IMPORTANT:-

The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized Bank only payable at “SURENDRANAGAR ”, drawn in favor of “GUJARAT ENERGY TRANSMISSION CORPORATION LTD.,” Tender without EMD and tender fee shall be rejected. Two separate demand draft for Tender fee and EMD should be submitted with technical bid.

7. The GETCO reserves the right to award the work to one or more bidders, considering their technical and financial capacity OR to reject any or all tenders or accept any tender without assigning any reason thereof.

TERMS & CONDITION OF CONTRACTOR FOR HIRING OF VEHICLE

1 SCOPE OF WORK

Contractor have to provide one company make Vehicle having company

make/original company ”Closed Body motor van vehicle” vehicle like

Tufan/van/Trax/Cruiser/Bolero having minimum 9 to 10 persons (Excluding

driver) Including Driver having locking arrangement optional on monthly hire on

rate contract basis by the Company. The cost of fuel - Driver’s salary, R.T.O. Tax,

Insurance, repair etc. will be paid by you and remain your responsibilities.

Company will pay the charges only as mentioned in Schedule-B

2 GENERAL TERMS & CONDITIONS:

2.1 TYPE OF VEHICLE :

The vehicle to be offered for hiring shall be in up-to-date condition, RTO

passing including Tubes, Tyres , Engine as well as good condition of out-

side body. The vehicle (Closed Body) to be offered shall not h ave been

registered before two years on the date of tender o pening.

2.2 AREA OF TRAVELLING

Anywhere in Gujarat, if required outside Gujarat as per instruction of E.I.C.

2.3 QUANTITY REQUIRED.

2.4 PERIOD OF CONTRACT

The period of contract will be of 24 months w.e.f. the date of

commencement of contract. However GETCO reserves the right of extend

by further period of twelve months at the same rate and terms and

conditions

2.5 If required G.E.T.C.O. can terminate the order by giving one month

advance notice.

3 PAYMENT

Bills should be prepared in duplicate at the end of month and submitted to concern

Engineer-in-Charge for necessary processing. The bills should be accompanied

with copy of abstract of Log Book duly signed by the concerned Engineer-in-

charge. The bill will be paid subject to submission of Advance Receipt within a

period of 10 days of receipt of the bills.

4.1 TYPE OF CONDITION OF VEHICLE

The vehicle proposed to be deployed for GETCO in good conditions . Vehicle

RTO permit, Insurance papers and other requisite documents, shall be periodically

inspected / verified by user department officer authorized by GETCO. The vehicle

which is proposed for vehicle use must be purely registered in the RTO office i.e.

1) In Taxi Quota Registration

2) No private registration number vehicle will be allo wed for GETCO.

3) Vehicle which is provided by the owner, must be insured comprehensive risk

policy of occupants risk by insurance policy

4) Vehicle owner must always provide :

a) One certified zerox copy of R.C. Book.

b) Insurance policy which covers comprehensive risk and certified zerox

copy be kept in the custody of the driver

c) The driver should be provided with enough money to cover the cost of

fuel, Too Tax repair and incidental expenditure while in journey

5) Before starting journey, vehicle driver must be in the position to have the log

book of journey of the registered, contractor and it must be filled up by the

vehicle USE OFFICEIRS by mentioning opening and closing Kms of the

journey.




6) LOG BOOK of the vehicle is also to be filled up day to day by the use officers

mentioning the place visited by him along with the duration of journey, traveled

and got if duly signed.

4.2 The vehicle proposed to be deployed shall be inspected by GETCO’s authorized

Representative at any during period of contract and any defect, if noticed shall be

rectified by the contractor immediately. GETCO shall have to reject any vehicle if

condition of vehicle is not satisfactory.

5 PENALTY

5.1 If the vehicle does not report for full day a penalty double the rent of day

proportionate rental will be levied for that day and no hire charges will be

paid for that particulars day. Normally vehicle must report on fixed given

time.

