The subproject “Rehabilitation and Upgrading of Phu Lam – Cai Lay 2 220kV Transmission line” is a component of the Transmission Efficiency Project (TEP). The subproject construction will be implemented in the areas of twenty three (23) communes under the management of seven (07) districts of Ho Chi Minh city and provinces of Long An and Tien Giang.
The subproject consists of three main works:
(i) Maintaining the original status from Phu Lam 500kV substation to tower G1 with 2,824 m in length;
(ii) stringing 23,627 m of wire on the towers of the Phu Lam – O Mon 500kV transmission line from tower G1 to G7;
(iii) upgrading the current 45,378 m single-circuit to a double-circuit from tower G7 to Cai Lay 220kV substation.
The route will be upgraded from single-circuit into double-circuit at tower G7 to Cai Lay 220kV substation, which will extend over the area of eighteen communes under the management of four districts of Long An and Tien Giang provinces as follows:
Long An province:
- Nhi Thanh and Binh Thanh communes of Thu Thua district;
- Huong Phu Tho commune, ward 2, 4, 6 and Khanh Hau ward of Tan An city;
Tien Giang province:
- Tan Huong, Tan Ly Tay, Tan Ly Dong, Tan Hiep, Than Cuu Nghia, Tam Hiep, Long Dinh, Nhi Binh and Diem Hy communes of the Chau Thanh district.
- Tan Hoi and Nhi My communes of Cai Lay district.
The proposed construction period of the subproject is twelve months (excluding period of clearance and compensation) as of the commencement date which is tentatively proposed in the second Quarter of 2014.
The subproject will affect 595 households (2,485 persons), five organizations, namely Vocational Training College of Long An province, Ly Tu Trong High school, Long An Teacher Training College, Tan Huong Industrial Zone and Vietnam Institute of Seed Sciences in eighteen communes of the four districts of Long An and Tien Giang provinces. However, due to the nature of this subproject being the upgrading works of the existing Phu Lam – Cai Lay 2 220kV transmission line; so the number of households directly affected by the subproject is only 126 households out of the above 595 households; these directly households will be considered for further compensation in this subproject due to their land being permanently acquired for construction of 126 new tower foundations. The remaining households only locate in the existing ROW and they shall comply with power safety regulations in the existing transmission line; and they will temporarily affect during the process of stringing wire. The area of permanently acquired land of the affected households ranges from 2.06% to 96.60% of the total land area that they possess. Details are as bellows:
- AHs with over 20% (or over 10% for vulnerable households) of cultivated land being permanently acquired: 66 households (290 persons)
- AHs with less than 20% (or less than 10% for vulnerable households) of cultivated land being permanently acquired: 47 households (208 persons)

- AHs with crops being permanently affected: 111 households (492 persons)
- AHs with cultivated land being temporarily affected: 595 households (2,485 persons)
- AHs with crops being temporarily affected: 446 households (1,867 persons)
Notes:
In the permanently acquired land for construction of tower foundations, there are five towers located in public land under the ownership of the Government; so there is no compensation for this land area. The data in this report excluded the land of these five towers.
Permanently acquired land area at tower foundation locations of the subproject is 38,828.2 m2, in which, cultivation land constitutes of 89.6% of total permanent acquisition land area and residential land 2.8% only.
Temporarily affected land area in the ROW of the subproject is 847,234 m2, in which, cultivation and residential land account for 82.9% and 17.1% respectively.
This resettlement plan is prepared based on the WB’s OP 4.12 Involuntary Resettlement (OP 4.12) and the Resettlement Policy Framework (RPF) of the Transmission Efficiency Project.
Land acquisition and compensation activities are expected to start in the first Quarter of 2014 with an estimated budget of 56,326,229,934 VND. The budget shall be reviewed and updated at the early stage of subproject implementation to ensure the compensation at replacement cost. Budget for RP’s implementation will be from reciprocal funds of EVNNPT.

1. INTRODUCTION
1.1. Transmission Efficiency Project (TEP)
1. The National Power Transmission Cooperation (NPT) is developing Efficient Transmission Project (TEP) with funding from the World Bank (WB). The Project Development Objective (PDO) for TEP is to support the implementation of an investment programs to increase capacity of Vietnam’s electricity transmission grid, improve efficiency and reliability of electricity services and strengthen the institutional capacity of the National Power Transmission Company. The direct beneficiary of the project would be Vietnam’s electricity transmission company NPT. Indirect beneficiaries would include all segments of population. They would benefit from: (i) Improved reliability, which will reduce unserved demand and the number and duration of power outages; and (ii) Increased energy efficiency, which will reduce overall costs and GHG emissions. The project would also bring direct temporary benefits for skilled and unskilled workers that would be employed for the construction of the project. The proposed project is comprised of the following three components:
(a) The Transmission Infrastructure Component will finance transmission lines and substations at voltage levels of 220kV and 500kV. The investments will target three areas that are key to the overall economic development of Vietnam, namely the Greater Hanoi Area, the Greater Ho Chi Minh City Area and the Mekong Delta. Investments at the 500kV level will help increase the transport capacity of the main 500kV trunk system while increasing its reliability. Investments at the 220kV level are aimed at increasing the capacity of the supply points to the distribution utilities and improve the reliability of the network that serves these points.
(b) The Smart Grid Component will support modernization of monitoring, control, and protection equipment in 500kV and 220kV substations to improve the reliability of the interconnected power system as a whole and of some bulk-supply points in the distribution network. Today, 60 percent of the faults in substations are a consequence of faulty operations of monitoring, control, and protection equipment. Aided by monitoring and control gear, protection equipment: (i) detects - among other things - the locations and intensity of faults and, based on such information, determines what equipment should be disconnected to protect the system from damage; and (ii) decides when disconnected equipment should be reconnected to ensure that interruptions in the provision of electricity services are minimized.
(c) The Capacity Building and Institutional Strengthening Component will contribute to the gradual development of NPT to become an independent transmission company with revenues from the application of cost-of-service regulation in the transmission sector. The steps to be supported in this operation include the definition of technical and financial performance indicators, the introduction of enterprise asset management systems and strategies.
Component No.1 and a part of component No.2 will be implemented by three Project Management Boards of EVNNPT; component No.3 and a part of component No.2 will be implemented by EVNNPT and Electricity Regulatory Authority of Vietnam (ERAV). In this project, the land acquisition is mainly in the subprojects of the component No.1. The RP of this subproject is prepared in accordance with the Resettlement Policy Framework for Transmission Efficiency Project.

