    Effective 6anuary -" -)4)" and for all successive ta% years" all retirement or compensation received as

    retirement benefits by any person retired from the military service of the !nited tates of America and

    survivor benefits derived therefrom is hereby e%empt from any state" county or municipal income ta% or

    li&e ta% whatever name called.

    /nem(loment 8om(ensation

    A person who served in the armed forces of the !nited tates and who is unemployed may be entitled tounemployment compensation based on their honorable military or naval service. 2ontact the nearest tate

    Employment 2ompensation 2laims Office.

    Any teacher entering the military service of the !nited tates" who is not on continuing service status but

    who has accumulated one or more years of teaching e%perience immediately prior to entering military

    service" shall be given credit for such e%perience if such teacher is re'imposed within one year after

    release from military service.

    Pre%erence in State 8lassi%ied !m(loment

    All persons who have been honorably discharged from the !nited tates armed forces at any time shall

    have five points added to any earned ratings in e%amination for entrance to the state classified service.

    Those honorably discharged veterans with the present e%istence of a service'connected disability and

    entitled to pension" compensation or disability allowance under e%isting laws shall have -* points added

    to any earned ratings. 8ives and widows of certain disabled or deceased veterans may have the -* point

     preference e%tended to them and added to any earned ratings.

    embershi( in State !m(loees,$eachers 7etirement Sstem

    :etirement benefits rights of state employees and teachers who enter the armed forces and return to state

    employment after discharge are preserved. A member who enter the armed services and does not

    withdraw contributions" and who returns to said employment within one year after being honorably

    discharged" may be granted credit for military service up to four years" provided the employee pays an

    amount e+ual to four percent of the average compensation paid to a state employee during each claimed

    year of full'time military service" plus and together there with eight percent interest compounded from the

    last date of such claimed military service. The contributions must be made within a period of time e+ual

    to the length of service in the armed forces or before attainment of age *" or in the case of a state

     policeman" age 7" whichever occurs first. /o credit for military service shall be granted if such member

    is receiving military service retirement benefits.

    Alabama Veterans Business Bene%its

    Business and *ccu(ation icense !'em(tions %or )isabled Veterans

    Any bona fide permanent resident of Alabama who is a veteran 88 55 or at any time past" present or

    future" when the !nited tates was" is or shall be engaged in hostilities with any foreign state and who has

     physical disabilities of 7 or more whether service'connected or not" who conducts their business as a

    means of livelihood through their personal efforts and has no more than one employee and whose property @both real and personal is valued at less than C7"***.** and net income is less than C"7**.** is

    entitled to businesses and occupations license e%emptions of C7.** for each state" county and

    municipality. There is not a deadline on these e%emptions.

    For%eiture o% Franchise

     /o corporate franchise shall be forfeited for non'use" if any of the managing officers of such corporation

     become engaged in military service of the !nited tates and as a result thereof the corporation suspends

    operations" if the corporation has paid all its franchise and other ta%es to the tate.

    Alabama !ducation Assistance Programs

    state'supported technical school without payment of any tuition" re+uired te%tboo&s or instructional fees

    for eligible dependents initially enrolling in school on or after Fall **). 2hildren who enrolled in school

     prior to Fall **) receive four academic years of scholarship benefits.

    A spouse or widow@er of a veteran who is rated * ' )* by the !#VA due to service connected

    disabilities" and who initially enrolls in school on or after Fall **)" are entitled to three standard

    academic years without payment of tuition" re+uired te%tboo&s and instructional fees or a prescribed

    technical course not to e%ceed = months of training. A spouse enrolled in school before Fall **) receive

    two academic years of scholarship benefits. /ote1 8idow@er forfeits benefits upon remarriage. pouse

    forfeits benefits upon divorce from veteran in which the spouse derived eligibility.

    Beginning in Fall *->" students enrolled for the first time in the program are limited to undergraduate

    level classes at in'state tuition rates. tudents admitted to the program before August -" *-> will retain

    the benefits as previously awarded.

     Age Deadline:  The child or stepchild must initiate training prior to their th birthday. Age ?* deadlines

    may apply in certain situations. There is no age deadline for submission of the application by the spouse

    or un'remarried widow@er. This deadline may be e%tended for previously denied applications who were

    denied solely on the veterans peacetime status. 5n order to receive this e%tension" applications must be

    resubmitted and received at A#VA Head+uarters no later than August -" *-7

    Office.

    Veterans 2emetery follows /ational 2emetery Administration eligibility re+uirements. 5n general" !..

    Veterans discharged under conditions other than dishonorable and their spouses and dependent children

    are eligible.

    Alabama state residency re+uirements for burial in the tate Veterans 2emetery must meet one of the

    following1

    • ;egal resident of Alabama at the time of deathD or 

    • ;egal resident of Alabama when he or she entered the Armed Forces of the !nited tatesD or 

    • ;egal resident of Alabama for a period of -* or more years @any cumulative period of -* or more

    years" regardless of residency at the time of death.

