"MORE lawyers nowadays complain of corruption in the judicial systemcompared to 10 years ago, according to the Social Weather Stations.One out of two lawyers knows of a trial judge in their city or provincewho has taken a bribe but they did not report it because they could not

prove it, said the SWS. In a briefing among lawyers Tuesday night, SWSpresident Mahar Mangahas saidthe perception of corruption in thevarious courts -- from the municipal trial courts all the way up tothe Supreme Court -- has risen among lawyers in the last 10years. "Ourlawyers are more critical now than before," Mangahas told the lawyers as hepresented the survey findings for the first time. The SWS polled 889 trialjudges -- or 61 percent of all trial judges in the country -- and 400 lawyers fromNovember 2003 to July 2004 to get their perceptions on various aspects of the judicialsystem. The last such survey was undertaken by SWS from 1994 to 1996.

"Corruption remains a major problem," the SWS said in a pressstatement. As in 1995, one-fourth of present lawyers say that manyor very many judges are corrupt. Although half or 49 percent saythey know a case in their own city or province where a judge took abribe, only 8 percent said they reported the bribery. The main excuse ofthose who kept silent is that they could not prove it," the SWS said. Amongjudges, only 7 percent said that many or very many judges were corrupt. TheSWS said the judges' perception of the extent of corruption among courtpersonnel was the same as in 1996."What has increased is the proportion ofjudges seeing many lawyers as corrupt," it said. Mangahas said the

survey showed that corruption "remains a serious problem in the judicial system but it is not cultural. "They're saying there'snothing to be done about (corruption) but it's not accepted. There'sstill the idealism," he said."

court had said that Judge Floro lacked the judicial temperament andthe fundamental requirements of competence and objectivity expectedof all judges. It said that the findings of psychosis by the mental health

professionals assigned to his case indicated gross deficiency incompetence and independence. In his appeal, Floro said his three

ABRA Rep. Luis Bersamin Jr. and his police bodyguard were shot deadby two gunmen yesterday after the lawmaker attended a nieceswedding at Mt. Carmel Church in New Manila, Quezon City. The 62-

LEGAL, CONSTITUTIONAL, FACTUAL AND MORAL /SPIRITUAL GROUNDS: BILL OF PARTICULARS

I. The Resolution dated 14 November, 2006, is nulland void, since it contravenes the 1987Constitutions (ART. VIII) mandate that -

Section 14. No decision shall be rendered by any court withoutexpressing therein clearly and distinctly the facts and the law onwhich it is based. No petition for review or motion forreconsideration of a decision of the court shall be refused duecourse or denied without stating the legal basis therefor.

Complainant is at a loss about the facts and the laws used to dismiss the

complaint. He is not unmindful of Court jurisprudence that minute resolutionscan be issued without following this mandate. But, the resolution IS NOT MINUTEBUT EXTENDED, hence UNCONSTITUTIONAL. It stated that the complaint - iscouched in obscure language, vague of expression and want of logical thought,bearing trance-like character the surreal frame of several pictures, noneclearing the obscurity, as it even included complainants obscure beliefs citingthe psychosis decision 486 scra 66.

REST ASSURED, that complainant will now make his case plain and clear, byasking this Court to enlighten him about the TRUTH, as simple as that .

Part I:

Marylin Puno and Jamin Mateo asked Judge Floro to help them aboutphone bugging. And the latter suggested NBI study but they refused since they

allegedly chose psychic phenomena or HULA. Judge Floro agreed on theconditions that he would use Spanish cards or spirituality based on Catholictenets and teachings, and provided further, that theActing Chief Justice R.Puno at that time would agree (in confidence).

And the Court sustained Justice Velasco in the March31, 2006 Decision, while Justice Velasco, Jr. not as accuser/complainant but asJustice/Judge, on August 11, 2006, signed the August 11, 2006 Resolution

dismissing the Appeal of Judge Floro. This not only a violation of the 1987Constitution prohibiting a fiscal, accuser, or complainant from being the judge atthe same time, but it is ANATHEMA to the RULE OF LAW and the CODE OF JUDICIALCONDUCT. And Judge Floro thrice predicted the disappointment of J. Velasco, Jr. infavor of J. Tinga, Nazario & Garcia. But since Sen. Jovito Salonga fought versus PGMAafter the appointment of J.