1.2. Subproject “Rehabilitation and Upgrading of Phu Lam – Cai Lay 2 220kV Transmission Line”
1.2.1. Scope of the Subproject
The subproject will be constructed within the boundaries of twenty three communes under the management of the seven districts of Ho Chi Minh city and provinces of Long An and Tien Giang. (Refer to appendix 4: Map of site area).
The subproject will be implemented to achieve the objective of (i) upgrading the existing transmission line that has been in operation for many years and with the technical and safety conditions being degraded; (ii) strengthening the transmission capacity, power network connection capacity and stabilizing the power system in the southern-west region in accordance with the National Power Development Plan for 2011-2020, considering in 2030; and (iii) creating a double-circuit axis line with high capacity to transfer electrical power from Phu Lam 500/220kV substation to Cai Lay 220kV substation in order to replace the Phu Lam – Cai Lay 1 and 2 220kV transmission line.
The scope of subproject consists of three main items:
(i) Maintaining the original status from Phu Lam 500kV substation to tower G1 with 2,824 m in length;
(ii) Stringing 23,627 m of wire on the towers of the Phu Lam – O Mon 500kV transmission line from tower G1 to G7;
(iii) Upgrading the current 45,378 m single-circuit to a double-circuit from tower G7 to Cai Lay 220kV substation.
1.2.2. Impact Scope of Subproject
Impact on land is only found at item (iii) Upgrading the current 45,378 m single-circuit to a double-circuit from tower G7 to Cai Lay 220kV substation; the works of item (iii) consist of (a) rebuilding new tower No.9B at the same position to connect to Phu Lam – O Mon 500kV transmission line; b) stringing 7,270 m of double-circuit wire on trible-circuit tower of Phu Lam – O Mon 500/220kV transmission line, section from G1 to G4; c) stringing 16,360 m of single circuit on trible-circuit tower of Phu Lam – O Mon 500/220kV transmission line, section from G4 to G7; d) upgrading the current 3,220 m single-circuit to a double-circuit from G7 to DC1 to Long An substation; e) upgrading the current 34,770 m single-circuit to a double-circuit from Long An substation to DD2 to My Tho substation; f) upgrading the current 7,400 m single-circuit to a double-circuit from My Tho substation to DC2 to Cai Lay substation; and g) upgrading two 220kV bays of 500/220kV My Tho substation (being connected from Cai Lay 220kV substation) of Long An 220kV substation. This section extends over the territory of eighteen communes.
The subproject construction of 126 tower foundations will permanently acquire 39.088,75 m2 land area; in which 38,828.2 m2 (for construction of 121 tower foundations) and 260,55m2 (for construction of 5 tower foundations) located in the land under the ownership of the local people and the Government, respectively. There is no compensation for the land area owned by the Government and the remaining land areas will be considered as further compensation and support by the owner if these acquired land areas were not compensated in the existing transmission line. Scope of the permanent land acquisition for the tower foundation construction of the subproject is as follows:

1.3. Objectives of Resettlement Plan
The resettlement plan is set up in line with the following objectives:
• Involuntary resettlement must be avoided where possible, or be reduced to the lowest possible extent by selecting appropriate design options.
• In the event that involuntary resettlement is unavoidable, resettlement activities shall be prepared and executed in accordance with sustainable development programs; and providing appropriate assistance and investments, and helping AHs to benefit from the sub-project. AHs will be thoroughly advised and allowed to participate in the preparation and execution of the Resettlement Plan;

As mentioned earlier, the subproject extends over 23 communes/wards of Ho Chi Minh city and in provinces of Long An and Tien Giang. Economic and welfare conditions are diversified through the length of the route; most of the businesses being agricultural production, orchards, small business and other small-scale industrial households. The subproject is not located near or in the environmental sensitive areas such as: cultural heritage; natural reserves and their buffer zone; wetlands; forests and estuary etc. therefore the implementation of the subproject shall not impact the sensitive areas in environment. Other impacts of subproject are recognized and assessed as follows:
a) Impact on crossing infrastructure: The location of the transmission line shall affect some infrastructure works, houses, fields and gardens of residents during upgrading. However, at crossing locations, there are methods to ensure safety, minimize damages for activities of residents under ROW.
b) Impact on land acquisition: The total area of land that is permanently occupied is 39,088.75 m2. On average, a tower foundation requires an area of 312.71 m2. In centralized residential area, foundations will be coincidently constructed with the centerline of existing foundations to minimize land acquisition impact. The area of permanent occupied land at each location of foundation is very low in comparison with the farmland area; therefore, impact on society and economy due to compensation, land acquisition is not muchIn the project area, no physical relocation is required due to the subproject’s impacts. The sub-project only affects the following areas:
- Location of tower foundations of the upgrading transmission line.
- Temporarily impact in surrounding area of the tower foundation during the construction process.
- Temporarily affected area due to stringing wire with an average width of 22 meters, the route is only calculated at area of cultivation land. The land area can be affected from 1 to 2 months.
Temporary land acquisition for the access road in the construction is not necessary because the existing domestic roads, alleys, lanes and ROW shall be used in the construction period.
2.1.2. Determination of Affected People of the Subproject
a) Determination of Affected People and Eligbility Criteria
Subproject Affected People:
The Phu Lam – Cai Lay 2 T/L subproject has only impacts covered in paragraph 3a (items ii, iii) of OP 4.12. People directly affected by this sub-project include:
- Persons whose agricultural land will be affected (permanently or temporarily) by the Project;
- Persons whose residential land/houses will be affected (permanently or temporarily) by the Project;
- Persons whose leased-houses will be affected (permanently or temporarily) by the Project;

- Persons whose businesses, occupations. or places of work will be affected (permanently or temporarily) by the Project;
- Persons whose crops (annual and perennial)/ trees will be affected in part or in total by the Project;
- Persons whose other assets or access to those assets, will be affected in part or in total by the Project; and
Identification of vulnerable groups or Households (HHs):
Vulnerable groups include those distinct groups of people who might suffer disproportionately or face the risk of being marginalized by the effects of resettlement, and specifically include:
- Poor and very poor household as identified by regulations of Government of Vietnam.
- Ethnic Minority Household.
- Household covered by Decree 67/2007/ND-CP of April 13th, 2007 on support policies for social protection beneficiaries and Decree 13/2010/ND-CP of February 27th, 2010 amending and supplementing a number of articles of the Government's Decree No. 67/2007/ND-CP.
Eligbility Criteria:
The eligibility for obtaining entitlements to compensation is generally built upon three concepts relating to asset ownership as follows:
(i) Those who have formal legal rights to land (including customary and traditional rights recognized under the laws of the country) – in the instance, it is also useful to document how long they have been using the land or the assets associated with it;
(ii) Those who do not have formal legal rights to land at the time the census begins but have a claim to such land or assets, provided that such claims are recognized under the laws of the country or become recognized through a process identified in the resettlement plan;
(iii) Those who have no recognizable legal right or claim to the land they are occupying.
Persons covered under (i) and (ii) are provided compensation for the land they lose, and other assistance. Persons covered under (iii) are provided resettlement assistance in lieu of compensation for the land they occupy, and other assistance, as necessary, to achieve the objectives set out in this policy, if they occupy the project area prior to a cut-off date established by the borrower and acceptable to the Bank. Persons who encroach on the area after the cut-off date are not entitled to compensation or any other form of resettlement assistance. All persons included in (i), (ii), or (iii) are provided compensation for loss of owned or used assets other than land.
b) Number of Affected People or Organizations or Households
1. Affected Organization
- Vocational training college of Long An province (305.25 m2 housing land at the dormitory are permanently affected.);
- Ly Tu Trong High School (305.25 m2 permanently affected);
- Long An training teacher college (369 m2 permanently affected);
- Tan Huong Industrial Zone (1,152 m2 of agricultural land permanently affected);
- Vietnam Institute of Seed Sciences (305.25 m2 of agricultural land, fruit – tree land permanently affected).

