The tent will accommodate approximately 12 artists. •If you have your own tent (and lights) and would rather set it up next to the large tent, this is acceptable too - as long as space is available. (You must have weights for your tent.) Dickens of a Christmas is Spartanburg’s “official” kickoff to the holiday season. An

estimated 10,000 people flood the streets of downtown Spartanburgto get into the

holiday spirit and enjoy the festivities.

•The Christmas Market consists of a large tent with tables for vendors. The tent

will accommodate approximately 12 artists.

HOLD HARMLESS AGREEMENT, WORKERS COMP, LIABILITY WAIVERThe undersigned agrees that they will comply with all policies, procedures and regulations included with this application, and agree to be bound by andcomply with all those documents. The undersigned understands that City of Spartanburg staff and executive volunteers are responsible for makingfinal decisions with regard to the event operations and agrees to abide by their decisions.

The Vendor hereby agrees to indemnify and hold harmless the City of Spartanburg, its agents, public officials, officers, employees and authorized volunteers, from and against any and all legal actions, claims, damages, losses, expenses arising out of the Event or any activity associated with theconduct of the Vendor’s operation, including but not limited to, claims for personal or bodily injury, disease or death, or injury to or destruction of property, excluding claims caused by the willful commission or omission by employees of the City of Spartanburg acting within the scope of theiremployment. Further, the Vendor agrees to indemnify the City of Spartanburg and any of its agents, public officers, officials or employees and authorized volunteers for any attorneys’ fees and court costs incurred or to be incurred in defending any actions brought against them as a result ofthe Vendor’s use of public property or operation during the Event.

WORKERS COMP & LIABILITY WAIVERThe Vendor agrees for itself and/or its employees, agents, or volunteers associated or to be associated with the event, to waive and relinquish all workrelated and other liability claims that may result in any manner against the City of Spartanburg, its agents, public officers, officials or employees andauthorized volunteers from said Event, except for acts caused by the wanton misconduct by employees of the City of Spartanburg acting within thescope of their employment.

AUTHORIZED SIGNATURESI hereby attest that I am authorized to bind the Vendor and/or its employees, agents, or volunteers associated or to be associated with the Event, tothe terms of this agreement. I have read and understand all regulations and requirements outlined herein. I/we do hereby agree to abide by all rulesand regulations outlined herein. I/we hereby agree to meet all requirements for documentation, certification, licensing, financial responsibility and allother aspects required by the City of Spartanburg, as outlined herein. I/we understand that our lack of meeting all requirements outlined herein mayresult in the denial to participate in the Event.

The undersigned represents that this Waiver, Release and Indemnity is given in consideration for being allowed to participate in Dickens of a Christmas.
