Agenda

Any interested person or group may address the City Commission on any agenda item when recognized by the presiding officer or upon request of any Commissioner. Also, any interested person or group may address the City Commission on any matter of City concern not on the Agenda during the agenda item designated Public Comment. The comment of any member of the public or any special interest group may be limited in time. Such limitation shall not be less than five minutes unless otherwise explained by the presiding officer, subject to appeal by the Commission.

SMOKING WITHIN CITY PARKS

THE CITY OF TRAVERSE CITY ORDAINS:

That Section 608.04 and Section 608.06 of the Traverse City Code of Ordinances be amended to read in its entirety as follows:

608.04 - Smoke Tobacco free areas.

(a) Purpose. The purpose of this Ordinance is to protect the public health and welfare by regulating smoking tobacco in work sites, public places and certain other areas.

(b) Findings. The United States Surgeon General has determined that: (1) secondhand smoke exposure causes disease and premature death in people who do not smoke; (2) children exposed to secondhand smoke are at an increased risk for sudden infant death syndrome, acute respiratory problems, ear infections and asthma attacks; (3) exposure of adults to secondhand smoke has adverse effects on the cardiovascular system and causes heart disease and lung cancer; and (4) there is no risk-free level of exposure to secondhand smoke. These findings are adopted. It is also found that tobacco smoke is a major contributor to indoor air pollution. People who are at special risk from secondhand smoke include infants, children, teens, pregnant women, elderly people, nonsmokers with long-term exposure to secondhand smoke, individuals with cardiovascular disease, and individuals with impaired respiratory function. Establishing smoke-free work places is the most effective way to ensure that exposure to secondhand smoke does not occur in the workplace. The U. S. Food and Drug Administration (FDA) considers e-cigarettes to be a tobacco product and has not approved e-cigarettes as a quit tobacco device. The FDA has reported finding ingredients of e­cigarette cartridges to contain levels of cancer-causing and toxic chemicals. The World Health Organization warns that nicotine exposure, whether through inhalation, ingestion, or skin contact, can be hazardous to the health and safety of children, young people, pregnant women, nursing mothers, people with heart conditions, and the elderly. The Michigan Department of Health and Human Services indicates that e-cigarettes are not a safe alternative to other forms of tobacco. These findings are adopted.

_( c) Definitions.

(1) Business means any partnership, joint venture, corporation or other for-profit or not­for-profit entity, including but not limited to any retail establishment, where goods are sold or services are delivered.

(2) Business vehicle means a car, bus, van or other motorized unit which is owned or leased by an employer for the use of employees.

(3) Employee means any person who is employed by any employer, whether for wages, profit, or on a volunteer basis.

(4) Employer means any person or business, including any governmental entity that has one or more employees besides the owner of the Business.

(5) £-Cigarette means an electronic, noncombustible device that employs a heating element, power source. electronic circuit, battery, or other electronic, chemical, or mechanical means, regardless of shape or size. that can be used to produce vapor from nicotine in a solution or other form and the use or inhalation of which simulates smoking. This term shall include any device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, or under any other such product name or descriptor.

( 6) Enclosed area means all space between a floor and ceiling which is enclosed on all sides by solid walls or windows ( exclusive of door or passage ways) which extend from the floor to the ceiling, including all of the space inside.

(7) Food service establishment. The term "food service establishment" has the same meaning as it does in the Michigan Public Health Code, 1978 PA 368, as amended, and includes bars. When a portion of a facility is licensed as a food service establishment, then only that portion of the facility shall be considered a food service establishment under this ordinance.

(8) Public place means any enclosed area to which the public is invited or in which the public is permitted, including but not limited to any business, retail store, health facility, manufacturing facility, convention hall, meeting hall, sports arena, theater, gymnasium, health spa, swimming pool, roller rink, ice rink, bowling alley, laundromat, professional office, school, or public building.

(9) Smoking means inhaling, exhaling, burning or carrying any lighted cigar, cigarette, e­cigarette, pipe, weed, plant or related substance or product.

(10) Tobacco product means a preparation of tobacco to be inhaled, chewed, sucked or placed in a person's mouth, including e-cigarettes.

(11) Worksite means any enclosed area under the control of an employer which employees frequent during the course of their employment, including but not limited to: work areas, common areas, lounges, restrooms, lobbies, conference rooms, class rooms, cafeterias and hallways. A private residence is not a "worksite" unless it is used as a child care, adult day care or health care facility.

( d) Prohibitions. Smoking is prohibited in all enclosed areas of all of the following places and sites:

(1) Worksites;

(2) Public places;

(3) Buses, taxicabs, and other means of public transit and including bus shelters;

(4) Business vehicles that are occupied by more than one person;

(5) Semi-private rooms of health facilities;

(6) Lobbies, hallways, and other common areas in apartment buildings, condominiums, trailer parks, retirement facilities, nursing homes, and other multiple-unit residential facilities;

(7) Public places where bingo games are held;

(8) Public places in hotels and motels, plus at least 80 pecent of the rooms rented to guests at each hotel and motel; and

(9) Any facility, site or vehicle where the owner, operator, or manager of such facility, site or vehicle has prohibited smoking and has posted that prohibition prominently in writing or has given actual notice of the prohibition to the person who is smoking or who is intending to smoke.

( e) Responsibility. Both the person who is smoking and the employer, owner, operator, or manager of the area in which smoking is prohibited is responsible for violations of this Ordinance.

