A. Introduction

1. The Asian Development Bank (ADB) approved a loan of $1,096 million on 14 December

2007 to help finance the GMS: Kunming-Hai Phong Transport Corridor: Noi Bai-Lao Cai

Highway Project (the “Project”). Vietnam Expressway Corporation (VEC) of the Ministry of

Transport (MOT) is the Executing Agency. The Project has a total length of 264km, starting at

interchange between Bac Thang Long - Noi Bai and the National Highway No.2 in Soc Son

District, Ha Noi City, crossing the provinces of Vinh Phuc, Phu Tho, Yen Bai and Lao Cai

before terminating at Bat Xat District, Lao Cai Province.

2. The project construction is divided into 2 phases:

➢ Phase 1:

o Construction of Noi Bai – Yen Bai Section with 4 lanes with the total length

of 121km.

o Construction of Yen Bai – Lao Cai section with 2 lanes with the total length

of 123km.

➢ Phase 2:

o Widening Noi Bai – Yen Bai section from 4 lanes into 6 lanes.

o Widening Yen Bai – Lao Cai section from 2 lanes into 4 lanes.

o Construction of the last 20km of the Project connecting Noi Bai – Lao Cai

Expressway and Kunming – Hekou Expressway.

3. The Project is designed and constructed following to the Standard "A". At the present, the

section from Noi Bai to Yen Bai has four lanes, two emergency stopping lanes and a design

speed of 100km/h, while the section from Yen Bai to Lao Cai has two lanes, two emergency

stopping lanes and a design speed of 80km/h. The first phase of the Project was commenced

in the third quarter of 2008 with the total length of 244km from Hanoi City to Lao Cai City and

the expressway was officially inaugurated issuing traffic and put into operation on September

21, 2014. The second phase is to be implemented.

4. As per ADB policy, the updated Resettlement and Ethnic Minority Development Plans

(REMDPs) were prepared (one REMDP was prepared for each project district) and approved

in 2010-2012. All affected households received full compensation and assistance payment in

2010-2012. Income restoration program was developed and implemented in 2013-2015 to

assist severely affected households and vulnerable households to restore of their affected

income and to develop their livelihoods.

5. In 2016, some land located along the expressway in 11 districts/cities needed to be

additionally required to construct frontage roads. REMDP Addendums for the districts/cities

were prepared for the land additionally affected. The REMDP Addendums were accepted by

ADB in November, 2016. Of 601 households (2,488 persons) who have land additionally

acquired, 508 households (85%) were affected households previously by the Project (had

land acquired by the Project and received compensation fully in 2010-2012) and 93

households (382 persons) who are the new affected households (had no land acquired by the

Project before).

6. There are 23 new severely affected households, of which, seven households who had

land marginally affected previously but become severely affected households due to

additional land acquisition; and 16 households who are new affected households by land

acquisition and the acquired land area is more than 10% of the total production landholding

of the household. There are 11 vulnerable affected households among 93 new affected

households and they are all ethnic minority people. The vulnerable households are also

severely affected households (lost from more than 10% of total production landholding of the

household) except three households in Chau Que Ha commune, one in Hoang Thang

commune, and another one household in Yen Hop commune (Van Yen District, Yen Bai

Province) - the households are marginally affected households but ethnic minority

households. Affected land by additional land acquisition is agricultural/forestry land. No

household has to relocate by the additional land acquisition.

B. Objectives of the Service Assignment of the External Monitor

7. The external monitoring of social safeguard mission1 was conducted from 26 October to

8 November 2017 in four provinces covered by the Noi Bai-Lao Cai Expressway Project with

the aims to:

➢ Review status of remaining issues identified in the report on implementation of the

Resettlement and Ethnic Minority Development Plan (REMDP) Addendums from April

2017;

➢ Review status of preparation of the additional REMDP Addendums; and

➢ Verify the other information, which will be included in the monitoring reports.

