City of Bennington City Council Meeting Minutes Tuesday, May 24, 2011; 6 p.m. City Office, 15514 Warehouse Street Bennington, NE 402-238-2375 Call to Order - Open Meetings Act - Roll Call Mayor Mary Johnson called the special meeting to order on Tuesday, May 24, 2011 at 6 pm. In attendance were City Council members Dan Menke, Gordon Mueller, Gary Sather and Al Tanner (6:05pm arrival). Johnson identified the location of the Open Meetings Act that is available to the public. Consideration of a Conditional Use Permit Application for a Canopy and Sign in a Downtown Commercial District located at 15408 South Second Street Bob Swanda, Hometown Investments, described the canopy and sign designed for the front of his building. Johnson opened a public hearing and there were no comments. Motion by Sather, second by Menke to approve the Conditional Use Permit Application as presented. All voted in favor and the motion carried. A motion by Mueller to exempt businesses from a fee when returning a building to its original historic look was not seconded. Council members discussed design standards and historic recommendations made in the 2003 Pathways Vision and Action Strategy and implemented into current zoning regulations. Further discussions were tabled until the next meeting. Planning Commission Appointment Recommendation Motion by Menke, second by Sather to approve Kevin Kuker for a 2-year appointment to the Planning Commission. All voted in favor and the motion carried. Call to Order - Open Meetings Act - Roll CallMayor Mary Johnson called the special meeting to order on Tuesday, May 24, 2011 at 6 pm. In attendance were City Council members Dan Menke, Gordon Mueller, Gary Sather and Al Tanner (6:05pm arrival). Johnson identified the location of the Open Meetings Act that is available to the public.

Johnson opened a public hearing and there were no comments.

Motion by Sather, second by Menke to approve the Conditional Use Permit Application as presented. All voted in favor and the motion carried.

A motion by Mueller to exempt businesses from a fee when returning a building to its original historic look was not seconded. Council members discussed design standards and historic recommendations made in the 2003 Pathways Vision and Action Strategy and implemented into current zoning regulations. Further discussions were tabled until the next meeting.

Planning Commission Appointment RecommendationMotion by Menke, second by Sather to approve Kevin Kuker for a 2-year appointment to the Planning Commission. All voted in favor and the motion carried.

Fire District BudgetA motion by Mueller to approve $54,000 for the 2011-2012 fiscal year was not seconded. Motion by Sather, second by Menke to approve $51,300 for the 2011-2012 fiscal year. All voted in favor and the motion carried.

Ridgewood Odor Chemical Feed SystemCity Engineer, Tyler Hevlin, explained the installation, use and costs affiliated with a chemical feed system to eliminate odors in the sewer lines. Hevlin will get an estimate on an air pump system. PeopleService will be asked to take samples for dissolved oxygen. After reviewing results from samples taken, a course of action will be determined.

AdjournMotion by Mueller, second by Menke to adjourn the meeting at 7:15pm. All voted in favor and the motion carried.

Bennington Daze Liquor License ApprovalMotion by Sather, second by Mueller to approve a Liquor License for Sportsman Bar on Friday, June 17, 2011. All voted in favor and the motion carried.

Motion by Menke, second by Tanner to approve a Liquor License for the Bennington Jaycees, Sportsman Bar and The Warehouse on Saturday, June 18, 2011.

Nebraska Sweeping Contract Renewal – Kevin SegebartMotion by Tanner, second by Sather to approve the contract effective October 1, 2011 through September 30, 2015. All voted in favor and the motion carried.

Papio Creek Bridge and Trail ProjectMotion by Tanner, second by Menke to approve Lamp, Rynearson & Associates, Inc. Invoice No. 0109005.01-0000009 for $131.21. All voted in favor and the motion carried.

Discussions regarding the project included National Environmental Policy Act (NEPA) compliance, a purpose and need statement, alternatives, neighborhood connectivity, public awareness and education and parking.

Inspro Insurance - Employee Health CoverageMotion by Menke, second by Mueller to approve Health Coverage through Coventry with a $500 deductible and Dental Coverage with Principal Insurance. All voted in favor and the motion carried.

Business Directory ReviewMotion by Sather, second by Menke to approve payment for printing 1,000 copies of the directory. Roll call vote: Menke – yes, Mueller – abstained, Sather – yes, Tanner – yes. Motion carried.

Fire District BudgetMembers of the Council will schedule a meeting with members of the fire district. The Fire District Budget will be added to the special meeting agenda on May 24.

Library ReportMotion by Sather, second by Menke to approve the Douglas County Library Interlocal Agreement. All voted in favor and the motion carried.

Police ReportParking and parking signs at the soccer fields are a concern.

Maintenance, Park & Street ReportThe City Engineer has recommended a chemical application and de-oxidizer be used in the lift station at Ridgewood.

Motion by Sather, second by Tanner to approve a Ball Field Agreement with the Bennington Athletic League for services valued at $800. All voted in favor and the motion carried.

Motion by Tanner, second by Sather to approve a Ball Field Agreement with the Bennington Baseball Club for services valued at $800. All voted in favor and the motion carried.

Western Engineering will patch 156th Street north of North 2nd Street. Lurvey will contact Douglas County regarding roadway improvements south of the Papio Creek on 156th Street.

Motion by Sather, second by Tanner to approve a street closing on 168th Street from Highway 36 to Bennington Road late in June and again in August to accommodate equipment being used during construction at Bennington High School. All voted in favor and the motion carried.

Employee Health InsuranceMary Grefe, Inspro Insurance presented a Group Health Plan Analysis to Council Members and Department Managers.

Street Closure / Event Permit Application Shaya Love explained the event and its components and requested approval of a street closure.