(f) Outside smoking. Smoking is prohibited within 15 feet of entrances, open windows and ventilation systems of all places where smoking is otherwise prohibited by this Ordinance. This prohibition shall not apply to persons who pass by such an entrance, open window, or ventilation system while traveling on a public street or sidewalk.

(g) Exemptions. The following areas are exempt from the requirements of this Ordinance:

(1) Food service establishments;

(2) Private residences and private vehicles, except when used or in connection with the child care, health care facility or adult day care facility;

(3) Tobacco specialty stores.

(h) Non-retaliation. It shall be unlawful for any person or employer to discharge, refuse to hire, or in any manner retaliate against any employee or applicant for employment because that person seeks enforcement of this Ordinance.

(i) Other laws. This Ordinance shall not be interpreted or construed to permit smoking where it is otherwise restricted or prohibited by other applicable laws or public health regulations.

(j) Penalty. A person found to violate this Ordinance shall be guilty of a municipal civil infraction subject to the sanctions as provided in this Code of Ordinances.

608.06 - Restricting smoking and use of tobacco products in designated city parks.

( a) Definitions. As used in this section: "Smoking or smoke" means the carrying by a person e>}a lighted cigar, cigarette, pipe or other lighted smoking device. The definitions contained in Section 608. 04(c) shall apply to this subsection.

(b) Smoking and use of tobacco products prohibited in designated areas in public parks. A person shall not smoke or use tobacco products in any park park buildings or shelters, designated swimming areas,___Q!-designated beach area er portions thereof, that are mechanically groomed, within 15 feet of a playground area, or waterfront parks that are

( c) Violations and penalties. A person who violates or fails to comply with this section shall be subject to any one or more of the following:

( 1) Being asked to stop smoking or using tobacco products;

(2) Being asked to leave the premises;

(3) Responsible for a municipal civil infraction and subject to the civil fines set forth in section 202.99 of this Code.

The effective date of this Ordinance is the __ day of _____ 2017.

An inspection was performed on the damages by Machin Engineering, who is currently working on the Public Services Building for another project and structural damage was not found.

Attached please find Proposals for Repair from Grand Traverse Construction and Grand Traverse Garage Door. As you are aware an employee was backing one of our large Plow Trucks out of the Wash Bay when the under-body blade came in contact with the garage door track (pictures attached) I have had Engineering along with Pat Machine from Machine Engineering inspect for structural damage with none being found. A Proposal was drafted from Grand Traverse Construction while they were still here working on the DPS Preservation project for $13,434.00 as you can see on the attached Proposal-Alternate #1 listed as the "Base Bid Amount" this has been forwarded to MML for an Insurance claim that has been paid less our deductible of $5.000.00, leaving us a check received in the amount of $8,434.00 from MML.

The current Wash Bay Entrance Door is a 12' wide door which with trim has an 11 '7" opening, the Under-body Blades of the Snow Plows are 12' wide and when angled to the plowing position is 10'6" leaving a little over 6" on each side to fit through the door. The current Truck Barn and Large Equipment repair doors are 14' wide doors. I feel that at this time given the trucks will not be any smaller and some could end up larger it would be in our best interest to take this opportunity to install a 14' Wash Bay Door. The proposal from Grand Traverse Construction dated 12-15-17 listed as Alternate #1 for a total of $22,690.00 and from Grand Traverse Garage Door of $3,291.00 reflect the cost of a 14'x14' door installation.

Would you please request of the City Commission to authorize a Service Order to Grand Traverse Construction in the amount of $22,690.00 and a Service Order to Grand Traverse Garage Door in the amount of $3,291.00.

Subsequent to the Court of Appeals decision, the owner of this project and application indicated they are not pursuing the project. While the owner's decision to not pursue the project essentially makes this matter moot, as a technicality, the City Commission needs to hold a public hearing on the issue. Attached is a communication from Acting City Attorney Karrie Zeits in connection with this matter.

At the December 4, 2017 Regular Meeting, the City Commission discussed the deficiencies in the analysis identified by the Court of Appeals on this matter and directed staff to prepare the related documentation. If you would like to documents distributed at the December 4th meeting, please contact the City Clerk's Office who will be happy to get those to you.

I recommend the following motion:

As has been identified by the City Attorney, Lauren Trible-Laucht, the Court of Appeals in Northern Michigan Environmental Action Council v City of Traverse City, COA No. 332950 (October 24, 2017), remanded consideration of the Special Land Use Permit (SLUP) issued to Pine Street Development One, LLC, which was vacated by the Circuit Court, for the construction of two 96-foot tall buildings at 305 West Front Street, to the City Commission for further action. The City Commission set a public hearing on December 4, 2017, for January 2, 2018, to comply with the Court of Appeals' decision. Pine Street Development One has determined not to pursue the SLUP any further.

The Court of Appeals' opinion identified two standards that require further action. The two standards that the Court of Appeals found deficiencies in are:

1. Section 1364.02(c). The use shall be served adequately be existing or proposed public infrastructure and services, including but not limited to, streets and highways, police and fire protection, refuse disposal, water, waste water, and storm sewer facilities, electrical service, and schools.

2. Section 1364.02(d). The use shall not create excessive additional requirements for infrastructure, facilities, and services provided at public expense.