2. Affected Households and People
According to the survey result, 595 households (2,485 people) are affected by the subproject in which 113 households (498 people) have impact on land of . The level of land acquisition impact (at household level) ranges from 2.06% to 96.60% of their total landholding area. Affected people include:
- People whose land is permanently revoked for tower foundation area;
- People whose cultivated land or residential land are affected temporarily in ROW;
- People whose perennial trees and /or crops are temporarily affected in ROW;
- People whose perennial trees and / or crops are temporarily affected in ROW.
None of the affected households fall into the definition of vulnerable groups as defined in the RPF of the TEP. All households losing more than 70% have another source of income from non-agricultural activities. Their residental land is not affected by the subproject. Main activities of this subproject is to rehabilitate the current transmission line. Tower foundations will be constructed in the same place of the existing tower foundation to minimize loss of land. In this subproject, there is no physical relocation required. The result is presented in the following tables (see details in Appendix 5: The inventory of people affected by the subproject):

2.2. Impact Types of the Subproject
Impact types for AHs in this subproject only include:
- Permanently acquired cultivation land (including areas of rice/crop, annual tree, fruit tree and garden land) due to construction of tower foundation.
- Temporarily acquired cultivation land (including areas of rice/crop, garden land) in construction process of each position of tower foundation.
- Permanently affected crops (including rice, annual plants) and plants in the area of tower foundation construction;
- Temporarily affected crops (rice, farm produce) surrounding tower foundation, plants in the ROW of stringing wire.
- Impact on trees in the ROW, trees with the distance of less than 4 meters from the tree tops to the lowest conducting wire will be cut down (as identified in Article 5, Decree No. 106/2005/ND-CP dated 17/8/2005).
- Impact on houses and buildings in the ROW, it is allowable that houses and buildings be located in the ROW of transmission line, but their roofsand walls must be of nonflammable materials. Metal structure must be grounded, and distance from any part of house, building to the nearest wire at the maximum sag state is not less than 6m (as identified in Article 1, Decree No. 81/2009/ND-CP dated 12/10/2009)

Affected land in the ROW has been existed in the previous ROW, cultivation activities and other activities on land in the ROW have adapted and matched with the existence of the previous transmission line. When the transmission line is rehabilitated and upgraded, impacts on the ROW will be reduced, because the designed transmission line follows the current electrical standard and relevant Governmental regulations, by which the height of line hanging is elevated, especially in residential areas. Land use in the ROW shall be better after the transmission line is rehabilitated and upgraded.

Houses and works existing in the ROW have the height from 2.5 to 11 m, the average height is 4.8 m. The transmission line is designed to cross residential areas with the hanging height that ensure the lowest point of transmission line at maximum sag status to natural ground

surface not less than 18 m. When Phu Lam – Cai Lay 2 220kV transmission line is rehabilitated, upgraded; it must be ensured that the distance from any part of houses, works within the ROW to the nearest line at maximum sag situation is not less than 6 m. It should alsobe ensured that houses and works existing in the ROW with their roof and earthing being renovated are permitted to exist under the corridor of 220kV power grid. Therefore, the subproject will not cause relocation, resettlement for the existing houses. Furthermore, when the transmission line is rehabilitated and upgraded, the hanging height is elevated, it ensures more safety for houses in the ROW and increases more space of housing development.

3. LEGAL FRAMEWORK AND COMPENSATION POLICIES
Applicable laws and policies for implementing the resettlement and compensation comprise (i) policies of the World Bank, (ii) the current policies of compensation, assistance, resettlement of Government of Vietnam; and (iii) procedures for compensation, assistance and resettlement of local authorities (Long An province).
3.1. Legal Framework
3.1.1. Vietnam’s Policies
(1) Regulations of the Government of Vietnam on compensation, assistance and resettlement will be applied in the RP’s implementation of subproject as follows:
- The Constitution of Vietnam, 2013;
- The Land Law 2003, No.13/2003/QH11, issued on November 26, 2003 (to be replaced by the Land Law 2013 which become effective from July 1st, 2014)
- Decree No.181/2004/ND-CP issued on October 29, 2004 guiding the implementation of the Land Law revised 2003.
- Decree No.188/2004/ND-CP issued on November 16, 2004 providing the method of land price calculation and the tariff for all types of land;
- Decree No.197/2004/ND-CP issued on December 3, 2004 on compensation, support and resettlement when land is recovered by the state.
- Decree No.188/2004/ND-CP issued on November 16, 2004 on methods to determine land prices and assorted land price brackets.
- Decree No.123/2007/ND-CP dated July 27, 2007, on revision and supplementation of some regulations in decree 188/2004/ND-CP of November 16, 2004 on methods to determine land prices and assorted land price brackets.
- Decree No.17/2006/ND-CP dated January 27, 2006 on revision and supplementation of some regulations in decrees guiding the implementation of the Land Law and Decree no. 187/2004/ND-CP on transformation of state companies into joint-stock companies.
- Decree No.84/2007/ND-CP dated May 25, 2007 on revision of issuing LURC, land acquisition, implementation of land use right, procedure for compensation, resettlement when land acquired by State and grievance redress.
- Decree No.69/2009/ND-CP, effective October 01, 2009; an amendment to Decree No. 197/2004/ND-CP; supplementary regulations on land use planning, land prices, land acquisition, compensation, support and resettlement.
- Circular No.116/2004/TT-BTC dated December 17, 2004 providing guidance for the implementation of Decree No.197/2004/ND-CP dated December 3,2004 on compensation, assistance and resettlement upon the State recovery of land;
- Circular No.14/TT-BTNMT dated October 01, 2009 providing detailed regulations on compensation, assistances, relocation and process and procedures for land acquisition, land hand-over and land lease.
- Circular No.57/2010/TT-BTC issued on April 16, 2010 prescribing the estimation, use and settlement of funds for compensation, support and resettlement upon recovery by the State.
- Circular No.02/2010/TTLT-BTNMT-BTC dated January 8, 2010 issued by the Ministry