    The surviving spouse of an eligible veteran that has been interred who remarries retains his or her

    eligibility for burial. !nmarried children who are under - years of age" or who are under ? years of age

    and are pursuing full'time education at an approved institutionD or an unmarried adult child of an eligible

    veteran of any age if the child became physically or mentally disabled and incapable of self'support by

    reason of mental or physical disability before reaching - years of age or before reaching ? years of age

    if pursuing full'time education at an approved institution are eligible.For spouses or dependent children" a C?=7.** fee will be charged on the day of interment. For veterans"

    there is no cost.

    8ommitment o% 5ncom(etent Veteran 

    8henever it appears that an incompetent veteran of any war" military occupation or e%pedition is eligible

    for treatment in a !.. #epartment of Veterans Affairs @VA (edical 2enter is necessary for the proper

    care and treatment of such veteran" the courts of this state are hereby authoried to communicate with the

    administration with reference to available facilities and eligibility and" upon receipt of a certificate from

    the administration stating that there are facilities available in a VA (edical 2enter is entitled to

    hospitaliation therein" the court may then direct such veteran0s commitment to such hospital. /otice of

    such pending proceedings shall be furnished the person so committed" and his right to appear and defendshall not be denied.

    !'ecutive Attestation and Ac;no&ledgment 8erti%ication

    Ac&nowledgments" proof of conveyance and affidavits may be ta&en by certain government" state or

    municipal officials or by any commissioned officer of any of the armed forces of the !nited tates" within

    or outside the limits of the !nited tates" and when such ac&nowledgment is ta&en by the latter" no seal of 

    office is re+uired and the signature of such commissioned officer is prima facie proof of his authority" and

    is retroactive as of #ecember =" -)>-.

    Fiduciaries in -ar Service

    Any fiduciary engaged in war service may be removed from this office as such upon petition filed in the

     proper court having $urisdiction and again serve as such fiduciary at any time after the termination of their 

    war service upon petition of the court.

    Fishing icense

    Any person who is totally disabled and who has been a bona fide resident of this state for not less than si%

    months preceding the date of application may" upon the payment of a license fee of C-.**" procure a

    special annual fishing license. There is also a discounted freshwater license available for * or greater

    disabled Veterans.

    3uardianshi( %or Veterans and inor )e(endents

    The !niform Veterans0 9uardianship Act provides for the appointment of a guardian for veterans and their 

    minor dependents who are mentally or physically incapacitated. This Act outlines the appointment

     process" duties" responsibilities" limits" ta%ing of costs and fees of guardianship. The control and

    accountability of the beneficiary0s estate and income include only moneys received by the guardian from

    the !.. #epartment of Veterans Affairs @VA and all earnings" interest and profits derived.

    ilitar eave o% Absence

    All officers and employees of the tate of Alabama" or of any county" municipality" or other agency or

     political subdivision thereof" who shall be active members of the Alabama /ational 9uard or naval

    militia" or of the Officers0 :eserve 2orps of the !nited tates Army" or of the reserve components of the

    !nited tated armed forces" shall be entitled to military or naval leave of absence from their respective

    civil duties and occupations on all days that they shall be engaged in field or coast defense or other

    training or on other service ordered under the provision of the below cited statute" or of the /ational

    #efense Act" or of the federal laws governing the !nited tates reserves" without loss of pay" time"

    efficiency rating" annual vacation" or sic& leave" but no such person granted such leave of absence with

     pay shall be paid for more than - wor&ing days at any one time.

    Notice o% Armed Forces )eath

    A written notice or communication from the #epartment of #efense" the Ad$utant 9eneral of the Army"

    the ecretary of the /avy or other officer charged with the duty of sending such notice or communication

    to the effect that any person in the armed forces of our country" or serving as au%iliary thereto" is dead

    shall be accepted as evidence of the death of such person.

    *%%icial 7e(ort o% Person issing !tc

    An official written report or record or duly certified copy thereof" that a person is missing" missing in

    action" interned in a neutral country" or beleaguered" besieged or captured by an enemy or is dead or is

    alive" made by any officer or employee of the !nited tates authoried by any law of the !nited tates toma&e same" shall be received in any court" office or other place in this tate as evidence as to the status of 

    the person. 

    Peace *%%icers 8redit %or ilitar Service

    Any peace officer who becomes a member of the fund and who left employment and entered directly into

    the armed forces of the !nited tates and who returned to wor& as a peace office within si% months after

    release or discharge shall receive prior employment service credit for service in the military not to e%ceed

    five years. 

    Validation o% arriage o% )ivorced Persons

    (arriages of all persons subse+uent to a divorce decree granted in the tate and not prohibiting the person

    from remarrying" are declared to be valid" notwithstanding that the decree of divorce did not specificallyconfer on such person the right to remarry. (any claims for pension and compensation against the !..