For the first standard, the Court of Appeals found deficiencies in the following aspects of this standard: evidence and rationale determining that the development would be adequately served by police protection was lacking, data about how the proposed development would affect traffic patterns was lacking, and evidence that local schools

could support the proposed development was lacking. Included in the packet are staff reports and a letter from TCAPS addressing these aspects.

For the second standard, the Court of Appeals found that there was no substantial evidence supporting the conclusion that the proposed development would create additional tax revenue that offset the increased cost of infrastructure and services. Specifically, the Court of Appeals stated that (1) there was no data explaining how much, if any, would go to the TIF and Brownfield programs and how much, if any, the City would retain and (2) the City Commission did not address the issue of whether the City's plan to build a parking garage for the development was an excessive public expenditure. Included in the packet is a report from the DDA addressing the distribution ofrevenue to TIF and the City's general fund. Also included is a memorandum from the Planning Director explaining that the parking garage was a planned project for the City long before the proposed development.

As Pine Street Development, LLC has abandoned the SLUP request, it is not the intention of the public hearing to lead to an approval of the SLUP, but rather to eliminate any argument that the City has not complied with the Court of Appeals' decision. The recommended motion following the public hearing and consideration of the further information included in the packet is as follows:

As you are aware the Michigan Court of Appeals upheld Judge Rogers decision to allow a public vote, to the people of the city of Traverse City, for approval of buildings over sixty feet in height. The court of appeals criticized the police department's procedures as to the deficiencies in the aspects of code 1364.02(c). In particular, as it pertains to the lack of evidence by the police department to determine if the development would be adequately served by police protection.

Pine Street Development One LLC proposed two buildings at 96 feet from street elevation. The two buildings were proposed to have 162 upper story dwelling units with 20,000 square feet of commercial space at street level. It was my understanding the housing would primarily be comprised of high end apartments with a portion allotted for middle income families to fill the workforce void for downtown businesses. This project would have been a frrst for Traverse City. There are no other buildings in comparisons to draw a defmite conclusion as to the impact on the police department. The only exception is a single 10 story · building at 150 Pine Street.

Hopefully I can put aside the court's concern of a mere "scintilla" of evidence. Utilizing a Calls for Service Per Capita Equation the Traverse City Police Department will respond to approximately 13,000 calls for service ending in calendar year 2017. Our population is about 15,479. Of those calls for service are included 2,400 traffic accidents. I subtracted the accidents out of the total calls for service; leaving calls for service response at 10,600. That computes our per capita equation at around 0.68 calls for service from our residents. Assuming 305 W. Front St. has around 300 residents, mathematically it computes to 205 calls at the new address. This information was obtained from our Central Records Division through AEGIS Record system and Computer Aided Dispatch (CAD).

There are several flaws in the equation and I have known this for most of my career at the police department. The majority of our calls for service are not from our residents; however, our tourists place an inordinate burden on our agency from civil, criminal, and

assist calls. The old adage, "Go to Traverse City on vacation, go home on probation," is true. To reveal the total calls for service from our visitors would be a pain staking job with a staff person looking at every call for service and determining where the caller lived. In an attempt to give some evidence of the calls for service at 305 W. Front Street I took some comparable numbers for other housing developments in Traverse City.

• Bay Hill is a low income housing project located at 600 Bay Hill Drive in Traverse City. It has 222 housing units. We responded to 137 calls for service for 2017.

• Riverine Apartments at 505 Riverine Drive. This apartment community was built in 1988 and bas 3 stories with 80 units. We responded to 22 calls for service for 2017.

• Tradewinds Terrace is a 122 unit affordable housing community in Traverse City. It has Traverse City HUD Rental Assistance Income Limits with 122 apartments. We responded to 24 calls for service in 2017.

• Riverview Terrace consists of 115 one-bedroom apartments in a 10-story apartment building. We responded to 15 calls for service in 2017.

By comparison I do not believe that 305 W. Front Street, in and of itself, will overly burden the police department in calls for service; however, each additional building project increases a system that is having a difficult time maintaining a level of service and officer safety.

The big picture is our tourist population and formulating a medium to facilitate fair and equitable public safety funding. By reading Captain Jim Bussell's attached memo you can see what affect the commuter population has on the TCPD's level of service in relation to our calls for service.

Calls for Service

Data is from Central Records through the AEGIS Records system and CAD. 2005 -

2015 numbers were taken from monthly CAD Report- Calls for Service by Area. For

2000 and prior, data was run under the Incident Analysis Report. No data 1985 and

prior. PRIMARY calls for service are all criminal, non-criminal and traffic crashes.

ALL calls include primary plus calls categorized as "other'' which includes call types

such as: BOL, Motorist Assists, 911 hang-ups and subpoena/legal paper service.

Daytime population is also referred to "commuter population." It is essentially the number of people daily on average throughout the year estimated to be within the city of Traverse City. ·

When I first compiled this data I was not able to find the 2010 numbers on line. I contacted the U.S. Census Bureau and the estimated daytime population in 2010 was calculated as indicated in the notes; directly with the U.S. Census Bureau.

From 2000 to 2010 there was an almost exact 10% increase (9.96%) in daytime population. By contrast, in the same time period, there was less than a 1 % increase in census population.

By applying 2010 data to the 2000-2010 daytime population increase we can estimate 2020 numbers would be 36,034. That is an increase of 326.60 people p/year. The same methodology would put 2018 numbers at 35,380.