5.2 In case of breakdown of any vehicle or in case of a vehicle not acceptable

to GETCO under clause No. 4.2 above the contractor will immediately

replace the same by good vehicle within shortest time say within 1 hour

only. Failure to replace the vehicle will entitle GETCO to impose penalty

equivalent to the average daily hiring charges for that period or actual

expenditure done whichever is higher for the period for which vehicle is

under breakdown and not be accepted by GETCO.

5.3 In case, if you fail to provide the vehicle requisitioned by GETCO. GETCO

authorities reserved the right to hire Car as may be required /available for

the time being from open market at the risk and cost of contractor and the

amount will be deducted from the monthly bill payable to the contractor.

5.4 If the driver fails to report on time given by controlling officer penalty of Rs.

50=00/ hour or part thereof the over time will be imposed.

6 FUEL PRICE VARIATION .

GETCO / Contractor will be allowed by claim price variation corresponding to

decrease / increase in prices of fuel only. No price variation will be payable on

cost of Oil / tyres, tubes etc. Only charges in price of Fuel will be adjustable. You

must quote prices on the basis of prevailing 15 days before the due date of tender.




Every Ten paise increase/decrease in price of fuel per Km pa yable price

shall go up/down by 1 paise. This will be applicabl e to the actual Km

traveled during the month

The tenderer must quote price on the basis of current prevailing Diesel price as base

price. Contractor shall have to produce attested photo state copies of bills of purchase

of fuel at lower and higher price and accordingly payment will be made.

7 ACCIDENT LIABILITY:

7.1 The contractor shall at all time identify and keep indemnified GETCO and its

officers, servants and agents against all third party claims, whatsoever

(including but not limited to) property losses / damages, personal accident, injury

or death of persons of any sub contractor and / or prevents of agents of the

contractor and /or of GETCO, damage to property of GETCO, arising out of the

under of the hired vehicle. The contractor shall at his own cost and initiative at

all times till the successful completion of the contractor period, maintain

comprehensive insurance policies in respect of all insurable liabilities, under

Motor vehicle act, workman’s compensation Act. Personal injuries Act,

Emergency risk Insurance Act. Approved by Secretary / GSECL and such

policies shall be of the amount and limits as may be specified by Secretary,

GSECL.

7.2 It is to be clearly understood that the GETCO shall have no privacy with the staff

employed by the contractor for the operation of the contract. Viz. drivers,

cleaners, conductors etc. The contractor shall be their principal employer for all

purpose. If due to any reason whatsoever, the GETCO is made liable to make

any payment, the amount so paid shall be payable by the Contractor to GETCO

and all such payments shall be recovered by GETCO from dues payable to the

contractor and / or from the security deposit of the contractor. Balance amount if

any is still payable by contractor; it has to be paid immediately to GETCO.

7.3 You shall have to enter into an agreement safety cum indemnity bond with

GETCO which should be executed on a non judicial stamp paper value of Rs.

100=00 at your cost.




7.4 All the general terms and conditions contained in the GETCO’s booklet of

contracts for works, not specifically brought out hearing above in this terms and

condition shall be applicable to the proposed contract

7.5 Jurisdiction: All disputes will be subject to Surendranagar jurisdiction only.

7.6 PARKING CHARGES / TOLL TAX.

The parking charges at the railway station, Bus station and at the Air Port for the

vehicle when utilized by GETCO for official purpose would be admissible subject

to the production of such parking slips duly authenticated by the use officer /

Deptt. These slips may submitted along with the bills for reimbursement of these

parking charges and same way Toll Taxes will be applicable on production of

documents duly attested by the user officer / Deptt.

8 DEFINATION OF HOURS, DAY AND MONTH

Hour’s means an hour of 60 minutes for the purpose of charges fraction of an hour up to 30 minutes will not be taken into account and more than 30 minutes will be reckoned as full one hour in a day. Day means a calendar day. (24 Hr per Day24X7) Month means a calendar month with 30 or 31 days including National Holidays and weekly holiday. Weekly holiday is not applicable in case of emergency, as the case may be. However if contract starts, say from of a calendar month a month’s period will be up to and inclusive of forth of the next month.

