1. DESCRIPTION OF THE PROJECT
1.1 General
1. The project will improve connectivity in the Mekong Delta Region and will provide efficient
access from Ho Chi Minh City to the Southern Coastal Region through construction of two cable
stayed bridges across the Mekong River and associated roads. The project will go through Dong Thap
Province and Can Tho City.
2. A Resettlement Plan (RP) for Dong Thap Province was prepared and approved by ADB on 5
April 2013. The RP covered the RoW, the construction yards and the 4 interchanges.
1.2 Cao Lanh Bypass Road
3. In An Binh commune, the Department of Transport (DOT) of Dong Thap province is building a
15 km bypass of Cao Lanh City. The start of this bypass is located at the location of the interchange
with NH30 under the CMDCP (see Figure 1.1). Compensation started in 2010; most of the land was
acquired and cleared however the project stopped at the end of 2012 due to lack of funds. We should
note that the project is not officially cancelled and will resume when funds will be available. Land
clearance is almost completed for the 15 km. Land acquired was compensated, cleared and sand
pumped in the RoW. Land cannot be returned for agriculture production.
4. The design of the interchange was revised during detailed design at the end of 2012. The ramp
of the interchange was modified to follow the alignment of the bypass in order to use existing
acquired RoW and reduce resettlement. Figures 1.2 & 1.3 present the overlap between the 2 projects.
5. Most of the HH under the local project were compensated in 2010 and handed over their land.
There are 10 HHs who have not been compensated under the previous Government project because
they refused to receive compensation due to low compensation rate for residential land.
1.3 Additional Compensation Plans Prepared
6. The approved RP didn’t cover these HH as they were supposed to be compensated under the
DOT Project. Therefore, these AH were not considered as AH under the CMDCP. To solve the
grievance related to low compensation rate for residential land, Dong Thap PPC in Notice No. 60/TB-
VPUBND dated 13 February 2015, decided to apply unit rates under the CMDCP for these HH.
7. On 12 March 2015, CHFLD submitted additional compensation plans for these 10 HH to the
Appraisal Committee of Dong Thap PPC. The compensation plans intended to cover the differences
(entitlements, compensation rates etc.) between the first plan, prepared according to PPC policy in
2009-2010, and the policy under CMDCP. However PPC requested CHLFD to update the DMS
prepared in 2009 and to prepare a new budget (not an additional budget) based on the CMDCP Policy
and new DMS. Compensation plans were re-submitted on 12 August 2015. Final compensation plans
were approved on 31st August 2015 by Dong Thap PPC (Decision No: 897/QĐ-UBND-HC).
8. In the MOU prepared following the May 2015 ADB/DFAT review mission, the Mission
indicated having no objection to use loan funds to finance resettlement costs for the HH affected by
the government-funded Cao Lanh bypass road who are now within the Project’s right-of-way. The
mission indicated that a RP Addendum has to be prepared and submitted to ADB for review and
concurrence.
9. In addition, the Mission requested CIPM to carry out due diligence for the other HH, who
already received compensation and who were also located in Project’s right-of-way, to identify if
there are any outstanding issues when land acquisition activities were carried out in 2010. The due
diligence is presented in Chapter 7 of this report.

10. This RP addendum describes the new impacts related to this bypass, the consultations
conducted, the additional costs and the new implementation schedule.

2.1 Detailed Measurement Survey (DMS)
11. The data collected during the DMS constitute the formal basis for determining AHs’
entitlements and levels of compensation. A first DMS was conducted by the Center for Housing and
Land Fund Development (CHFLD) of Dong Thap Province in 2009. This DMS was updated on 11
August 2015 for the 10 HH.
12. A first compensation plan was prepared in 2009 following national and provincial regulations.
A new compensation plan was submitted in 2015 based on the CMDCP policy. The new
compensation plan is also based on the updated DMS conducted in August 2015.
2.2 Scope of Land Acquisition and Resettlement
2.2.1 Households affected
13. The additional compensation plans cover the 10 AHs not yet compensated (see Table 2-1). A
total of 49 persons are affected. 5 HH belongs to the same family (Mrs. Nguyen Thi Ba and her 4
children: Dang Kim Hung, Dang Kim Toi, Dang Thi Ngoc Bich and Dang Thi Kim Loan).
2.2.2 Impacts for the AHs
• Land acquisition
14. The 10 HH will request acquisition of 1,148 m2 of land. Most of the affected land is residential
(955.4 m2). Little garden land will be acquired (193.1 m2). 5 HH will lose trees. Due to little productive
land affected, no severely affected HHs is present. None of the HH depends on productive land for
their income. Two HH raise pigs but on their residential land.
• Structures affected
15. 7 AHs will have their main house totally affected and will need to relocate. All the 7 AHs opted
to move to My Tho Relocation Site (RS); this RS is located 4km from their current location close to
NH30. CHLFD allocated to the 7 HH a plot of land in My Tho RS on 9 October 2015. A plot of land is
72 m2 (4.5 m x 16 m). My Tho RS is a fully serviced RS; all infrastructures have been completed at the
end of 2013. 37 plots have already been allocated in My Tho RS for HH affected under the CMDCP
and 8 HH built a house.
16. Quality of houses is generally low, built mainly with temporary materials (see photos in Annex
2). 1 grave, belonging to Mr. Dang Kim Hung, will also be affected
2.2.3 Socio-Economic Situation of the 11 Affected Households
• Source of Income
17. As indicated in Table 2.1, the 10 AHs derive their income from various sources (i.e. 6 HH rely
on hired labor, 2 on business and 1 on raising pigs and 1 on hired labor and raising pigs).
• Poor and vulnerable HH
18. One HH, Mrs. Dang Thi Ngoc Bich is landless (built house on her mother’s land – Nguyen Thi
Ba. No other poor or vulnerable HH are present. All other AHs have a LURC.
• Services
19. The AHs with house affected are connected to the city water supply network and the public
electrical network.
20. Table 2.1 presents the impacts and socioeconomic information for each of the 10 AHs.

