    2 The feepayablefor anannualpermitshall be $52 which shall bepayable-a in advancein full;b in advancefor each3 monthlyperiod;orc eachfortnight by payroll deduction.

    3 The secretarymayissue a temporary.permit to a personwherehe considerstheissue of an annualpermit would be impracticableor inappropriateand a temporarypermitmaybe in respectof suchperiodand shall be paid for at suchtime and in suchmanneras the secretarymay determinein eachcasebut the fee in all casesshall bepayableandcalculatedattherateof $1 perweek or part thereof.

    4 An applicationby a personfor anannualpermitor a temporarypermitshall be-a madein accordancewith the form approvedby the secretary;b accompaniedby a deposit fee of $10 for theissueof a boomgatecontrol card,

    exceptwherethepaymentof that fee is waivedby thesecretary,andin thecaseof anapplicationfor anannualpermit-

    c accompaniedby the fee payableunder sub-bylaw 2 a or b or where apersonintends to pay each fortnight by way of payroll deduction,a procuration authorityin theform approvedby thesecretary.

    5 A personholding anannualpermitor a temporarypermitwhich will soonexpirewhodesiresto obtain a further permitof eitherclassmay without completinga furtherapplicationform requestthesecretaryto issue a furtherpermit and thesecretarymayissue a furtherpermit-

    a in thecaseof anannualpermit, on paymentof thefeereferredto in sub-bylaw2 in themannerprescribedby that sub-bylaw;or

    b in thecaseof a temporarypermit,in accordancewith sub-bylaw3.6 Notwithstandingsub-bylaws1 to 5, the secretarymay waive the fee for an

    annualpermit or a temporarypermit in any casewherehe considersthereare propergroundsfor so doing.

    7 A permit may authorizeparking in a specifiedportion of a parking facility oranywherewithin eithera specifiedparkingfacility or anyparkingfacility.

    8 The useof a permitissuedto a personis valid-a if issuedin relationto a specifiedvehicleorclassof vehicle, for thepurposesof

    parkingonly thevehicleor classof vehicle so specified;b if issuedfor the purposesof parkinga vehicle ownedby a specifiedperson or

    class of persons,for the purposesof parking only a vehicle owned by thepersonor classof personsso specified;

    c if issued for the purposesof parking a vehicle in a specifiedportion of aparking facility or a specifiedparking facility, for the purposesof parking avehicleonly in theportion of aparkingfacility orparkingfacility so specified;

    d if issuedfor thepurposesof parkinga vehicle duringspecified hours,for thepurposesof parkinga vehicleonly duringthe hoursso specified;

    e for thepurposesof parkinga vehicleonly duringthe periodof time specifiedinor providedfor by thepermit.

    9 The Secretarymaycancela permit if-a a vehicle in respectof which the permit is issued is parkedin the site in

    contraventionof theseby-laws;b thepersonin relationto whom thepermitis issuedcommitsanoffenceagainst

    theseby-laws;c the personin relation to whom the permit is issuedceasesto have a connec

    tion with thesite; ord anychargerequiredto bepaid in relationto thepermit remainsunpaid.

    10 A personshall not usea permit for a purposethat is not valid under sub-bylaw8.

    11 In this by-law-"specified"meansspecifiedin therelevantpermit. ".

    Refundof parking permit fees26A. 1 A refundin relation to a fee for a permit paid in advanceshall be madein

    accordancewith sub-bylaw 2 to a person whose employment at the Hospitalterminatesor who is grantedabsenceon long serviceleave or sick leavein relation toemploymentat theHospitalfor a periodof 4 consecutiveweeksor longer.

    2 The refundshallbe-a in thecaseof a personwhoseemploymentterminates,anamountin thesame

    proportion to the amountof fee paid as is representedby the period of thepermit which remainsunexpiredafter the last day of serviceof thepersoninproportionto theperiodfor which thepermitwasissued;and

    b in thecaseof a persongrantedabsenceon long serviceleaveor sick leave,anamountin thesameproportionto theamountof feepaid as is representedbytheperiodof leavein proportionto theperiodfor which thepermitwasissued.

    Removalof vehicles26B. 1 A vehicleparkedin breachof theseby-laws or a vehicle whichis believedto

    have been left on the site for more than 3 days may be removedby order of thesecretaryto thesecuritycompoundwithin thesite andtherestored.

    2 For thepurposeof removinga vehicleunder sub-bylaw1, an authorizedpersonmaytake suchactionby way of unlocking,driving, towingor otherwiseasis reasonablynecessary.

    3 The Boardof theHospital may retainpossessionof a vehicle removedandstoredunderthis by-law until theownerof that vehiclehaspaidto theBoardfeesfor recoveryof it at therateof $50 for the first 24 hoursor part thereofand $5 for each 7 daysorpart thereofthereafter. ".

    By-law 27A inserted6. After by-law 27 of theprincipal by-laws,thefollowing by-law is inserted-

    Offences27A. A personwho contravenesor fails to comply with anyof theprovisionsof these

    by-lawscommitsanoffence. ".

    By-law 30 amended7. By-law 30 of theprincipal by-lawsis amendedin sub-bylaw1 by deleting"officer" and

    By-law 32 repealedandaby-law substituted8. By-law 32 of theprincipalby-lawsis repealedandthefollowing by-law is substituted-

    32. 1 Subject to sub-bylaw2, an authorizedpersonmay by notice in theform ofForm 3 in Schedule3 servedon theallegedoffenderwithdraw aninfringementnotice.

