability to share products is critical for them toaccess new and wider audiences. And the final piece that I think appliesto food but also to every -- all the businesses thatare in the room and in the county is increased localand sustainable procurement by the county government.And so for food specifically, incorporating productsfrom our farms and other producers into our menus atcounty food service facilities or anywhere where thecounty is buying food and then also incentivizingpurchases from local food and beverage businesses andagencies small expenses so that is sort of an

But the food that’s here tonight which isnot only delicious but is local and those investments-- they seem really small but they add up and theymake a big difference to those businesses as they’regrowing. And it establishes local businesses as apriority not only for our -- for local food as acommunity priority and more importantly it serves asa model for the private sector to do the same. ROPER: I’m Karen Roper, one of thefounders of Fenton Village, Inc. whose mission is toprotect and preserve the nearly 200 small independentbusinesses in Fenton Village -- 80 percent of whichare minority; almost 40 percent owned by women.Right now Pepco is holding them hostage. As you maybe aware, they’re replacing the line down FentonStreet. They were supposed to do one block at a timefor three months and move on. That’s just what theytell you. They’re doing four or five blocks at atime. They’re unnecessarily blocking severaldriveways. DPS is acting as their PR man. Thebusinesses that have complained have now beenghosted. They now won’t even respond to me. They’vecalled us liars. Businesses are reporting abuse bythe subcontractor that they feel is coming from theirethnic and racial background. This is insane. Wehave got to lobby the state to give us local controlover Pepco. We need to -- the county can’t doanything. They have cart blanche. So everything we do for small businessesis being wiped out right now and they’ve got another
