1. GENERAL INFORMATION OF THE PROJECT1.1. Mong duong Thermal Power Plant Project

Mong Duong Thermal Power Plant complex with a total combined capacity of 2’200 MW, is

located in the Mong Duong Ward (Cam Pha town, Quang Ninh province). It is situated along

Highway 18, 300 km northeast of Hanoi and 18 km from the Center of Cam Pha town. The

Project site is located at the mouth of the Mong Duong River and includes one ward (Mong

Duong) and one commune (Cam Hai). The objective of building this Plant is to increase the

capacity of the thermal electric power source and contribute to the stable supply of electricity

throughout the year and especially in the dry season when the hydro plants do not generate

much of their maximum capacity

1.2. The Fresh Water Component

The Mong Duong Thermal Generation Plant complex needs a large amount of fresh water from

4th Quarter, 2013. It is calculated that, the combined Plant needs 15.000 m3 of fresh water per

day. A fresh water supply system therefore must be constructed to serve the project. The system

consists of the reservoir, the pumping station, the 10 KV power supply to serve for the pumping

station, the water pipe line, and the access road.

Of which, only the Reservoir area and the Water Pineline area relates to land acquisition and

resettlement.

1.3. The Scope of Land Acquisition and Resettlement

Based on the detailed design, a total area of 1,849,411.39m2 with 192 households will be

permanently affected. Among the permanently affected land, 1,366,399.76m2 is affected by the

reservoir in Mong Duong Ward and 483,011.63m2 by the pipe-line and other works (access road,

powerhouse, etc) in Cong Hoa Commune and Cam Hai Commune (Cam Pha City). 34% of

affected area is productive forest land which is currently used for planting Acacia of 71

households (385 persons) in three communes/wards. FWC will also affect 8000.0m2 of residential

land of 37 households (182 persons) in Village 10, Mong Duong Ward. Cong Hoa and Cam Hai

communes will not have residential land affected by the FWCt. Area, number of households and

persons of affected land are shown detailed in Table 1 and Table 2. Beside, 17,756.5m2

temporary land is also acquired for the Project during construction phase and the compensation

was paid for the temporarily affected households.

In the pipeline, DMS also conducted in 2014 to analyze the road wideling. According to the

original design, pipeline will crossed over on road number 18, thus, the change in in alignment

should be done due to the wider road. Because of this change, 3 more households were affected

by this project.

2. DETAILED RESETTLEMENT IMPLEMENTATION PROGRESSDetailed on the progress of Resettlement Plan Implementation is in the Annex 2

2.1. Information Disclosure and Community Participation

The objectives of Information dissemination and community consultation include: (i) enhancing

the local people’s awareness of the project; (ii) Ensuring the design of a reasonable re-

resettlement and income restoration programe compared to the demands of the affected

households maximizing the socio-economic benefit of project; (iii) ensuring that the affected

people are able to participate and make proper selections of the issues which may directly impact

on their income and living standard; (iv) Ensuring the transparency of all activities related to land

withdrawal, displacement and economic restoration ; (v) Obtaining the co-operation participation

and contribution of ideas from the affected people to the activities to be done for the planning and

implementation of resettlement, preparation and carrying out of income restoration and livelihood

enlargement programs; (vi) Creating a continuous dialogue mechanism, addressing the

supervision and implementation issues; (vii) Creating a continous dialogue mechanism,

addressing the supervision and implementation issues; (viii) surveying the measures to control

the natural resource with the aim to achieve a suistainable use and preservation

During the preparation of draft resettlement plan in 2009,, the orientation meeting was conducted

by Thermal Power Project Management Unit No.1 (TPMB1) and DCARB of Cam Pha city with

relevant parties and affected households. Project information has been delivered to 100%

affected households (such as introduction of detailed technical design, scope of impacts on land

and asset upon on lands, entitlements for compensation, assistance and resettlement,

implementation schedule of land acquisition, compensation, assistance and resettlement and

grievance redress mechanism). The documents have also been placed in public places and in the

house of village leaders and head of mass-organization

During the implementation of Resettlement Plan, information disclosure activity was continuously

and regularly implemented through the implementation progress. This kind of activity is to

enhance local awareness, reduce grievance or complaints from AHs as well as speed up the

implementation of the project’s components. The information disclosure was mainly carried out

through: residential meetings, delivery of notices to each household, posting up notice at local

government’s offices, delivery of project leaflets and posters, direct meetings with AHs by

TPMB1’s, and local authorities. The disclosed information included; (i) information about the

compensation policy and the right of AHs; (ii) information about environmental impacts; (iii) issues

arising from the construction execution affecting local people.