9 COMPUTATION OF KILOMETERS

The starting and closing kilometers will be admissible from the point of starting and

closing of journey, considered from Office of the Sup. Eng. 400KV Chorania sub-station

and back or as may be directed by Engineer-in-charge. No additional kilometers will be

allowed for to and fro journey from the Head Quarter of vehicle by owner to any place

for personal use from Head Quarter of Vehicle.

No price variation will be admissible on any other account whatsoever either the inputs

of the vehicles or for labor index.




10 MAINTENANCE OF LOG BOOK

The contractor will be required to maintain Log book as per the standard format which

will record the journeys performed by the GETCO’s officer. The Log Book when closed

or at the end of the contract should be handed over to the Company for its record.

11 MAINTENANCE OF SPEEDOMETERS

The speedometers recording the kilometers run by the vehicle should always be

maintained in working conditions. If at any time the speedometer goes out of order

then the kilometers traveled will be admissible according to route kilometers till the

speedometers is brought back into working conditions. No average shall be

admissible based on the earlier journeys to the same place

12 TERMINATION OF CONTRACT

In case of breach of any of the terms of the contract GETCO without prejudice to

any other right in law or under the contract, may cancel the work order and

terminate the contracting with 12 hours. Notice on termination, GETCO shall be

free to hire vehicle from any other sources and in such an eventuality if any extra

expenditures in incurred that amount shall be recovered from the contractor.

13 GENERAL CONDITIONS

13.1 Drivers which are provided by contractor must be fully conversant with the

routes over Gujarat State and he must be having valid driving license with

him

13.2 When day to day, vehicle reports for its duty on specific time given by

GETCO at that time driver must be fully equipped i.e. including required

money to keep the vehicle running in full condition. He should not demand

money from the officer traveling for repairing the vehicle on the road etc. If

such case of demand of money will come to our notice serious view will be

taken.

13.3 As and when the driver report with the vehicle, it should be duty topped up

with fuel, oil lubricants etc. and no extra time will be allowed for such work

after he report on duty.




13.4 GETCO also reserves the right to split up the work between two or more

parties

13.5 All vehicles hired will display boldly in paint the words ON GETCO DUTY

for vehicles hired on monthly basis. Stickers can be used for casual hired

vehicles

Driver will extend help to staff for day to day work as and when required

13.7 Vehicle should have a mobile charger permanently

13.8 Vehicle should have curtains.

13.9 The bills for travelling of the vehicle shall be paid on monthly bases.

13.10 Driver shall be preferably below the age of 40 years and never above 55yrs. The

loadging and boarding of driver shall be burner by owner.

13.11 If the contractor fails to provide a vehicle; the deduction from his RA bill should

be made on prorate considering the monthly rate payable within 26 days per month.

13.12 The driver should provide with enough money to cover the cost of fuel, repair

and incidental expenditure while in journey. Driver should provide mobile phone facility

for communication. Driver should always keep all documents relating vehicle such as

RC books, insurance, valid license and PUC certificate or any other important

documents in original copy of vehicle.

13.13 Contractor should appoint a driver with valid license to vehicle. Driver must not

be addicted of any habits. Changing of driver shall be intimated by contractor to user

of vehicle in prior.

13.14 If the contractor fails to execute the order successfully, the order will be got

completed thought agency and if required to pay higher rates in that case, difference

will be recovered from the contractor.

13.15 The agency shall submit contract agreement & indemnity bond as per format

given. The cost of agreement shall be borne by agency.

13.16 Type of fuel utilized in vehicle shall be mentioned in vehicle RC book as

well as insurance policy copy.




