NUCA Position Paper – Locating and Marking Service Laterals The National Utility Contractors Association (NUCA) represents underground utility contractors, manufacturers and suppliers who provide the workforce and materials to build and maintain the nation’s network of water, sewer, gas, telecommunications and construction site development industries. As an active member of the Common Ground Alliance—an organization that works to promote best practices and shared responsibility by all stakeholders in damage prevention—NUCA strongly encourages its members do their part to prevent damage to underground facilities during construction activities. There is an ongoing debate in many states over who is responsible for the underground service laterals that run from the mains to buildings and residences that are in most cases on private property. It is unrealistic to expect property owners to fulfill the responsibility of locating and marking their service laterals. NUCA believes that effective damage prevention is ensured when both parties fill their respective responsibilities. Excavators are responsible for notifying their one-call centers prior to excavation and employing safe digging practices; underground facility owners/operators are responsible for accurately locating and marking the facilities according to their state one-call laws. As a member of the CGA’s Best Practices Committee, NUCA is currently working on developing a best practice that will address the issue, but the CGA is limiting the discussion to locating sewer laterals. While NUCA is prepared to support a CGA best practice that to some extent limits the facility operator’s responsibility to locate sewer laterals, our official position is that facility owners/operators should be required to locate all service laterals. Locating and marking underground facilities is a primary responsibility of the facility operator. Therefore, NUCA supports all efforts to change state damage prevention laws so that they require underground facility owners/operators to locate and mark all underground service laterals. This would be consistent with their responsibility to locate and mark all of their underground facilities prior to excavation activity.