of Natural Resource and Environment and Ministry of Finance guiding the preparation appraisal, and issuance and revision of land prices revision and the competence of the city/province PC under the National Government control.
- Decision No.1956/2009/QD-TTg, dated November 17, 2009, by the Prime Minister approving the Master Plan on vocational training for rural labors by 2020.
- Decision No.52/2012/QD-TTg, dated November 16, 2012, on the support policies on employment and vocational training to farmers whose agricultural land has been recovered by the State.
- The Electricity Law 2004, No.28/2004/QH11, ratified on December 03, 2004.
- Decree No.106/2005/ND-CP (and its associated guiding circulars) dated on August 17, 2005, guiding the implementation of a number of articles under the Electricity Law regarding safety protection of high-voltage power grid.
- Decree No.81/2009/ND-CP (and its associated guiding circulars) dated on October 12, 2009, amending or supplementing a number of articles of the government’s decree No.106/205/ND-CP of August 17, 2005 which details and guide a number of articles of the electricity law regarding the safe protection of high-voltage power grid works.
- Circular No.03/2010/TT-BCT dated on January 22, 2010 of Ministry of Industry and Trade, regulating a number of articles under decrees No.106/2005/ND-CP and decree No.81/2009/ND-CP.
(2) The current stipulations on compensation, assistance and resettlement of local authorities are applied in RP’s implementation of the subproject as follows:
- Decision No.07/2010/QD-UBND dated 01/3/2010 of Long An province on the issuance of regulations of compensation, assistance and resettlement when the State claims land in Long An province;
- Decision No.55/2011/QD0UBND dated 20/12/201 of Long An province People’s Committee issuing the tariff of types of land in 2012 in Long An province;
- Decision No.17/2011/QD-UBND on 24/6/2011 regarding on amendment, supplement some of Articles of Decision on compensation, assistance and resettlement when the State claims land in Long An province, attached with the Decision No.07/2010/QD-UBND dated 01/3/2010 of Long An province
- Decision No.64/2012/QD-UBND on 17/12/2012 regarding issuance of list of land price for land types of Long An province in 2013.
- Decision No.22/2011/QD-UBND on 20/07/2011 of People’s Committee of Long An province on the issuance of unit price of plants and animals, costs of the remaining land, living activities and tombs in regions of Long An province.
- Decision No.15/2013/QD-UBND dated 24/5/2013 of Tien Giang Province People’s Committee issuing regulations on compensation, support and and resettlement when the Government revokes land to use for purposes of national defence, security, national benefits, public benefits and economic development in Tien Giang Province;
- Decision No.28/2012/QD-UBND dated 21/12/2012 of Tien Giang Province People’s Committee issuing regulations in types of land in Tien Giang Province area in 2013;
- Decision No.32/2011/QD-UBND dated 28/10/2011 of Tien Giang Province People’s Committee issuing regulations in unit price of compensation for damage of fruits, crops when

the Government revokes land to use for purposes of national defence, national benefits, public benefits, economic development.
3.1.2. World Bank’s Policies
The primary objective of the World Bank’s OP 4.12 is to explore all alternatives to avoid or at least minimize involuntary resettlement. Where resettlement is unavoidable, the living standards of displaced persons should be restored or improved relative to those conditions that prevailed prior to the subproject. The policy applies to the taking of land and other assets when land acquisition results in the loss of shelter, the loss of all or part of productive assets, or access to them, and the loss of income sources or other means of livelihood.
(Main characteristics of OP 4.12 are detailed in Resettlement Policy Framework of Efficiency Transmission Project).
3.1.3. Compatibility between policies of Government and the World Bank and necessary exemptions
Current Laws, Decrees and Regulations bring the Government of Viet Nam resettlement policies and practices to be more consistent with the World Bank’s resettlement policies. The differences between the Government’s Laws and Decrees and World Bank Policy with regard to resettlement and compensation, and how to address these gaps are shown in table 3.1.

Required Waivers
To satisfy WB OP/BP 4.12 policy on Involuntary Resettlement, articles in the laws and regulations of Vietnam that do not guarantee the APs’ right to compensation at replacement costs, or eligibility articles that do not extend the right of being restored and/or assisted to households without valid land papers, or otherwise limit the compensation required by WB OP/BP 4.12, will not apply. The requirements of WB OP/BP 4.12 will fully apply in all cases. This is in accordance with Decree No.38/2013/ND-CP, which states that in case of “discrepancy between any provision in an international treaty on Official Development Assistance, to which the Socialist Republic of Viet Nam is a signatory, and the Vietnamese Law, the provision in the international treaty on ODA shall take precedence” (Article 6, Article 7).
3.2. Principle of Compensation Applied for the Subproject
3.2.1. General Principles
All DPs who have assets within or reside within the area of project land-take before the cut-

off date are entitled to compensation or assistance for their losses. Those who have lost their income and/or subsistence will be eligible for livelihood rehabilitation assistance, based on the criteria of eligibility defined by the project and in consultation with the DPs. If, by the end of the project, livelihoods have been shown not to be restored to pre-project levels, additional measures will be provided.
- The compensation rates will be determined based on the results of independent land/assets appraisal in a timely and consultative fashion. All fees and taxes on land and/or house transfers will be waived or otherwise included in a compensation package for land and structures/houses or businesses. The local authorities will ensure that DPs choosing relocation on their own obtain, without additional cost, the necessary property titles and official certificates commensurate with similar packages provided to those who choose to move to the project resettlement sites.
- Land will be compensated “land for land” or in cash according to the DP’s choice whenever possible. The choice of land for land must be offered to those losing 20% or more of their productive land. If land is not available, the borrower must assure itself that this is indeed the case. Those losing 20% or more of their land will have to be assisted to restore their livelihood. The same principles apply for the poor and vulnerable people losing 10% or more of their productive landholding.
- DPs that prefer “land for land” will be provided with land plots with the equivalent productive capacity for lost lands or a combination of land (a standard land plot) in a new residential area nearby for residential land, and cash adjustment for the difference between their lost land and the land plots provided. The resettlement area will be planned properly and implemented in consultation with the DPs. All basic infrastructures, such as paved roads, sidewalks, drainage, water supply, and electricity and telephone lines, will be provided.
- DPs that prefer “cash for land” will be compensated in cash at the full replacement cost. These DPs will be assisted in rehabilitating their livelihoods and making their own arrangements for relocation.
- Compensation for all residential, commercial, or other structures will be offered at the replacement cost, without any depreciation of the structure and without deduction for salvageable materials. Structures shall be evaluated individually. Any rates set by category of structure must use the highest value structure in that group (not the lowest).
- The DPs will be provided full assistance (including a transportation allowance) for transportation of personal belongings and assets, in addition to the compensation at replacement cost of their houses, lands, and other properties.
- Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out in consultation with the DPs (with particular attention to vulnerable DPs), to minimize the disturbance and shorten the resettlement transition period. The rehabilitation measures will be provided to the DP's prior to the expected start-up date of works in the project sites.
- If, by the end of the project, livelihoods have been shown not to be restored to pre-project levels, additional measures should be considered.
- Financial services (such as loans or credits) will be provided to DPs, if necessary. The installment amounts and the schedule of payments will be within the repayment capacity of DPs.
- Additional efforts, such as economic rehabilitation assistance, training and other forms of assistance, should be provided to DPs losing income sources, especially to vulnerable groups

in order to enhance their future prospects toward livelihood restoration and improvement.
- The previous level of community services and resources, encountered prior to displacement, will be maintained or improved for resettlement areas.
- Contractors can only commence civil works after (i) the governmental competent agency has satisfactorily completed compensation payments and rehabilitation assistances in accordance to approved RP for sub-project; (ii) already-compensated DPs have cleared the area in a timely manner; and (iii) the area is free from any encumbrances.
3.2.2. Policies for compensation, Support and Resettlement Applied to the Subproject
In addition to the direct compensation for damages in accordance with the policy framework of World Bank and policy framework of Vietnam mentioned at the above item 3.1.1, APs have the right to receive allowance as stipulated in the Decree No.197/2004/ND-CP, Decree No.69/2009/ND-CP, and Decree No.81/2009/ND-CP. Allowances/ supports include:
- Support in renovation of roof and earthing for houses in ROW
Houses, accessory structure for accommodation, or part thereof located in the ROW, support shall be granted for renovation of roof and earthing to ensure safety conditions for existing in the ROW as stipulated by the Decree No.81/2009/ND-CP.
- Other rehabilitation measures
In addition to aforementioned, any AP exposed to any impact other than those considered to be minor, will have a range of programs to support their full livelihood restoration and assure asset compensation at replacement values; i.e. either at a replacement value for each structure or using the value of the most expensive structures as a bench mark in case those structures are categorized by “types”.

