Mr. Weir asked that additions to the agenda be made as follows: Introductions would be made before Presentations from the Public and in addition to the items listed in the agenda, attendance and quorums would be discussed as well as Mr. Weir’s report to the Governing Board. At this point in the meeting, all those present introduced themselves. Mr. Weir commended Dr. Benjamin on assembling a competent and confident staff and added that he enjoyed working with her and her staff. AGENDA ITEMS Goals/Plans for 2007 Mr. Weir reviewed responses received from committee members. He said the main goals of the Measure A committee are to track construction costs and to make sure money is not spent on deferred maintenance or faculty salaries. Mr. Weir also said the committee must ensure that the District provides value to the taxpayers and other constituents in the community. Dr. Benjamin said a report to the community should be forthcoming. She added that information could be shared in the Contra Costa Times or in a public forum to gain information from constituent groups. Both Mr. Weir and Mr. Jones said a mailer would be a good idea. Mr. McNeil said a mailer would be cost effective, but added that everyone does not subscribe to the Contra Costa Times . Mr. McNeil said a public forum, with a

PowerPoint presentation would be more effective. In this way, community members could ask questions. Mr. McNeil further suggested contacting Comcast to find out if they would run a piece on Measure A. Chancellor Benjamin said Contra Costa College has a television station that could make the announcements about Measure A projects. Interim Special Assistant to the Chancellor Ted Wieden said he would obtain information on costs for a Comcast ad, a mailer, newspaper insert, etc. Mr. Weir said it is very important for the community to understand the bond measure and noted the passage of the most recent bond is not the entire story. Dr. Benjamin said she and past Governing Board President John T. Nejedly thanked Contra Costa County voters for passing the bond in a letter to the Contra Costa Times last June. She said new information on the bond should include a timeline for projects. Facilities and Operations Representative Kindred Murillo added that photographs showing projects completed with 2002 bond funds could be included in the communication, along with photographs of projects being started with 2006 bond funds. Mr. Wieden and Ms. Murillo would also look into holding public forums on the bond projects in all three sections of the county. Mr. Weir said it would be helpful to have periodic reports on contractors being hired for Measure A projects. Mr. McNeil said this information could be provided in the public forums. Mr. McNeil asked about progress on a Project Labor Agreement (PLA) for the District. Dr. Benjamin responded that the District is in the process of negotiating and developing a PLA. Mr. Weir said he does not favor a PLA, but it was noted that since a resolution was already passed by the Governing Board to adopt a PLA, this item need not be discussed. Chancellor Benjamin said the development of a PLA does not fall within the scope of the Measure A committee.

Mr. Weir said he would like the goals discussed at this meeting to be listed as an action item at the next Measure A meeting.

New Project Report Format Ms. Murillo summarized the new project report format. Mr. Weir asked why 2002 was included in this report. Mr. Wieden said this information would show how the funds were used appropriately. Ms. Murillo added that this information showed how the dollars were expended and when the projects were completed. Mr. McNeil said he wanted the 2002 information included because it shows how the bond money was used from start to finish and illustrates what was accomplished and what was unfinished. Ms. Murillo added that projects coded green indicated there were no issues; projects coded yellow or red indicated that issues existed with those particular projects. Mr. McNeil said he liked the new report layout. In the comments section, he would like details on value engineering. Mr. Weir asked whether status on deferred projects would continue to be reported and Ms. Murillo said it would be reported. Mr. McNeil requested that a legend be placed on the bottom of report pages so that people would know what the acronyms and codes meant.