21. A new Land Law came into force on 1st July 2014. Circular 37/2014 /TT- BTNMT1 issued by MONRE on 30 June 2014 to implement the land law indicates, in Chapter III Article 14, that for projects where resettlement framework was approved by the Prime Minister before the 1st July then the provisions of the new Land Law will not apply.
22. It was confirmed by CHFLD Dong Thap that based on this Circular, because compensation was provided by tranche from 2012 to 2014 based on approved resettlement framework, then additional compensation under the CMCDP, even after the 1st July 2014, is not submitted to the provision of the new land law and related decrees
23. All AHs under the CMDCP, including these 10 new AHs, are entitled to the policy identified in the RP for Dong Thap Province and approved by ADB on 5 April 2013. The approved compensation plans are based on the same entitlements than other HH affected under the CMDCP in An Binh commune.
24. The new affected households are entitled to various types of entitlements according to their loss and impacts based on the Entitlement Matrix included in the RP for Dong Thap Province. Table 3-1 summarizes the main entitlements. These entitlements are reflected in the additional compensation plans submitted to PPC.

Households or persons with (i) LURC; or (ii) in the process of acquiring LURC (iii) are eligible to acquire LURC according to the regulations of GoV;

- If the area of the remaining land with structure is not viable: i) 60 m2 for rural area and ii) 40 m2 for urban area (Decision 57/2007, Art.4(2)) and if the AH so agrees, then the remaining portion of land will be acquired

- For those without alternative accommodation and are waiting for resettlement land/house at a resettlement site shall receive the amounts for rental assistance as follow: 900 000 vnd/ HH/month in urban area and 700 000 vnd / HH /month in rural area for 6 months.

4.1 Under Government Project
25. Notice of Land Acquisition No 14/TB-UBND was issued on 28 May 20102. The notice indicates that land will be acquired to carry out bypass for NH 30 , section : Cao Lanh- Hong Ngu in An Binh Commune, Phong My commune and Cao Lanh city

4.3 Consultation Conducted under CMCDP
27. DDIS conducted a meeting with AH on 16 June 2015 to collect information and give general information on the project (location of plots of every HH and overlap with CMDCP project, content and status of additional compensation plan). During this meeting the Public Information Brochure (PIB) was distributed and explained to AHs.
28. Due to the limited number of HH, local authorities conducted individual meetings during the preparation of the new DMS on 11 August 2015 among the 10 AHs. During the preparation of DMS the following information was delivered to the 10 AH: i) Project policy; iii) compensation rates; iii) support and allowances; iv) option for relocation; and v) grievance procedures.
29. Regarding RS, HH already opted to be relocated in My Tho RS in 2010. Most of the AHs are relatives and want to be relocated in the same RS.
4.4 Disclosure
30. The compensation plans were disclosed in An Binh commune PC office on 3 September 2015.
31. On 8 of September, CHLFD invited all the 10 AHs to receive compensation. 7 AHs accepted and 3 refused (Dang Van Toi, Dang Kim Hung and Dang Kim Loan). Dang Van Toi finally accepted the proposed compensation by the end of September 2015.
32. Two HH (Dang Kim Hung and Dang Kim Loan) first refused compensation and sent a complaint to CHLFD. Ms. Dang Kim Loan wanted to receive additional support and Mr. Dang Kim Hung complained regarding the categorization of his land; he wanted his land to be considered as category 1 (currently divided in categories 2 and 3). Following discussion between CHLFD and the 2 HH, the complaints were solved and the 2 HH received compensation by the end of October.