In another study we completed 2016 concerning our calls for service and staffing it was discovered that our complaint load (calls for service/incidents) is almost exactly double during the second and third quarters of the year (April-September).

If the assumption is that complaint load/calls for service are directly related to population then it can be calculated that seasonal average day time population by quarter in 2020 would look like this:

We initially gathered information about the proposed development and focused on the public

utility capacities that service the site. With two travel lanes to receive vehicular traffic and

wide sidewalks to service pedestrians and in-street bike lakes to service bikes we did not

anticipate significant impacts as a result of the projected 1620 trips per day from the project.

The addition of housing units to the downtown will provide a variety of options for multi-modal

use including transit, walking and biking. The transit center is nearby, a short walk away.

As you are aware, our area benefitted from a regional transportation planning effort, The Grand

Vison in 2010. The outcomes of four different scenarios, the Trend, Rural, Village and the City

were evaluated with transportation modeling and the preferred scenario, the Village was

selected to direct growth and development into established areas. We've attached select pages

from the Modeling Report for your reference. The maps show less capacity issues with our

current network of streets if development occurs in existing developed areas.

The site for this project is situated uniquely where the two lane street becomes a two lane,

one-way street. Based on an August 2017 traffic count of Pine St/State St between Front St and

Union St, there is an average of 5320 vehicles traveling on this section of Pine Street each day

during the work week, with a peak hour volume of 495 vehicles. Currently the site is a

municipal parking lot that has 405 daily trips during the work week based on observations

conducted in 2016.

We understand you want us to formalize our initial assessment of the data you provided for the

trips generated by the proposed development. To do this, we entered the existing and

· proposed traffic and geometric data into LOS+ (a hybrid traffic analysis method based on the

Highway Capacity Manual 2010 and NCHRP Project 3-70) to determine the potential impact of

the development on vehicular, pedestrian, bicycle, and transit level of service. It was assumed

that on street parking occupancy will increase from 60% to 80%, pedestrian volumes will

increase from SO pedestrians per hour to 75 pedestrians per hour on either side of the street,

and that the peak hour traffic volume will increase by 160 vehicles (approximately 10% of the

projected increased traffic generation) with the proposed development. Using this program,

we found the existing street network operates at a level of service B and, when conservatively

adding all of the projected trips generated by the proposed development as vehicular trips, the

proposed street network also operates at a level of service B. Thus there is no change to the

level of service as a result of this project which confirms our initial assessment. We state this

assessment is conservative because it does not reduce the proposed trips by the number of the

existing trips generated by the current use as a parking lot. Please see the table below for

details pertaining to other modes of transportation.

The level of service for bicycles and transit each drop a grade as a result of the anticipated

increase in vehicular traffic resulting from the proposed development. It makes it more difficult

for transit to move in and out of the traffic flow and decreases the comfort level for bicyclists.

The levels of service in urban areas for these modes are often C or D which reflects the density

and vitality of the urban core. Attached for your reference are the data sheets from the LOS+

assessment program.

Congested Areas The changes in traffic patterns as a result of scenario planning can vary due to differences in land uses.

However, overall there is a lot of overlap between the different scenarios and the streets that will need

future focus. As mentioned earlier the 2035 scenario demographics are used in the TDM to determine

congestion on the streets in the region. A street with congestion is considered one that has a larger

traffic volume than the capacity of street can handle. For example, if a roadway can handle 10,000

vehicles per day and the volume of the road is 12,000 vehicles per day, it is operating above the

capacity. The following maps show the priority roadways for each respective planning TDM scenario.

While these maps are general in nature, data for each roadway within each model is available. These

areas should only be used as a starting point to the development of a long range transportation plan.

Once the region agrees upon an approved demographic forecast, a more detailed traffic analysis should

be conducted. This analysis was completed to compare growth scenarios using the initial 2007 version

of the TDM. The addition of lane. miles was determined through demand and level of service (LOS).

Roadways that consistently showed poor levels of service (volume to capacity ratio greater than 1) were

widened in the future scenarios. Within each scenario, roadways were widened based on a combination

of LOS across the link and surrounding land uses. For instance, most roadways that observed poor LOS

and were near commercial retail centers are eligible for widening.

Rural Scenario This scenario focuses on the development in

rural areas as clusters which consolidates

growth into focus nodes. This growth pattern

reduces vehicle travel within the region;

however, it is still a dispersed type of

development. The amount of lane miles

needed to accommodate the growth in this

scenario is 86 additional miles.

Trend Scenario The Trend Scenario follows the current progression of

development in the area. This scenario has the most

corridors of concern with the need to add another 142

lane miles. This development pattern encourages

increased driving because the built environment is

much less dense, thus increasing VMT, VHT, and Delay.

Village Scenario As a result of even more focused development in

key areas of the region, this scenario limits the

need for new roadway infrastructure with only 78

lane miles needed.

City Scenario This scenario allows for growth to occur mainly in

already populated areas the region. This scenario

has the highest population density and

employment of any scenario and therefore people

will not need to drive as far as they would in a

more spread out pattern. Only 58 additional lane

miles are needed under this type of growth

pattern, making it the least expensive

transportation alternative in terms of roadway

construction.