From 1 th October to December 31 th 2014, many consultation meetings on the payment and

Income Restoration program and assistance among the affected households has arranged at the

headquarters of Communal People’s Committees. Besides, local were also informed of the

arrangements of the project compensation, responsibilities of relevant stakeholders and

grievence redress mechanism and result of grievance redress as well as newly arising issues

during the project implementations.

The results of the consultation show that most of the affected people have been aware of the

process of the project RP Implementation by listening or seeing. Some of the illiterate Project has

signed into the documents of compensation money transference by pressing their fingerprints

under the witness of a majority of attendees and with the confirmation of local authority to ensure

the explicitness. Both men and women from affected households are encouraged to attend, as

well as other interested community members. The list of public meetings for the Fresh Water

Component is provided in the following Table.

The meetings were included all affected households, local authorities, head of mass-

organizations and village leaders. The total turns of participants are around 950 people, of whom

560 people are female (accounting for 55.4%).

Consultations continue to be deployed in the project area through community meetings. 100% of

affected households were consulted 3 times or more on the project’ policy of land acquisition,

compensation, support, and resettlement.

Affected people have been consulted on the needs of participating in the income restoration

program, however, many households are still not aware of the importance of the program,

therefore, they are not ready to participate in the program. Propaganda, information

disseminating to these households will be continuously performed during the implementation of

the income restoration program.

The consultation process has also paid its attention to the needs of women and vulnerable

groups such as the poor, single women headed household, elderly or some other policy objects.

Due to the Consultants providing information adequately and transparently on compensation

entitlements the complaints of affected people are not considerable in numbers.

2.2. Detailed Measurement Survey

The project mainly cover: (i) Mong duong ward where the reservoir has been constructed; (ii)

Cam Hai and Cong hoa Communes where the pipeline has been constructed. Detailed

Measurement Survey was completed before November 10th, 2012. Due to changes in technical

alternatives or some assets outside the project sites but is no longer valid for use left, some

added surveys was carry out in 2014 to compensate for the household

The Inventory of losses has been done with the participation of the relevant parties include: (i)

TPMB1 and Cam Pha Land Fund Development Center; (ii) Communal cadastral officer and

representatives of communal authorities; (iii) Representatives of affected hamlets and; (iv)

representatives of affected households (normally householders)

The Plan of compensation assistance and resettlement/relocation has been prepared based on

the Project Policy Framework ( as stated in RP) approved by ADB and the decision issued by

People’s Committee of Quang ninh Province. The Project Policy has considered that: the

household suffered from losses of plants, trees, structures have been compensated by cash with

assistances such as displacement fees, rewards for good progress in site-hand over, income

restoration and social benefits for Vulnerable Group

The discrepancies and omissions in the loss inventory process or other damages arising due to

changes in technical alternatives or some assets outside the project sites but is no longer valid for

use caused by land acquisition was timely inventory replenishment to ensure the entitlements of

the affected people, ensuring compliance RP framework of the project.

Need assessment survey was conducted in July 2013 to design and implement the measures for

income and livelihood restoration. Participants choosed the vocational training, Aacia’s Cultivating

and the breeding’s model. The Income Restoration Program has prepared by TPMB1 and

approved by ADB

In the pipeline, 3 more households were affected in DMS 2014 by this project After making the

DMS survey, the project prepared a summary table of DMS’s result then publicized at hamlet

community houses. Any complaints about affected assets such as land area, structures, trees

and other properties were checked and verified by members of Compensation Board. The records

of additional DMS (if any) will be made after reaching an agreement and having the signature of AHs

representatives. As a result, all that household got their payment and restored their income

2.3. Compensation payment, assistance and resettlement

As of December 31st, 2014, the project has basically completed payment of compensation and

support to affected households. In the freshwater pipeline and power line 65 affected households

have got payment with the amount of VND 17,059,295,200. In the Reservoir Area, the total 127

households affected households have paid with the amount 84,012,033,600. Timing of payments

from 2012 to May 10th 2014.

