3. Solvency: Latest bank solvency certificate from any Nationalized/Scheduled Bank of a
sum of minimum 20 % of the estimated cost shown in the tender.
4 Provident Fund Code: Separate provident fund code number towards firm registered with
Regional P. F. Commissioner. 5 Nature of Firm: Attested copy of Partnership Deed, Power of Attorney, if any, for signing
the bid documents in case of partnership firm &self affidavit for proprietorship firm. All such documents shall have to be NOTARISED
6. VAT Registration: The Bidder shall be registered under the “GUJARAT VALUE ADDED TAX – ACT”. The
certified Xerox copy of such registration under Gujarat VAT Act indicating “TIN” shall have to be submitted along with the bid by the bidder.
7. I.T. PAN CARD: The bidder should submit the attested zerox copy of PAN Card of their firm. 8. Service Tax Registration: The bidders should submit the certified copy of service tax registration
Form ST-2 of their firm. 9. Electrical contractor’s license: The bidders should submit the attested copy of GOG
Electrical Contractor licenses of firm with latest validation. 10. List of Tools & Tackles.
The bid should be clearly subscribe with our reference number due date and title of work. The offer should be
valid for acceptance for a minimum period of 6 months from the date of opening of technical bid.
No tenders will be considered received without EMD.Demand Drafts towards tender fee & EMD is to be

1. SECURITY DEPOSIT: Security Deposit should be paid within 10 days after receipt of LOI or work order.
The successful tenderers will be required to pay an amount equivalent to 5% of the value of the order as a Security Deposit for satisfactory execution of the contract. Such Security Deposit will be payable in Cash / D.D. If the full Security Deposit amount is not paid within 3 days after the receipt of the order, then the order will be cancelled at the risk & cost of the Tenderer (at the discretion of the Corporation) and without entering into any correspondences and this will be binding on the Tenderer.
2. PRICES: Prices quoted should be FIRM and exclusive of all taxes, taxes as per Govt. rules and reimbursed on production of proof. Nothing will be paid extra.
3. VALIDITY OF THE OFFER: The offer will have to be kept valid for a period of 180 days from the date of opening of technical bids. In case of finalization of the tender is likely to be delayed, the tenderers will be asked to extend the same without change in the prices or any terms and conditions of the offer. If any change is made, original or during the extended validity period, the offer will be liable for outright rejection without entering into further correspondence in this regard and no reference will also be made.
4. PRICE EVALUATION: No price preference shall be given on any account. All tenders will be evaluated on firm price basis. Corporation may go for the price L-2 depending upon the exigency. If Corporation feels that there is lack of serious competition or any other reasons, Corporation may negotiates with the L-1 party. Corporation’s decision shall be final and binding to all the parties.
5. QUANTITY DISTRIBUTION: As per current practice, in case where the quantity is to be distributed to more than one supplier, 100% quantity shall be given to the parties who are techno-commercially qualified and the L-1 prices.
6. If the Tenderer fails to pay the Security Deposit or defaults in execution of the orders placed or if Corporation suffers any financial loss due to this, then Corporation will be at liberty to adjust the amount from other orders of the same firm or by encashing the Bank Guarantee.
7. PAYMENT TERMS:Payment shall be made by the Limbdi Transmission DIVISION Office on completion of the job and production of work completion certificate of the Engineer in charge, after following the procedures of GETCO.100% Payment will be made after successful completion of the work. The payment will be made within 30 days after submission of bills.
8 SERVICE TAX :- (i) Contractor has to submit the Service Tax Registration certificate (ST-2). (ii) Contractor should be registered for the service under which they shall pay the service tax for
this contract. (iii) Contractor has to submit invoice with each RA bill & Final Bill and in which it shall be
specifically mention the nature of service &code under which the amount ofservice tax payable by contractor and payable by GETCO (if any))without fail.
9. WELFARE CESS:-
1. As per the Welfare Cess Act, the welfare cess @ 1% is applicable on supply and erection items for supply, erection, testing & commissioning of substation, transmission lines, EPC/Turnkey projects, and civil works.
2. Contractor shall get registered under Welfare Cess Act before commencement of work in required head as per nature of work. Office of the Factory Inspector is authorized at present as a registering authority.

