ASSISTANCE FROM NCRPB 27th February, 2013 LSQ 512 DR. NILESH NARAYAN RANE Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) the details of development works undertaken in urban areas of States and Union Territories with the financial assistance from the National Capital Region Planning Board; (b) the funds allocated and dispersed during the last three years and the current year, State and Union Territory-wise; and (c) the current status of these projects, project-wise? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT (SMT. DEEPA DASMUNSHI) (a): The National Capital Planning Board (NCRPB) has informed that it provides loan to the State governments and their implementing agencies upto 75% of the project cost for implementing infrastructure development projects in the Capital Region (NCR) and the Counter Magnet Areas (CMA). These projects are prepared by Participating States & their implementing agencies and submitted to NCRPB for loan assistance. Various projects financed by Board includes Water sector, Sewerage, Solid Waste Management, Power (transmission & distribution), Roads, Road over Bridge’s, Medical college, Irrigation canal, Technical Institutions & Land Development projects, etc. (b): NCRPB has also informed that following funds have been allocated by the Government of India to the National Capital Region Planning Board during the last three years and the current year; 2009-10 Rs.50.00 crore 2010-11 Rs.50.00 crore 2011-12 Rs.50.00 crore 2012-13 Rs.55.00 crore However, during last three years (2009-10 to 2011-12) and the current year (2012-13) up to January, 2013, the Board has released loans amounting to Rs. 2278.48 crore to State Governments/their implementing agencies as under:- Rs. (c): NCRPB has further informed that since inception, NCRPB has approved financial assistance for 277 infrastructure development projects. Completed 188 Ongoing 89 Total 277 MONITORING COMMITTEES UNDER FRA 27th February, 2013 LSQ 540 SHRI KOWASE MAROTRAO SAINUJI Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) whether the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 mandates for the constitution of monitoring committees; (b) if so, the details thereof; (c) the compliance/implementation status in regard to the constitution of the said committees by the States/Union Territories, State/UT-wise; and (d) the measures taken by the Government to persuade the States/UTs which have not constituted the said committees so far to do the same at the earliest? MINISTER OF TRIBAL AFFAIRS (SHRI V. KISHORE CHANDRA DEO) (a) & (b) : Yes Madam. Section 6(7) of the Scheduled Tribe and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (In short FRA) provides for constitution of State Level Monitoring Committees by the State Governments to monitor the process of recognition and vesting of forest rights and to submit to the nodal agency such returns and reports as may be called for by that agency. Further Section 6(8) of the Act inter-alia provides that the State Level Monitoring Committee shall consist of officers of the departments of Revenue, Forest and Tribal Affairs of the State Government and three members of the Panchayati Raj Institutions at the appropriate level, appointed by the respective Panchayati Raj Institutions, of whom two shall be the Scheduled Tribes members and at least one shall be a woman, as may be prescribed. Further, Rule 9 of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Rules, 2008 provide that the State Government shall constitute a State Level Monitoring Committee with the following members namely:- (a) Chief Secretary - Chairperson; (b) Secretary- Revenue Department - Member; (c) Secretary Tribal or Social Welfare Department - Member; (d) Secretary, Forest Department - Member; (e) Secretary, Panchayati Raj - Member; (f) Principal Chief Conservator of Forests - Member; (g) three Scheduled Tribes member of the Tribes Advisory Council, to be nominated by the Chairperson of the Tribes Advisory Council and where there is no Tribes Advisory Council, th ree Scheduled Tribes members to be nominated by the State Government; (h) Commissioner, Tribal Welfare or equivalent who shall be the Member Secretary. (c) & (d): As per the information available with the Ministry, as on 31.3.2013, all the State/UT Governments except Manipur, Nagaland and A&N Islands Administration have constituted the State Level Monitoring Committees. The

Ministry of Tribal Affairs has been constantly persuading with the State Governments/UT Administrations to implement the provisions of the Act in a time bound manner, including constitution of State Level Monitoring Committees as required under the Act. Further to strengthen the monitoring of the implementation of FRA, FR Rules have been amended on 6.9.2012 to include that SLMC is mandated to meet at least once in each quarter to take stock of the field level problems and submit Quarterly Progress Report (QPR) to the Ministry. KARUNAKARAN SHRI HARISH CHOUDHARY SHRI IJYARAJ SINGH Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) the details of various urban development schemes being run by the Government in the country and the steps taken for timely completion of these schemes; (b) the number of proposals received by the Government from various States under these schemes, State-wise; (c) the details of proposals cleared and the number of them still pending, State-wise, along with the reasons for such pendency and the time by which these pending proposals are likely to be cleared; (d) the details of funds sanctioned during the last three years and the current year to various States under these schemes along with the work undertaken by the State, year and project-wise; and (e) whether the Union Government is not sanctioning /releasing requisite funds to various States including Madhya Pradesh and if so, the details thereof and the reasons therefor?