The total budget of approved compensation, assistance and resettlement is VND

103.837.805.600,and VND 103.837.805.600 has been paid for the affected people (including

budget for the DCARB), reached 100%.

In general, The Application Cost for the project was in compliance with the provisions of ADB

about the Compensation and Assistance will be based on the principle of replacement cost

(market value in normal conditions) at the time of The Compensation Implementation.The TPMB1

has many solutions to make sure that all the displaced Households in the project without having

any certificate of Land Use rights or any legal recognition of the acquired land are eligible to

receive compensation and resettlement assistance, non-land assets to support the replacement

cost of ABD and policies of Vietnam’s Law.

2.4. Land Acquisition

According to the implementation process of the project, land acquisition has been implemented

after project affected household Have received compensation, assistance and resettlement, at

least , in the time of 30 days

The land acquisition and resettlement has achieved good results in general for the Pipeline

Component (Cong Hoà and Cam Hai communes), and also in Resevoir. 127/127 affected

household in Resevoir got the payment. Site clearance rate for Reservoir Component has

completed 100%, the water has stored up in the Resevoir since January 2014, now has

integrated into the freshwater lake to fix with the design with construction depth of Dam 15m at

least metres of water

There are 117 land plots of households in the Resevoir which are recovered additional at

17.5metres depth of Dam to prevent the risk in case stream level rose high extraordinary by the

flood. The compensation step has been done based on the framework of project’s policy. TPMB1

and the local government implemented the compensation, all the affected households got the

payment and moved out of the resevoir to hand over the land for project

Of total 37 resettlement households, 12 households returned their fatherland in another province

such as Hai Phong, Lang Son, Bac Giang and Quang ninh because they migrated to this area 15

-25 years ago and now they come back the origin; 25 other households still stay inside the

commune but move near to the 329 road. The staying households situation as follows: (i) 25 HHs

completed repaired their facilities such as yard, roof, shed, workshop equipment; (ii) 12

househods have built the new house in the mainroad of the community, of which 8 households

finished build the brick houses and moved to their new houses, 7 households finished to build

the 2 floors house with shop/ restaurant, and 2 houses are under construction; (iii) 8/37 relocation

households bought a small truck to make the transportation service business. These households

have restored income by using the amount of compensation they received from the compensation

payment; (iv) 12/37 relocated households had opened a shop such as rice shop, grocery store or

small restaurants and other business related to be essential items for daily life of local people

All households have access to clean water and electricity, and some of households also have

accessed to potable water supply because they buy their own pumpling machine to collect the

water from streams. The Broadcasting Wave is being upgraded by Cam Pha city People’s

Committee, households in Mong duong may soom approach the Radio and Watch Tivi with better

with better quality

2.5. Restoration of APs’ livelihoods and rehabilitation of APs’ lives

Land acquisition for construction of the Project has caused certain impacts on the households in

the Project area. However, these impacts have been minimized at least by relevant parties since

the design stage of project

Besides compensation for affected land and property, the project has adopted many policies to

support affected households to ensure the progress of relief work as well as the interests of the

people and help them to restore stable life

All the affected households who get the payment received full assistances according to project

policies such as living stabilization assistance, occupation transmission assistance, and business

stabilization assistance.

To mitigate the risk for AHs, the income restoration has been prepared in RP and also in the

Updated RP approved by ADB

The project has complied with the policies which stipulated in the Resettlement Plan in which

clearly defined that all the severely affected household loss from 10% or more of productive land,

relocated households and the vulnerable households will not only get assistance fully from

project but also be participated in the Income Restoration Plan. The project has conducted

surveys for subsistence needs of households affected by the project . Based on the needs of

people affected , the income restoration program has been developed and approved by ADB and

TPMB1 and has implemented since 1/2014 .

Therefore, Income Restoration Plan (IRP) was prepared in order to (i) ensure entitlements for

Project affected persons (PAPs) are prepared in a transparent, consistent and equitable manner;

(ii) identify severe APs that require assistance other than cash compensation to restore their

livelihoods; (iii) design and implement the measures for income and livelihood restoration; and (iv)

establish monitoring and evaluation mechanisms on IRP implementation.

