Watercraft power
Designedforinstalledwatercraft-use,Harpoon GPS is powered by your watercraft’s battery.HarpoonGPSmustbeinstalledtoacontinuoussourceof12VDCor24VDCpowerfromyourwatercraft.Whenwatercraftpowerisnolongeravailable,suchasifthewatercraftbatterybecomesdrainedorHarpoonGPSisdisconnectedfromyourwatercraftelectricalsystem,HarpoonGPSwilltransitiontoitsinternalback-upbattery.
NOTE:Theback-upbatteryisdesignedtomaintainingsecuritycapabilityforupto2days.

Wireless coverage
Similartohowamobilephonerequires wireless (cellular) coverage in order to send or receive a phone call, HarpoonGPSrequireswirelesscommunicationtocommunicatesecurityandlocationinformation.Whenwirelessservicecoverageisavailable,HarpoonGPSautomaticallyconnectstotheBlacklineGPSlocation-basedservicesplatform(BlacklineGPSNetwork)usingwirelesscommunication.
GPS coverage
HarpoonGPSrequires GPS satellite signal coveragetofindalocation.HarpoonGPSfeaturesBlacklineGPSUltimateSense™antennatechnologythatprovidesindustry-leadingreception.UltimateSensetechnologyenablesHarpoonGPStobeconvenientlyhiddenwithinyourwatercraftwhilecontinuingtodeliverexceptionaltrackingperformance.
Security mode features
YourHarpoonGPSfeaturesasecurity mode that can be armed (enabled) or disarmed (disabled) using your MyPasskeyfoborfromwithinyourNetworkAccount.
Whilearmed,HarpoonGPSisnotonlysensitivetowatercrafttampering(vibration),italsomonitorsitsGPSlocationwithinanautomatically-createdGPSsecurityperimeter.GPSsecurityperimetermonitoringenablesHarpoonGPStodetermineifyourwatercrafthasmovedfromwhereyoudocked/parkedit(aGPSsecurityperimeterbreach).Youcanoptionallysubscribetoemailand/ortextmessage(SMS)securityalertsthatprovidevisibilityoftamperingandaGPSsecurityperimeterbreach.ThisisdiscussedwithinthePreferences section of the Network Account chapter.

MyPass key fobYourHarpoonGPSproductcomeswithoneMyPasswirelesskeyfobthatautomatesHarpoonGPSsecurityarminganddisarmingusingshort-rangeradiotechnology.
OnceyoupairyourMyPasskeyfobwithyourHarpoonGPS,MyPassautomaticallyidentifiesyoutoyour HarpoonGPSproductwhennearby(approximately10’to30’).WhenHarpoonGPSsensesvibrationandyouarewithinproximityofyourwatercraftwithyourpairedMyPass,HarpoonGPSwillautomaticallydisarm.WhenyouleaveproximityofyourwatercraftwithyourMyPass,HarpoonGPSwillautomaticallyarmitself.
NOTE:YourMyPasskeyfobcontainsastandard,user-replaceableCR2032lithiumbatterythatoperatesforuptooneyear,dependinguponuse.Replacementscanbepurchasedfromcamerastores,drugstores,andelectronicsstores.

Using MyPass
IfyousubscribetotheoptionalBlacklineGPSMonitoring&RecoveryService(BMRS),youmustpairyourMyPasskeyfobwithyourHarpoonGPSinordertoautomatethesecurityfeature.IfyouhavenotsubscribedtotheBMRS,useoftheMyPasskeyfobisoptional.
NOTE:WhenusingtheMyPasskeyfob,pleasekeepitwithyouatalltimes(suchasonyourkeyring),exceptasnotedinthePreventingfalsesecurityalarmssectionbelow.
NOTE:Youmaypairupto10MyPasskeyfobswithoneHarpoonGPS.OneMyPasskeyfobcanbepairedwithanynumberofHarpoonGPSproducts.
Preventing false security alarms
Topreventfalsesecurityalarmswhileyourwatercraftisintransport(forexample,beingtowedforserviceortransportedonaferry),yourMyPasskeyfobmustremainwithyourwatercraft.Bydoingso,yourHarpoonGPSsecurity mode will remain disarmed.
NOTE: If you have concern about the security of your watercraft while in transport with the security mode disabled, at anytime,youcanlocateyourwatercrafttoensureitiswhereyouexpectittobe.
Pairing your MyPass key fob
YourMyPasskeyfobmustbepairedwithyourHarpoonGPS.WhenyourHarpoonGPShasbeenactivatedand is online(wirelesslycommunicatingwiththeBlacklineGPSNetwork),youmaypaironeormoreMyPasskeyfobswithyourHarpoonGPS.TopairyourMyPasskeyfob,followthestepsprovidedinthePreferences page section, in the NetworkAccountchapter.