RATNA DE SHRI GOWDAR MALLIKARJUNAPPA SIDDESWARA SHRI JAGDISH SINGH RANA Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) the schemes being implemented for the development of basic amenities and infrastructure in the urban areas; (b) the criteria regarding inclusion of cities in the schemes; (c) whether various State Governments including Karnataka have submitted proposals to the Union Government under the schemes; (d) if so, the details thereof, State-wise along with the names of the cities to which they belong to; and (e) the action taken/being taken by the Government in this regard along with the details of funds released to various States, State-wise and proposal-wise? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT (SMT. DEEPA DASMUNSHI) (a)&(b): Urban Infrastructure Development Scheme for Small and Medium town (UIDSSMT) a sub-component of Jawaharlal Nehru National Urban Renewal Mission (JNNURM) is being implemented in 28 States and 5 UTs. All towns, except cities covered under Urban Infrastructure Governance (UIG) Sub-Mission of JNNURM, are covered under the Scheme. (c) to (e): 807 projects at a project cost of Rs.14020.96 crore involving Additional Central Assistance (ACA) of Rs.11240.02 crore have been sanctioned. A sum of Rs. 9494.83 Crore has been released to the States so far. The details of 807 projects showing names of the cities, State-wise is annexed at Annexure-I. 38 projects with an ACA commitment of Rs.545.99 crore have been sanctioned to the State of Karnataka of which as on 27.02.2013, Rs.528.49 crore has been released. (a) to (c): JNNURM is a reform driven Urban Infrastructure Program for provisioning of Urban Infrastructure and services in Urban areas, started by the Govt. of India in 2005. The Small and Medium Towns of all States and UTs are covered under the Urban Infrastructure Development Scheme for Small and Medium Towns (UIDSSMT), a sub-component of JNNURM, while there are 65 large “Mission” Cities. Water Supply, Sewerage, Drainage, Solid Waste Management sectors in the small, medium and other towns, as recommended by the State Govt., are admissible components. Sanction of projects is also dependent upon the funds availability and technical appraisal of the project. The details and present status of the projects sanctioned for Chattisgarh, Jharkhand and Uttrakhand States under the UIDSSMT are enclosed at Annexure.

(d) if so, the details thereof? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT (SMT. DEEPA DASMUNSHI) (a)& (b): Based on the recommendations of the 13th Central Finance Commission, the Government has decided to provide Rs.8000 crores to the 28 States as performance based grants for Urban Local Bodies (ULBs)for the period 2010-15.The 13th Central Finance Commission has recommended grant-in-aid to urban local bodies as a percentage of the previous year’s divisible pool of taxes (over and above the share of the States) after converting this to grant-in-aid under Article 275 of the Constitution. The grant has two components – a basic grant component and a performance based component. The performance based component grant will be released to the ULBs of those States for ULBs duringthe award period i.e. 2010-15. Performance based grants to all States will be 2.28 percentof the previous year’s divisible pool. (c)& (d): The Grants have been allocated as per the recommendations of the 13th Central Finance Commissionand will be released on the compliance of the nine conditions as follows:- a. Putting in place a supplement to the budget documents for ULBs,Double Entry based accounting system; b. Putting in place Audit system for all local bodies; c. Establishment of Independent Local Body Ombudsman; d. Electronic Transfer of local body grants within five days of receipt from the Central Government; e. Prescription of the qualification of persons eligible for appointment of members of the State Finance Commission; f. Levy of Property Tax by ULBs without hindrance; g. Establishment of a property tax board; h. Disclosure of service standards proposed to be achieved by each ULB in respect of the water and sanitation sector etc; and i. Putting inplace a Fire Hazard Mitigation Plan for million plus cities. URBANISATION NO 6th March, 2013 LSQ 1519 SHRI PULIN BIHAR BASKE Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) whether growing urbanisation is causing health and environmental problems in the country; and (b) if so, the details thereof and the action taken /being taken by the Government in this regard? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT ( SMT DEEPA DASMUNSHI ) (a)& (b): According to 2001 census, the urban population of the country was 286.11 million, living in 5161 towns, which constitutes 27.81% of the total country’s population. However, the same as per 2011 census has risen to 377.16 million viz. 32.16% of the total country’s population and at the same time number of towns has gone up to 7935. The rate of urban growth in the country is very high as compared to developed countries, and the large cities