3. GETCO shall pay the welfare cess by way of reimbursing to contractors on production of documentary evidence of payment. Registration charges will not be reimbursed.
4. The contracts for which supply or part supply of material are in the scope of GETCO, then contractors shall deposit welfare cess on estimated cost of supplied items to GETCO on progressive basis of utilization. As this part of welfare cess is on GETCO account, the same shall be reimbursed to the contractor on receipt of request letter along with documentary evidence of payment. For calculation of welfare cess on supply part, valuation as per MR shall be taken and informed to the contractor for payment. This will be over and above the A/T value. The modality of payment/ reimbursement of welfare cess will be as under.
5. On receipt of A/T, the contractor / bidder will get them registered under Welfare Cess Act and submit the documentary evidence to the concern office.Copy of Registration certificate shall be submitted before submission of 1st RA bill
6. Before release of payment of first R.A.Bill, the contractor has to submit the documentary evidence of registration. Only thereafter, the bill will be processed for payment.
7. Before release of payment of subsequent R.A.Bills, the contractor has to submit the documentary evidence of payment of welfare cess of previous R.A.Bill.
8. The welfare cess shall be reimbursed to the contractor on submission of copy of documentary evidence of payment by observing due formalities.
10. REPEAT/ADDITIONAL ORDERS:
The Corporation reserves the right to place repeat orders / additional orders on the successful tenderer up to 50% of the original quantity of the A/T at the same prices terms and conditions stipulated in the original order mutually agreed upon.
11. EXECUTION OF THE WORK: The party will have to complete the job within 24 Months from the date of issue of Commencement order. Penalty will be levied at ½ % of the order value on delays portion of the work 12. POST TENDER CORRESPONDENCE / ENQUIRIES:
Any correspondence or enquiry subsequent to opening of Technical and Commercial bids is not desirable, if the same is indulged into, it will be considered for disqualifying the tender. The Tenderer will be required to abstain from pursuing / canvassing the matter, directly or indirectly with any Officers of the Corporation, as otherwise the same would also amount to disqualification of the tender.
13. Tendered must submit offers / bids along with requisite descriptive literature etc. 14. Site visit:
(i) The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to be carried out and to get himself fully Acquainted at his own responsibility for all information that may be necessary. All cash and Liabilities arising out of the site visit shall be at bidder account.
(ii) The contractor shall be deemed to have carefully examined the work & site conditions, the general conditions, the special conditions, specifications, Schedules, drawings shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions.
(iii) If there shall have any doubts as to the meaning of any portion of these general conditions or special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed.
15. The GETCO shall have the right to make any changes, additions / deletions or modifications in any terms / conditions of the tender and / or specifications as may be deemed necessary by the Corporation at its sole discretion at any time before the due date of opening of the tender.

16. Tenderer should furnish a list of orders for similar items executed by them indicating the name of the party and their order reference to which they have supplied, to be furnished in Annexure- 6. Failure to do this will result on suppliers tender being rejected without any reference. In case of bought out items they should furnish the back up guarantee from their principals.
17. Corporation does not accept the printed conditions of any Tenderer. It will be ignored without any reference; hence tenderers should withdraw such printed conditions if they have any.
18. If the tenderer desires to quote with any technical deviations they should specifically quote the deviation & the ISS or BIS Nos. in the body of the tender itself under the respective Annexure of this tender document. If technical deviations furnished by the Tenderer are not agreeable to the Corporation, the offers may be ignored. However it will be solely at Corporation’s discretion to consider the technical deviations OR not for considering the Tenderer. No correspondences of the Tenderer after opening of the bid will be entertained in this matter.
19. Revision of prices or any commercial terms affecting the price after opening of technical bids shall not be considered and will be ignore.
20. Tenderer should specifically mention in the offers and should indicate in Block letters the name of the Partners / Proprietor / Directors who is / are the signing authority.
21. GUARANTEE: You will be responsible for the proper maintenance/performance of the line maintenance work for
the respective period for 24 months. 22. OTHER CONDITION OF WORKS:
The Corporation’s General Conditions of contract will apply to all contracts and supplier will be deemed to be fully aware of the Corporation’s general conditions of contract for the supply of plant equipment and materials except the conditions modified in this commercial terms and conditions and any ignorance of these Conditions, will not exempt supplier from their liability to abide by the same.
23. Please note that any additional conditions / deviations, if any, found in the Commercial terms & conditions, then the Price Bids of such tenderers will not be opened and no further correspondences in the matter will be allowed.
24. ARBITRATION: All questions, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out of or in relation there to and whether as to construction or otherwise shall be referred to the decision of the Sole Arbitrator, appointed by the Chairman, GETCO, for that purpose, who shall be a retired High Court Judge or retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties. Reference to the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act. 1996 as amended from time to time and the rules made there under.
25. JURISDICTION: All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of tender is issued, is situated i.e. Surendranagar.
26. SUBMISSION OF OFFERS: The firm having single legal entity and having two or more works / factory and submits offers from two or more different works / factory, in such case Corporation will consider only ONE lowest offer for allocation of quantity. Many of the tenderers are submitting their offers with the conditions of advance payment along with the order; such conditions are not acceptable by the Corporation.
27. The Tenderer if being an agent, who submits its offer to Corporation, will have to give information and declare the name of the principle from which he will procure the materials and supply to Corporation along with company’s written confirmation about quality and backup performance