4. COMPENSATION, ASSISTANCE AND RESETTLEMENT
4.1. Compensation
Cut-off date will be proposed in the Quarter II of 2014; the cut-off date of the subproject will be officially notified to affected people by relevant local authorities. Damages will be inventoried in detail after the cut-off date to implement compensation, resettlement assistance under the stipulations. The impacts listed in this report is totaled up in line with the preliminary survey data in investment phase, its data will be used to prepare plan and cost estimate for compensation. All damages and compensation costs will be made accurate in phase of compensation and land acquisition.
Persons who encroach and move into the area that proposed to be affected area after the cut-off date will not be entitled to compensation and resettlement. They will be requested to dismantle affected structures, cut trees or harvest crops for land clearance of the project; however, they will not have to pay any fine. The cut-off date and terms “no compensation for the encroachers” will be announced clearly to People’s Committee of commune level by the project’s owner.
Replacement cost: In this subproject, the damages are only lands, perennial trees and crops. Survey result has shown that transmission line in the sub-project will be built in rural areas; most of the land is only for agricultural production (rice plants, crops) and gardening with long term stability. There is no trading of land, plants and crops (mostly land is transferred from the owners to their children and relatives) and through consultation with local authorities (Thu Thua, Tan An city of Long An province and Chau Thanh district, Cai Lay of Tien Giang province), compensation prices of land, plants and crops will be applied according to the price regulated by the People’s Committee of province). It is based on the following Decisions:
- Decision No.07/2010/QD-UBND dated 01/3/2010 of Long An province on the issuance of regulations of compensation, assistance and resettlement when the State claims land in Long An province;
- Decision No.17/2011/QD-UBND on 24/6/2011 regarding on amendment, supplement some of Articles of Decision on compensation, assistance and resettlement when the State claims land in Long An province;
- Decision No.64/2012/QD-UBND on 17/12/2012 regarding issuance of list of land price for land types of Long An province in 2013.
- Decision No.22/2011/QD-UBND on 20/07/2011 of People’s Committee of Long An province on the issuance of unit price of plants and animals, costs of the remaining land, living activities and tombs in regions of Long An province;
- Decision No.15/2013/QD-UBND dated 24/5/2013 of Tien Giang Province People’s Committee issuing regulations on compensation, support and and resettlement when the Government revokes land to use for purposes of national defence, security, national benefits, public benefits and economic development in Tien Giang Province;

It is worth to note that land and plant unit prices applied in this RP is only for estimation (at the time of compiling this RP). At the time of implementation of RP (expected in 2014), land compensation unit price will be updated to ensure that affected people will be compensated at the level of replacement cost for their losses.

Notes: The unit price residential land applied is the average unit price in commune/ town/ ward.
In the case that the land use purposes are not changed (e.g: houses and works that are allowable to exist in the ROW) but its usage capacity is limited, compensation will be paid in cash based on the real damage.
However, the transmission line of rehabilitation from 1 circuit to 2 circuit from G7 – Cai Lay 220kV substation mainly enters the ROW of the existing Phu Lam – Cai Lay 1 220kV transmission line and Phu Lam – Cai Lay 2 220kV transmission line. Effects due to limitation of land use posibility has previously existed in ROW of the existing Phu Lam – Cai Lay 1 220kV transmission line and Phu Lam – Cai Lay 2 220kV transmission line. Therefore, effects due to limitation of land use posibility in ROW when improving and upgrading of this transmission line will not be compensated and supported.
4.1.2. Compensation Unit Price for Crops, Plant, Domestic Animal
- Compensation for plants, crops and domestic animals is applicable to permanently occupied land areas for the construction of tower foundation, revoked area of pond land for aquatic production and plants affected in the construction process of the transmission line.

- For aquaculture that at the time of revoking land, but the harvesting time has not come, compensation for actual damage will be implemented due to early harvest. The unit price for compensation of actual damage is temporarily VND 40,000/m2.
4.2. Assistance
In addition to direct compensation for damages, APs are entitled to enjoy assistance as regulated. The assistances are as follows:
4.2.1. Assistance with Occupational Change and Job Creation

4.2.3. Assistance with Production Stability
Households, individuals directly involved in agricultural production at the time the Government revokes agricultural land will be assisted in terms of life stability according to the follows:
For revoking from 20% (or 10% in case of vulnerable households) to 70% of the agricultural land area in the current use in the region of commune, ward, town; people will be assisted with their life stability within 6 months if houses removal is not required, and within 12 months if not;
For revoking more than 70% of agricultural land area in current use in the commune ward, town; people will be assisted with their life stability within 12 months if house removal is not required and 24 months if not;
The assistance for each person according to the above stipulation will be calculated in money, equivalent to 30kg of rice per month according to the average current price at the time of assistance.

4.2.4. Assistance with Renovation of Roof and Roof Earthing of Houses in the ROW
Assistance with renovation of wall, roof and earthing by technical method will be implemented for 56 houses with corrugated roof and 15 houses with leaf roof to ensure their continuing habitual condition and no necessary house removal with Article 6 of Decree No.106/2005/ND-CP on 17/8/2005 stipulating in details and guiding, implementing some articles of the Electrical Law in safety protection for high-voltage grid.
The costs for renovation of wall, roof, earthing (by the technical methods) will not be included in the cost estimate of the project because SPMB and Long An province Power Company and Tien Giang province Power Company will implement this work.
5. PUBLIC CONSULTATION AND PEOPLE PARTICIPATION
5.1. Public Consultation and People Participation
Public consultation is carried out in public meeting. In this meeting, the subproject’s owner has presented information on the subproject, compensation policies, site clearance and power

safety of the TEP by giving a lecture at the meeting and direct negotiation to affected people. This is a base for community and affected people to be participated in different phases of the subproject.
Based on information provided at the public meeting, survey result on damages and losses, implementation plans for compensation and assistance, entitlement matrix and relevant works of compensation; community and affected people will participate directly and effectively in monitoring activities of this plan. District Compensation Council shall hold meetings with the relevant communes/hamlets to announce all information relating to the subproject. In addition, local authorities shall also announce local people related to the subproject of the potential impacts of the subproject, especially about the Entitlement Matrix.
During the preparation of the RP, Consultant has held public consultation meetings at commune and ward levels with the participation of APs and representatives from People's Committee, Women Union, Veterans’ Organization, Farmer Association, Chief of Hamlet, Officer of land survey, Fatherland Front etc. of communes/wards in region of the subproject in accordance with the below schedule.