5. RESETTLEMENT BUDGET
5.1 Preparation of New Compensation Plans
33. New compensation plans submitted to Dong Thap PPC use the same rates as AHs under the CMDCP. The Appraisal Committee reviewed the new compensation plans on 19 March 2015 and submitted comments. Following comments from the Committee, CHFLD submitted the revised plans to PPC on 22 June 2015. PPC (DONRE) requested CHLFD to update the DMS and to prepare a new budget (not an additional budget) based on the CMDCP policy and on the new DMS. Compensation plans were re-submitted on the 12 August 2015 and approved on 31st August 2015 by Dong Thap PPC (Decision No: 897/QĐ-UBND-HC).
34. The new compensation plans submitted to Dong Thap PPC replace the compensation plans prepared in 2010 and follow the CMDCP resettlement policy.
35. Table 5.2 presents the summary of costs for the new approved compensation plans. The costs were calculated based on the CMDCP policy with the approved compensation rates under the CMDCP for all types of compensation.
5.2 Replacement Cost Survey
36. An independent appraisal agency, the Southern Information and Appraisal Corporation (SIAC), conducted a Replacement Costs Survey (RCS) on 17 October 2014 for the CMDCP in An Binh commune. Dong Thap PPC approved the replacement costs survey on 27 November 2014. Approval letter by Dong Thap PC is presented in Annex 3. Results of the RCS are presented in Annex 5.
37. The following table indicated the differences, for the main types of land, between new compensation rates based on RCS and PPC rates.

38. External valuer also conducted a replacement cost survey for structures, trees and crops in 2014. No major differences were found with PPC rates and compensation rates of Decision No 16/2012/QĐ-UBND dated 12/6/2012 by Dong Thap PC will be used.
39. Annex 4 presents the valuation certificate issued by SIAC regarding the various compensation rates. The certificate is still valid and are still the basis for compensation for PPC. The valuation certificate includes the following appendixes:
− appendix 03: compensation rates for land;
− appendix 04: compensation rates for structures;
− appendix 05: compensation rates for trees and crops
40. Compensation rates for land (5.860,000 VND/m2) have been approved by PPC in May 2015 and were applied to all HH in the same situation (i.e. losing residential land along NH30) between June and July 2015.

6. IMPLEMENTATION SCHEDULE
42. All resettlement activities will be coordinated with the civil works schedule. The Executing Agency will not allow construction activities in affected sites until all resettlement activities have been satisfactorily completed, agreed rehabilitation assistance is in place, and that the site is free of all encumbrances.

7. DUE DILIGENCE
7.1 Background
43. In the MOU prepared for the May 2015 ADB/DFAT mission, the Mission requested CIPM and DDIS consultant to carry out due diligence for the households, affected by the Cao Lanh bypass, who already received compensation and who were also located in the Project’s RoW. The purpose of this due diligence is to assess if there are any outstanding issues when land acquisition activities were carried out in 2010.
44. The due diligence report examines (i) the requirements of the approved resettlement documentation and the extent to which these requirements have been satisfied by the project, (ii) compliance with national laws and regulations on land acquisition and social issues; and (iii) aspects where significant discrepancies exist between the observed outcomes of the resettlement implementation and objectives of ADB social safeguards policies.
45. We should note that, at the time of the compensation of the HH (2010 and 2011), these HH were not affected by the CMDCP Project. Change of design was approved at the end of 2012. They were compensated under the provincial department of transport project.
46. The due diligence study covers the Land Acquisition and Resettlement for the 20 HH affected by both the Cao Lanh bypass and the CMDCP and who have already been compensated and handed over land.
7.2 Methodology
47. Due diligence was conducted on 15-16 June and on 23 June 2015. Among the 20 HH, 18 could be contacted and interviewed. The following activities were conducted:
- Meetings with stakeholders (An Binh commune people’s committees, Center for Housing and Land Fund Development of Dong Thap Province);
- Meetings with affected persons and site visits;
- Implementation of a survey among all affected HH (household questionnaire) during meetings;
7.3 Impacts
48. Land acquisition was publicly announced on 28 May 2010. Notice of land acquisition included information on the project and its impacts to the AHs. Compensation took place between in 2010 and 2011. Land were handed over following compensation in 2010.
49. Land acquisition for the 20 HH represents 6557.1 m2 of land. Agriculture land represents 49%, residential land 19%, garden land 3% and other land (industrial land occupied by brick kilns) 27%. All land affected was compensated and handed over. All HH had a Land Use Right Certificate on their affected land.
50. 5 HH lost agriculture land. Among these 5 HH, 3 HH: Đoàn Hữu Thảo, Trịnh Văn Theo and Dương Thành Thi lost more than 10% of their productive land (respectively 13,8, 57.2 and 17,6%).
51. 11 HH lost residential land. Among these 11HH, 4 HH have their main house affected. 3 HH could reorganize on their remaining land while 1 HH, Mrs. Huynh Thi Phi, had his main house totally affected and had to relocate. She opted for self-relocation in 2010.