SAFETY CUM INDEMNITY BOND

(On Nonjudicial Stamp paper of value not less than Rs. 100.00)

KNOW ALL MEN BY THESE PRESENTS that we, _______ by this SAFETY CUM INDEMNITY BOND Executed on this _____________ Day of _________ 2014. I/We Having Registered Office _______________________________(herein after called “THE CONTRACTOR” which expression shall mean and includes my /our heirs, executors, administrators and legal representatives, successors and permitted assigns) do hereby binds myself/ourselves and also our company/firms after having the power to bind by this promise and undertaking in favour of the Gujarat Energy Transmission Corporation Limited (GETCO), Vadodara a State Transmission Utility under The Electricity Act, 2003 having its registered office at Sardar Patel Vidyut Bhavan, Race course, Vadodara.( hereinafter called as GETCO, which expression shall mean and include its legal representative, administrators assigns) has agreed under the terms and conditions of the contract no.______ dated_______made between __________ and ___________for the contract of the ____________value of Rs. __________ interalia on production of Safety Cum Indemnity Bond.

We do hereby undertake and agree to Indemnify and keep Indemnified GETCO from time to time to the extent of Rs.______ Rupees________only against any losses or damages, costs, charges and expenses caused to or suffered by reason of the CONTRACTOR while Project, R&M, O&M work including work carried out by outsourcing agency, failing to take proper care or not complying the guidelines given hereunder as per AnnexureA and instructions which may be given from time to time during the continuance of the contract and we further undertake to unconditionally pay the amount claimed by the GETCO on demand and without demur to the extent aforesaid.

Whereas the CONTRACTOR has/have been awarded to execute the job/works under order no._____, dated ______ for _________ issued by the GETCO after having observing necessary formalities, the details of which is described in the order no.______ dated ______ and whereas the said job/works will be /likely to be done in places covered under Employees’ State Insurance Act,1948 (ESI) and /or the Workmen Compensation Act,1923 and /or other laws relating to the Labour Management and Welfare Act. (Respective Amendments)

And whereas according to the condition of the Contract the CONTRACTOR is under obligation to execute this Safety cum Indemnity Bond before the commencement of actual execution of work

Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the guidelines as per AnnexureA prepared by the GETCO.

Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether there has been any breach of the guidelines as per AnnexureA of this bond and as to the extent of the loss, damages, costs, charges and expenses caused to or suffered by the GETCO.

We the CONTRACTOR further agree that our liability under this bond shall not be discharged because of the change in the constitution of the GETCO or for the extension of the time limit or for any other reason.

We the CONTRACTOR further agrees to the given terms and conditions: a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO




from all claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR. b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the time being in force. c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per AnnexureA or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labour Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR . d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE. e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated violation of any guidelines as per AnnexureA and terms and conditions mentioned in this Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR . f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider due to negligence or noncompliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below:

g. I/We the CONTRACTOR hereby confirm that in case of any dispute/difference for settlement of claims under this Safety Cum Indemnity bond the courts in Gujarat State wherever job/work is performed or as per GETCO norms shall have the jurisdiction to decide the rights & liabilities of the parties while adjudicating the matter of claims under this Safety Cum Indemnity Bond. h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the GETCO in Writing on the CONTRACTOR’s application after the Contractor has discharged all his obligations under the order mentioned hereinabove and submitted a “NO DEMAND CERTIFICATE” from the GETCO under the said order. The Safety cum Indemnity Bond shall be valid for a CONTRACT PERIOD and renewable thereof (Claim Period). i. This Safety cum Indemnity Bond and the guidelines as per AnnexureA herein contained are in




addition to And not by way of limitation or substitution for any other guarantee, indemnities Hereto before given to the GETCO by the

ANNEXURE A

OUR ENDEVOUR Safety a habit

To create environment where Business Confidence is built through Best Business Practices and is fostered in an atmosphere of trust and respect between providers of goods and services and their users for the ultimate benefit of society a the nation, safety guidelines are agreed upon by the agency as under.

Safety is our prime concern and zero accident is our goal. In order to prevent the accident, while execution of works in indoor and outdoor systems of GETCO, the following guideline and preventive measures are identified.

Indoor safety precaution Outdoor safety precaution

The method of work required T&P and manpower should be discussed between GETCO supervisor, contractor’s supervisor and gang leaders.


