The Automotive Centre of Excellence (ACE) has been an inspiring experience for me. It has been a privilege to have been part of such a progressive and modern centre. I have been highly motivated and committed to give my very best and to work diligently at my assignments and tasks and as a result I have achieved averages of 90% with the help of the excellent knowledgeable teachers. I have thoroughly enjoyed the interactive lessons and classroom environment. The workshop environment and practical instruction with the hands on technology has been a fantastic experience.
This has directly helped me in my work placement with leading Melbourne Automotive companies, as I was able to go into the work environment confidently and well prepared. As a result of this learning I have had a head start in the job industry and have been able to contribute to the work place by being competent in undertaking tasks and apply the knowledge gained at ACE. Budget

Section 1 - General
1.1 Aprospectiveand/orenrolledinternationalstudentacknowledgesandagreestotheTermsandConditionsofEnrolmentonsigningtheOfferandAcceptanceAgreement.
1.2 TheTermsandConditionsofEnrolmentapplyequallytoanewand/orcontinuingstudentunlessotherwisespecified.
1.3 AnapplicationforrefundforaninternationalstudentmustbeauthorisedbytheChiefExecutiveOfficer(CEO)ofKanganInstituteorhisorhernominee.
1.4 BendigoTAFEandKanganInstitutereservetherighttoamendtheTermsandConditionsofEnrolmentatanytime.
1.5 Wherefeesarepaidbyapartyonbehalfofthestudent,BendigoTAFEorKanganInstitutereservetherighttonotifythatparty.
1.6 BendigoTAFEandKanganInstituteareobligedtoinformtheDepartmentofImmigrationandBorderProtectionandDepartmentofEducationofanychangeofstatuswhereastudentcompleteshisorherprogramearly,transferstoanotherprovider,isexcludedonacademicgroundsandfailstomeethisorhervisaconditions,defersorintermitshisorherstudyorotherwisechangetheexpectedcompletiondateofhisorherstudy.
1.7 BendigoTAFEandKanganInstitutemustnotreceivemorethan50%ofthetotaltuitionfeesfortheprogrampriortoprogramcommencementwheretotalprogramdurationismorethan24weeks.
1.8 BendigoTAFEandKanganInstitutemustnotrequiretheremainingtuitionfeesfortheprogrammorethan2weekspriortocommencementofstudyperiod2.
Section 2 – Default
2.1 StudentDefault

2.1.2 thestudentwithdrawsfromtheprogrameitherpriortooraftertheagreedstartdate.
2.1.3 BendigoTAFEandKanganInstituterefusetoprovide,orcontinueprovidingtheprogramduetooneormoreofthefollowing:
a) studentfailedtopayanamountpayabletotheproviderfortheprogram
b) studentbreachedaconditionoftheirstudentvisa
c) misbehaviourbythestudent
2.2 Aprospectiveand/orenrolledinternationalstudentdoesnotdefaultunderSection2.1ifthestudentdoesnotcommencethecoursebecausetheregisteredproviderdefaultsunderSection2.5.
2.3 Aprospectiveand/orenrolledinternationalstudentdoesnotdefaultunderSection2.1unlessBendigoTAFEandKanganInstituteaccordthestudentnaturaljusticebeforerefusingtoprovide,orcontinueprovidingtheprogram.
TERMS & CONDITIONS OF ENROLMENT
2.4 BendigoTAFEandKanganInstitutemustreportastudentdefaultviaPRISMSwithin5businessdaystotheSecretary(ordelegate)andTuitionAssuranceScheme,andthedefaultoutcomewithin14days.
2.5 StudentDefaultPriortoProgramCommencement
2.5.1 (i)visarefusal–refundofallfeespaidless5%oftotalpre-paidtuitionfeesor$500,whicheverisless(basedonnon-fraudulentdocumentation).
(ii)Visarefusal–norefundforallfeespaid(basedonfraudulentdocumentation).
2.5.2 Where28days,ormore,writtennoticeofwithdrawalisprovidedarefundofpre-paidfeesless15%ofpre-paidtuitionfeesforthefirstqualification.Thetuitionfeedepositforeachsubsequentqualificationisnotrefundable.
2.5.3 Wherelessthan28dayswrittennoticeofwithdrawalisprovidedarefundofpre-paidfeesless50%ofpre-paidtuitionfeesforthefirstqualification.Thetuitionfeedepositpaidforpackagedcoursesisnotrefundable(applicabletonon-SVPstudentenrolmentsonly).
2.6 StudentDefaultafterProgramCommencement

2.6.5 suspension–norefundforallfeespaid.WhereasuspensionisapprovedbyBendigoTAFEorKanganInstitutefor“compassionate&compelling”circumstancesanypre-paidtuitionfeesnotutilisedwillbetransferredtothenextstudyperiod.Alltransferredfeesarenotrefundableandsubjecttoanofurthertransfercondition.Anycompassionateandcompellingcircumstanceprovidedwillbestrictlyverifiedandexamplesof“compassionateandcompellingcircumstances”mayinclude:seriousillnessordeathofthestudentoraclosefamilymember(parent,sibling,spouseorchild),apolitical,civilandnaturaleventsortraumaticeventspreventingstudent’scommencementorfullpaymentoffees;this decision is subject to the provision of acceptable documentary evidence in support of the refund application.