52. We should note that among the 20 HH, 4 HH: Đoàn Hữu Hiếu, Đoàn Hữu Thảo, Trịnh Văn Theo and Dương Thành Thi are also affected by the CMDCP Project. Mr. Trịnh Văn Theo and Mr. Dương Thành Thi are also participating in the IRP under the CDMCP (losing respectively 29% and 11% of their productive land under the CMDCP).

7.4 Findings of the Due Diligence Survey
7.4.1 Policy and Standards Applied
54. The legal framework and principles applied in the implementation of the resettlement was the relevant national Government legislations and Dong Thap Province People’s Committee Decisions at the time of the start of the implementation in 2010. The legal documents comprise:
- Decree No.197/2004/ND-CP, extends eligibility and provides additional entitlements, compensation and assistance over previous legislation.
- Decree 69/2009/ND-CP of 13/8/2009 (Supplementary Regulations Regarding Land Use Planning, Land Pricing, Land Acquisition, Compensation, Assistance and Resettlement)
- Decision 29/2009/QD-UBND regarding compensation, support and resettlement where the state acquires land in Dong Thap Province.
- Decision No 08/2008/QD- UBND dated 04/03/2008 of Dong Thap PPC issued Regulations on compensation prices for cultivated crops, domestic animals, cost for relocating grave when Government recovers land in Dong Thap province
- Decision No 15/2010/QD0-UBND dated 14/6/2010 of Dong Thap PPC of issue on standard price table for house and substructures constructed new and applying on Dong Thap province

7.4.2 Compensation for Productive land
55. Households were compensated based on Dong Thap Provincial People’s Committee rates applicable at the time (Decision No.08/2008/QD-UBND). Compensation rates for agricultural and residential land depends on the distance of the road (Location 1: from 0 to 150 m; Location 2 from 150 to 300 m; Location 4: from 300 to 450 m; Location 4; over 450 m (see Table below).
56. In addition farmers received the allowance for occupation change equivalent to 3 times the compensation rate for agricultural land per m2 for the area acquired but not exceeding 3 ha (Decision 29/2009 art. 16 (1) b).
57. Some HHs whose agriculture land is located along the road, received an allowance corresponding to 50% of the compensation rate for residential land instead of the allowance for occupation change.
58. Relocated HH also received the stabilization allowance (30 kg of rice per month per capita for 12 months) equivalent to 4,000,000 VND.

7.4.3 Compensation for Residential land
59. Households affected trough residential land were compensated based on Dong Thap Provincial People’s Committee rates applicable at the time of implementation (Decision No.29/2009/QD-UBND). Compensation rates depends also on the location as presented in Table 7.3.

60. One HH, Mr. Pham Phi Phung, is losing commercial/industrial land (brick kilns). His land was compensated at 70% of compensation rate for residential land in the same zone for the same location as presented in Table 7.4.

7.4.4 Compensation for Trees, Crops and Structures
61. For houses and structures, trees and crops, compensation rates used were based on Decision No 15/2010/ QĐ-UBND of issue of standard prices for house and structure applying in Dong Thap province and Decision No 08/2008/QĐ-UBND of issue of compensation unit prices for trees, domestic animal and grave remove).
7.4.5 Allowances
62. As specified in the Dong Thap policy, the AHs also received a number of allowance as follow:
- Allowance for occupation change (for HH affected through loss of agriculture land)
equivalent to 3 times the compensation rate for agriculture land per m2 for the area acquired but not exceeding 3 ha (Decision 29/2009/QD-UBND art. 16 (1) b).
- Transport allowance (Decision 29/2009/QD-UBND art. 12)
- Life Stabilization allowance (Decision 29/2009/QD-UBND, Art. 14) This allowance was given to HH who are losing between 30% and 70% and more than 70;
- Rental assistance (Decision 29/2009/QD-UBND Art. 12 (2)) For those without alternative accommodation and are waiting for resettlement land/house at a resettlement;