Blackline GPS Monitoring & Recovery ServiceIfyousubscribedtotheBlacklineGPSMonitoring&RecoveryServiceduringHarpoonGPSactivation,yourwatercraftwillbeprotectedbyourprofessionalmonitoringservices.Similartoahomealarmsystem,ifyourHarpoonGPSleavesitsautomatically-createdGPSsecurityperimeterwhilearmed,alivealarmoperatorwillcontactyoutoverifyifyourwatercraft has been stolen or if it is a false alarm.

How it works
WhenyouleaveyourwatercraftwithyourMyPasskeyfob,HarpoonGPSautomaticallyarmsitselfandcreatesavirtualGPSsecurityperimeter.IfyourwatercraftleavesthisperimeterwithoutyourMyPasskeyfobpresent:
• YouareoptionallynotifiedoftamperingandtheGPSsecurityperimeterbreachthroughemailandortextmessage(SMS)alertingasconfiguredonthePreferencespageofyourNetworkAccount
• Alarmoperatorpersonnelareimmediatelynotifiedofpossibletheftandwillcontactyoutovalidate
• Ifyouconfirmthatyourwatercrafthasbeenstolen,thealarmoperatorwillworkwithyouandtheauthoritiesto recover your watercraft promptly, reducing the risk of damage

2. Thefirstlocationwillbedisplayedonthemapwithinapproximately20 to 40 seconds

4. Oncethecontinuoustracksession stops after 10 minutes, a notice will be appear within the command feedback window.

e) Thepositioning-deriveddataobtainedwhenusingtheServicewillbeaccurate,precise,oravailable.Thepotentialpositioningaccuracyas
deliveredthroughtheServicesasstatedinBlacklineliteratureandspecificationsprovidesonlyanestimateofachievableaccuracybased
on:specificationsprovidedbytheUSDepartmentofDefenseforGPSPositioningandbasedonGPSOEMReceiverspecificationsofthe
appropriatemanufacturer(ifapplicable)
LimitationofLiability
General
BlacklineprovidesyouwithServicesthroughthenetworksoftelecommunicationsprovidersandthroughothersuppliersandthirdparties(together“Suppliers”).YouruseoftheServicesofBlacklineandequipment,facilitiesandservicesofSuppliersisatyourownrisk.Subjecttothetermshereof,BlacklineandtheSupplierswillnotbeliableforanydamages,lossesofanykindorinjury,includinglostprofits(regardlessofwhetherwehavebeennotifiedthatsuchlossmayoccur)arisingdirectlyorindirectlyfromanyofthefollowing:
a) YouruseoftheServicesofBlacklineandoftheSuppliers,includingtheuseofanyfacilitiesorequipmentusedinconjunctionwithsuch
ServicesincludingtheSoftwareandtheBlacklineSites
b) Anyact,mistake,omission,interruption,delay,error,defectormisroutingofcommunicationsbytheSuppliersorBlackline
c) AnyfailurethatmayarisefromthefacilitiesorequipmentusedbyBlacklineortheSuppliers
d) Libel,slanderordefamationarisingfrommaterialtransmittedorreceivedthroughtheuseoftheServicesandtheservices,equipmentand
facilitiesoftheSuppliers
e) Infringementofpatents,trade-marksorcopyrightsarisingfromcombiningorusingtheServicesorSoftwareorequipment,orthatofthe
Suppliers
f) Anydamage,lossorinjurycausedbyortoavehicle,watercraft,aircraftorotherpropertyifsuchdamage,lossorinjuryresultedin
connectionwiththeSoftwareortheServices,ortheservicesoftheSuppliers
g) Physicalinjuriesordeath,anyotherdamages,lossofprofits,lossofearnings,lossofbusinessopportunities,orotherlossresultingdirectly
orindirectlyoutoforinconnectionwiththeuseoftheSoftwareorServices,ortheservices,equipmentandfacilitiesoftheSuppliers.
TheselimitationsofliabilityapplytoactsoromissionsofBlackline,itspartners,affiliatesandSuppliersandeachoftheirrespectiveofficers,directors,employees,suppliers,agents,consultantsorotherpersonsforwhominlawsuchpartiesareresponsible(together“Representatives”),whichwouldgive rise to a cause of action in tort, contract or any other doctrine of law.
NOTWITHSTANDINGANYTHINGELSEINTHISAGREEMENT,OURTOTALLIABILITYTOYOUUNDERTHISAGREEMENTORINCONNECTIONWITHTHESOFTWAREOROURSERVICESWILLBELIMITEDTOTHEFEESYOUPAIDTOUS(DIRECTLYORINDIRECTLYTHROUGHADISTRIBUTOR)FORTHESOFTWAREINTHE6MONTHSPRIORTOTHEFIRSTEVENTGIVINGRISETOTHELIABILITY.
Indemnification
YouagreetoindemnifyandholdBlackline,itspartners,affiliates,andSuppliersandeachoftheirrespectiveRepresentativesharmlessfromanyandallliabilities,penalties,claims,causesofactionandjudgmentsbroughtbythirdparties(includingcosts,expensesandrelatedreasonablelegalfees)resultingfromyouruseormisuseoftheSoftware,Services,ortheBlacklineSites,orabreachofanyoftheTermswhetherbasedincontract,tort(includingstrictliability),orotherdoctrineoflawandregardlessoftheformofaction.