1 VEC does not have resources for the external monitoring and preparation for two pending quarterly reports. The external monitoring consultants were originally mobilized in December 2008, but the consultants kept failing to submit reports satisfactory to ADB. Therefore, ADB requested VEC to replace the consultants in 17 March 2016. VEC removed the external resettlement monitoring task from the consultants but VEC has not recruited another consultant to implement the external monitoring. Since it is now difficult for VEC to recruit the replacement EMA in timely manner due to internal procedure, in July 2017, VEC requested the ADB Mission to send ADB resettlement consultants to the Project to conduct the monitoring and prepare the remaining external monitoring

reports. In September 2017, ADB has sent an ADB resettlement consultant to support VEC in the external monitoring activities upon VEC’s request. The consultant, although was mobilized once by the previous external monitoring agency in a monitoring batch in 2011, since then does not have any involvement in the resettlement implementation of the project.

8. Specifically, the EM is tasked to look into the following concerns:

➢ The outstanding issues of the REMDP Addendums implementation including (i) three

households who have not received compensation as of February 2017; (ii) the

complaint of one household in An Thinh Commune, Van Yen District, Yen Bai Province

regarding the erosion issues of his resettlement land plot allocated in Dai An

Resettlement Site; (iii) the impacts on public structures in Cam Khe District, Phu Tho

Province; and (iv) the inclusion of 26 severely affected and vulnerable households into

the local socioeconomic development or rural development programs within respective

provinces.

➢ The status of additional REMDP Addendums prepared for the households who are

subject to additional land acquisition or conversion of land use purposes of the land

along with the highway, which were affected by highway constructions.

➢ Verify other outstanding and/or arising issues (if any) during the project

implementation and propose necessary corrective actions in the implementation of the

REMDP Addendums to improve implementation effectiveness.

C. Activities Carried out

9. A kick-off meeting was held on 26 October 2017 at NBLC-EPMU office to (i) discuss the

objectives of the monitoring mission; (ii) review the progress and status of remaining issues;

and (iii) agree on the itinerary and logistic arrangements of the monitoring mission. From 26

October to 3 November 2017, the EM conducted field visits at various project sites, met with

the staff of the Land Acquisition Project Management Units (LAPMUs) of the provinces,

District Compensation and Site Clearance Boards (DCSCBs), Commune People’s

Committees (CPCs), and interviewed randomly selected affected households.

10. Project areas visited under the Project were the public infrastructures which have received

complaints from the communes in Cam Khe District, Phu Tho Province and Dai An

Resettlement Site located in Van Yen District, Yen Bai Province. Regarding affected

households, priority was given to the households who (i) have not received compensation as

of February 2017; (ii) have complaints and queries; (iii) are among 26 severely affected

households and vulnerable households; and (iv) other affected households. The site visits

were photo-documented. (See Appendix 1 for the Mission Itinerary and Appendix 2 for the

List of Key Persons Met).

11. A warp up meeting was held on 8 November 2017 at the NBLC-EPMU office where the

observations and recommendations of the EM was discussed. The opinions of the NBLC-

EPMU regarding the observations and recommendations of the EM were taken into

consideration in the preparation of this report.

D. Findings and Recommendations

1. Compensation payment

12. Up to 31 October 2017, 601 affected households (100%) have fully received

compensation and assistances. The three households2 whose compensation was not yet

made for their affected land and trees have been provided with compensation on 30 March

2017 (for two households in Cam Con Commune, Bao Yen District, Lao Cai Province) and 12

May 2017 (for one household in Hop Minh Ward, Yen Bai City, Yen Bai Province). The

payment was made in accordance with the Decisions No. 893, 894, and 895/QD-UBND dated

17 June 2016 by Bao Yen DPC and Decision No. 4130/QD-UBND dated 17 October 2016

regarding the approval of compensation value by Yen Bai City People’s Committee.

13. Interviews with these affected households showed that they have fully received

compensation for their affected land and trees as well as allowances for their crops affected

during construction period with the total amount of VND 434,912,300. The households have

received compensation and assistances and signed the payment vouchers. As of now, the

households do not have any complaint or query.