The Table 20 demonstrates the overall mobility indicators for each scenario. While the TDM has

volumes and delay for every link, their numbers are better reflected in a summary format as shown

below. It is also important to note that the model only contains arterials and collectors. Subsequently,

as the network becomes dense in the urban areas, an operations model is needed to truly evaluate the

congestion levels. For instance, in downtown Traverse City the gridded network can handle much more

traffic than this model reflects. It is recommended that a specific downtown circulation plan be

developed before any projects are recommended. TDMs are an excellent tool to compare scenarios and

determine overall mobility indicators.

Other departments must weigh in to fully answer this question. Looking at this and other developments from a broad view, however, we know that certain infrastructure improvements, and service delivery, if needed, will be paid for by enterprise funds. Enterprise funds are sustained by user fees, so the more users created by the development, more fees collected to pay for improvements and services.

The City's General Fund provides police, fire, parks and other improvements and services. Site plan/special land use review allows us to estimate the revenue generated by a project, which can be compared to an average general fund expense per acre. This is detailed below.

The general fund collects 5% of revenues from electricity, water and wastewater revenues. The table, above, summarizes the impact on the general fund, calculation on the attached worksheet. The general fund also collects 10% from the parking fund, but the project's impact on the parking fund is difficult to estimate and therefore it was not included in these calculations.

To put the impact on the General Fund in perspective, it is helpful to think of revenue per acre. Since the property is 1.63 acres, the General Fund revenue per acre for 305 W. Front is $30,930/1.63 or $18,975 per acre. This compares favorably with the General Fund's expenditure per acre, or more specifically, expenditure per taxable acre, which is approximately $7,900.

TIF 97 Fund The impact on the TIF 97 Fund is important because the TIF 97 Fund is used mostly for infrastructure improvements within the TIF 97 district, which includes 305 W. Front. The net impact on TIF 97 is $316,734. The proposed project does not require any additional costs to TIF 97 beyond what is already built or planned.

Tentative plans to build a parking garage at 124 West Front Street

The purpose of this communication Is to provide the Court of Appeals an historical perspective on the City of Traverse City's interest in building a parking garage on the west end of downtown Traverse City. There was an assertion made by the Court of Appeals that the City did not address whether the City's tentative plan to build a parking garage to support the development would be an excessive expenditure to improve infrastructure with public funds. The record below shows the parking deck proposed for 124 West Front Street was considered and planned long before the 9-story buildings at 305 West Front Street were proposed.

The 1977 City Plan shows the potential for a ramped parking area in the near vicinity of 124 West Front Street is shown on page 43. Also on page 42, a policy reads, "The City shall: Encourage a relatively few selectively located parking structures in the CBD instead of surface parking." Please see the attached pages from the 1977 City Plan.

The 1994 Traverse City Plan on page 4.12 shows a potential parking deck at or near 124 West Front Street. On page 4.13 the Traverse City Plan reads, "Construction of strategically located parking structures is envisioned." Please see the attached pages from the 1994 City Plan.

In 1997 the Downtown Development Authority adopted a Tax Increment Financing Plan for downtown. This Plan shows a parking structure fronted by commercial space along West Front and Pine Streets including where 124 West Front Street is located. Please see this Plan marked "TIF Plan 97".

In 2006, the City pursued constructing a public parking deck associated with a private development at 124 West Front Street. In a letter dated April 5, 2006 from former DOA Executive Director Bryan Crough, Mr. Crough states, "the Tax Increment Financing Plan of the DOA outlines a long term solution of providing parking in a deck on the southeast corner of Pine and Front Streets. This deck is meant to improve pedestrian relationships by being built as part of a mixed-use project, and to meet the need for the west end of downtown." Please see Bryan Crough's letter attached.

In the current Traverse City Master Plan adopted in 2009 and the Transportation Element on page 3 adopted as part of this Master Plan in 2012, there is an objective to "Adopt a comprehensive parking strategy." and "Reduce land dedicated to the use and investment of parking associated with private uses." The purpose of this second objective is to make efficient use of land by providing more efficient public parking in the downtown versus having private parking that is more likely to sit idle parts of the day.

In summary, the City of Traverse City has been pursuing building a public parking garage on the west end of downtown for many years. The purpose of the garage is to meet the needs of development anticipated for the west end of downtown and not necessarily for any particular project downtown. The City intends to build a parking deck with our without a development at 305 West Front Street.

time, will include remote parking for employees utilizing existing church and other outlying parking lots in locations that do not conflict with neighborhoods. As public transit becomes accepted, a park and shop program can be instituted for persons that reside beyond the City's limits as a means to intercept the automobile before it reaches its down­town designation. City residents, it is assumed, will increasingly utilize public transit for Central Area access over the time frame of this plan.

Policies

The City shall: 1 Encourage a relatively few selectively located parking structures in the CBD instead of surface parking.

2 Play a role in the financing of CBD parking improvements with minimum risk to taxpayers and the spreading of cost according to benefits received.

3 Encourage customer parking in the center of the CBD and employee parking at its periphery.

4 Take measures to insure the safety and amenities of parking structures and integrate them architec­turally with surrounding developments.