are becoming larger mostly due to continuous migration of population to these cities. This creates enormous pressure on existing urban infrastructure. Ministry of Urban Development has formulated the National Urban Sanitation Policy in 2008. The main goal of the policy is to transform Urban India into community-driven, totally sanitized, healthy and livable cities and towns. The vision of the policy is that all Indian cities and towns become totally sanitized, healthy and livable and ensure and sustain good public health and environmental outcomes for all their citizens with a special focus on hygienic and affordable sanitation facilities for the urban poor and women. i. In order to supplement the effort of State Governments and Urban Local Bodies(ULBs), Government of India has launched reform linked Jawaharlal Nehru National Urban Renewal Mission (JNNURM) and Urban Infrastructure Development Scheme for Small & Medium Towns (UIDSSMT) in December 2005 with a view to provide infrastructure facilities including sewerage & sewage treatment as well as solid waste management in all the urban areas of the country. ii. The Ministry has also launched Schemes namely North Eastern Region Urban Development Programme (NERUDP), 10% Lump-sum provision scheme for North Eastern Region including Sikkim and Scheme for urban infrastructure development in satellite towns around seven megacities. WASTE MANAGEMENT NO 6th March, 2013 LSQ 1604 SHRI VIKRAMBHAI ARJANBHAI MAADAM Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) whether the Government has conducted any study on challenges of waste management; (b) if so, the details thereof; (c) whether there is any long term scheme for waste management; and (d) If so, the steps taken for adopting modern technology for the purpose of waste management? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT ( SMT DEEPA DASMUNSHI ) (a)&(b) :Yes Madam. The Ministry of Urban Development constituted a Technology Advisory Group on Solid Waste Management. The report of the Group which was finalised in May 2005 addresses various issues related to solid waste management including financial and technological issues. The report was circulated to all State Governments for adoption. In March 2003, a Task Force was set up to prepare an action plan for promoting integrated plant nutrient management using city compost alongwith chemical fertilisers. This report was also circulated to State Governments. (c): Under the various schemes of this Ministry, which include the Jawaharlal Nehru National Urban Renewal Mission, Central Sector Scheme for Solid Waste Management projects in 10 Airfield Towns, North Eastern Region Urban Development Programme, Urban Infrastructure Development Scheme in Satellite Towns, 10% Lump Sum Scheme for North Eastern Region including Sikkim, support is provided for implementation of solid waste management projects. (d):The Manual on Solid Waste Management and report of Technology Advisory Group on Municipal Solid Waste Management brought out by the Ministry of Urban Development in the years 2000 and 2005 respectively specify various technologies for collection, transportation, processing, treatment and disposal of municipal solid waste in a scientific and hygienic manner. The National Capital Planning Board (NCRPB) has informed that it provides loan to the State governments and their implementing agencies upto 75% of the project cost for implementing infrastructure development projects in the Capital Region (NCR) & the Counter Magnet Areas (CMA). These projects are prepared by Participating States & their implementing agencies and submitted to NCRPB for loan assistance. Various projects financed by Board includes Water sector, Sewerage, Solid Waste Management, Power (transmission & distribution), Roads, Road over Bridge’s, Medical college, Irrigation canal, Technical Institutions & Land Development projects etc. Since inception, NCRPB has approved financial assistance for 277 infrastructure development projects. This is a State subject and it is the responsibility of the State