2.9 BendigoTAFEandKanganInstitutemustreportaproviderdefaultviaPRISMSwithin3businessdaystotheSecretary(ordelegate)andTuitionAssuranceScheme,anddefaultoutcomewithin7days.
2.10 BendigoTAFEandKanganInstitutewillrefundpre-paidfeesnotutilisedwithin2weeksofthedefault.
2.11 BendigoTAFEandKanganInstitutedischargeobligationstorefundwhereaplaceinanalternativeprogramisarrangedatBendigoTAFEorKanganInstitute’sexpenseandtheofferisacceptedbythestudentinwriting.
*Explanatory note: If Bendigo TAFE or Kangan Institute fails to deliver the program for any of the reasons listed under 2.7 above, the student will be automatically entitled to a refund.
Section 3 - Refunds
3.1 Thetuitionfeedepositpaidforeachsubsequentqualificationisnotrefundable-exceptionSection2.5.1(i)
3.2 ThefundscoveringthetuitionfeesmustbeclearatthetimetherefundrequestismadeandalldebtstoBendigoTAFEorKanganInstitutebepaidinfullpriortoprocessingofarefund.
3.3 ArefundmustbepaidtothestudentorthepersonnominatedintheAcceptanceAgreementDeclaration(Item31).
3.4 ApartfrominstancesofproviderdefaultwherenoApplicationforRefundisrequired,arefundrequestmustbemadewithacompletedBendigoTAFEandKanganInstituteInternationalApplicationforRefundformtobesubmittedeither:

3.5 AllsectionsoftheApplicationforRefundformmustbecompletedbythestudent,signedanddatedcorrectly.Theapplicationwillnotbeprocessedwherethesignatureontheapplicationdoesnotmatchthestudent’ssignatureonotherdocumentsprovidedtoBendigoTAFEorKanganInstitute.
3.6 Thisagreement,andtheavailabilityofcomplaintsandappealsprocesses,doesnotremovetherightofthestudenttotakeactionunderAustralia’sconsumerprotectionlaws.
3.7 TheInstitutehastherighttoapprovediscretionalrefundsonacase-by-casebasis.
Section 4 - Payment of Refunds
4.1 Arefundduetoproviderdefaultwillbepaidwithin2weeksofdefault.
4.2 Arefundduetostudentdefaultwillbepaidwithin4weeks.
4.3 TherefundprocessingperiodcommencesthedatethecompletedApplicationforRefundformisreceived.Whereapplicationsareincompleteorpendingsupportingdocumentationtheprocessingdatewillcommencethedatetheapplicationiscomplete.
4.3 ArefundwillbereimbursedinAustraliandollarsunlessotherwisestipulatedbythestudentontheapplicationforrefund.
Section 5 – Overpayment and unclaimed refunds
5.1 Whereastudentmakesanoverpaymentoftuitionfees,theoverpaidamountwillbecreditedintothenextstudyperiod.Ifthestudentisinthelaststudyperiodanapplicationforrefundmustbesubmitted.
5.2 Studentshaveupto12weeksfromtheinitialdateofwrittencommunicationtoclaimtherefund.Failuretosodowillresultinforfeitoftherefundamount.
Section 6 – Transfer Fee internal Transfer or External Transfer
6.1 Internal:Whereastudentenrolledinapathwaypackagedprogram(mayincorporateGeneralEnglishand/orVocationalEducation&Trainingand/orHigherEducation)requeststotransfertoadifferentprogramwithintheInstitute,atransferfeeof$1500willbecharged.
6.2 External:Whereastudentenrolledinapathwaypackagedprogram(mayincorporateGeneralEnglishand/orVocationalEducation&Trainingand/orHigherEducation)requeststotransferprovider,atransferfeeof$2500willbecharged.Documentaryevidence/swillbestrictlyverifiedbeforetransferrequestisapproved.
6.3 Thetransferrequestwillnotbeprocesseduntilpaymentisreceivedandthetransferfeeisnon-refundable.
6.4 Thetransferrequestwillbereviewedonacase-by-casebasis.