guarantee. Only on getting complete information from Agent, such offer if found suitable shall be taken in consideration.
28. Corporation reserves the right to cancel any or all the offers / bids or to accept any offer without assigning any reasons. Also in case Corporation finds that there is an attempt of cartel in the prices, Corporation reserves the right to consider or reject any or all the parties offers without assigning any reasons thereof.
28. Corporation reserves the right to increase or decrease the quantity against each item/s while placing the order.
29. Tenderer should invariably fill up all the details of all the Annexure including the prices in the Price Bid Annexure of this tender document. This is mandatory. Also all the Annexure should be duly signed by authorized signatories with their rubber stamp and along with Company’s Rubber (Round) seal / stamp affixed on each paper.
30. The tenderer are required to furnish the technical information along with company seal and signature of the Tenderer on each and every page / papers of the tender documents.
31. The following List of Annexure and Documents should be invariably submitted along with the tender: 1) APPENDIX-1 to 3 2) Annexure – 1 TO 4 3) Certificate – “A”. 4) All the above documents should be duly filled in, signed & stamped with company’s seal should
be submitted along with the Technical Bids.
32. (1) All the costs of the stamp papers are to be borne by tenderer as per the Govt. Of India’s
latest guidelines. (2) The contractor shall make their own arrangements for the necessary approach, road, for
transport of their materials, men power and be responsible for the compensation on account of damage to crop etc. & shall till completion of work.
(3) All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor and no extra be claimed on this account.
33. All the tenderers must ensure that all the relevant documents / papers submitted with the tender should be serially numbered, properly bounded / tied together and properly documented. This must be adhered to.
34. All the above points should be complied by the Tenderers. If not, tenders are likely to be ignored without making any further reference.

(1) The work is to be executed with all tools, equipments required for line maintenance work in Limbdi TR. Division jurisdiction by contractor.
(2) Contractor in shall submit the daily report of work done on each day checked and signed by out supervisor prescribed. Performa shall be brought by the contractor at his own cost for such reports.
(3) Contractor shall be responsible for any accident or damage or any inconvenience caused by contractor for which the necessary compensation shall be paid by the contractor or else the same shall be recovered from the bill.
(4) It is the responsibility of the contractor to get the work done satisfactorily failing which necessary action shall be taken as per Company’s rules.
(5) The contractor or his authorized representative and his supervisor shall remain present during the work execution as & when required.
(6) If work is not carried out by contractor , it will be get done at risk and cost of contractor and amount of rate difference along with 15% Supervision charges will be recovered from the next R.A. Bill.
(7) Necessary Labor License should be obtained by the contractor, if required. (8) You shall be responsible for safety and security of your staff, tools, plants, etc. throughout the tenure of
contract without any financial implications. (9) All royalties, Sales Tax, Toll Tax, Local Tax, VAT and any other taxes including works contract tax in
respect of this contract and also any statutory variation in future towards above mentioned taxes shall be payable by the contractor and GETCO will not entertain any claim whatsoever in this respect.
(10) The contractor shall require obtaining labor license from Assistant Labor Commissioner (Control) Ahmedabad to start with the work if applicable.
(11) The contractor shall pay at the rate to his labors as per the minimum wages act as notified by the Regional Labor Commissioner (Control) Ahmedabad from time to time.
(12) The contractor shall have a Provident Fund code allotted to him by the Regional Provident Fund Commissioner and submit a monthly challan copy of PF deposit amount along with list of labors /employees, if applicable.
(13) The Contractor shall require to deposit with PF authorities the PF deduction of this labors well in time and submit a copy of Challan to Engineer in charge on monthly basis failing which owner will deduct from his bills the amount equivalent to PF deduction with Penalty Under the Act.
(14) The contractor shall strictly comply with the various provisions of payment of Wages Act, Workman Compensation Act, Minimum Wages Act, contract Labour (Regulation and Abolition) Act 1970, employees State Insurance (ESI) Act 1948 and various other labour legislatures as in existent at present in India and as amended from time to time.
(15) Paid leave facility & wages act as per the provisions of the payment of wages act at the rate of one day for each 20 days of working shall be provided and paid by the contractor.
(16) The contractor shall in the event of his workmen/employee labors sustain any injury of disablement due to an accident arising out of and in the course of his employment provide necessary medical treatment and pay compensation if any, under Workmen’s Act, 1923.
(17) The contractor shall provide safety items/kits to his employees if any, required under law. (18) The contractor shall provide necessary insurance coverage to his workmen engaged in the execution of
this contract and produce for inspection to Engineer-in-charge. (19) The labour payment is to be made in presence of Board’s officer. (20) The contractor shall maintain all records/registers required to be maintain by him under various labour
laws & produce the same before the statutory authorities when required mainly Master Roll, Register of Wages.
(21) No children under the age of 18 shall be permitted to employ by the contractor.