- Infrastructure Development Grant
Those who choose to relocate individually received a lot infrastructure development grant (Decision 29/2009/QD-UBND Art. 13 (2) b))
7.4.6 Public Consultation
63. Public meetings were conducted in An Binh Commune in 2010 and 2011. Detailed information is provided in Table 3.1.
7.5 Satisfaction of HH
7.5.1 Compensation rates
64. Based on survey conducted, all 18 HH complained about the lower rates especially for residential land and agriculture land. Compensation rates were the ones issued by PPC in 2009 and 2010 and were lower than market rates as assessed by external valuer in 2012 in the same area for the CMDCP5. We should note that HH are now aware of compensation rates under the CMDCP in the same area.
65. On 16 September 2015, 9 of the 18 HH submitted a written complaint to CHLFD to increase the compensation rates for land based on compensation rates used for the CMDCP along NH30 (see Annex 5). All the 9 HH are affected by residential land along NH 30. In October 2015, the 20 HH also submitted a collective grievance requesting additional compensation based on compensation rates under the CMDCP.
66. On 9 October, CHLFD submitted these grievances to Cao Lanh District through a letter for review and decision. In this letter, CHLFD indicated that the HH have the right to lodge these grievances as they are in the same situation as the 10 HH compensated in September based on the CMDCP compensation rates (see chapters 1 to 6).
7.5.2 Household Income & Livelihood
67. The household survey obtained information regarding household income and livelihood of individual household. Regarding household income, among the 18 HH, where information was available, 14 reported no change in income, 3 HH lower income and 1 higher.
68. Regarding the 3 HH who reported to have lower income, their situation is as follow:
- Mr. Doan Huu Hieu lost 223 m2 of agriculture land under the local project; however he has his remaining part of agricultural land in the loop of the interchange (2035.8 m2); currently, this remaining land is cultivated and irrigated normally. However, Mr. Hieu indicated that he cannot cultivate his land due to lack of irrigation in the loop. The loss of income reported is not due to the impacts of the CMDCP
- Before land acquisition, Mr. Phạm Phi Hùng had a brick kiln; he could earn as much as 100 M VND/month. Under the local project he lost 1,667.60 m2 of dedicated land for brick production on a total of 5.661,00 m2 (30%). He still have a brick kiln but his production is much lower and income decreased to 10 M đ/month. With the compensation he received he bought gold and he still keeping the same amount of gold. He continues his brick production however due to the high cost for materials and labour there is now little profit according to him. He didn’t receive allowance for loss of business because his business was not stopped.

Currently Mr. Hung is not in a difficult situation. He has still a regular income from brick production and kept all the compensation he received (changed cash in gold). He lost 30% of land dedicated for brick kiln but declared 90% loss of income. Decrease of income also comes from the economic situation regarding brick production.
- Mrs. Nguyen Thi Le had her residential land along NH30 which was a good location for business. Due to land acquisition she had to move back of 8 m and the location is now not so close to HW 30, with less business opportunity.
69. For five other HH, Nguyễn Thị Bé Hai, Phạm Văn Minh, Trịnh Văn Theo, Dương Thành Thi and Nguyễn Thanh Vũ, even if they maintained their income (see Table 7-5), they feel that their situation is worse than before. This is the case of Mr. Trịnh Văn Theo and Mrs. Dương Thành Thi who cannot cultivate land in the loop of the interchange (see photos in Annex 3). Because the irrigation ditches were blocked at the end of the dry season (May 2015), they don’t have currently significant effects on their production; during the rainy season, they can cultivate. However they anticipate loss of income for the next dry season.
70. Regarding Mr. Nguyễn Thanh Vũ, he is operating a saw mill. His house was affected but not the saw mill close to his former the house. He complained of low compensation rates but his income was not affected by the land acquisition. Income reported (12 M VND/month) is relatively important.
71. Mrs. Nguyễn Thị Bé Hai was affected by loss of residential land without structure. Following land acquisition, she rented a house belonging to some relatives and is now operating a business (small retails shops) near a market in Cao Lanh City. She complained about the low compensation rates but her income was not affected. Her current location, close to a market generate good business opportunities.
72. Regarding Mr. Phạm Văn Minh, he retired and moved to Ho Chi Minh City. He kept a land and a small house in An Binh his home town. These land and house were affected by the bypass projects. However at this time he already moved to HCMC where he is living with relatives. Due to low compensation rates he reported to have difficulties to keep the same living standards. However his income was not affected; he is still receiving pension from the government.
7.5.3 Reestablishment of Livelihood
73. Table 7-6 presents the change in income and in living standards as reported by HH and as evaluated by the DDIS team.
74. It was assessed that for 2 HH, livelihoods are not totally restored. To assist these HH to restore their income, some recommendations are proposed (i.e. participation in the income restoration program). These recommendations are presented in section 7.6.
75. We should note that according to detailed design, in all the loops, the main irrigation channel will be maintained by building box culverts. However due to the presence of soft soils, culverts could be installed only in 15 to 18 months from now, once soil settlement has occurred.
76. In the transition period, temporary pipes have been installed but according to farmers, water flow is not sufficient, especially for farmers at the end of the irrigation network. Additional surveys conducted in October 2015 showed that the contractor dug an open ditch to supply sufficient water for agriculture production. Conditions of cultivation of annual crop (mainly paddy) are near normal in the loops. Most of the land is currently cultivated along the main irrigation canal.
77. Fruit trees, especially mango trees, also need regular irrigation. Lack of water will affect the fruit size and therefore the income from mango trees.

