    Activities of IATA

    IATA administrates worldwide the Billing and Settlement Plan (BSP)and Cargo Accounts Settlement Systems (CASS) that serve as afacilitator of the sales, reporting and remittance of accreditedtravel and cargo agencies. Both settlement programmers are ruledby standards and resolutions.

    IATA regulates the shipping of dangerous goods and publishes theIATA Dangerous Goods Regulations manual, a globally acceptedfield source reference for airlines' shipping of hazardous materials.

    IATA assigns 3-letter IATA Airport Codes and 2-letter IATA airlinedesignators, which are commonly used worldwide. ICAO alsoassigns airport and airline codes. For Rail&Fly systems, IATA alsoassigns IATA train station codes. For delay codes, IATA assigns IATADelay Codes.

    IATA is pivotal in the worldwide accreditation of travel agents withexception of the U.S., where this is done by the Airlines ReportingCorporation. Permission to sell airline tickets from the participatingcarriers is achieved through national member organisations. Over80% of airlines' sales come from IATA accredited agents.

    five initiatives which it says will save the industry US$6.5billion every year. These projects are BCBP, IATA e-freight,CUSS (common use self-service), Baggage ImprovementProgramme (BIP) and the Fast Travel Programme.

    In 2003, the IATA Safety Operational Audit (IOSA) waslaunched with the aim to serve as a standard andworldwide recognized certification of airlines' operationalmanagement. The IOSA certification has now become anmandatory requisite for all IATA member airlines.

    WarsawConventionThe Warsaw Convention is an international

    convention which regulates liability for internationalcarriage of persons, luggage or goods performed byaircraft for reward.

    Originally signed in 1929 in Warsaw (hence thename), it was amended in 1955 atThe Hague and in1975 in Montreal. United States courts have heldthat, at least for some purposes, the Warsaw

    Convention is a different instrument from theWarsaw Convention asAmended by the HagueProtocol.

    Activities ofWarsawConvention

    In particular, the Warsaw Convention:

    y mandates carriers to issue passenger tickets;

    y requires carriers to issue baggage checks forchecked luggage;

    y creates a limitation period of 2 years within which aclaim must be brought (Article 29); and

    y limits a carrier's liability to at most:y 250,000 Francs or 16,600 SpecialDrawing Rights (SDR)

    for personal injury;y 17 SDR per kilogram for checked luggage and cargo,

    y 5,000 Francs or 332 SDR for the hand luggage of atraveller.

  • 8/3/2019 T&T Assignment o1

    68/97

    The sums limiting liability were originally given in Francs(defined in terms of a particular quantity of gold by article 22

    paragraph 5 of the convention). These sums were amended by

    the MontrealAdditional ProtocolNo. 2 to substitute anexpression given in terms of SDR's. These sums are valid inthe absence of a differing agreement (on a higher sum) withthe carrier.Agreements on lower sums are null and void.

    A court may also award a claiming party's costs, unless the

    carrier made an offer within 6 months of the loss (or at least6 months before the beginning of any legal proceedings)which the claiming party has failed to beat.

    The MontrealConvention, signed in 1999, will replace theWarsaw Convention system, once Montreal has been ratifiedby all states. Until then, however, there will be a patchwork of

    rules governing international carriage by air, as differentstates will be parties to different agreements (or no agreementat all).
