Michigan Legislature bans 'retarded,' 'retardation' from laws
LANSING The words retarded and mental retardation will be
officially banished from a wide variety of state laws after both
the House and Senate gave final passage Thursday to a package of 15
bills commonly referred to as remove the word. All 15 bills eight
House bills and seven from the Senate passed unanimously and will
remove the words from laws dealing with criminal justice, criminal
activity, the foster care system, mental health institutions,
insurance claims, educational facilities and surrogate parenting.
The less stigmatizing terms developmentally disabled or
intellectually disabled will replace retarded and mental
retardation in state laws. The recommendations came after the
Michigan Mental Health and Wellness Commission released a report
last month that called for less incendiary language in state law.
Lois Arnold, president and CEO of Special Olympics in Michigan
which supports the bills, said all but five states in the nation
have removed the offending word from state law. Gov. Rick Snyder
supports the bills and is expected to sign them when they hit his
desk.

postsecondary goals that are annually updated and based upon an age
appropriate transition assessment, transition services, including

Case name: Utica Cmty. Schs., 113 LRP 7453 (SEA MI 01/29/13).
113 LRP 7453 Ruling: Citing numerous defects in a high school
senior's postsecondary transition plan, an ALJ determined that a
Michigan district denied the student FAPE. The ALJ gave the
district 30 days to reconvene the student's IEP team, including
representatives from any community agencies that might provide or
pay for transition services, and develop a transition plan with
measurable goals. Summary: Noting that the transition plan
developed for a high schooler with autism did not mention the
results of transition assessments, failed to include measurable
goals, and disregarded the student's clear need for adult-living
services, an ALJ determined that the plan was "woefully
inadequate." The ALJ ordered the district to reconvene the
student's IEP team and develop an appropriate postsecondary
transition plan.