Economic Impact Study and its Relationship to Bond Expenditures

Mr. Wieden summarized the above study. Mr. McNeil expressed concern over a recent article in the Contra Costa Times describing how many students attend community colleges, but never graduate. Dr. Benjamin said many folks attend community colleges with no intention of graduating. Among other interests, Chancellor Benjamin commented that students take classes to earn certificates or get exercise through physical education programs. She said committee members can respond as private citizens and correct the misinformation coming from the media. Audit Results Mr. Weir said three specific requirements were addressed in the audit firm’s letter concerning the Measure A bond. Mr. Weir added that deferred maintenance, the audit’s third item was not specifically addressed in the audit firm’s letter. He would like staff to report back whether or not deferred maintenance is a problem. District Bond Project Management Chancellor Benjamin introduced Ms. Murillo as the interim replacement for the Vice Chancellor, Facilities and Operations. Dr. Benjamin also said that a chief facilities planner job announcement had been created and would be advertised in the next ten days. She further said that the District will advertise for an accountant to monitor the Measure A funds. When these job announcements are finalized, they will be sent out to committee members. 2007 Meeting Dates A schedule of meeting dates will be developed and e-mailed to committee members. The next regular meeting for the committee will be held at 4:00 p.m. on March 15, 2007, at the San Ramon Campus. Attendance and Quorums Mr. Weir asked if staff were doing everything possible to remind members to attend scheduled meetings. Staff responded that both reminder phone calls and e-mails are sent to committee members to make them aware of scheduled meetings. The meeting was reconvened at 5:20 p.m. PRESENTATIONS FROM THE PUBLIC Interim Special Assistant to the Chancellor Ted Wieden asked that everyone introduce themselves. Mr. Wieden also said that a committee chair would have to be selected. On motion of Mr. Jones, seconded by Ms. Gibson-Gray, by unanimous vote, Mr. Weir was chosen as the chair for the Measure A 2002/2006 committee. Mr. Weir asked if there were any changes to the agenda. Mr. Weir added one item to the agenda: possibility of relocating Contra Costa College (CCC) due to seismic concerns. AGENDA – ACTION ITEMS Approval of Minutes of Regular Meeting March 15, 2006 On motion of Mr. McNeil, seconded by Mr. Jones, by unanimous vote, the March 15, 2006, minutes were approved.

Approval of Minutes of Regular Meeting July 19, 2006 On motion of Ms. Gibson-Gray, seconded by Mr. Jones, by unanimous vote, the July 19, 2006, minutes were approved. GENERAL AGENDA ITEMS – INFORMATION/DISCUSSION

Nomination of Committee Membership Replacement Mr. Wieden summarized the Measure A committee structure. He also explained that new members would be recommended to the Governing Board for approval. Mr. Wieden said the new members recommended to the committee were Jack Weir, Ed Best, Jerry Okendo and Raja Hudson. Mary Erbez was recommended for reappointment to the committee. On motion of Mr. McNeil, seconded by Mr. Best, by unanimous vote, the nomination of committee membership replacements and a reappointment were approved. Status Report on Measure A Projects Jeff Kingston, Vice Chancellor, Facilities and Operations gave a general overview of Measure A projects and staffing associated with same. Mr. Weir requested that color graph charts be included in member packets. Chancellor Benjamin said color graph charts would be provided at the next meeting. Mr. Weir asked for a brief explanation of how to read the charts included in the report and Mr. Kingston gave a brief overview. Mr. Weir asked if Mr. Kingston’s staff costs were included in construction management costs. Mr. Kingston said four firms were being used along with the state allocation of 2% of construction cost. Mr. Kingston added that inspectors are hired independently by the state and paid by the District. Mr. Weir asked the committee if everything made sense to them in the reports that were mailed out. Mr. Best said the reports made sense, but he was unsure whether the level of detail shown in the reports was necessary. Mr. Weir said the primary interest of the committee is to make sure the community gets good value for its taxpayer dollars. He added that details should be available but it would be helpful to “get a flavor” for how things are going; that is, if they are “green, yellow or red.” Teresa Greenwell, project manager for CCC summarized the vocational technology building remodel/addition. Mr. Weir asked about the fault traces. Mr. Kingston said the results from the seismic study were inconclusive and inconclusive results will put a building on hold. Mr. McNeil asked if acronyms could be spelled out in reports so that all committee members would know what the acronyms meant. Ms. Greenwell continued her presentation of CCC projects with the library remodel and the student services building. Mr. Weir asked who determines work stoppage when the rainy season begins. Mr. Kingston said the contractor makes this call and added that the contract generally incorporated an average number of days for the rainy season. He further stated that sometimes a black fabric fence would be placed around the site to filter

sediment from any water running off the site. Mr. Kingston said the contractor is responsible for a storm water prevention plan.