14. Meeting and discussion with the local authorities of Hop Minh Ward, Yen Bai City, Yen Bai

Province showed that three households ([This information has been removed as it falls within

exceptions to disclosure specified in paragraph 97, (exception (x) Information that, if

disclosed, would or would be likely to endanger the life, health, safety, or security of any

individual, or safety or security of ADB assets, or to prejudice the defense or national security

of a member) of ADB’s Public Communications Policy (2011)) in the area had not received

compensation and assistances for impacts caused by construction activities. According to the

Hop Minh ward authorities, the houses of these three households developed cracking due to

the construction vibration of heavy machines (dozers and rollers).

15. NBLC-EPMU has informed the EM that the contractor has negotiated with the households

on the compensation and assistances for these impacts. A total amount of VND 20,687,000

has been determined according to the construction unit prices of the PPC; however, the

households did not agree and requested to receive higher rates. The local authorities are

supporting the contractor in negotiating with the affected households. It is expected that a

meeting between the local authorities, contractor, and affected households will be organized

in mid-November.

Recommendations: Compensation and assistances for the remaining three households

shall be fully and directly delivered to the households by end of November 2017. NBLC

EPMU, Yen Bai LAPMU and the contractor will work together on this issue. VEC should

participate in and monitor this negotiation and payment process, then will inform ADB on

the payment of compensation and assistances for the remaining three households in the

next internal monitoring report.

2. Erosion in Resettlement Site

16. As reported in the REMDP Addendum implementation report in February 2017, one

household ([This information has been removed as it falls within exceptions to disclosure

specified in paragraph 97, (exception (x) Information that, if disclosed, would or would be likely

to endanger the life, health, safety, or security of any individual, or safety or security of ADB

assets, or to prejudice the defense or national security of a member) of ADB’s Public

Communications Policy (2011), Dai An Village, An Thinh Commune, Van Yen District, Yen

Bai Province) complained that the received plot in the resettlement site was eroded and he

requested the LAPMU of Yen Bai Province to fix it.

The current status of resettlement land plot of the household of Le Xuan Kinh in Dai An Resettlement Site, An Thinh Commune, Van Yen District, Yen Bai Province. At the present, trees and grasses have covered the plot, so it is difficult to clearly check the erosion part of the plot.

17. Dai An Resettlement Site located in Dai An Village, An Thinh Commune, Van Yen District,

Yen Bai Province was arranged for 24 households and the land plots of 300m2 to 400m2 were

allocated to the affected households of Noi Bai-Lao Cai Expressway Project3. The affected

households have received resettlement land plots since 2011 and 2012 and the resettlement

site has been accepted and handed over to the local authorities. As of now, the warranty

period has been expired. Therefore, the verification of the land erosion and/or impacts caused

by natural disasters at the site shall rest with the local authorities.

18. The EM has met with the household of [(This information has been removed as it falls

within exceptions to disclosure specified in paragraph 97, (exception (x) Information that, if

disclosed, would or would be likely to endanger the life, health, safety, or security of any

individual, or safety or security of ADB assets, or to prejudice the defense or national security

of a member) of ADB’s Public Communications Policy (2011)] and been informed that the

household together with five other households4 have lodged their complaints regarding

erosion issues in the resettlement site to the district and commune. These households have

requested the LAPMU of Yen Bai Province and other relevant agencies to either (i) cut the

area close to the erosion part and allocate the household with additional area of the adjacent

plot; or (ii) fix the site.

Recommendations: It is recommended that NBLC EPMU should advance the local

authorities, particularly the Construction Division of Van Yen DPC, to survey the

resettlement site and have an official response to the household. If the erosion is evaluated

and confirmed to not cause danger to the household, there should be an official response

to the household of Le Xuan Kinh as well as other households as listed above. On the other

hand, if the erosion is verified as causing danger to the household, it should be fixed

immediately. VEC will monitor the progress and solution agreed between the local

authorities and the affected households and then report to ADB regarding the matter.

3. Income Restoration Measures

19. Income restoration measures have not yet been implemented for 23 new severely affected

households and three vulnerable households. Per the REMDP Addendums prepared for each

district/city, these households were eligible to participate in the Income Restoration Program

(IRP) of the Project; however, as the budget for IRP has been liquidated and it is difficult,

particularly in terms of procedures, to prepare and implement an IRP for just 26 households,

it was advised and agreed that livelihood restoration support would be provided to these

households through integration into existing socioeconomic development or rural

development programs within the province. The supports would be covered by the budget of

these programs being managed by the province and concerned districts5.