ApplicableLaw
ThelawsoftheprovinceofAlberta,Canada,withoutregardtoprinciplesofconflictoflaws,willgoverntheseTermsandConditionsandanydisputeofanysortthatmightarisebetweenyouandBlackline.
Disputes
AnydisputerelatinginanywaytoyouruseoftheSoftware,ServicesortheBlacklineSiteshallbesubmittedtoconfidentialarbitrationinCalgary,Alberta,Canada,exceptthat,totheextentthatyouhaveinanymannerviolatedorthreatenedtoviolatetheintellectualpropertyrightsofBlackline,Blacklinemayseekinjunctiveorotherappropriatereliefinanyprovincial,stateorfederalcourt,andyouconsenttoexclusivejurisdictionandvenueinsuchcourts.ArbitrationunderthisagreementshallbeconductedundertheNationalArbitrationRulesthenprevailingoftheADRInstituteofCanada.Thearbitrator’sawardshallbebindingandmaybeenteredasajudgmentinanycourtofcompetentjurisdiction.Tothefullestextentpermittedbyapplicablelaw,noarbitrationunderthisAgreementshallbejoinedtoanarbitrationinvolvinganyotherpartysubjecttothisAgreement,whetherthroughclassarbitrationproceedingsorotherwise.

Severability
IfanyoftheseTermsandConditionsshallbedeemedinvalid,void,orforanyreasonunenforceable,thattermorconditionshallbedeemedseverableandshallnotaffectthevalidityandenforceabilityofanyremainingtermorcondition.
EntireAgreement
ThisAgreementsupersedesallprioragreementsofthepartiesregardingthesubjectmatterofthisAgreement,andconstitutesthewholeagreementwithrespecttothatsubjectmatter.
AssignmentandSublicensing
YoumaynotassignorsublicensethisAgreementoranyofyourrightsunderthisAgreementwithoutourpriorwrittenconsent,whichmaybewithheld without cause.
Enurement
ThisAgreementwillenuretothebenefitofandbebindinguponthepartiesandtheirlawfulsuccessorsandpermittedassigns.
ForceMajeure
Wewillnotbeliableforanynon-performanceordelayinperformancebythatisduewhollyorinparttofire,flood,anyactofGod,riot,actofwar(whetherornotdeclared),terrorism,changeinlaworanyothercausebeyondourreasonablecontrol.