5 Undertake a comprehensive parking study in an effort to make parking function as efficiently as is practicable.

6 Expand and coordinate CBD and Clinch Park parking.

7 Discourage parking from en­croaching on neighborhood streets.

Parking Proposals

Over the next few years, additional parking is proposed to be accom­modated within the commercial core to allow for future growth. Gener­ally speaking, a 1 :1 parking ratio is desirable for downtown Traverse City (one square foot of parking area for each square foot of gross floor area). The City is considerably below this figure (.72:1) at the present time (approx. 2700 spaces and 1,500,000 square feet of GFA) utilizing 400 sq. ft. per parking space. The CBD is also somewhat deficient in parking spaces at the present time. Thus, assuming no change in travel habits, the City should probably try to improve the overall CBD parking ratio to .80:1. This would result in 5000 to 6800 total parking spaces based on the proposed FAR range. Parking guidelines for individual CBD land uses are as shown in Table 7.

Customer parking is located along the State Street parking spine between Union and Park Streets to maximize convenience. Employee parking is located north of the river and at the ends of the CBD. Lots north of the river will necessarily be shared with customers due to the proximity of these lots to Front Street shops. Proper metering of the river lots will induce employees to use the most remote of parking spaces .

Parking structures are proposed in lieu of surface lots in the CBD and in designated peripheral locations. General areas for surface and ramped parking are identified on the Central Area Off-Street Parking Concept Plan, however, neither the number or size is established by the plan. It is conceivable that a very few large structures or several smaller ones may be needed. Before each is constructed, its economic feasibil­ity should be established in light of already existing downtown parking . In other words, parking ramp construction will evolve at a rate com­mensurate with demand.

If it ever becomes necessary to discourage downtown automobile accommodations, an initial measure to be employed, at the appropriate

Circulation in the Regional Center

The plan for the Regional Center is one that provides additional access from the south and relegates Union and Cass Streets south of Eighth Street to subcollector street functions with the development of a new road along the west shore of Boardman Lake. The system purports to separate traffic according to destination, trip purpose and duration. It.is intended that State Street will serve as a parking spine and that Cass Street will provide access to parking lots to reduce the amount of circulating traffic on Front Street.

The existing gridiron street network sho~ld continue, to serve as the -backbone for the system. However, consideration needs to be given to the possible creation of new traffic patterns in the Center to reduce the flow of through traffic in the neigi1boring residential areas.

For the most part, the existing street pattern is true to the grid system. One exception is Garland Street, which curves to empty onto Grandview Parkway west_ of Union Street. The Plan calls for realignment of Garland Street to connect with Union Street and for Park Street to be extended to connect with Washington Street.

The Plan places emphasis on pedestrian circulation in the Regional Center. It calls for sidewalks to all major destinations, including the bayshore, the riverwalk systems, and the surrounding neighborhoods. The Plan also calls for the development of bikeway routes through the Regional Center that will connect with the citywide network. Improved bike storage is also encouraged. It is intended that all development decisions, both public and private, reflect an ever improving pedestrian environment by planning for the necessary linkages set forth in this plan.

Parking in the Regional Center

Parking in the Regional Center should be delivered in a manner that is the least obtrusive to the riverfront and streetscapes. It is the intent of the Plan to encourage that surface parking be moved away from the Boardman River over time. Construction of strategically located parking structures is envisioned. Commercial and residential uses could be incorporated into parking structures along key Regional Center streets to create more ac­tive and interesting pedestrian walkways. Parking garages should be well detailed, and screened with generous landscaping with setbacks similar to other buildings along the street. Wherever possible, other uses should be incorporated to face the street edge. In most cases, off-street parking facilities shall have access from alleys to minimize conflict with pedestrian circulation.

As growth continues in the Regional Center, incentives may be needed to encourage alternative forms of travel within the Center. That will also help reduce parking demand. The goal is to reduce traffic over time but not reduce person trips.

When considering a parking structure for the Regional Center, shops and offices and residences should front the streets to create an inviting atmosphere.

I understand that Federated Properties plan for re-development of the Grand Traverse Auto property on the north side of Front Street includes 69 private spaces. As you know, we traditionally view private surface parking as a negative, but it is my understanding this parking will be enclosed and is only accessible from Front Street in thatthere is no public alley behind the building. We can offer the following in support of this request for enclosed private parking:

1. The restriction in the zoning ordinance relates to long term solutions.

The City's Master Plan, and specifically, the Tax Increment Financing Plan of the DDA outlines a long term solution of providing public parking in a deck on the southeast comer of Pine & Front Streets. This deck is meant to improve pedestrian relationships by being built as part of a mixed-use project, and to meet the need for the west end of downtown. Currently, we envision 530 public spaces to be built on the south side of the street as part of a mixed use development by Federated Properties. That project will take several years to complete, .and its future may very well be in the hand of the voters in August. In short, there is no guarantee of public parking in the area in the near future, if at all.

2. The restriction in the zoning ordinance stipulates that there be an availability of public parking.

Currently, the supply of public parking in the area is inadequate. The City and DDA have leased three parking lots in the area, providing 133 permit spaces. In addition there are 66 metered spaces in lot E, behind the Post Office. Lot X, (behind the Light & Power Sub-station on Hall Street) which is more remote has 36 spaces. At the current time, virtually all of the on-street spaces are fully occupied year round between 7 a.m. to 5:30 p.m. The leased permit spaces are also fully occupied, and lot E is generally 85-95% full. Only lot X is under-utilitized, with 22 to 27 spaces available. In short, we recognize that there is a need for additional parking in the area, and are pursuing it in the planned parking deck.