7.6 Conclusion and Recommendations
78. Compensation for land. The compensation rates paid for land were based on the Dong
Thap PPC unit rates (decisions No. 28/2009/QD-UBND and No.08/2008/QD-UBND). It was
assessed that compensation rates were lower than market rates as established by the
independent valuer in 2012 when he conducted RCS for the CMDCP. However at the time of
compensation, these HH were not affected by the CMDCP, the design was changed later. At the
time of the change of design, HH had already been compensated and handed over the land.
Therefore they have never been considered as affected under the CMDCP. The 10 HH, already
compensated, were located within the RoW of the CMDCP when the detailed design was
approved and have been considered as AHs under the CMDCP. The 20 HH recently complained
to the CHLFD and their complaints were channeled to the Cao Lanh District for review and
decision in October 2015. The 20 HH have the right to complain and Cao Lanh district will review
their cases and will decide if additional compensation is necessary or not. Low compensation rate
is also not the main reason for loss of income and negative change for livelihood. It is also due to
the decision of some HH to stop to cultivate land even if the land is irrigated for 2 HH or location
of small business for 2 HH. Households have also received various assistance (i.e. life stabilization
allowance, allowance for occupational change) to support them during the transition period. No
action required
79. Irrigation ditches blocked: 3 HH, Mr. Doan Huu Hieu, Mr. Trịnh Văn Theo and Mrs. Dương
Thành Thi have land inside the loops. They indicated that their land inside the loops are currently
not irrigated. However, additional surveys conducted in October showed that their land is
normally irrigated following new ditch dug by contractor. Several farmers cultivate annual crops
normally within the loops (including Mr. Doan Huu Hieu).t. Permanent culverts will be installed
in 15 months. No action is required as Mr. Doan Huu Hieu lost only 233 m2 of land and his land
inside the loop is currently cultivated. Regarding Mr. Trịnh Văn Theo and Mrs. Dương Thành Thi,
their lands are normally irrigated following works conducted by the contractor but not cultivated.
They are also already involved in the IRP. No Action required.
80. Income Restoration Program (IRP) for agriculture; 3 HH lost more than 10% of their
agriculture land, Đoàn Hữu Thảo, Trịnh Văn Theo and Dương Thành Thi. They reported lack of
irrigation and impacts on their agriculture production. However their land within the loop is
currently irrigated and the land of Mr. Đoàn Hữu Thảo is cultivated. MM. Trịnh Văn Theo and
Dương Thành Thi are already involved in the IRP under the CMDCP. For equity, because he lost
more than 10% of his productive land, Mr. Đoàn Hữu Thảo should also be involved in the IRP.
Action required. Đoàn Hữu Thảo should be eligible to the IRP for next stage (after mid-term
evaluation).
81. Income Restoration Program (IRP) for small business. Mrs. Nguyen Thi Le meets
difficulties with her small business and experienced loss of income and decrease in living
standards. Action required. Mrs. Nguyen Thi Le should be eligible to the IRP for small business
for next stage (after mid-term evaluation) to benefit from training on business management and
provision of equipment.
7.7 Budget for Corrective Actions
82. The budget to cover proposed corrective actions is presented in Table 7.6. Costs of
rehabilitation of irrigation ditches was under contractor’s budget. Other costs are related to
inclusion of HH in the IRP for the next stage (after mid-term evaluation report). Costs estimates
is 19.5 M VND equivalent to 900 USD).

Dong Thap province:
- The Valuation Certificate No.Vc14/10/455A/TS-VL dated on 17 October, 2014 issued by
Southwest Information and Appraisal Corporation;
- On 28 October, 2014, The Task Team (established at the Decision No.85/QD-UBND-TL dated on
25 July, 2014 issued by People’s Committee of Dong Thap province to solve difficulties in
compensation - support - resettlement task for the Central Mekong Delta Region Connectivity
Project) submitted the Report No.02/BC-DCT to PPC to approve residential land price applied in
An Binh commune, Cao Lanh district, Dong Thap province (Residential land price for location 1:
5,860,000 VND/m2).
- On 27 November, 2014, PPC issued the document No.371/TB-VPUBND, in article 8 stated that
“Agreed policy for resolving difficulties in compensation implementation proposed by
Department of Natural Resources and Environment at document No.02/BC-DCT dated on 28
October, 2014 (the Task Team established at the Decision No.85/QD-UBND-TL dated on 25 July,
2014 issued by People’s Committee of Dong Thap province”.
- On 13 February, 2015, PPC issued the document No.60/TB-VPUBND. It was stated that “Center
for Development of House Land Fund implements: ……… The intersection area with NH30
bypass road project, checks, submits the procedure, prepares the compensation plan for unpaid
households belong to NH30 bypass road project, applies new compensation rate and policy of
Central Mekong Delta Region Connectivity, send to DONRE for review and submit PPC for
approval, using the fund of Central Mekong Delta Region Connectivity to do payment for HH”.