Prior to execution of work a joint survey must be conducted by GETCO supervisor and contractor’s supervisor for risk assessment •Clearly identify the work location, to distinguish between the equipment that is dead and other equipment / part that may be live. •Disconnect equipment from supply. •Protect against other live parts. •Take special precautions when close to bare conductors / Bus bar.

Prior to execution of work a joint survey must be conducted by GETCO supervisor, contractor’s supervisor and DISCOM line man in order to identify the following : a. HT/LT line or tap line crossing under each span of line of the work. b. Isolation point of each line crossing. c. Each line crossing & isolation point under each span must be discussed and noted in maintenanceregister with sketch.

Following safety guidelines are mandatory for all contractors operating in GETCO premises for Electrical, non electrical & civil works. 1. The contractors must provide advance planning of work to concerned incharge of substation in writing. 2. Before starting any work whether switch yard, “permit to allow to work” must be taken from control room incharge. 3. TERMS & CONDITION OF CONTRACTOR FOR HIRING OF VEHICLE

1 SCOPE OF WORK

Contractor have to provide one company make Vehicle having company

make/original company ”Closed Body motor van vehicle” vehicle like

Tufan/van/Trax/Cruiser/Bolero having minimum 9 to 10 persons (Excluding

driver) Including Driver having locking arrangement optional on monthly hire on

rate contract basis by the Company. The cost of fuel - Driver’s salary, R.T.O. Tax,

Insurance, repair etc. will be paid by you and remain your responsibilities.

Company will pay the charges only as mentioned in Schedule-B

2 GENERAL TERMS & CONDITIONS :

2.1 TYPE OF VEHICLE :

The vehicle to be offered for hiring shall be in up-to-date condition, RTO

passing including Tubes, Tyres , Engine as well as good condition of out-

side body. The vehicle (Closed Body) to be offered shall not h ave been

registered before two years on the date of tender o pening.

2.2 AREA OF TRAVELLING

Anywhere in Gujarat, if required outside Gujarat as per instruction of E.I.C.

2.3 QUANTITY REQUIRED.

2.4 PERIOD OF CONTRACT

The period of contract will be of 24 months w.e.f. the date of

commencement of contract. However GETCO reserves the right of extend

by further period of twelve months at the same rate and terms and

conditions

2.5 If required G.E.T.C.O. can terminate the order by giving one month

advance notice.

3 PAYMENT

Bills should be prepared in duplicate at the end of month and submitted to concern

Engineer-in-Charge for necessary processing. The bills should be accompanied

with copy of abstract of Log Book duly signed by the concerned Engineer-in-

charge. The bill will be paid subject to submission of Advance Receipt within a

period of 10 days of receipt of the bills.

4.1 TYPE OF CONDITION OF VEHICLE

The vehicle proposed to be deployed for GETCO in good conditions . Vehicle

RTO permit, Insurance papers and other requisite documents, shall be periodically

inspected / verified by user department officer authorized by GETCO. The vehicle

which is proposed for vehicle use must be purely registered in the RTO office i.e.

1) In Taxi Quota Registration

2) No private registration number vehicle will be allo wed for GETCO.

3) Vehicle which is provided by the owner, must be insured comprehensive risk

policy of occupants risk by insurance policy

4) Vehicle owner must always provide :

a) One certified zerox copy of R.C. Book.

b) Insurance policy which covers comprehensive risk and certified zerox

copy be kept in the custody of the driver

c) The driver should be provided with enough money to cover the cost of

fuel, Too Tax repair and incidental expenditure while in journey

5) Before starting journey, vehicle driver must be in the position to have the log

book of journey of the registered, contractor and it must be filled up by the

vehicle USE OFFICEIRS by mentioning opening and closing Kms of the

journey.




6) LOG BOOK of the vehicle is also to be filled up day to day by the use officers

mentioning the place visited by him along with the duration of journey, traveled

and got if duly signed.

4.2 The vehicle proposed to be deployed shall be inspected by GETCO’s authorized

Representative at any during period of contract and any defect, if noticed shall be

rectified by the contractor immediately. GETCO shall have to reject any vehicle if

condition of vehicle is not satisfactory.