The aim of this IRP is to minimize the adverse impacts of the Project and to ensure that income

and livelihoods of AHs will be restored and improved better or at least equal pre-project levels.

As in December 2014, The Income restoration Programs have been implemented and included

the following steps: (1) Establish Management Program Committee (2) Organize the consultation

in 100% wards in the project area, (3) Cost Estimation has been prepared and approved by the

TPMB1 city; (4) Communications and dissemination of effective economic models in the project

wards by establishing material facilities and information channels for livelihood restoration

programs; (5) PMU has selected the center provide the agriculture technical training for the

income restoration program and began conducting training for farmers; (6) Deployed model

vocational training according to the Income restoration program which has been approved by

ADB; (7) Conducted community awareness programs in various forms such as through television

reports, through the training materials and integration in community activities

After the need assessment survey in participating in income restoration programs, an income

restoration plan was approved by ADB in March and have been implemented. As soon it is

approved by the ADB, icome restoration activities have been conducted immediately. The TPMB1

and the Land Fund Development Centre have coordinated to carry out the activities as follows:

1. Information dissemination Implementation included: (i) Conducted the Information

dissemination about Income Restoration Program and models livelihood restoration through

community meetings in Mong Duong ward, Cam Hai commune and Cong Hoa commune; (ii)

Selected and signed contract with Radio and TV Cam Pha town to implement the Disclosure of

information on policies and livelihood restoration programs through local information channels.

The main content of this activity is to communicate about effective economic models in the

region, in the country and other areas; provide technical guidance and production outputs,

communications through the local radio and Cam Pha province Television (each news from 15’-

20)’

2. Management and Training for Steering Committee conducted in 28th July 2014: (i) Established

the "Steering Committee of IRP Implementation” includes: Representatives from TPMB1,

Representative of the City’s leadership, City RC, the related agencies (Farmer’s Association,

Women’s Union, Agriculture Expansion Station,Economic Department); Representative of ward

or commune, Farmer’s Association, Women’s Union, Land Officials, village leaders. This

Committee is resposible for inspecting, supervising, monitoring to implement the IRP, to quarterly

report on the IRP implementation and to participate in solving the issues of implementation

process; (ii) held a meeting of Steering Commitee of IRP, to disseminate the content of IRP of the

Project and assign specific tasks for the members; (iii) TPMB1 coordinate with Consultant,

Agricultural extension center of the Province and city, Agricultural extension associations and

another organization to prepare the technical Support for training; (iv) Carried out the

Management Training

3. Acacia and Livestock Technique Training Implementation conducted: (i) TPMB1 coorperated

with the Agricultural Extension Centers and Department of Economics to set up the schedule for

the training courses on application of technics and the guidelines on capacity and productivity

improving, using the high quality Acacia trees; (ii) The training course carried out on 27 of June

2014 with 52 participants. At the monitoring’s survey, 95% the affected household was attended

and high appriciated about the result of the training and they thought that all the knowledge they

got from the course could be applied in their forestry activity. At the time of monitoring, 5

households have applied the model of Acacia planting in their forestry model which used high

quality Acacia auriculiformis as an intensive plantations model, primarily basal fertilizer inorganic

and microbial fertilizer. 5 other households who have a big garden remaining has applied the high

quality chicken modeling by using the steel mesh enclosure the garden and drop chicken inside

to feed. All the production models of the household is technical supported by the authorities and

4. Vocational Training Model Implementation: (i) signed the contract with Vocational Training

Centrer such include the Industrial and Construction Vocation College of Quang Ninh Province ,

Mining College Hữ u Nghị, Industrial College of Cam Pha, Vocational Center of Cam Pha

City,Provincial Women Union, Vocational College belong to Mining Company to support for the

affected household to attend; (ii) provided the information about available course and collected

the list of participants to support for basically vocational training such as automotive and

motorcycle repair, Mechanics, Electricity and Water Pluming Repair, Sewing Industry worker. The

