Dear "ianning and Zoning Reviewer,
On behalf of the property owners, Frank and Terry Spath, I am submitting a Variance request for 8 feet to the 15-foot setback of the northern extended property line for the proposed installation of two mooring piles.Additionally, a Variance of 7 feet to the 15-foot setback of the southern extended property line is requested toallow two mooring piles. A 6' wide x 75' long pier with two mooring piles currently exists on this waterfrontproperty. The owners are proposing a 6' wide x 30' long extension to the existing pier and the 4 proposed pileswould support two boat lifts.
The property is developed with a single-family home and includes 8, 750 square feet of area. It exhibits 50 feet ofroad frontage along Orchard Point Road and 50 feet of riparian frontage on Bodkin Creek in northern AnneAmndel County. As stated above, a 6' wide x 75' long pier currently exists on the site. During the summer of2018 the owners purchased a new 31 ' boat which requires a 4. 3' draft. Additionally, due to health issues of theowner, maintenance would be more easily attained by having the vessel at a greater water depth while on the boatlift. It is expected that the State MD Dept. of the Environment woulu not object to the project as 30' pierextension wouic! ailow for a preferred water depth of greater than 2.5' at mean-iow-water.
Many of the adjacent waterfront properties in this community are characterized by long and narrow lots, 50 feet inwidth. Given that the narrow nature of this property, which was created by subdivision in 1937, is not out ofcharacter of this neighborhood, this is believed to be a valid request for the proposed variances.