Governments / Urban Local Bodies (ULBs) to plan, design, execute and operate the waste management schemes in the urban areas of the Country. The Ministry of Urban Development acts as a facilitator in framing broad policies, programmes and guidelines on municipal solid waste management. The schemes initiated for supplementing the effort of State Governments are: i. Ministry of Urban Development launched Jawaharlal Nehru National Urban Renewal Mission (JNNURM) in 2005 with a view to provide financial assistance to the State Governments for creating infrastructure including municipal solid waste management with a reform oriented agenda in all the urban areas of the country. Under Urban Infrastructure & Governance (UIG) and Urban Infrastructure Development in Small and Medium Towns (UIDSSMT). Solid Waste Management is one of the admissible component for grant of Additional Central Assistance (ACA). ii. Ministry of Urban Development has also formulated a Scheme for Urban Infrastructure Development Scheme in Satellite Towns Magnets of Million plus Cities (UIDSST). The objectives of this scheme amongst others are to develop urban infrastructure facilities such as water supply, sewerage, drainage and solid waste management etc. at Satellite towns/ Counter Magnets around Seven mega-cities. iii. The Ministry has also launched North Eastern Region Urban Development Programme (NERUDP). The capital cities of the five states are covered in the first phase viz., Agartala (Tripura), Aizawl (Mizoram), Gangtok (Sikkim), Kohima (Nagaland) and Shillong (Meghalaya). Solid Waste Management Projects are also supported under this scheme. iv. The Ministry of Urban Development has also launched a scheme on 10% Lump-sum provision for the Development of North Eastern Region including Sikkim. v. Under the Central Sector Scheme of `Solid Waste Management and Drainage in 10 Selected Indian Air Force (IAF) Airfield Towns` launched by the Ministry in 2003, integrated Solid Waste Management projects including compost plants for converting garbage into organic fertilizers have been approved in 10 all airfield towns. Out of 10 solid waste management projects, 8 projects for towns namely, Sirsa, Jodhpur, Gwalior, Tezpur,

Adampur, Ambala, Dundigal and Pune have been completed and the remaining 2 projects for the towns, namely, Hindon and Barelilly are at different stages of implementation. An amount of Rs. 2.88 crore has been released to the Implementing Agency (NBCC) on March 2010 (FY 2009-10) for implementation of Tezpur Airfield project. No fund has been released during FY 2010-11 & FY 2011-12 and current year under this scheme. (d) &(e): The funds sanctioned/released and utilized for the purpose during each of the last three years and the current year, city/town-wise under Infrastructure and Governance (UIG) Sub-Mission of JNNURM of Solid Waste Management & Sewerage at Annexure –I, Urban Infrastructure Development Scheme for Small & Medium Towns (UIDSSMT) at Annexure-II. Urban Infrastructure Development Scheme in Satellite Towns Magnets of Million plus Cities (UIDSST) at Annexure-III and North Eastern Region Urban Development Programme (NERUDP) at Annexure IV. ANNEXURE IV

North Eastern Region Urban Development Programme for Waste Management Projects (Annexure for Lok Sabha Unstarred Question 2747 regarding Waste Management) The Ministry of Urban Development (MoUD) is implementing the North Eastern Region Urban Development Programme (NERUDP) with the financial assistance from Asian Development Bank (ADB) covering capital cities of 5 North Eastern States viz. Agartala (Tripura), Aizawl (Mizoram), Gangtok (Sikkim), Kohima (Nagaland), and Shillong (Meghalaya). Under the programme following waste management projects have been sanctioned: 1. SWM projects sanctioned in 2009 for a. Kohima (Nagaland) at Rs 16.85 crore b. Shillong (Meghalaya) at Rs 2.06 crore SWM projects sanctioned in 2012 for c. Gangtok (Sikkim) at Rs 16.48 crore d. Shillong (Meghalaya) at Rs 4.25 crore, and 2. Sewerage project sanctioned in 2012 for a. Aizawl (Mizoram) at Rs 35.38 crore Assessment of progress The progress of projects is assessed and monitored by a National Steering Committee set up in the Ministry of Urban Development and by State level Committees in the project States. The progress achieved so far is given below : 1. 25% under SWM projects sanctioned in 2009 for Kohima (Nagaland) and Shillong (Meghalaya) 2. SWM and Sewerage projects sanctioned in 2012 Gangtok (Sikkim), Shillong (Meghalaya), and Aizawl (Mizoram) are in the process of tendering.

