Over the last seven or eight years boundary and access issues have thwarted the sales of numerous properties. This has, in turn, shattered

the hopes of dozens of prospective homebuyers, having been consistently denied loans by their mortgage lenders for such problematic properties.

Difficulties in securing access rights have also made it a nightmare for the conveyancing departments of Guernsey law firms, with staff devoting a huge amount of time and effort in their bid to satisfy the banks’ requirements.

Now the nightmare could soon be over thanks to a brand new law of access that will be put to the States for approval in principle at the end of this month. The law will enable homeowners who believe they are being denied reasonable access by their neighbours the right to go to the Royal Court for an order of temporary access while work is carried out.

The proposed legislation has the full backing of the Guernsey Bar and it is also fully supported by the island’s estate agents, who believe it will result in a significant boost in market activity. It should also see an end to the unsavoury practice of property owners charging large sums of cash in return for access rights.

The problems associated with access and boundaries began to manifest themselves around 2008. Until that time the customary laws and practices that had served the island for centuries had been sufficient for the banks to grant a loan.

In recent years advocates have highlighted any kind of title ‘flaw’ in respect of a property and advised lenders not to lend until the problem has been resolved. In some cases the solution has been relatively straight forward, with the owner of the neighbouring property agreeing readily to sign a formal legal agreement that is subsequently registered with the Royal Court.

In other cases the neighbour has been willing to grant formal access rights, but only in return for money. In one or two instances, according to our legal

sources, the cost of gaining access has been as much as £50,000. Those who have been ‘held to ransom’ in this way have either had to cough up to seal the deal or simply walk away from it.

There is, of course, a third type of response from neighbours who are asked to grant a right of access. This is the traditional Guernsey response that goes along the lines of ‘yes, you can have access any time you want, I would never stop you, you have my word on that, and I don’t want any money for it, but I am not going to sign up to anything’.

Bearing in mind that this is how things have been done locally for generations it is not an unreasonable response. Unfortunately, though, it counts for nothing with the lenders. This is because the only way you can bind the owner of a property – as well as all of his or her successors in title – is by having a document of access registered before the Royal Court.

When the new law is passed, as everyone expects, it should put an end to these problems. Our legal source stressed that the legislation will not provide any automatic rights of access. However, it will enable property owners who feel they are not being given fair access by a neighbour the right to go to court for a ruling.

There is also provision within the law for property owners to be able to maintain pipes, cables and drains that run through or under neighbouring properties. However, it is not a panacea or ‘cure all’ and there will still, inevitably, be boundary disputes between neighbours in other respects.

Above all else the new legislation is meant to make it a fair, level playing field for all property owners and members of Guernsey’s legal profession are confident it will mean fewer delays with property transactions. They are also hoping to see an immediate positive response from lenders as soon as the law is approved in principle.