5 PENALTY

5.1 If the vehicle does not report for full day a penalty double the rent of day

proportionate rental will be levied for that day and no hire charges will be

paid for that particulars day. Normally vehicle must report on fixed given

time.

5.2 In case of breakdown of any vehicle or in case of a vehicle not acceptable

to GETCO under clause No. 4.2 above the contractor will immediately

replace the same by good vehicle within shortest time say within 1 hour

only. Failure to replace the vehicle will entitle GETCO to impose penalty

equivalent to the average daily hiring charges for that period or actual

expenditure done whichever is higher for the period for which vehicle is

under breakdown and not be accepted by GETCO.

5.3 In case, if you fail to provide the vehicle requisitioned by GETCO. GETCO

authorities reserved the right to hire Car as may be required /available for

the time being from open market at the risk and cost of contractor and the

amount will be deducted from the monthly bill payable to the contractor.

5.4 If the driver fails to report on time given by controlling officer penalty of Rs.

50=00/ hour or part thereof the over time will be imposed.

6 FUEL PRICE VARIATION .

GETCO / Contractor will be allowed by claim price variation corresponding to

decrease / increase in prices of fuel only. No price variation will be payable on

cost of Oil / tyres, tubes etc. Only charges in price of Fuel will be adjustable. You

must quote prices on the basis of prevailing 15 days before the due date of tender.




Every Ten paise increase/decrease in price of fuel per Km pa yable price

shall go up/down by 1 paise. This will be applicabl e to the actual Km

traveled during the month

The tenderer must quote price on the basis of current prevailing Diesel price as base

price. Contractor shall have to produce attested photo state copies of bills of purchase

of fuel at lower and higher price and accordingly payment will be made.

7 ACCIDENT LIABILITY:

7.1 The contractor shall at all time identify and keep indemnified GETCO and its

officers, servants and agents against all third party claims, whatsoever

(including but not limited to) property losses / damages, personal accident, injury

or death of persons of any sub contractor and / or prevents of agents of the

contractor and /or of GETCO, damage to property of GETCO, arising out of the

under of the hired vehicle. The contractor shall at his own cost and initiative at

all times till the successful completion of the contractor period, maintain

comprehensive insurance policies in respect of all insurable liabilities, under

Motor vehicle act, workman’s compensation Act. Personal injuries Act,

Emergency risk Insurance Act. Approved by Secretary / GSECL and such

policies shall be of the amount and limits as may be specified by Secretary,

GSECL.

7.2 It is to be clearly understood that the GETCO shall have no privacy with the staff

employed by the contractor for the operation of the contract. Viz. drivers,

cleaners, conductors etc. The contractor shall be their principal employer for all

purpose. If due to any reason whatsoever, the GETCO is made liable to make

any payment, the amount so paid shall be payable by the Contractor to GETCO

and all such payments shall be recovered by GETCO from dues payable to the

contractor and / or from the security deposit of the contractor. Balance amount if

any is still payable by contractor; it has to be paid immediately to GETCO.

7.3 You shall have to enter into an agreement safety cum indemnity bond with

GETCO which should be executed on a non judicial stamp paper value of Rs.

100=00 at your cost.




7.4 All the general terms and conditions contained in the GETCO’s booklet of

contracts for works, not specifically brought out hearing above in this terms and

condition shall be applicable to the proposed contract

7.5 Jurisdiction: All disputes will be subject to Surendranagar jurisdiction only.

7.6 PARKING CHARGES / TOLL TAX.

The parking charges at the railway station, Bus station and at the Air Port for the

vehicle when utilized by GETCO for official purpose would be admissible subject

to the production of such parking slips duly authenticated by the use officer /

Deptt. These slips may submitted along with the bills for reimbursement of these

parking charges and same way Toll Taxes will be applicable on production of

documents duly attested by the user officer / Deptt.

