Approved Code of Practice (ACoP)

All HSE Guidance has the following text in its Preface…•Following the guidance is not compulsory and you are free to take other action, but if you

do follow the guidance you will normally be doing enough to comply with the law.

An ACoP however has a second paragraph…•If it is shown that you did not follow the relevant provisions of this code, you will need to

show that you have complied with the law in some other way or a Court will find you at fault

members are competent, are adequately resourced to do the work, and appointed early enough this applies to:

• Designers

What Must Clients Do for ALL Projects

• Allow sufficient time for each stage of the project

• Co-operate with others concerned in the project to allow them to comply with their duties

• Ensure there are reasonable management arrangements in place to ensure construction works can be undertaken safely

• Co-ordinate their work with all others involved to ensure the safety of those carrying out construction and others who may be affected

• Any fixed workplaces are to be designed and comply with the requirements of the Workplace Regulations.

• Ensure relevant information needed by Contractors to manage their work safely is passed to them

Addition Client Duties for Notifiable Projects

1. Appoint CDM Co-ordinator to advise/assist Client

2. Appoint a Competent Designer or Design team

3. Appoint a Principal Contractor to plan and manage the construction works

4. Do not allow a start on site until the Principal Contractor has provided:

• a suitable written Construction Phase Health and Safety Plan and

• suitable welfare facilities

Addition Client Duties for Notifiable Projects

5. Make sure that a Health and Safety File is:

• prepared, reviewed, or updated ready for handover

• this must be available for future construction work

• For Notifiable appointments if the Client does not make these appointments they become legally liable for the work that the CDM C and principal contractor should do, as well as for not making the appointments.

What Clients Do Not Have to Do…

Clients are not required or expected to:

1. Plan or manage construction projects themselves

2. Specify how work must be done,

3. Provide welfare facilities for those carrying out construction work

4. Check designs to make sure regulation 11 has been complied with

5. Visit the site to supervise or check construction work standards

6. Employ third party assurance advisors to monitor health & safety standards on site

7. Subscribe to third party competence assessment schemes

DesignersWho are designers?

Designers are those who have a trade or business

which involves them in:

• Preparing designs for construction work

including variations

• Or arranging for their employees or others

under their control to prepare designs

Therefore Designers include:– Architects, civil and structural engineers, building

surveyors, landscape architects, and design practices contributing to, or having overall responsibility for, any part of the design, e.g. drainage engineers designing the drainage for a new development;

– Those purchasing materials where the choice has been left open, e.g. people purchasing building blocks and so deciding the weights that bricklayers must handle;

– Contractors carrying out design works as part of their contribution to a project such as design and build contractors

Therefore Designers include:– Anyone who specifies to alter a design, or who specifies the

use of a particular method of work or material,

– i.e. someone who insists on specific materials or a client who stipulates a particular layout

– Anyone specifying or designing how demolition, dismantling work, structural alteration; and temporary works including those designing auxiliary structures such as formwork, falsework, scaffolding

– Those determining how buildings and structures are altered, for example during refurbishment, especially where this has a potential for safety and health issues

– E.g. for a new sun terrace to their building;

What Designers should do

– Designers must prepare designs with adequate

regard to health and safety in both

construction, future maintenance and

eventual dismantling

– Designers must provide adequate information in or with the design

Designers must ensure that they avoid hazards to;

– Anybody carrying out construction works including

demolition or taking down

– Anyone who undertakes cleaning works in or on

the structure at any time, or maintains the fixtures

and fittings

– Anybody who uses the building as a place of work

– Anybody else who may be affected by this work,

for example people who use the building,

customers or the general public.

Regulation 25 (2) also statesEvery person (other than the contractor carrying out the work) who

controls the way in which any construction work is carried out by a person at work shall comply with the requirements of the

CDM Regulations 26 - 44

In essence this requires anyone who asks for work to be undertaken to ensure that it is carried out safely and by

competent capable staff.

It can go wrong and people do end up in Criminal Courts

What Can Happen If It All Goes Horribly Wrong?

• A large school in Dorset was fined for failing to appoint a CDM Co-ordinator, which led to the unsafe removal of asbestos.

• The HSE prosecuted the School and the director of a company responsible for the refurbishment project. The HSE investigation found that from the initial design stages right through to undertaking the construction work were inadequate planned.

• The Court heard that neither the School, as Client, or the Contractor, had appointed a CDM-C for the refurbishment project, despite the Project being notifiable and a requirement for work of this size.

• The school was fined a total of £60,000 and ordered to pay £13,000 in costs.

• The Director of the construction company, was found guilty of breaching Section 37 of the Health & Safety at Work Act. He was also found guilty of breaching Regulations 11(3) and 18(1) of the CDM Regulations 2007 and was fined a total of £10,000 with costs of £6,000.

Case Study 2

A roll of felt fell through a fragile roof light and hit a secretary on the shoulder:

• The Client should have ensured an adequate system of work was in place and that roof lights were adequately protected before repair work began.

• The Contractor should, as a roofer, should have been aware that fragile roof lights needed to be protected.

• Mr A, a Manager, and Mr B, a Roofing Contractor were each given an 18 week prison sentence suspended for 12 months, with 280 hrs Community Service and £2,114 each costs.

Chester Crown Court heard that a plastic roof panel Mr J was moving across gave way and he fell about two metres from the roof of the carport to the ground below and died:

• HSE investigation found a management Company contracted Mr J to carry out the repair work, but failed to ensure the work was properly planned and organised, or the contractor was competent to carry out the work.

• The Management Company who looked after the property on behalf of the landlord, were prosecuted by the HSE. They pleaded guilty and were fined £75,000 and ordered to pay costs of £11,153.
