News Briefs from Washington Survey: Small Business Financing Demand Picks Up; Success Rates Steady Small businesses’ profitability and their success applying for financing held steady from 2017 to 2018, according to the latest Small Business Credit Survey—a joint effort by the 12 regional Federal Reserve Banks—released Tuesday. More than half of employer firms surveyed reported that they were profitable at the end of 2017 and had seen increased revenues throughout the year. More than 7 in 10 said they expect revenue to grow in 2019, while 44% expect to add more jobs.
Demand for financing climbed from the 2017 survey, with 43% of employer firms applying for financing in the previous 12 months. Of those who applied, 47% received the full amount requested, roughly the same as the year before. Traditional bank lending remains the primary source of financing for the nation’s small businesses, though the survey noted continued growth in borrowers who applied for financing through nonbank online lenders (32% in 2018 versus 24% in 2017 and 19% in 2016).
Small banks approved at least some of the amount requested for 71% of credit applicants, while large and regional banks approved credit for 58% of applicants—both figures in line with recent trends. Approval rates at online lenders shot up to 82% from 69% in 2016. However, higher interest rates and unfavorable repayment terms drove significantly lower satisfaction rates with online lenders compared to banks. Net satisfaction with online lenders fell six points to 33% in 2018, while it rose to 55% for larger banks and held steady at 73% for small banks. Read the survey report.
New FHFA Director Warns of Vulnerability in Housing Finance System In his first remarks as director of the Federal Housing Finance Agency, Mark Calabria Monday cautioned that “the foundations of our mortgage finance system remain vulnerable,” and highlighted the need for housing finance reform.
Calabria noted that while the market has seen strong house price growth over the past several years as a result of strong economic performance, “too many remain locked out of housing, while others are dangerously leveraged.” He added that making changes to the housing finance system now when the economy is strong is critical to ensure that it is prepared for another potential downturn. “Booms will eventually be followed by busts,” Calabria said. “It is during these moments we must prepare for the inevitable downturn.” Read Calabria's remarks.
Large Bank CEOs Raise Cybersecurity Concerns, Slowing Global Growth Cybersecurity and the slowing of the global economy are two key issues of concern, the CEOs of the nation’s largest banks told the House Financial Services Committee last week. Noting that “cyber risk is probably the biggest risk the financial system faces,” according to JPMorgan Chase Chairman and CEO Jamie Dimon, the CEOs called for greater collaboration and information sharing between banks and regulators to counter the growing threat of cyber-related crime. Higher Limits Now Available on USDA Farm Loans Higher limits are now available for borrowers interested in United States Department of Agriculture’s (USDA) farm loans, which help agricultural producers purchase farms or cover operating expenses. The 2018 Farm Bill increased the amount that producers can borrow through direct and guaranteed loans available through USDA’s Farm Service Agency (FSA) and made changes to other loans, such as microloans and emergency loans. NBA Offers Banker Resources on County Borrowing Authority Due to recent floods and blizzard disasters in Nebraska, your NBA team has compiled a quick reference to Nebraska law concerning the borrowing authority of counties. Some bank representatives have commented that county officials are asking local banks for options available during these pressing times. The following Nebraska Statutes may be helpful to review in determining lending options.
Emergency Transfer of Funds – Nebraska Statute 13-510 If due to unforeseen emergencies there is temporarily insufficient funds to pay expenditures in a particular fund to meet the requirements of the adopted budget of expenditures for that fund, a political subdivision (county) may, by majority vote, transfer money from one fund to the other. Specific limitations are stated in the statute.
Emergency Appropriations – Nebraska Statute 23-918 During the fiscal year, a county is able to make additional or increase of appropriations to meet emergencies. Temporary loans are required to be approved by a two-thirds vote of the county board. A temporary loan must be repaid from sources available, and if none, by an annual levy not exceeding seven cents on each $100 of taxable property. Such levy, together with the annual levy for any succeeding year cannot exceed the levy limitations of law.
Installment Loans - Nebraska Statute 23-160.01 Counties have limited authority to borrow using installment loans. The following limitations apply: A negotiable promissory note is limited to a term of one year; the funds borrowed cannot be in excess of the amount of the warrants issued; and the amount of the warrants are limited to restrictions in the law. The promissory notes must be presented to the county treasurer and registered by such officer before being negotiated.
Registered Warrants – Nebraska Statutes 23-1602 & 77-2203 Generally, when there are insufficient funds on hand to pay county expenses, a warrant may be registered pursuant to the above sections of law. The endorsement on the warrant must state “Not paid for want of funds”; the warrant must be dated and signed by the treasurer; and the endorsement on the warrant must state “Registered for payment.” The county treasurer is also required to maintain a warrant register. The treasurer is required to pay each registered warrant in the order in which they are registered. Finally, the rate of interest is fixed by the county board and stated on the warrant.
Limited Bonded Indebtedness – Nebraska Statute 23-120 If a county had no bonded indebtedness payable from its general fund levy, the county may levy 5.2 cents on each $100 upon the taxable value of all the taxable property for a limited number of projects. Unfortunately, the statutory limitations are for a courthouse, jail and other county buildings.
Lease-Purchase – Nebraska Statute 23-3114 Counties are authorized to enter into contracts for the lease of real or personal property for periods in excess of one year.