20. The EM has discussed with the LAPMUs of relevant provinces, Division of Agriculture and

Rural Development at district level, CPCs, and affected households. The results showed that,

as of 31 October 2017, these households have not been included in any existing

socioeconomic development or rural development programs within their respective provinces

and districts. According to the relevant authorities, as the number of households was small

and scattered in different villages and communes, it was difficult to integrate them into the

local programs. Discussion with Van Yen District Division of Agricultural and Rural

Development showed that the inclusion of these households into existing local programs was

easier in some communes, for example, Chau Que Thuong Commune, because this was the

Program 135 commune and thus had more socioeconomic development supports. In other

communes, the integration would face more difficulties because (i) the households did not

belong to the list of beneficiary households of government’s social policies6; (ii) the concerned

districts and communes were not well aware of this integration plan; and (iii) there was no

suitable program in place for these households.

21. Meeting and discussions with the relevant local authorities and affected households

suggested that (i) the concerned divisions at district level and communal authorities were not

aware of the plan to include these 26 affected households into the existing socioeconomic

development or rural development programs; (ii) vocational training programs were suggested

by relevant departments and local authorities as the most suitable programs to be provided

for these households. Nevertheless, the needs and actual conditions of the households should

be taken into consideration.

22. The consulted Division of Agriculture and Rural Development at district level has reported

to the EM that there was a case of [(This information has been removed as it falls within

exceptions to disclosure specified in paragraph 97, (exception (x) Information that, if

disclosed, would or would be likely to endanger the life, health, safety, or security of any

individual, or safety or security of ADB assets, or to prejudice the defense or national security

of a member) of ADB’s Public Communications Policy (2011)] household in Chem Village,

Dong An Commune, Van Yen District, Yen Bai Province who was eligible to participate in the

IRP but not included in the list of the 26 households. The household was affected through two

times of land acquisition of 2,500 m2 for the development of Noi Bai-Lao Cai Expressway

Project in May 2014 (losing 49.6% of the total productive landholdings) and April 2016 (losing

100% of the total productive landholdings). The household has fully received compensation

and other allowances, except for the IRP supports. In September 2016, the household has

lodged a request to the Division of Agriculture and Rural Development under Van Yen DPC

to review the household’s entitlements. After receiving the district’s response, the household

has not lodged further request or complaint regarding the income restoration supports.

23. Furthermore, there might be cases where additional land acquisition will result in additional

severely affected/vulnerable households. If that is the case, the budget of the local programs

will not be enough to cover all the eligible households. In addition, will the inclusion of these

households in the local socioeconomic development programs cause disadvantages, that is,

less resources and supports, to other households targeted by the programs?

Recommendations: Regarding the integration of the eligible affected households into the

local socioeconomic development and/or rural development programs, VEC should work

and discuss with the local authorities on the inclusion of these households into the local

programs. As each socioeconomic development and rural development programs have

their own target groups, the local authorities shall integrate the participation of these

households in the suitable programs.

In order to ensure that no eligible household is left out of their entitlements to

participate/receive income restoration measures, VEC together with the concerned

LAPMUs should review and verify whether the households have been included.

In case there is enough budget for the income restoration measures for the additional

severely affected/vulnerable households, VEC should transfer to the PPCs to cover for the

programs in which they are integrated to avoid resource/support competition among

households in the area.

4. Restoration of Damaged Community Infrastructure

24. During the meetings with Sai Nga and Phung Xa communes of Cam Khe District in Phu

Tho Province, the CPCs’ representatives as well as affected households raised the issue of

damaged community infrastructure including irrigation canals, local roads, and box culverts.

Regarding this issue, the NBLC EPMU explained to the mission that since construction and

restoration of damaged public infrastructure was finished and the warranty period (two years)

was expired, the community infrastructure (irrigation canals and local roads) has been

checked and handed over to the local communities for operation and maintenance. For the

box culverts and underpasses, VEC Operation and Maintenance (VEC O&M) is the

responsible unit for regular maintenance.