5.2. Information Disclosure
Per requirement of Bank’s policy, the Vietnamese version of this draft report was publically disclosed at subproject communes, SPPMB, and VDIC of the World Bank office in Hanoi (Jan. 2014). English version was also disclosed in InfoShop of the World Bank in Washington D.C. Final versions (English and Vietnamese) will also be re-disclosed at project sites, SPPMB, VDIC and InfoShop.
5.3. Complaints and Grievances
DPs are entitled to the complaints regarding their interests and responsibilities in the Project implementation including but not limited to entitlements, compensation policy, unit prices, land acquisition, resettlement and other entitlements related to the recovery support programs. Complaints can also concern issues related to construction safety and nuisances caused by construction. Grievance procedures should be affordable and accessible procedures for third party settlement of disputes arising from resettlement; such grievance mechanisms should take into account the availability of judicial recourse and community and traditional dispute settlement mechanisms.
The mechanism of complaint and grievances resolution steps are as below:
First Stage - At Commune People’s Committee (CPC)
An aggrieved DP may bring his/her complaint to any member of the CPC, in writing or verbally. It is incumbent upon said member of CPC to notify the CPC about the complaint. The CPC will meet personally with the aggrieved DP and will have 15 days following the lodging of the complaint to resolve it. The CPC secretariat is responsible for documenting and keeping file of all complaints that it handles.
Second Stage - At District People’s Committee (DPC)
If after 15 days the aggrieved DP does not hear from the CPC, or if the CPC gives its solutions, but DP is not satisfied with the decision taken on his/her complaint, the DP may bring the case, either in writing or verbally, to any member of DPC or DCB. The DCB in turn will have 30 days to resolve the case. The DPC is responsible for documenting and keeping file of all complaints that it handles.
Third Stage - At Provincial People’s Committee (PPC)
If after 30 days the aggrieved DP does not hear from the DCB, or if the DP is not satisfied with the decision taken on his/her complaint, the DP may bring the case, either in writing or verbally, to any member of the PPC. The PPC has 45 days within which to resolve the

complaint to the satisfaction of all concerned. The PPC secretariat is also responsible for documenting and keeping file of all complaints that it handles.
Final Stage - Court of Law Decides
If after 45 days following the lodging of the complaint with the PPC, the aggrieved DP does not hear from the PPC, or if he/she is not satisfied with the decision taken on his/her complaint, the case may be brought to a court of law for adjudication. Under no circumstance, can the DP be evicted from his/her property nor can the Government take over his/her property without the explicit permission of the court.
In order to minimize complaints, SPMB (via their assigned grievance focal point or grievance facilitation unit – GFU) will cooperate with the District Compensation Board/ Center for Land Development Fund to participate in and consult on settling complaints. Names and contact details of Grievance Focal Points and/or the Grievance Facilitation Unit (GFU) will be made publically available in information brochures and at project areas.
Local mass organizations such as Fatherland Front, Farmer’s Union, Women’s Union will be mobilized to participate actively in the process of resolving complaints, questions. The independent monitoring agency will be responsible for checking the procedures for and resolutions of grievances and complaints. The independent monitoring agency may recommend further measures to be taken to redress unresolved grievances.
DPs will be exempted from all administrative and legal fees. Besides that, an escrow accounts for resettlement payments should be used when grievance is resolving to avoid excessive delay of the project while ensuring compensation payment after the grievance has been resolved. SPMB should maintain a system to register queries, suggestions and grievances of the DPs. All queries, suggestions and grievances and their resolution should be recorded and forwarded to the PC and its functioning monitored monthly. SPMB will formulate and maintain a database of the DPs’ grievances related to the Project to ensure that all complaints are recorded, recognized and processed by the functional units at all levels.

6. REPORT, SUPERVISION/MONITORING AND EVALUATION
The implementation of RP will be periodically supervised and monitored by the SPMB in a close coordination with Peoples' Committees at different administrative units and independent monitoring agencies. The findings will be recorded in quarterly reports to be furnished to NPT, SPMB, and World Bank.
6.1. Internal Monitoring and Supervision
Internal monitoring and supervision for the RP’s implementation shall be the responsibility of SPMB. The internal monitoring and supervision will:
- Verify that the baseline information of all DPs has been carried out and that the valuation of assets lost or damaged, and the provision of compensation, resettlement and other rehabilitation entitlements have been carried out in accordance with the provisions of this Policy Framework and this RP.
- Oversee that the RPs are implemented as designed and approved.
- Verify that funds for implementing the RP are provided to the SPMB in a timely manner and in sufficient amounts for their purposes, and that such funds are used by SPMB in accordance with the provisions of the RP and policy framework.
- Record all grievances and their resolution and ensure that complaints are dealt with in a timely manner.

6.2. Independent Monitoring
An independent agency or agencies or individual consultant will be retained by SPMB to periodically carry out external monitoring and evaluation of the implementation of RP. The independent agencies would be an academic or research institutions, non-Governmental Organizations (NGO) or independent consulting firms, all with qualified and experienced staff and terms of reference acceptable to the World Bank. Depending on the magnitude of project impact, borrower with consultation from Task’s Team of the World Bank will decide the extent of using independent monitoring consultant. In addition to verifying the information furnished in the internal supervision and monitoring reports of the SPMB, the external monitoring agency will collect information from affected households.
6.3. Reporting
Internal monitoring agency will prepare quarterly report with detail of its implementation schedule, this report shall send to EVN/NPT, WB and external monitoring agency. The terms and condition applicable to the external monitoring agency shall be stipulated in detail in the contract of both parties (the external monitoring agency and SPMB).
A Resettlement Plan cannot be considered as complete until a completion audit or survey confirms that all entitlements have been received by beneficiaries and livelihood restoration is progressing on schedule.