On getting opinion to solve difficulties in compensation, support and resettlement for
HHs affected by Component 1 Project - Cao Lanh Bridge Construction in An Binh
commune, Cao Lanh district
Pursuant to Decision No.85/QD-UBND-TL dated on 27 July, 2014 issued by
Provincial People’s Committee on establishing the Task Team to audit, verify complains
by HHs related to compensation, support and resettlement for Component 1 Project - Cao
Lanh Bridge Construction, Component 2 Project - The Interconnecting Road Construction
between Cao Lanh Bridge and Vam Cong Bridge belong to Central MeKong Delta Region
Connectivity Project in Dong Thap province (hereinafter referred to as the Task Team).
After discussing with Le Minh Chi HH at the minute No.06/BB-DCT dated on 22
August, 2014 and Dinh Thi Ngoc Tuyen HH (is authorized by Mr.Vu Van Binh, Mr.Vu Van
Sach, Ms.Vu Thi Thom, Mr.Vu Van Phung and Ms.Le Thi Thu Chi) at the minute No.07/BB-
DCT dated on 22 August, 2014. The Task Team had a meeting to unify a proposal in order
to submit PPC to getting opinion for implementation (described at minute No.10/BB-DCT
dated on 09 October, 2014), as follows:
1. Compensation price for land:
Pursuant to The Valuation Certificate No.Vc14/10/455A/TS-VL dated on 17 October, 2014
issued by Southwest Information and Appraisal Corporation and document No.28CV.2014
dated on 17 October, 2014 issued by Southwest Information and Appraisal Corporation
on feedback consultancy result of price for Component 1 Project - Cao Lanh Bridge
Construction in An Binh commune, Cao Lanh district.
Whereby, Southwest Information and Appraisal Corporation (the consultancy
agency for compensation land price) proposed the compensation price for
implementation Component 1 Project - Cao Lanh Bridge Construction in An Binh
commune, Cao Lanh district at location 1: 5,860,000 VND/m2 (the remaining locations are
calculated as regulations on land price of People’s Committee of Dong Thap province at
the time when the compensation plan for Component 1 Project - Cao Lanh Bridge
Construction in An Binh commune, Cao Lanh district is approved).
The Task Team realized that this is a legal basic to adjust compensation price for
land. In order to resolve difficulties for implementation Component 1 Project - Cao lanh
Bridge Construction in An Binh commune, Cao Lanh district, the Task Team proposes PPC
to approve compensation price for land in An Binh commune to at location 1: 5,860,000
VND/m2 (the remaining locations are calculated as regulations on land price of People’s
Committee of Dong Thap province at the time when the compensation plan for

Component 1 Project - Cao Lanh Bridge Construction in An Binh commune, Cao Lanh
district is approved).
Besides, some HHs had acquired land for Component 1 Project - Cao Lanh Bridge
Construction where is quite convenience for doing business (near the existing asphalted
road and river, larger font). Thus, the Task Team proposes PPC to review and approve one
of two following options:
- Option 1:
Besides compensation price is applied for residential land at location 1 proposed
by the consultant agency (the remaining locations are calculated as regulations stated at
Decision No.35/2011/QD-UBND dated on 27 December, 2012), it is aslo applied other
support policy by 10% of compensation price for residential land depending on locations
(ratio is calculated for each location complies regulations of land price issued by People’s
Committee of Dong Thap Province at the time when the compensation plan for
Component 1 Project - Cao Lanh Bridge Construction in An Binh commune, Cao Lanh
district is approved).
- Option 2:
Compensating for land as the plot has 2 fronts: location 1 is defined from the
asphalted road and river for each location according to regulations of land price issued by
People’s Committee of Dong Thap Province at the time when the compensation plan for
Component 1 Project - Cao Lanh Bridge Construction in An Binh commune, Cao Lanh
district is approved.
After reviewing 2 above options, Department of Natural Resources proposes
Provincial People’s Committee accept the option 2 because it is better than for HHs.
2. Compensation price for Vu Thi Thom’s house
After reviewing the proposal prepared by Center for Development of House Land
Fund and comments of Department of Construction, the Task Team agrees to propose
PPC accept this proposal due to it is based on comments of Department of Construction
for calculating compensation price for Vu Thi Thom’s house: compensation price is
average of prices promulgated at Item a and Item c, Clause 1, Article 7: Storehouse,
factory of Decision No.16/2012/QD-UBND.
Detail: (1,038,240 VND/m2 + 1,545,600 VND/m2)/2 = 1,291,920 VND/m2
3. Support for stopping business
It is considered that Huong Thao Gas Station Enterprise (Dinh Thi Ngoc Tuyen HH)
is a special case in whole project and has to stop gas business (due to they cannot find
the suitable place to continue business) when handing-over land for the project (labour
contracts of Huong Thao Gas Station Enterprise are compensated for employees because
they have to stop their job at Article 11 - Decision No.29/2009/QD-UBND). Therefore, the
Task Team agrees to propose PPC apply the transition and creation job policy as Article
22 - Decree No.69/2009/ND-CP, support amount is based on cost for job training to
members in their family).
4. Non-term interest rate support
It is considered that the compensation, support and resettlement plan for
Component 1 Project - Cao Lanh Bridge Construction in An Binh commune, Cao Lanh
district was approved in 2012 but so far they have not received compensation, support
payment. In order to reduce disadvantages for HHs, the Task Team proposes PPC accept