SANJEEV GANESH NAIK SHRI SAROJ PANDEY Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) whether sanitation level in the urban areas including Mumbai and other A and B category cities is reportedly not at par with international level; (b) if so, the details thereof and the reasons therefor along with the steps taken/ being taken by the Government in this regard; (c) the details of the financial and other assistance provided by the Government for the purpose during the last three years and the current year, city, year and State-wise; and (d) the details of works undertaken by the said assistance during the above-mentioned period, city and State-wise ? THE MINISTER OF URBAN DEVELOPMENT (SHRI KAMAL NATH) (a) to (d) : A Statement is laid on the Table of the House. STATEMENT REFERRED TO IN REPLY TO LOK SABHA STARRED QUESTION NO. 336 FOR 20.3.2013 REGARDING URBAN SANITATION (a) and (b): Public Health and Sanitation in urban areas is a State subject as per the Constitution of India List II – State List entry 6. Sanitation is defined as safe management of human excreta, including its safe confinement, treatment, disposal and associated hygiene-related practices. In addition to management of human excreta and associated public health and environmental impacts, it is recognized that integral sanitation solutions need to take account of other elements of environmental sanitation, i.e. solid waste management; generation of industrial and other specialized / hazardous wastes and drainage; There is no defined International level but different countries have their own methods of defining sanitation. The Government of India / Ministry of Urban Development formulated the National Urban Sanitation Policy (NUSP) on 03.10.2008. One of the components of NUSP is National Monitoring and Evaluation by periodic sanitation rating of cities by independent agencies. The national rating for cities has been launched by theGovernment of India to achieve the goals of the National Urban Sanitation Policy (NUSP) which aims at making Indian cities and towns totally sanitized, healthy, and livable. The first such exercise undertaken during 2009-2010 with publication of results in May 2010rated 423 cities (with population greater than 100,000) for their performance across various aspects of sanitation. The Ministry of Urban Development acts as a facilitator in framing broad policies, programmes and guidelines on Urban Sanitation. The Central Government supplements the efforts of State Governments/Union Territories in providing sanitation facilities through various schemes as follows: i. In order to supplement the effort of State Governments, the Ministry of Urban Development launched Jawaharlal Nehru National Urban Renewal Mission (JNNURM) in 2005 with a view to provide financial assistance for creating infrastructure facilities in all the urban areas of the country including sanitation with a reform oriented agenda. The

cities are supported through Urban Infrastructure & Governance (UIG) Sub-Mission of JNNURM and Urban Infrastructure Development Scheme for Small and Medium Towns (UIDSSMT).Projects in the sectors of Sewerage, Drainage and Solid Waste Management are supported through grant of Additional Central Assistance (ACA). ii. Ministry of Urban Development has also formulated a Scheme for Urban Infrastructure Development Scheme in Satellite Towns/Magnets of Million plus Cities (UIDSST). The objectives of this scheme amongst others are to develop urban infrastructure facilities such as water supply, sewerage, drainage and solid waste management etc. at Satellite towns/ Counter Magnets around seven mega-cities. iii. The Ministry has also launched North Eastern Region Urban Development Programme (NERUDP). The capital cities of the five states are covered in the first phase viz., Agartala (Tripura), Aizawl (Mizoram), Gangtok (Sikkim), Kohima (Nagaland) and Shillong (Meghalaya). Solid Waste Management Projects are also supported under this scheme. NATIONAL URBAN SANITATION POLICY 20th March, 2013 LSQ 3777 DR AJAY KUMAR Will the Minister of URBAN DEVELOPMENT be pleased to state:- (a) whether any schemes have been initiated in order to achieve the objectives of the National Urban Sanitation Policy, 2008; (b) if so, the details of schemes initiated, funds allotted and targets fixed/achieved during the last three years and the current year, State-wise; (c) whether the Government proposes to initiate a rating of Class 2, Class 3 and Class 4 cities on sanitation parameters, similar to the national rating exercise for Class 1 cities; and (d) if so, the details thereof and the time by which such rating exercise is likely to be conducted and the methodology that is likely to be applied for the same? THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT (SMT DEEPA DASMUNSHI) (a)&(b) Government has set up the National Clean Development Mechanism (CDM) Authority headed by the Ministry of Environment & Forests since December 2003 to act as the nodal agency for according Host Country Approval (HCA) for CDM projects. The National CDM Authority accords host country approvals to CDM projects under the modalities and procedures laid down by the Executive Board of the CDM under the United Nations Framework Convention on Climate Change (UNFCCC) and its Kyoto Protocol. The Authority is an inter-ministerial body headed by the Ministry of Environment & Forests and comprising of representatives from various ministries including the Ministries of External Affairs, Finance, New and Renewable Energy, Power, Petroleum and Natural Gas, Department of Science & Technology, and the Planning Commission. The Authority also provides relevant technical and capacity building support to project proponents with an aim of helping enhance the depth and penetration of CDM projects in India (c ) & (d) In 2011, the UNFCCC formed an independent High Level Panel consisting of eleven members drawn from different areas of expertise and regions in the world to lead a dialogue on the CDM Policy. The High Level Panel has analysed the issues relating to the role of CDM and its impact on carbon markets to date, the governance and operations of the CDM, and the future context in which the CDM could operate, with a view to address the crisis in international carbon markets and develop new approaches to enhance mitigation impact. The Panel has recommended, inter alia, setting of robust standards, implementing standardized methods for assessing additionality of impact of environmental actions, promoting sustainable development, encouraging greater access to the CDM for underrepresented regions, and improving the existing governance arrangements for CDM.
