This user guide provides information on how the Mackay Region Planning Scheme 2017 applies to industrial development. This user guide provides information on how industrial development is defined, whether an application or referral to Council is required and key planning scheme requirements.

Mackay region planning scheme 2017The planning scheme is the primary instrument for managing development in our local government area.

The planning scheme: • outlines a 20 year vision for the region

• identifies zones and overlays over land

• defines various forms of development

• determines the level of assessment for each type of development

• sets codes for the assessment of development

Upon coming into effect on 24 July 2017, the planning scheme replaced three previous planning schemes based on the former Mackay City, Sarina Shire and Mirani Shire local government areas.

industrial zonesThe planning scheme intends that industrial development is located on appropriately zoned land. The planning scheme provides for industrial development in the following zones:

► Intent of each zone

The purpose and land use of each industry zone is summarised as follows:

• High impact industry zone - Provides for large-scale, medium and high impact industrial development. Development forms regional economic and employment hubs. Development provides separation distances from residential areas (between 250m and 1500m depending on the type of industry) and adjoins key transport infrastructure.

• High impact industry zone, Sugar mill precinct - Precinct provides for continuation of existing sugar mills and related activities.

• Low impact industry - Provides for low impact industrial development and service industries, including hardware, trade supplies and warehouses.

• Industry investigation - Provides land for future industrial development. The conversion of land to industrial is managed through a development framework plan in a coordinated, sequenced and economically efficient manner. Importantly, development is supported by extensive investigations and framework planning which addresses constraints.

• Special purpose - Provides for transport and utility infrastructure. Land regulated by other legislation (eg. strategic port land at Port of Mackay, Port of Hay Point and Mackay Airport) is identified as Special Purpose but the planning scheme does not apply.

To determine if your industrial development is a special, low, medium or high impact industry use, refer to SC1.1.2 - Industry thresholds.

Do I need to submit an application?The table below identifies (with a P) industrial uses that are code assessment (material change of use application to Council required, no public notification, code based assessment) or accepted subject to requirements in certain circumstances (application to Council not required if criteria met) in each of the industry zones.

Unticked uses are impact assessable (material change of use application to Council required, public notification, full assessment). Any use that is inconsistent with the zone requires an impact assessable application.

What are the key requirements in the industry code?The Industry Activities Code applies to several industry uses, including:

• hardware and trade

supplies (not open to

general public)

• high impact industry

• low impact industry

• marine industry

• medium impact industry

• research and technology

industry

• service industry

• special industry

• transport depot

• warehouse

Key requirements in the Industry activities code and other relevant codes include:

• separation distances from residential development and other sensitive land uses:- special industry - 1,500 metres- high impact industry - 500 metres- medium impact industry - 250 metres

• minimum site requirements:High impact industry zone

• road frontage setbacks:- non-key active frontage streets:

~ arterial or sub-arterial: 10 metres~ other road types: 6 metres

- key active frontage streets: no more than 2.5 metres

• site cover and gross floor area:- site cover (area under roof) is not more

than 60% of total site area- gross floor area is not greater than total

site area

• building design:- offices located at the front of the building and face the road- minimum floor levels in flood hazard

areas, the highest of: ~ 300mm above defined inundation level~ RL 5.4m AHD in Mackay~ 225mm above natural ground level~ 300mm above kerb / crown of road

- pedestrian entry is visible from the street

and visitor car parks, covered by an awning and adjoined by landscaping

- elevations facing roads include: ~ activation measures (windows,

doors, openings) for at least 40% of the elevation length

~ articulation measures (variations in building line, materials and roof profile, awnings) spaced no more than 15 metres apart

• landscaping and front fences:

The Planning Act 2016, Planning Regulation 2017 and the Development Assessment Rules set out the requirements for the development assessment process.