to apply non-term interest rate support for these HHs by calculating interest and capital,
calculating time is defined from date of the payment announcement of the state
management agency (according to the minute No.07/NN-DCT dated on 22 August, 2014).
After having PPC’s approval, assign:
- People’s Committee of Cao Lanh district completes legal documents and check all
relevant documents to prepare enforcement implementation in case that HHs do not
agree to hand-over land for the project when PPC approves the above proposal.
- Center for Development of House Land Fund:
+ Responsible for volume, area which has defined and calculated for HHs as PPC
regulations and the proposal of the Task Team, prepares the compensation plan to send
DONRE in order to submit PC of Dong Thap province for approval.
+ Coordinate with PC of Cao Lanh district to complete relevant legal documents.
- Department of Natural Resources and Environment: After receiving the
compensation plan prepared by CDHLF, DONRE will appraise and submit PPC for approval.
Propose PPC for consideration and approval.

Restrictions of the Valuation Certificate
The following restrictions apply to the Valuation Certificate:
1. Results of the valuation certificate is only used for the purpose of specific evaluation following
the customer’s request, which have been presented in the first part of the first page of this
valuation certification
Customer will be completely responsible when using improperly this valuation certificate
2. Validity period of the valuation certificate is calculated from the date of the issuance of the
Valuation certificate:
- 03 ( three ) months for assets of individual property;
- 06 ( six ) months for assets is property of enterprise;
(After the periods indicated above, value assets can change following market evolution)
3. Only the originals and copies valuation certificates issued by SIAC are truly valuable
All acts used copies of valuation certificate without confirmation by SIAC will be considered as
breach of law with no legal value
4. Customer requires valuation and valuation appraiser guide to valuate the current state of the
property must be entirely responsible for information related to technical-economic
characteristics, features and legality valuation of assets provided to SIAC at the time and place of
valuation
SIAC is not responsible for checking the information of copies of documents relating to the legality of
the property valuation requirements in comparison with the original

In order to reduce disadvantages, ensure benefits to affected households after land acquisition
as well as to implement compensation task to be favorable, SIAC - Preventative Office in Dong
Thap proposes the final replacement cost for rural residential land at the front of Highway No.30
(Can Lo bridge - An Binh bridge) as below:
Location 1 (VT1) = 5.860,000 VND/m2
The remaining locations are applied ratio of percentage as prescribed at Decision
No.35/2011/QD-UBND dated on 27 December, 2011 by Dong Thap People’s Committee,
detailded:
Location 2 (VT2) = 50%*VT1 = 50%*5,860,000 = 2,930,000 VND/m2
Location 2 (VT3) = 30%*VT1 = 30%*5,860,000 = 1,758,000 VND/m2

II. LIVESTOCK
1. Principle to be compensated:
a- For aquaculture when at time of land acquisition as well as time for harvesting. will not be compensated
a- For aquaculture when at time of land acquisition but time is not for harvesting. Will be compensated
2. Method to calculate
Compensation level for damage when harvesting soon will be defined according to actual cost. In Case can relocate , will
be allowanced cost for removing and lost due to relocation : allowance level will be defined : 5,000 VND/m2 -10,000
VND/m2 of cultivated pond area.
III. COMPENSATION FOR RELOCATING GRAVES
− Earth grave: 6,000,000 VND/grave
− Normal grave (around by brick, stone, laterite, no tumulus): 8,000,000 VND/grave
− Semi- solid tumulus: 10,000,000 VND/grave.
− Solid Grave( foundation, top and roof ) grave with complicated architecture will be compensated for top of grave as
same standards as regulated in item 2 and 3 of this article, remaining part of grave will be compensated following
new constructed cost as regulated currently
− PC of commune level where land acquisition will create favorable conditions and guide to HH, individual to planed
cemetery to carry out relocation of grace as custom,habits,and regulation of environment sanitation
− For grave without owner, grave have owner but over limit of date of relocation. Organization for compensation,
support and resettlement implementation will hire to conduct relocation under supervision of commune PC where
land acquisition. Cost for relocation will follow as actual cost , but not over as regulated at item 1 of this article

3. Co HLFD will issue letter to report to Cao lanh district PC and propose Cao lanh district pc will solve
grievance to the HHs