25. The most common issues found during the discussion with NBLC EPMU, local authorities,

and affected households include: (i) the collapse of drainage blocking the irrigation canal of

the communes; (ii) concentration of water in the underpasses; (iii) 150m of inland

pathway/road (Km 82+940 to Km83+165) has not been restored to the local communities,

which is under negotiation between the contractor and local authorities. As of now, the local

communities are using another pathway (to the right of the previous pathway) to serve their

farming activities; (iv) the solutions by VEC O&M at some sections are not effective, for

example, concrete has fallen off from the expansion joint of the underpass although this issue

was addressed by VEC O&M once.

Recommendations: VEC should review and plan corrective actions to respond to Cam

Khe District on the claim regarding damaged infrastructures of district and communes.

VEC should disclose contact information and responsibilities of VEC O&M (in official written

document) to the local authorities and communities to contact for regular maintenance and

impacts/incidences during the operation of the works. In which, the responsibilities for

operation and maintenance of the infrastructure should be clarified between VEC O&M and

the local authorities for irrigation canal, local roads, box culverts, and underpasses.

With regards to the sections where VEC O&M has carried out maintenance but been

assessed as not effective by the local authorities and communities, VEC should instruct

VEC O&M to address the issues thoroughly.

Although the restoration of the road to paddy field of Phung Xa Commune has not caused

much difficulties to the farming activities of the households who have paddy fields here as

the households are using another existing pathway to the right of the paddy fields.

Nevertheless, the relevant parties (VEC, contractor, and commune authorities) should

discuss and reach agreement to carry out the restoration activities. VEC should follow up

the process and report to ADB regarding this matter.

5. Status of Additional REMDP Addendums Preparation

26. Since lands along with the Noi Bai-Lao Cai Expressway Project subsided because of its

embankment construction in some locations, the Ministry of Transport and VEC decided to

acquire those affected lands or change the land use purpose. The cost will be covered by

ADB loan using the remaining amounts in imprest account. Therefore, additional REMDP

Addendums are required.

27. The EM was informed by NBLC-EPMU that the additional land acquisition and changes in

land use purpose would take place in eight districts of three provinces, namely Vinh Phuc,

Phu Tho, and Yen Bai. As the Variation Order (VO) No. 13 including the additional scope of

work of the consultant preparing additional REMDP Addendums has just been submitted by

VEC to ADB and MoT in October 2017. As scheduled, the additional REMDP Addendums will

be submitted to ADB and MoT by mid-November 2017.

28. Regarding additional land acquisition and changes in land use purpose, an issue was

raised by Dinh Chu Commune in Lap Thach District, Vinh Phuc Province. As informed by the

staff of Lap Thach DCSCB and cadastral officer of Dinh Chu CPC, two areas in Dong Dep

(1.3 ha) and Dong Cham (0.56 ha) of the commune were affected by the construction

activities, causing inundation and inability of farming activities on these areas. Therefore, land

would be acquired and/or subject to changes of land use purpose. While the area in Dong

Dep (1.3 ha) was surveyed and accepted by VEC and relevant agencies to be covered in this

additional land acquisition (to be included in the additional REMDP Addendums), 0.56 ha of

land in Dong Cham was still being verified. As reported by NBLC-EPMU staff, VEC was aware

of the situation and had worked with the commune and relevant departments for the solution;

however, the commune and district were yet to submit to VEC and carry out the requested

papers and actions including the design of the works and dredging the culverts for two years.

Recommendations: VEC should accelerate the preparation of the additional REMDP

Addendums and submit to ADB and MoT for review and concurrence as the loan will be

closed in December 2017.

Regarding the issues in Dinh Chu Commune, Lap Thach District, Vinh Phuc Province, VEC

should promptly and closely coordinate with the local authorities to submit sufficient papers

and evidences for verification.

E. Conclusion and Program for the Next Monitoring Mission

29. The next monitoring mission in December 2017 will look into whether or not the actions

and recommendations mentioned in this monitoring report have been adopted and if they have

contributed in the improvement of resettlement implementation.