    2 A personshall not be authorizedto withdraw aninfringementnotice which wasissuedby that person. ".

    Definition of "usedpesticidecontainer"21A. 1 Subjectto subregulation2 for the purposesof regulations21B, 21C, 21D

    and21E-"usedpesticidecontainer" meansa container-

    a which hascontainedpesticide;or

    b in which pesticideis contained.2 Subregulation1 doesnot applyto a containerdesignedto contain lessthan-

    a 2 L of liquid pesticide;or

    b 2 kg of solid pesticide,whenusedfor domesticor homegardenpurposes.Disposalof usedpesticidecontainers

    21B. UnlesstheExecutiveDirector, Public Health in any particularcaseotherwisedirects, a person shall, after disposingof the contents if any in accordancewithregulation21F and washingout theusedpesticidecontainer,disposeof a usedpesticidecontainerby oneof thefollowing methods-

    a by arrangementwith a local rubbishcollectionagency;b at a local shire rubbish tip after the ownerof the container,by puncturing,

    breakingor flatteningit, hasrenderedthecontainerunusable;or

    c subjectto regulation21C by buryingon theproperty of the ownerof theusedpesticidecontainer.

    Disposal onprivate property21C. Where a usedpesticidecontaineris disposedof by the method referredto in

    regulation21B c theownershall ensurethat theusedpesticidecontainer-

    a is renderedunusableby puncturing,breakingor flatteningit; and

    b is buried at least0.5 m belownaturalground level in a placewhich is situatedat least30 m from anywater courseand a minimum of 3 m above thewatertable.

    21D. 1 Subjectto subregulation2, a usedpesticidecontainermay be reusedafterit hasbeen-

    a cleansedin a mannerapprovedby theExecutiveDirector, Public Health;andb subject to subregulation3 clearly labelled "USED PESTICIDE CON

    TAINER".2 A containerreferredto in subregulation1 shall not be-

    a usedto containsubstancesor foodstuffsfor humanoranimalconsumption;or

    b reusedas a pesticidecontainer.3 A personwho reusesa usedpesticidecontaineron the property of the ownerof

    theusedpesticidecontaineris not requiredto comply with subregulation1 b.

    Authority required for disposaletc.ofusedpesticidecontainers

    21E. 1 A person shall not undertake to collect and dispose of used pesticidecontainersfor rewardunlessthe personholds a written authority from the ExecutiveDirector,Public Healthapprovingtheperson’smethodsof collectionanddisposal.

    2 The ExecutiveDirector, PublicHealthmay-a impose anyconditionson anauthorityreferredto in subregulation1; or

    b atanytime cancelorrevokeanysuchauthority.Disposalof pesticides

    21F. 1 Pesticidesmaybedisposedof-a by usingin accordancewith thelabel registeredin respectof thepesticide;

    b by destroyingby chemical meansapprovedby theExecutiveDirector, PublicHealth;

    c by incineratingat high temperaturein an incineratorapprovedby theExecutive Director,Public Health;

    d in a mannerapprovedby theExecutiveDirector, Public Health in a gazettedland-fill site;

    e where thepesticidecontainsless than 500 mL or 500 g of active constituentand thematerial doesnot containa prescribedorganochlorineor a substancespecifiedin theSeventhSchedulein AppendixA to thePoisonsAct 1964, byburying at least0.5 m below naturalground level in a pit lined with anequalvolume or weight of lime situatedat least30 m from any water courseand aminimum of 3 m abovethewatertable;

    f where thepesticidecontainsa prescribedorganochlorineor a substancespecifled in the SeventhSchedulein Appendix A to the Poisons Act 1964, byburying the pesticide in accordancewith paragraphe after obtaining thepermissionof and subjectto any conditions imposedby the ExecutiveDirector, Public Health; or

    g by any other methodapprovedin writing by the ExecutiveDirector, PublicHealth.

    2 For thepurposesof subregulation1 "prescribedorganochlorine"shall have thesamemeaningas in.regulation54. ".

    79. 1 When pesticidesare used by being sprayed,spreador dispersedfrom anaircraft in flight, a persontaking part in thespraying,spreadingand dispersalshall notleaveusedpesticidecontainersunattendedon any landwhich is not ownedor occupiedby him unless the owner or occupier of the land is notified in writing before thecontainersareleft on theland.

    2 Whenusedpesticidecontainersareleft on any land-a the personleaving thecontainersshall ensurethat they aresealedand clearly

    labelledwith particularsoftheir previouscontents;andb theowneror occupierof thelandshall ensurethat thecontainersare-

    i cleaned,reusedandlabelled;or

    ii disposedof,in accordancewith theseregulations.

    3 In subregulation1-"the owner or occupier" in relation to land which is Crown land means the

    ExecutiveDirector,Public Health.4 In this regulation-

    9. Compensationwill not be payablefor damagebyflooding of thedemisedland.

    10. Compensationshall not be payableto the lesseeinrespectof any improvementseffectedby him on thedemisedland and remainingthereonat the expiration or earlierdeterminationof thelease.

TheCommission funds the servicing agent direct and thedeveloperrepaysthe moneyat treasuryinterestrates,withrepaymentsgearedto thecashflowof thebusiness.

    The servicesbeing provided to the lots are a gravel road,power and water and the ingoing premium of $35 000 ispayablewithin 30 daysof acceptanceof application.

    At any time during the currency of the lease, uponcompletion of the minimum developmentof 100 caravanbaysand ancillary facilities to the satisfactionof the Minister for Lands,considerationmay be given to the lesseeacquiring the freeholdof the land.