Compliance Alliance Q&A Q: We are selling one of our branches next month. The branch only has one HMDA loan to date. Do we need to report that loan on the HMDA LAR? The bank that is purchasing the branch is not a HMDA-reporting bank.
A: Assuming that purchasing this branch will not cause the acquiring back to become a HMDA-reporting bank, then yes, in this instance you'd report any HMDA reportable loans that originated prior to the sale in April. Any reporting after the sale by the acquiring bank is optional for the remainder of the year. Data collection by the acquired Branch Office is optional for transactions taking place in the remainder of the calendar year of the acquisition.

HOME MORTGAGE DISCLOSURE ACT (HMDA) CHANGE IN EXEMPTION THRESHOLD
The Board of Governors of the Federal Reserve System recently published in the Federal Register its annual notice of the asset-size exemption threshold for depository institutions under Regulation C, which implements the Home Mortgage Disclosure Act (HMDA). By this amendment, the Board of Governors has increased the asset-size exemption threshold to $46 million in 2019 for depository institutions that are required to report data under HMDA.
As a result of this action, depository institutions with assets of $46 million or less as of December 31, 2018, are exempt from data collection in 2019. An institution’s exemption from collecting data in 2019 does not affect its responsibility to report the data it was required to collect in 2018. The adjustment was effective January 31, 2019.
A review of the HMDA exemption threshold is mandated by provisions of the Economic Growth and Regulatory Paperwork Reduction Act of 1996. The adjustment reflects changes in the Consumer Price Index for Urban Wage Earners and Clerical Workers for the 12-month period ending in November 2018.

TILA RESPA INTEGRATED DISCLOSURE FAQS
The Consumer Financial Protection Bureau (CFPB) recently released FAQs to assist with TILA – RESPA Integrated Disclosure Rule (TRID) compliance. Three of the four FAQs relate tocorrected closing disclosures and the three business–day waiting period, while the fourth FAQrelates to the use of model forms.
The TRID rule, which applies to many consumer mortgage loans, consolidated the various disclosure forms that were required under the Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA) into two forms: (1) Loan Estimate that must be given to a borrower by the third business day after the lender receives an application; and (2) a Closing Disclosure that must be given at least three business days before consummation.
Highlights of the FAQs include:
Under TRID, a creditor must ensure that a consumer received a corrected ClosingDisclosure at least three business days before consummation of the transaction (i) forcertain APR changes; (ii) if the loan product information changes; or (iii) if a prepaymentpenalty has been added to the loan. Any of these changes would trigger a new threebusiness-day waiting period.
A corrected Closing Disclosure is required under TRID if the APR changes, including ifit decreases. If the change in the APR is within applicable tolerances under Regulation Z,the creditor may provide the new Closing Disclosure without triggering a new threebusiness-day waiting period. If the change in the APR is outside applicable tolerances,the creditor must wait three business days before consummation.
Section 109(a) of the Economic Growth, Regulatory Relief, and Consumer ProtectionAct did not change the timing for consummating transactions if a creditor is required toprovide a corrected Closing Disclosure under TRID.
A creditor is deemed in compliance with the disclosure requirements of TRID if it usesthe appropriate model forms provided by the CFPB and properly completes them withaccurate content.

REGULATION Z – CONSUMER CREDIT TRANSACTIONS THRESHOLD AMOUNT
The Board of Governors of the Federal Reserve System and the Consumer Financial Protection Bureau have issued final rules pertaining to the implementation of the Consumer Protection Act (CPA). Effective January 1, 2019, the threshold for exempt consumer credit transactions increased from $55,800 to $57,200.

First Community Bank (Fremont) has completed their remodel of 100-plus year-old building located at 5th & Main streets. F&M Bank (Falls City) participated in the Teach Children to Save program this past week by giving out an activity packet about saving and giving 81 local second-graders a piggy bank! (pictured below)
F&M Bank (Gretna) has begun their Food Truck Fridays initiative again this year; the bank has collaborated with Take ’Em Catering to serve lunch on select Fridays this spring in the bank’s parking lot from 11:00 a.m. – 2:00 p.m. Great Western Bank (Grand Island) has presented a $2,000 Making Life Great grant to Choice Family Health Care of Grand Island. Mainstreet Bank (Tecumseh) recently presented the Tecumseh Aquatic Association with a $30,000 donation toward the construction of the new Aquatic Center. Nebraska State Bank (Oshkosh) hosted their annual community appreciation dinner March 26. Bank employees served the meal to their fellow community members.

NebraskaLand National Bank (North Platte) will celebrate the graduation of 34 students from the NebraskaLand University Financial Literacy Scholarship program designed to educate students on budgeting, savings, credit, loans and more. Graduates are awarded with academic scholarships ranging from $250 to $1,000. Platte Valley Bank (North Bend) was presented with the Daughters of the American Revolution Historic Preservation Award, April 2 at the May Museum. Scribner Bank (Scribner) recently showed their appreciation for the Scribner Fire & Rescue Departments by treating the members to a grilled hamburger meal at their monthly meeting and donated $1,000 to each department. Retirements Mary Kjeldgaard, First Northeast Bank of Nebraska (Tekamah), is retiring, effective this week. Mary served as vice president and branch manager of the bank’s Tekamah location. An open house was held April 10 & 11 during business hours for customers and friends to wish her well in her new endeavors.