Cooking vocational course was openned on 24th July 2014 with 12 members of affected

households attend. Other vocational course was openned on 24th July 2014 is motorcycle repair

with 10 people attending. Based on knowledge have been trained, 3 households have opened

their motorcycle-repair shops, 1 household opens stores offer repair and plumbing service, and

two other families are processing overlock clothing at home. According to the report of local

authorities, income from non-farm activities and forestry increased by 30% in 2014. The income

restoration programmes also facitilated the development of local economy in Mong duong

increased 10% on average

The local people in general are satisfied with the result of the lost inventory, compensation price

assistance and resettlement policies of the Project with the rate up to 100% people who was

intervied. With the loss of agricultural land household: They are highly appreciated with the

counting method, applying the replacement cost and compensation payments. As of

Resettlement Monitoring the household who lost some Item during DMS was additional

compensation.

In 2014, among 25 complaint letters from 25 affected household relates to misidentify the

acquired land and compensation rate. And all 25 of complaints had been solved. The 2

households have not been solved in the semi-annual report in July 2014 has agreed to get

payment and moved to the new place and restore their livelihood

2.6. Issues concerning gender and ethnic minority

Gender Issue: Gender equality is one of the important criteria to evaluate the development of a

community. Gender issues have been detailed in the RP that is being updated in term of the

socio-economic situation of females and gender strategy to ensure the effective integration of

gender related issues into such documents

Activities of RP implementation in the locality have been regconized by TPMB1 during the field of

monitoring such as community consultant, information dissemination through meeting with the

local people, answering questions arising during the meeting of community Consultation. The

Cam Pha Town Resettlement Committee (TRC) include women representatives from the Mong

Duong Ward and Women Union of the Residential Area No.10 to represent the interests of

women in the affected households. Capacity-building training were provided to the leaders of the

Women’s Union, by the social consultant of the TPMB1, to increase their participation in the TRC.

The participation of women in leadership and decision making in resettlement planning were

guaranteed through equal representation of men and women during the resettlement

implementation.Training program to enhance the awareness of the local people about the

HIV/AIDS was also mainstreamed inside the healthcar for the women.

During group discussions, it was mentioned that household members rely on men’s decision with

regard to business decisions while women are responsible for household chores. Men are more

likely affected because they are the primary income-earners in the households. In Mong duong

commune, when we asked about shifting to a new job most of the interviewed said that they are

old and cannot work as hired labour. They are relying on their children for support. Younger male

said they will shift to seasonal construction work. Women have to take care of their families, look

after their children.

By in-depth interview with women in the affected communities, the consultant found out women’s

awareness on environment sanitation in hamlet and healthcare for themselves. Because the

project is conducting in the urban area, the women understand clearly about the gender equity as

well as their society role. The women who are impacted by the project play an important role in

their family and also in the mass organizations. 95% ofinterviewed women attended the

community meetings. Most of women are confident to discuss about project activities and the

income restoration plan.

Land use rights certificates (LURC) for residential plots are registered under the namesof both

husband and wife. LURCs for plots at the resettlement site will also be registered under the

names of both husband and wife.However, with regard to agricultural lands LURCs in the area

are usually issued to women as they directly involved in agricultural production activities.During

discussions, DPs mentioned that household members rely on men’s decision with regard to

business decisions while women are responsible for household chores. Men are more likely

affected because they are the primary income-earners in the households.

Ethnic Minority Issue: The population of the commune mostly affected by the project, Ward No.

10, is inhabited predominantly by members of the two ethnic minorities living in this area, Dao

and Tay, while in the area affected by the pipeline, the majority is Kinh. The community

consultation, project information disclosure for all PAPs, including ethnic minorities have been

conducted in the project during the project implementation by TPMB1, People Committee of

Mong duong, and the Communes in the project regions. Seriously the Asian Development Bank

has provided affected households in the vulnerable group including minorities with a certain

amount to support their life and livelihood development in compliance with the updated RP and

legal framework

Together with the efforts in State governance reform at the macro level, local governance reform

plays an important role in poverty reduction for affected household. No10 Village institutions, both

official and unofficial, are the basis for local governance. Strong village institutions enhance

community assets and increase the effectiveness of external support. Forming and strengthening

village institutions contributes to local governance reform and to the development of rural civil

society. By the supporting from TPMB1 and Mong Duong People Committee have special

focused on conducting the assistance for local people, mainly the poverty, income, agriculture

production, housing conditions, and access to the basic public services

3. CONCLUSIONS AND RECOMMENDATIONS3.1. Conclusions

The dissemination of information about the project in general and the policy on Compensation,

support and Resettlement has been coordinated between TPMB1 and stakeholders with efforts.