(22) As per provisions of Income Tax act, Company shall deduct income tax/service tax at the applicable rate.

(24) THE TIME LIMIT FOR COMPLETION OF WORK AS STIPULATED IN TENDER NOTICE WILL BE ADHERED TO.
(25) The company will not pay any kind of advances including mobilization advance. (26) Service tax shall be reimbursed on production of proof of such payment made by the contractor to the
appropriate department. (27) The successful contractor will give contact numbers of his and representatives to make immediate
contact. (28) All required tools, tackles and safety accessories will be arranged by the contractor at his cost as per
norms of GETCO. (29) The GETCO will not provide any manpower, tools, tackles, vehicles or safety accessories. (30) Successful contractor has to work on S/C and D/C tower lines. Work may have to be executed on one
circuit of D/C tower line in HOT CONDITION i.e. other circuit of D/C line in live condition. Working in HOT or COLD will be decided by the Engineer-in-Charge, considering nature and merits of work.
(31) The contractor will observe all measures for safe working and as per standards. (32) The contractor will ensure safe isolation of the line/s to be attended and line clear permits from
authentic Board officer of a sub station.
(33) The contractor will provide local earthing/s as per requirement.
(34) The contractor will remove all man, materials and local earthing provided before declaring work
completed. However they have to remain at working site till the line is taken in service satisfactorily.
(35) Work is to be executed to the full satisfaction of Engineer-in-charge.
(36) Material required will be issued from the respective jurisdiction’s store and/or Transmission
circle stores as per suitability decided by Engineer-in-charge.
(37) All the materials will be credited to the respective sub-station and/or Transmission circle stores as
decided by Engineer-in-charge after completion of work.
(38) The line maintenance program, planning and deviation shall be informed to contractor well in advance minimum before two days by in charge engineer & if contractor fails to execute the work, the penalty shall be applicable per person Rs. 300/- per days or rules as per GETCO.

We the CONTRACTOR further agrees to the given terms and conditions:
a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO from all claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR.

b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the time being in force. c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per AnnexureA or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labour Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR . d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE. e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated violation of any guidelines as per AnnexureA and terms and conditions mentioned in this Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR . f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider due to negligence or noncompliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below:

g. I/We the CONTRACTOR hereby confirm that in case of any dispute/difference for settlement of claims under this Safety Cum Indemnity bond the courts in Gujarat State wherever job/work is performed or as per GETCO norms shall have the jurisdiction to decide the rights & liabilities of the parties while adjudicating the matter of claims under this Safety Cum Indemnity Bond. h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the GETCO in Writing on the CONTRACTOR’s application after the Contractor has discharged all his obligations under the order mentioned hereinabove and submitted a “NO DEMAND CERTIFICATE” from the GETCO under the said order. The Safety cum Indemnity Bond shall be valid for a CONTRACT PERIOD and renewable thereof (Claim Period). i. This Safety cum Indemnity Bond and the guidelines as per AnnexureA herein contained are in addition to And not by way of limitation or substitution for any other guarantee, indemnities Hereto before given to the GETCO by the