Dear Sir/Madame,

I am submitting my application to be involved. I am applying for various reasons. I moved to

Traverse City almost 18 years ago after growing up in Chicago. I attended college here through

NMC and decided to stay. Traverse City is not only my home but I am very passionate about our

community. I am blessed to be able to raise my children here, is this beautiful tight knit town,

which offers so many things that you cannot find anywhere else. I am an avid runner, camper,

and nature enthusiast. These are things that our community offers us, along with, cultural

growth and a sense of community, in which we don't always have in the larger cities. Over the

years, I have volunteered in various areas from coaching, tutoring, and cooking for the

homeless. I have done volunteering events with Goodwill and Chamber events. I have also

volunteered services for the school, from tutoring to resume building and interviewing skills. I

have been actively involved with TCYP and Business after Hours. I am on the committee for the

TCYP Connect to help people that would like to move to this area but don't know where to

start. I try and teach my children the value of giving back even if it's just your time and

supporting the local community. I do this because I truly feel honored to be a part of not only

such an amazing community, but a part of what makes us a community, the people that live

and work here. I wish to apply so that I can further have a voice, partnership, and

understanding of our community and its growth, resources, and opportunities. I believe that my

appointment would benefit the city because I have a very diverse background. I am a parent

who's raising her children in Traverse City and went to college at NMC. I have a background in

Education and Business. I have ran multiple businesses in town, and now I currently do staffing

for over 40 businesses within our local community. I would love to be involved more in other

areas and hope you consider me for the Commission.

Resolution establishing the Brown Bridge Advisory Committee as a twelve-member committee, to allow for the establishment of a seat to be nominated by the Traverse City Light and Power Board was adopted by the City Commission on June 4, 2001 - - this Resolution supersedes the April 3, 1993 , action of the City Commission relating to the establishment and composition of the Committee.

Ordinance Amendment 651 ( enacted 8-16-04) revised manner in which appointments are made; the method for appointments in light of this change is reflected above. Ordinance Amendment 872 ( enacted 8-16-2010) revised manner in which appointments are made; therefore removing the provision for a Traverse City Light and Power Board seat nomination. At the October 16, 2017 Regular City Commission Meeting, an ad hoc interview committee was appointed to make recommendation regarding one vacancy on the Parks and Recreation Commission, seat previously held by William Dorrier.

The City Clerk's Office advertised for this board on the city's website, Facebook and Twitter pages. As a result the following applied for this bored and were interviewed: Zachary Malewitz, Evan Dalley, Rebecca Rogan, Mark Wagner, and Rick Brown; I have attached their applications.

My purpose for wishing to be on the Park Commission is to give back my time, effort, and professional expertise to our adopted hometown. In addition, I was the Smart Commute Coordinator for Meridian Township, where we were the Greater Lansing area champions for two years in a row, and have been actively involved in non-motorized transportation advocacy for the past decade. Lastly, I have donated my personal time , resources, and efforts to numerous community and nonprofit endeavors in the community.

I am interested in serving on Traverse City's Parks and Recreation Commission because

I've spent my entire life enjoying everything that our city has to offer and I would like to take

advantage of this opportunity to give back, and I believe I have the knowledge and skills

freedom under law. Such service may include activities which encourage greater respect for the law in the courts or

stimulate the decpC'r sense of individual responsibility to the end that citizens recognize their duties as well as their righ ts as it relates to the legal system.

In 2015 I was honored to receive the Legal Professional of the Y car presented by the Grand Travene Area Legal

Professionals (GTALP) . Each year, members arc nominated by their boss or Board who write an anonymous letter

outlining what they believe sets the member apart from others. The letters arc then sent to a neighboring chapter of

NALS of Michigan, where a committee reads and judges them with all names removed . The award .is a recognition of the members service to their community, the GT ALP, and the members of the local organization.

Hccause of my education, skills, and work/ volunteer experience, I am able to read and understand a budget, work

well individually and in groups , ask questions, speak up when there might be other positions to consider, and am

willing to listen to ideas and opinions that may not be popular but arc worth considering or may contain important

I am submitting my application and resume for consideration for the available Board positions of City Planning Commission and Parks & Recreation Commission. Please find attached the following: City of Traverse City Board application, professional resume, and letters of recommendation.

I am submitting my application for consideration because I am a believer in community service. My architecture internship required a period community service and involvement as part of the core tenet of service to the health, safety, and welfare of the communities in which we live and work. As such, I have been active an advocate for the rehabilitation of chemical dependency for The Talbert House in Cincinnati and started the Colerain Township chapter of Drug Free Cincinnati. I was also a presenter and instructor for AIA Cincinnati's Architecture By Children program. In Traverse City, I briefly worked for Choices Inc., a mentoring program for ask risk boys, and regular assist the homeless community that reside part time in the woods surrounding the Traverse Commons.

Another service that I've provided for the Traverse City community is starting a summer beach volleyball league for the residents of Traverse City which I started four years ago. The league has steadily grown over the past four years, tripling in size from 10 to 33 teams and over 130 players. This was part of my plan of introducing myself and integrating into a new city while being of service.

My education includes several urban planning and design classes and studios within the College of Design Art Architecture and Planning (DAAP) at the University of Cincinnati. One of my projects was selected for use by the small urban neighborhood of Ludlow, Kentucky in the Cincinnati metropolitan region. My professional career involves working with local zoning and building departments on a regular basis dealing with interpretations, variances, and appeals.