Motion by Sather, second by Tanner to approve an event application for a Benefit Car and Motorcycle Show on Saturday, May 21, 2011. South Second Street will be closed from Molley Street to Allen Street from 12-6pm.

Budget DiscussionsMotion by Mueller rescinding a motion made at the April 11, 2011, meeting to use $800 of Keno Fund money for community betterment purposes to pay for maintenance on a 2003 Ford police cruiser. The motion went without a second and was lost.

Inspro InsuranceThe City received a worker’s compensation dividend check totaling $3,274.68 from Inspro Insurance.

Laaker will invite an Inspro Insurance representative to the April 27 th budget meeting to talk about employee health coverage.

Benn Daze Security – Benn Foundation, Dave ClarkMotion by Sather, second by Tanner approving the Bennington Foundation’s reimbursement to the City for security provided by the Bennington Police Department during Bennington Daze. All voted in favor and the motion carried.

ADA Committee – Dave Clark ResignationThe City Council accepted Clark’s resignation as Chairman of the ADA committee.

Business Directory ReviewDiscussions regarding use of the directory will be placed on the City Council’s May agenda.

Library ReportThe March report is on file in the City office.

Police ReportMotion by Sather, second by Tanner approving Keno Fund money of $800 for community betterment purposes, to pay for maintenance on the 2003 Ford police cruiser. All voted in favor and the motion carried.

Mayor Johnson presented an update to the language in the Police Department’s Standard Operating Procedures Manual specific to citizen’s calls via cell phones.

Office ReportA budget meeting is scheduled for Wednesday, April 27, 2011 at 6pm in the City office.

Bennington Public Schools and NS – The Heritage, LLC Bennington School District Superintendent, Terry Haack, addressed the Council requesting the park fee for the Heritage Lot 196 be waived.

Motion by Menke, second by Mueller to approve a request to waive the park fee payment for the Heritage Lot 196. Lot 196 will be an elementary school with playgrounds and play areas of which are acceptable in lieu of the required parkland dedication and park fee. Roll call vote: Menke – yes, Mueller – yes, Sather – abstained, Tanner – yes. The motion carried.

Citizen’s Advisory Panel Motion by Mueller, second by Tanner to approve a revised Purpose and Need Statement. All voted in favor and the motion carried.

A motion was made by Mueller for the Citizens Advisory Panel to make recommendations to the City Council for the continuation and formalization of the

Resolution 2011-01 Adopting the One and Six Year Street and Road Plan for the City of Bennington, NE as Required by Nebraska Revised Statute 39-2119Tyler Hevlin, JEO Consulting, indicated the projects in the one and six year plan had been updated and as a reminder noted that the plan is a flexible document.

Johnson opened a public hearing and Kevin Kuker asked the Council to review the list of projects.

Motion by Mueller, second by Sather to approve Resolution 2011-01 adopting the One and Six Year Road Plan. All voted in favor and the motion carried.

A Street Maintenance Expense Report and Highway Allocation Income Report were reviewed.

A motion by Mueller to establish a separate account for highway allocation funds and a 25% match requirement was not seconded.

Review of One and Six Year Street and Road PlanJulie Ogden, JEO Consulting, explained the plan and its purpose. A public hearing will be held at the February 14, 2011 City Council meeting for the plan approval. Laaker will provide the Council with a summary of highway allocation monies and street maintenance expenses for the past five years.

In 2010 the Citizen’s Advisory Committee made a recommendation to the City Council to use the Pavement Surface Evaluation and Rating (PASER) System for the City’s street evaluation process. It was recommended that a committee be formed to incorporate the PASER System for the review of streets in the spring and fall in preparation for the approval of the annual One and Six Year Street and Road Plan. The recommended committee could include: members of the CAP and representatives from City Maintenance, City Engineer and City Council Street Commissioners.

Consideration of a Revised Preliminary Plat Application including Lots 196-218 for a Future Phase of “The Heritage” - an Area South of the Intersection of Rainwood Road and Rosewater Parkway Mark Westergard, E&A Consulting, explained that Bennington Public School’s original school site in The Heritage was not conducive due to geotechnical issues. The alternative site includes single family lots. The school’s primary entrance will be located on Rosewater Parkway. A portion of Rainwood Road will be constructed. At the request of Douglas County’s Engineering Department, DLR Group conducted a stacking study for vehicles dropping off and loading students before and after school. The length of the platted cul-de-sac does not meet requirements. All other City zoning conditions will be met with the presentation of the final plat.

Johnson opened a public hearing. The assignment of property taxes on the original school site was questioned.

Motion by Sather, second by Menke to approve the Preliminary Plat Application. All voted in favor and the motion carried.

Liquor License Application – Chalk Enterprises LLC DBA The Warehouse –David NelsonDavid and Jill Nelson have purchased the previously named Keno Cabana business located at 15409 S. 2nd Street.

Johnson opened a public hearing. Nelson stated that there will be no changes in indoor or outdoor activities. Hours of operation fall within City guidelines.

Ordinance No. 396 Adopting Text Amendments to Fence Regulations and Zoning Regulations Sections 4.14, 2.03.159 and 2.03.160 Regarding Unique Uses, Fences and Wall HedgesFence regulations currently defined in the zoning regulations refer primarily to residential properties. More extensive fence regulations have been introduced as guidelines for commercial and industrial properties.

Library ReportBob Zaruba, Community Center/Library Chair, inquired about a future use plan for the fire department’s portion of the building currently shared with the library.

Police ReportThe results of a speed study conducted after the mill and overlay of 156th Street will lead to further monitoring of speeds in the project area.

Maintenance, Park & Street ReportA sub-committee meeting will be held regarding the continued sewer line problems at Ridgewood.

The maintenance department will purchase a chain saw.