Most of interviewees said that they had received information about the project as well as the

compensation policy of the implementing agencies. Information dissemination, community

consultation have witnessed the cooperation of DCARBs of Cam Pha city along with Mong Duong

ward in the project region and have basically conducted as per the regulated process resulting in

the certain efficiency. The policy priorities of the City support has been consulted dissemination to

affected households and communities, contributing relatively satisfactorily in resolving the

complaints and questions which still remain.

The site Clearance and Resettlement of the Project are now basically completed. The

Resettlement Policy has been implemented in a satisfactory way by TPMB1 that ensuring

meeting the objectives of the project. The problems happended in the implementation has been

solved in time by exchange and collaborate solution by stakeholders. The Resettlement Policy has

been implemented in a satisfactory way that ensure meeting the objectives of the project. The

problems happened in the implementation has been solved in timeby stakeholders through exchange

and collaborating solutions.

Implementing the activities on compensation, assistance and resettlement were delayed in

comparison with the approved resettlement plan. Progress on compensation and resettlement

implementation until December 31th, 2014 is 100%. The compensation payment completed

100% of total of anticipated compensation budget.

The dissemination of project information in general and the policy on compensation, support and

resettlement has been done with effort in the coordinationbetween MRB and stakeholders. Most

of interviewees said that they had received information about the project as well as the

compensation policy of the implementing agencies.

The resolution of questions and complaints feedback of the affected household has been doneby

TPMB1, local governments and related stakeholders. These questions raised in the construction

process such as the material gathering influence traffic, tunnel construction work was calculated by

TPMB1 to make sure that it will be solved to ensure the rights of the affected household.

In general, Compensation, Assistance and Resettlement of the project was carried out basedon the

Legal Framework of RAP, they followed up the scheduled in RAP and public for affected household

before payment. 100% affected people agreed with the Implementation steps of the project.

Granting land use right certificates (both resident land and production land) for relocated

households in Mong Duong is being submitted to CPC for approval, other land area have not

been implemented

At the monitoring time, 100% of relocated households moved out of the Resevoir, they repaired

the facilities and built the new house, some other households left Mong duong to their homeland

in another province. Among relocated households, 15 households have their new own business

such as transportation service and small business

Gender equity and ethnic minority activities have been effectively intergrated into the project

activities

The income restoration program have approved by ADB and implemented by TPMB1 with a good

results. The project has established the “Steering Committee, carried out the public consultation

and implemented the Vocational Training

3.2. Recommendations

The dissemination of information about the project operation need to continue to support

information to the community and policies as well as their interests in the Project. TPMB1 and

stakeholders should collaborate more in solving problems which could be arised in the Process of

Resettlement and Income Restoration of affected household in particular and the other affected

households in general.

The PC of Quang Ninh province, and DCARBs of Cam Pha city should pay its special attention

and put emphasis on households that have to move to another place and/or those are serverely

affected on their income source. The PC should approve, make decisions and create favorable

conditions for remaining households to move to the new place as well as the activities to restore

income of the affected households.

TPMB1 should closely cooperate with the PC of Quang Ninh province, Cam Pha city, and

DCARBs of city to support and create favorable conditions of compensation funds, to help the

locality to resolve shortcomings related to land acquisition and resettlement in an effective and

timely manner to ensure the planned implementation of the project

Quickly complete the granting of land use right-certificates for resettled households and prevent

the encroachment problem of agricultural and forestry land which has been handed over to

hamlet community

Income restoration activities should be conducted based on the approved IRP of ADB and that

program should calculate the vulnerable group and ethnic group in any stage. The TPMB1 should

closely with the PC of Quang ninh province, the PC of Cam Pha city to support the forestry land

for affected household by the land funding of The Cam Pha Forestry Company

It is necessary to enhance the participation of women in community activities and their ideas

sharing in meeting leaded by women union. Training course on gender equity should be held at

all the communesfor both men and women to increase the society on women’s equity.