Mr. Best questioned the magnitude of budget changes. He noted the student center building was only 7% complete. Mr. Kingston said the budget changes are the result of inflation. These projects were budgeted years ago and were deferred due to inflation. He added that there has been a 30% impact of inflation over the past three years (2004 to 2006) and overall the program has been impacted by $36M. Ms. Hudson asked if the costs were expected to go up much more. Mr. Kingston said $300M has an inflation rate of $100,000.00 per day and added that speed and delivery is critical to construction projects. Ms. Hudson asked how much would be cut out of the current projects. Mr. Kingston said every project from 2002 has already been bid and the cost risk has been shifted to the contractor. Ms. Greenwell completed her presentation of CCC projects with the Americans with Disabilities Act (ADA) path of travel. Jack Shaffer, project manager for DVC summarized projects. He said that 98% of projects at the college were completed. Mr. Best asked about the cost increases. Mr. Shaffer said water in the basement for the DVC bookstore contributed to a lot of the dollar increases. Mr. Kingston added that a subsurface drainage system was put into place with a perimeter drain added. As a result, Mr. Kingston said a project at CCC was moved from a hillside to another spot to avoid a water problem. Mr. McNeil asked if there was any recourse from the original geotechnical testing at the site. Mr. Shaffer said the geotechnical firm was not liable for the cost increase. Cam Perrotta, project manager for Los Medanos College (LMC) summarized projects at the college. Mr. Best said if budget changes were significant from the original budget, the changes should be identified so they could be understood. Mr. McNeil requested statistical data on the usage of local contractors so the community could be shown how the bond measure contributes to the local economy. Mr. McNeil requested a breakdown of local contractors for each project. Chancellor Benjamin said the Governing Board requested similar information and she added that Mr. Wieden would follow up on this report. Mr. Kingston said of a total of 115 contractors, all but a handful, possibly ten, were from outside the Bay Area. Mr. McNeil requested a summary form with percentages of money doled out. Mr. Weir requested that time be spent on developing this report. Mr. McNeil further requested a list by county and by college. Mr. Okendo asked how contractors were notified for bids. Mr. Kingston said a list of requirements for contractors across the Bay Area is followed. Possibility of Relocating Contra Costa College due to Seismic Concerns Dr. Benjamin explained that the Hayward fault runs through the campus. In August 2005, a geotechnical report revealed the extent of seismic issues at the college. Mr. Kingston said seismic studies at CCC have been underway for the past 20 years. The first site-wide geotechnical study was conducted by Kleinfelder. A second site-wide

building survey was conducted to determine how buildings would perform in a seismic event. This study revealed that 15 out of 32 buildings needed attention due to seismic concerns, not necessarily due to the proximity of a fault, but due to the age of the buildings. The next step in the master planning of the college is considering whether the college should be moved entirely. CCC President McKinley Williams said the newspaper article which talked about seismic concerns at the college sensationalized the facts. Chancellor Benjamin said each college is developing a master plan. Once the plans are complete, each college will receive an allocation from the 2006 Measure A bond money. Dr. Benjamin said one of the agenda items for the next Measure A meeting would be discussion of how to communicate about the progress on the Measure A projects with the community. Chancellor Benjamin said the District Office will go through reorganization to include a bond measure project manager/facilities planner. She added this position would be advertised in January 2007. Mr. Wieden informed Mr. Weir that an annual report on Measure A is made each January to the Governing Board. Mr. Weir requested that the specific date of the January Board meeting be e-mailed to him. Mr. Weir also requested that name plates be supplied for future committee meetings.