7. IMPLEMENTATION PLAN
7.1. Implementation responsibility
Southern Power Projects Management Board (SPMB) representing NPT, have following responsibilities:
- Prepare RPs in accordance with the RPF. Coordinate with the provincial People’s Committees and local authorities to obtain consensus from provincial People’s Committee for the RPs and submit them to the WB for review and clearance.
- Develop and implement a training program for the provincial and district People’s Committee’s, relevant stakeholders involved in RP implementation and Grievance Redress.
- Where relevant, provide technical support (e.g. consultation mobilization) in identifying the replacement cost to inform compensation rate during the RP implementation.
- Secure timely availability of required budget for RP preparation and implementation;
- Conduct internal monitoring of RP implementation as per requirements set out in the project’s RPF and the RPs.
- Prepare bi-annual progress reports and submit to WB
- Designate staff with solid experience in resettlement and familiar with Bank’s safeguard policies as a social focal point for PMB.
- Take part in compensation, support and resettlement council at local level and ensure that the agreed RPs are properly implemented, documented and reported.
- Work closely with competent governmental agencies to address concern, grievances related to resettlement in their managed subprojects.
Provincial People’s Committees have responsibilities as follows:
- To direct, organize, propagate and mobilize all organizations and individuals concerning compensation, support and resettlement policies and ground clearance according to the land recovery decisions of competent State bodies;
- To direct the provincial/municipal services, departments, branches and district-level People's Committees: (i) To draw up resettlement and resettlement area plans in service of the land recovery; (ii) To draw up compensation, support and resettlement plans according to their competence;
- To approve or assign the district-level People's Committees to approve compensation, support and resettlement plans;
- To approve land prices; promulgate the property price tables for compensation calculation; prescribe support levels and supporting measures according to their competence; resettlement arrangement plans, job change training plans according to their assigned competence;
- To direct the concerned agencies to settle citizens' complaints, denunciations related to compensation, support and resettlement according to their law-prescribed competence;
- To guarantee impartiality and equity when considering and deciding on the compensation, support and resettlement when land is recovered by the State according to their competence prescribed in this Decree;
- To decide or assign the district-level People's Committees to apply coercion to cases of deliberately failing to abide by the State's land recovery decisions according to their

competence;
- To direct the examination and handling of violations in the compensation, support and resettlement domain.
The District People’s Committees have responsibilities as follows:
- To direct, organize, propagate and mobilize all organizations and individuals concerning compensation, support and resettlement policies and ground clearance according to the land recovery decisions of competent State bodies;
- To direct the compensation, support and resettlement councils of the same level to draw up, and organize the implementation of, the compensation, support and resettlement plans; approve the compensation, support and resettlement plans according to the responsibility assignment by the provincial-level People's Committees;
- To coordinate with the provincial/municipal services, departments and branches, organizations and investors in executing investments projects to build and plans to create resettlement areas in their localities according to the assignment of the provincial-level People's Committees;
- To settle citizens' complaints, denunciations related to compensation, support and resettlement according to their assigned competence; issue coercive decisions and organizing coercion in the cases falling under their competence; coordinate with the functional agencies in organizing coercion according to the decisions of competent bodies.
The compensation, support and resettlement councils shall assist the People's Committees of the same level in making, and organizing the implementation of, compensation, support and resettlement arrangement plans; work on the collective principle and decide by majority; where the numbers of votes for and against are equal, the opinion of the side joined by the council chairman shall be followed. Responsibilities of council members are as follow:
- The council chairman shall direct the council members to make, submit for approval and organize the implementation of, the compensation, support and resettlement plan;
- The investor shall be responsible for assisting the council chairman in making the compensation, support and resettlement plan, ensuring sufficient funds for timely payment of compensation, support and resettlement money;
- Representatives of persons who have land recovered shall be responsible for reflecting the aspirations of persons who have land recovered, persons who must be relocated; mobilizing persons who have land recovered to move and clear the ground according to schedule;
- Other members shall perform the tasks as assigned and directed by the council chairman, suitable to their respective branches.
- The compensation, support and resettlement councils shall be responsible for the accuracy and rationality of inventory statistics, the legality of land and property eligible or ineligible for compensation, supports in the compensation, support and resettlement.
The Center for Land Fund Development has main responsibilities related to resettlement as follows:
- To assume the prime responsibility for, or coordinate the with the compensation and ground clearance council in, organizing compensation and ground clearance;
- To work and coordinate closely with project’s stakeholders to update and implement RP as per project’s RPF.

- To provide compensation and ground clearance services;
- To develop resettlement areas;
- To build infrastructure on land funds assigned to it for management in order to organize auction;
- To provide information on land prices and land funds to organizations and individuals upon request;
- To assist the District People’s Committee and Provincial People’s Committee in disseminating information related to Resettlement Plan.
- To assist the District People’s Committee in handling complaints at district level.
- To perform other tasks under decisions of the provincial-level People's Committee.
The Commune People's Committees shall have the responsibilities:
- To organize propaganda on the land recovery purposes, compensation, support and resettlement polices of the projects;
- To coordinate with the compensation, support and resettlement councils in certifying land and property of persons who have land recovered;
- To join in, and create conditions for, the payment of compensation and support money to, and arrange resettlement for, persons who have land recovered, and create conditions for the ground clearance.

8. COST AND BUDGET 8.1. Budget
The budget for RP’s implementation is from EVNNPT’s reciprocal funds.The funds will be channeled to SPMB who will work with local competent agencies (in provinces of Long An and Tien Giang) to implement the RP as approval.
8.2. Costs of RP Implementation
Costs of the RP implementation include:
8.2.1. Cost of RP Preparation
At the beginning of the RP implementation, a survey team shall be established to (a) study design and survey the subproject site, (b) prepare forms of survey and statistics (preliminary measurement of real estates and property statistics), (c) organize community consultation meetings etc. … (d) analyze data and (e) prepare RP for approval.
SPMB has signed contract with consultant to carry out the above tasks:

8.2.2. Cost of Compensation, Assistance
- Compensation for permanently and temporarily acquired land.
- Compensation for permanently and temporarily affected trees and crops.
- Assistances according to national stipulations and the bank’s policy.

8.2.3. Cost for Compensation Council (Management Cost)
Preparation of the RP implementation, the support groups of the District Compensation Council shall be mobilized to implement (a) preparation of detailed mapping and statistical table, documents and information on resettlement, (b) organizations community meetings, (c) detailed mapping and inventory, (d) negotiate with APs and (e) complete compensation for APs and submitted for approval to District People’s Committee.
The cost for compensation council will be about 2% of the total compensation cost.
8.2.4. Cost for Independent Monitoring
Temporarily estimated cost for independent monitoring: 500,000,000 VND.
8.2.5. Contingency Cost
Pursuant to the proposed period for RP’s implementation (proposed in the first quarter of 2014) and experiences of other subprojects with similar natures/scope, which have been implemented and being implementing, the contingency cost is estimated about 10% total cost of compensation and the RP preparation.