For those reasons, I believe I am a good fit for the City's needs for both Commissions and look forward to the opportunity to discuss future opportunities and the chance for both parties to find out more about each other.

Attached to this report are the following items: November's report to the state, which has been submitted electronically, a financial summary for the Traverse City Regional Wastewater Treatment Plant and the Grand Traverse County Septage Facility, the monthly loadings report, and the annual influent flow measuring devices verification data.

OPERATIONS AND PROJECTS

The Treatment Plant was in full compliance through the month of November.

We started the last biosolids haul of 2017.

The population of comma shaped Gram-positive bacteria increased in our biomass through the month of November. We are collecting samples for the University of Michigan to analyze. (Photos are not available this month because the microscope is getting serviced)

We are able to permeate at a rate that can more than meet current flow demands and produce an effluent that meets, and for many parameters, exceeds DEQ requirements. (Please refer to the permeability graph) The trains show a decrease in overall permeability. This is due in large part to the increase of comma shaped Gram positive bacteria in our biomass. Seasonally, as water temperatures decrease, permeability will decrease, as a result of the water viscosity increasing, however the decrease is much more gradual than shown in the graph below. (Permeability is the parameter we use to track how hard the trains are working)

• The Reduced Pressure Zone Device (RPZ) at the Front Street Lift Station was replaced. A reduced pressure zone device is a type of backflow prevention device used to protect water supplies from contamination.

• The classifier failed in the east grit chamber. Ace is currently fabricating a classifier for $1,800. A new classifier from a vendor was quoted to cost $9,200. We diverted influent flow to the west grit chamber while the east grit chamber is out of service.

• We recently confirmed the influent flow measuring device verification for this year which reported the west partial flume flow measuring device did not pass verification. We originally had thought this could be because flow was not going through the partial flume at the time of verification. (Normally all the flow goes through the east flume.) When we had to switch to the west grit chamber we moved the flow measuring device that passed verification from the east flume to the west flume and recalibrated it. We are currently in the process of purchasing new flow measuring devices for the facility. (See accompanying verification data at the end of this report)

• The control wiring for the drive for 3 and 4 north primary tanks was rewired because the current wiring was faulty causing a short to ground.

• We replaced the diaphragms in both Air Diaphragm Pumps. These pumps are used to pump settled solids from the primary tanks to the digesters for stabilization.

• We replaced the hot water pump for the heat exchanger in the Gravity Belt Concentrator room.

• We replaced the ethernet switch for digester s's PLC.

• We replaced the air regulator for Train #5's cyclic air valve.

• The west roll up door for the MBR chemical room was repaired.

• ABI Mechanical replaced the discharge lines for both back pulse pumps with schedule 80 pvc, the ductile iron piping was corroded and leaking.

• The motor for Scour Air Blower A needs to be repaired. We are obtaining quotes to get this repair completed. When the scour air blowers are in 10/10 aeration (every 10 seconds each membrane train is aerated for 10 seconds), we use all four of the remaining in-service blowers, so we have no blower redundancy when one blower is out of service.

• We purchased 2 new storage cabinets for fuel cans and tools.

Digester #3's condition assessment was completed and the follow-up report was received. CH2M is developing a Rf P for the reconditioning of Digester #3 in the CIP for 2018-2019. This digester is currently out of service.

Digester #4's condition assessment is scheduled for 2019-2020

Contractors have installed the new control panel, and the pump pit has been relined as of 7-11-16. CH2M reviewed t he punch list for the controls with the contractor. (In the CIP for 2017-2018 estimated to cost $150,000) Screw Pumps #2 and #3 st ill need to be replaced In the CIP for 2018-2019.

The plant is required to have a pump that can fill hauling trucks at a certain rate, and the piston pump that is currently in use has been in place since the 1970s, and fails often. CH2M recommends replacing the current West SST piston pump with a new pump. This recommendation Is Included in the City's 6-year capital Improvement Plan. (Capital Improvement 11894)

Operations

The daily average eft1uent BOD loading for the month of November was 11.9 lbs/day.

PCS cleaned the rock traps and floor drains on 11/22/17.

Biotech completed the last biosolids haul of the year. They hauled 281,987 gallons of biosolids from the facility for land application. We accompanied them to a farm field and verified that the land application was performed according to the facility's Residual Management Plan.

Maintenance

• Topline completed the install of the vibration sensors for the ATAD building pumps. An alarm will generate alerting the operator if pump vibrations increase by 10%.

• We received a "bad» load (A load with an unusual amount of rags, flushable wipes, etc.) from a hauler in the afternoon of Friday 12-1-17. The hauler plugged one unloading bay and then moved to the other unloading bay and plugged it. We were able to get the east unloading bay up and running right away. The west unloading bay's motor had burned up and we are waiting for it to be repaired. While it was down, we installed the new coarse screen brushes and wear plates. We have added signs to the control panels of the unloading bays requesting that the haulers let us know when a bad load is coming through so we can help off load and hopefully prevent a similar occurrence in the future.

• Last month, we reported that there were leaks present on the roof of the ATAD building allowing water to travel through electrical conduit into the ATAD control panel. These leaks have been repaired and we have not seen signs of moisture in the control cabinet.

We observed the average unloading time for the haulers in November to be 12.9 minutes, with an average unloading rate of 159 gallons/minute. The photos below show the general condition of the unloading bays. The bays are cleaned a minimum of twice a day.