Prior to execution of work a joint survey must be conducted by GETCO supervisor and contractor’s supervisor for risk assessment •Clearly identify the work location, to distinguish between the equipment that is dead and other equipment / part that may be live. •Disconnect equipment from supply. •Protect against other live parts. •Take special precautions when close to bare conductors / Bus bar.
Prior to execution of work a joint survey must be conducted by GETCO supervisor, contractor’s supervisor and DISCOM line man in order to identify the following : a. HT/LT line or tap line crossing under each span of line of the work. b. Isolation point of each line crossing. c. Each line crossing & isolation point under each span must be discussed and noted in maintenance register with sketch.
Following safety guidelines are mandatory for all contractors operating in GETCO premises for Electrical, non electrical & civil works. 1. The contractors must provide advance planning of work to concerned incharge of substation in writing. 2. Before starting any work whether switch yard, “permit to allow to work” must be taken from control room incharge. 3. Utilizing Electrical / nonelectrical equipments, safety rules must be implemented. 4. If the work is to be carried out on Sunday or Public holiday, the necessary permission must be taken in advance, requesting in writing. 5. Unwanted person including children of labours will not be allowed at working site/ in the switchyard and in the prohibited area. 6. Contractor’s supervisor and GETCO Supervisor must ensure all isolations physically with adequate earthing technically prior to give clearance to gang leader for taking up job. While execution of stringing work, the identified line crossing must be isolated / deenergized and written clearance should be obtained from concerned DISCOM supervisor. The isolation of Tap line must be physically seen and verified by Contractor and GETCO supervisor. At D.O. fuse junction contractors person should be posted to ensure that no person restore D.O. supply while work is under execution Contractor’s supervisor must ensure that concern officer take LCP for EHV line and power line crossing.

electrician/wiremen with adequate size of wire through MCB as per I.E. Rule. -Live penal area / bus bar must be isolated and sealed / bifurcated with red colour tape for visible warning. Display Board must hang on LCP panel. -Transformer must be switched off whenever and wherever contractor and line workers are not satisfied with isolation, earthing or any equipment performance of GETCO, it will be pointed out and work shall begin only after resolution. 11 kV breaker in panel must be switched off and racked out only after ensuring no voltage in breaker and without door opening.

works” and more particularly described and enumerated or referred to in the specification, terms and
conditions prescribed in the order letter, covering letter and other letters and schedule of price which for the
purpose of identification have been signed by Shri ____________________________________ on behalf of

Schedule hereunder written and all of which said documents are deemed to form part of this contract and

The conditions and covenants stipulated here-in-before in this contract are subject to and without prejudice to the rights of the Board to enforce penalty for delays and / or any other rights whatsoever including the right to reject and cancel on default or breach by the contractor of the conditions and the covenants as stipulated in the general conditions, specifications, forms or tender schedule etc. attached with GETCO’s Order No. __________________________________ ____________________________________________________.

The contract value, extent of supply & erection works, delivery dates , specifications and other relevant matters may be altered by mutual agreement and if so altered shall not be deemed or construed to mean or apply to affect or alter other terms and conditions of the contract and the general conditions and the contract so altered or revised shall be and shall always be deemed to have been subject to and without prejudice to said stipulation. demand from the GETCO within 30 days the market value of such materials which is lost, damaged or
deteriorated in full to the GETCO and shall also hereby authorize the GETCO to deduct the said sum from any
sum due to the contractor or any sum which may at any time become due to the contractor under the above
referred contract or any other contract entered into by the contractor with the GETCO.
AND WHEREAS the contractors do hereby agree to be responsible for the safe custody and protection and
preservation of the said materials against all risks (excluding war risks) and against loss, damage and
deterioration of whatsoever nature in respect of the said materials while it remains in the custody and
possession of the contractor.
AND WHEREAS the said materials shall at all times be open for inspection by any officer authorized by the GETCO
Now the conditions of the above written bond are such that the contractor shall pay the full amount forthwith to the GETCO in the event of loss, damage or deterioration or whatsoever except due to circumstances arising out of war in respect of the materials supplied by the GETCO and shall fully and effectually indemnify and keep indemnified to the GETCO against such loss, damage and deterioration.
The contractor shall keep the said materials open at all times for inspection by the officers authorized by the GETCO and produce at anytime when demanded.