1.1. Marginal loss (<20% of land holding or <10% for vulnerable group) The remaining area of affected plot is still economically viable for use or meets the expected personal yield.
Cash compensation at replacement cost (free from taxes and transaction costs) at 100% replacement cost for the lost area.
- Affected households to be notified at least ninety days before land recovery by the Project.
- The owner of land will hand over the land within 20 days from the date District Compensation Board fully pays compensation for land.
- For vulnerable and severely affected households, affected farmers, including landless, allocation of arable land equal per capita arable land in commune. If there no land available for allocation or, on the DPs’ request through informed choice, training/ rehabilitation programs will be provided to at least restore, if not improve, their income and living standards.
1.2. Loss >20% or >10% for vulnerable groups
Land for land compensation should be as the preferred option. If land is not available, or at the DP’s choice, cash compensation can be provided for the lost area at 100% of land replacement cost. The DP will be provided with the additional rehabilitation measures to restore the lost income sources
- Other assistance options which each province could decide based on the locality conditions.
- Affected households to be notified at least ninety days before land recovery by the Project (Land law-2003; Article 39- Item 2).
- The owner of land will hand over the land within 20 days from the date District Compensation Board/ Land Fund Development Center has paid compensation and other allowances in full.
- For poor, vulnerable and severely affected farmers, including landless, allocation of arable land equal to per capita arable land in commune, or if there no land available for allocation or, on the DPs request through informed choice, training/ rehabilitation programs will be provided to at least restore, if not improve, their income and living standards.
Land Users with temporary or leased rights to use land.
Cash compensation at the amount corresponding to the remaining investment on the land or corresponding to the remaining value of the land rental contract.
Land Users who do not have formal or customary rights to the
DPs will receive assistance corresponding up to 100% of the land value in cash. In addition to above, rehabilitation/training assistance will be provided.

affected land In case the DP uses public land where there was previous agreement to return the land to the Government when so requested, they will not be compensated for the acquired public land but will be compensated for structures, crops, trees and other assets on the land at 100% of the replacement cost.
2. Residential land
2.1. Marginal loss (i.e., land is still viable for use and not requiring relocation).
Compensation for loss of land in cash at (i) replacement cost to the legal and legalizable land users; (ii) An financial assistance of an agreed amount to the land users not having recognizable land use right.
If DPs have to rebuild their houses, they will receive a house rental allowance for 3 months in recognition of the time needed to rebuild their houses.
- Affected household to be notified at least 180 days before land recovery by the Project.
- The owner of land will hand over the land within 20 days from the date District Compensation Board/ Land Fund Development Center has paid compensation in full.
2.2. Relocated DPs
(i) Legal or legalizable land users:
It land is not available, a land plot in a resettlement site or apartment will be provided to the DP, in consultation with them. They will have full land title or apartment ownership title without any cost to them.
Or, on request of the DPs through informed choice, cash compensation at full replacement cost plus the amount equivalent to the value of the infrastructure investments calculated averagely for each household in a resettlement site. In this case, they will be expected to relocate themselves.
If the compensation amounts to less than the cost of a land plot in the project’s resettlement site, DPs will be provided additional supported to enable them to acquire the land plot (or cash assistance will be provided equivalent to this difference for self-relocated

An identified assistance amount will be provided based on the level of legality of the land and on a case by case basis.
If the DP has no place to move, a land plot or an apartment satisfactory to them will be provided in the resettlement site.
In case the relocated DP belong to vulnerable groups, the project will consider providing them with additional assistance (in cash and kind) to ensure that they can afford to relocated to a new site.

3. Houses
3.1. Partial impact: Unaffected portion of the house is still viable for use and could be remained from the technical viewpoints, therefore, require no relocation.
- If house/structure is partially affected and the remaining structure is viable for continued use, the project will provide a house/structure repair cost, in addition to the compensation for affected portion at replacement cost, to enable DPs to restore it to former or better conditions.
- Compensation for other structures/fixed assets will be at full replacement cost and will be in cash.
The calculation of rates will be based on the actual affected area and not the useable area.

3.2. Full impact (i.e., house is partially acquired by the project but no longer viable for continued use or the entire structure is acquired).
- Compensation in cash for entire affected structures will be provided at 100% of the full replacement cost for materials and labor, regardless of whether or not they have title to the affected land or permit to build the affected structure. The amount will be sufficient to rebuild a structure the same as the former one at current market prices. No deductions will be made for depreciation or salvageable materials.
- Compensation for other structures/fixed assets will be at full replacement cost and will be in cash. Tenants of state or organization’s houses will be: (i) entitled to rent or buy a new apartment of the area at least equal to their affected ones; or (ii) provided an assistance equal 60% of replacement cost of the affected land and houses. Any investments such as structures, trees, crops etc. made on the land by the DPs will be compensated at their full replacement cost.
The tenants who are leasing a private house for living purposes will be provided with transportation allowance for moving their assets. They will also be assisted in identifying alternative accommodation.
The calculation of rates will be based on the actual affected area and not the useable area.
4. Crops and Trees, aquaculture products
Owners regardless of tenure status
For annual and perennial standing crops or trees, aquaculture products regardless of the legal status of the land, compensation in cash will be paid to the affected persons, who cultivate the land, at full replacement cost in local markets to ensure the compensation is sufficient to replace the lost standing crops, trees or aquaculture products.
DPs will be given notice several months in advance regarding evacuation. Crops grown after issuance of the deadline will not be compensated.
6. Public structures
Loss of, or damage to assets
Either in (i) cash compensation to cover the cost of restoring the facilities or (ii) in kind compensation based on the negotiation between District Compensation Board/ Land Fund Development Center

9. Loss of Income/ Livelihood due to loss of productive land
Impacts due to permanent loss of 20% or more of their total productive land or where <20% land affected but the remaining land is rendered unviable.
(Legal, legalizable land users and DPs with lease agreement over the affected land)
- Allowance for Loss of Livelihood: Affected person will be compensated with one-time payment at cash equivalent to 30 kg of rice/person/month at local market price , including:
(a) DPs losing 20 - 70% of their agricultural landholding (or 10 - 70% for the poor and vulnerable groups) will be provided with the amount equivalent to 30 kg of rice/person/month for 6 months if they do not have to relocate and 12 months in case of relocation. In some special cases, in extremely difficult areas, the compensation may be provided for a maximum of 24 months;
(b) DPs losing more than 70% of their agricultural landholding will be assisted for 12 months if they do not have to relocate and 24 months in case of relocation. In some special cases, in extremely difficult areas, the compensation may be provided upto a maximum of 36 months; .(c) Households affected by loss of less than 20% of land, where the remaining land is rendered unviable for continued use, will be assisted with the above support plus any additional support as

determined, for a period of 12 months. In case of land-for-land compensation, DPs will be assisted with seedlings, agricultural-forestry extension programs, husbandry etc.
Support for job changing: Every DP affected by loss of productive land, irrespective of the degree of impact, will be provided with additional assistance equivalent to 2 - 5 times the compensation amount.
Support for vocational training and job creation: DPs will be exempted from exemption from tuition fees for the training courses for those of working age (not applicable for those who enroll for a vocational training outside the province). After finishing training courses, they will be given priorities to be recruited in local manufacturers/businesses.
10. Loss of Income/ Livelihood due to relocation of business

11. Allowances /Assistance Targeted to Vulnerable Households

12. Other Allowances/ Assistances
Loss of land and non-land assets
Incentive Bonus: A bonus of maximum 5 million VND will be awarded to DPs who dismantle their houses and vacate their premises in accordance with the resettlement schedule.
Repair Allowance: If house/structure is partially affected and the remaining structure is viable for continued use, the project will ensure that these will be restored or repaired at no cost for the community and to the community’s satisfaction.
The relocating households with children who are going to schools will be supported with 1-year tuition as regulated by the Ministry of Education
Based on the actual situation of the locality, the PPC Chairman issues other allowances to ensure accommodation and livelihood restoration for DPs. Special cases have to be submitted to the Prime Minister for approval.