8 DEFINATION OF HOURS, DAY AND MONTH

Hour’s means an hour of 60 minutes for the purpose of charges fraction of an hour up to 30 minutes will not be taken into account and more than 30 minutes will be reckoned as full one hour in a day. Day means a calendar day. (24 Hr per Day24X7) Month means a calendar month with 30 or 31 days including National Holidays and weekly holiday. Weekly holiday is not applicable in case of emergency, as the case may be. However if contract starts, say from of a calendar month a month’s period will be up to and inclusive of forth of the next month.

9 COMPUTATION OF KILOMETERS

The starting and closing kilometers will be admissible from the point of starting and

closing of journey, considered from Office of the Sup. Eng. 400KV Chorania sub-station

and back or as may be directed by Engineer-in-charge. No additional kilometers will be

allowed for to and fro journey from the Head Quarter of vehicle by owner to any place

for personal use from Head Quarter of Vehicle.

No price variation will be admissible on any other account whatsoever either the inputs

of the vehicles or for labor index.




10 MAINTENANCE OF LOG BOOK

The contractor will be required to maintain Log book as per the standard format which

will record the journeys performed by the GETCO’s officer. The Log Book when closed

or at the end of the contract should be handed over to the Company for its record.

11 MAINTENANCE OF SPEEDOMETERS

The speedometers recording the kilometers run by the vehicle should always be

maintained in working conditions. If at any time the speedometer goes out of order

then the kilometers traveled will be admissible according to route kilometers till the

speedometers is brought back into working conditions. No average shall be

admissible based on the earlier journeys to the same place

12 TERMINATION OF CONTRACT

In case of breach of any of the terms of the contract GETCO without prejudice to

any other right in law or under the contract, may cancel the work order and

terminate the contracting with 12 hours. Notice on termination, GETCO shall be

free to hire vehicle from any other sources and in such an eventuality if any extra

expenditures in incurred that amount shall be recovered from the contractor.

13 GENERAL CONDITIONS

13.1 Drivers which are provided by contractor must be fully conversant with the

routes over Gujarat State and he must be having valid driving license with

him

13.2 When day to day, vehicle reports for its duty on specific time given by

GETCO at that time driver must be fully equipped i.e. including required

money to keep the vehicle running in full condition. He should not demand

money from the officer traveling for repairing the vehicle on the road etc. If

such case of demand of money will come to our notice serious view will be

taken.

13.3 As and when the driver report with the vehicle, it should be duty topped up

with fuel, oil lubricants etc. and no extra time will be allowed for such work

after he report on duty.




13.4 GETCO also reserves the right to split up the work between two or more

parties

13.5 All vehicles hired will display boldly in paint the words ON GETCO DUTY

for vehicles hired on monthly basis. Stickers can be used for casual hired

vehicles

Driver will extend help to staff for day to day work as and when required

13.7 Vehicle should have a mobile charger permanently

13.8 Vehicle should have curtains.

13.9 The bills for travelling of the vehicle shall be paid on monthly bases.

13.10 Driver shall be preferably below the age of 40 years and never above 55yrs. The

loadging and boarding of driver shall be burner by owner.

13.11 If the contractor fails to provide a vehicle; the deduction from his RA bill should

be made on prorate considering the monthly rate payable within 26 days per month.

13.12 The driver should provide with enough money to cover the cost of fuel, repair

and incidental expenditure while in journey. Driver should provide mobile phone facility

for communication. Driver should always keep all documents relating vehicle such as

RC books, insurance, valid license and PUC certificate or any other important

documents in original copy of vehicle.

13.13 Contractor should appoint a driver with valid license to vehicle. Driver must not

be addicted of any habits. Changing of driver shall be intimated by contractor to user

of vehicle in prior.

13.14 If the contractor fails to execute the order successfully, the order will be got

completed thought agency and if required to pay higher rates in that case, difference

will be recovered from the contractor.

13.15 The agency shall submit contract agreement & indemnity bond as per format

Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the guidelines as per AnnexureA prepared by the GETCO.

Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether there has been any breach of the guidelines as per AnnexureA of this bond and as to the extent of the loss, damages, costs, charges and expenses caused to or suffered by the GETCO.

We the CONTRACTOR further agree that our liability under this bond shall not be discharged because of the change in the constitution of the GETCO or for the extension of the time limit or for any other reason.

We the CONTRACTOR further agrees to the given terms and conditions: a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO




from all claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR. b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the time being in force. c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per AnnexureA or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labour Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR . d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE. e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated violation of any guidelines as per AnnexureA and terms and conditions mentioned in this Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR . f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider due to negligence or noncompliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below:

I/We the CONTRACTOR hereby confirm that in case of any dispute/difference for settlement of claims under this Safety Cum Indemnity bond the courts in Gujarat State wherever job/work is performed or as per GETCO norms shall have the jurisdiction to decide the rights & liabilities of the parties while adjudicating the matter of claims under this Safety Cum Indemnity Bond. h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the GETCO in Writing on the CONTRACTOR’s application after the Contractor has discharged all his obligations under the order mentioned hereinabove and submitted a “NO DEMAND CERTIFICATE” from the GETCO under the said order. The Safety cum Indemnity Bond shall be valid for a CONTRACT PERIOD and renewable thereof (Claim Period). i. ANNEXURE A

OUR ENDEVOUR Safety a habit

To create environment where Business Confidence is built through Best Business Practices and is fostered in an atmosphere of trust and respect between providers of goods and services and their users for the ultimate benefit of society a the nation, safety guidelines are agreed upon by the agency as under.

Safety is our prime concern and zero accident is our goal. In order to prevent the accident, while execution of works in indoor and outdoor systems of GETCO, the following guideline and preventive measures are identified.

Prior to execution of work a joint survey must be conducted by GETCO supervisor and contractor’s supervisor for risk assessment •Clearly identify the work location, to distinguish between the equipment that is dead and other equipment / part that may be live. •Disconnect equipment from supply. •Protect against other live parts. •Take special precautions when close to bare conductors / Bus bar.

Prior to execution of work a joint survey must be conducted by GETCO supervisor, contractor’s supervisor and DISCOM line man in order to identify the following : a. HT/LT line or tap line crossing under each span of line of the work. b. Isolation point of each line crossing. c. Each line crossing & isolation point under each span must be discussed and noted in maintenanceregister with sketch.

Following safety guidelines are mandatory for all contractors operating in GETCO premises for Electrical, non electrical & civil works. 1. The contractors must provide advance planning of work to concerned incharge of substation in writing. 2. Before starting any work whether switch yard, “permit to allow to work” must be taken from control room incharge. 3. Utilizing Electrical / nonelectrical equipments, safety rules must be implemented. 4. If the work is to be carried out on Sunday or Public holiday, the necessary permission must be taken in advance, requesting in writing. 5. Unwanted person including children of labours will not be allowed at working site/ in the switchyard and in the prohibited area. 6. Any electrical work or electrical connections to equipment for any other work must be carried out by certified

Contractor’s supervisor and GETCO Supervisor must ensure all isolations physically with adequateearthing technically prior to give clearance to gang leader for taking up job. While execution of stringing work, the identified line crossing must be isolated / deenergized and written clearance should be obtained from concerned DISCOM supervisor. The isolation of Tap line must be physically seen and verified by Contractor and GETCO supervisor.At D.O. fuse junction contractors person should be posted to ensure that no person restore D.O. supply while work is under execution Contractor’s supervisor must ensure that concern officer take LCP for EHV line and power line crossing.

11 kV breaker in panel must be switched off and racked out only after ensuring no voltage in breaker and without door opening.

Circuit breaker opening is not an isolation and isolator on either side must be opened. No work during rains and cloudy weather condition.

Transmission line activities. 1) Used of Voltage detector to ensure outage. 2) Earthing at three point, local, left & right side of bus bar / string bus. 3) Match line colour code with colour of wrist band.

Local earthing of electrical equipments like filter M/c, welding machine, testing kits etc. is must. Crane shall only be used for material handling and erection. Working platform shall only be used for work in switchyard.
