RESOLUTION

VILLAGE OF MAMARONECK PLANNING BOARD

(Adopted July 14, 2015)

RE: 1064 BAYHEAD DRIVE

Resolution of Wetland Permit Approval

After due discussion and deliberation, on motion by ________, seconded by

__________and carried, the following resolution was adopted:

WHEREAS, on May 24, 2015, Stephen and Cecile Bassas, the Applicant, (all references to

which shall include and be binding upon the Applicant’s successors and/or assigns) submitted to

the Village of Mamaroneck Planning Board (“Planning Board”) an Application seeking a wetland

permit to allow the removal of paved area and construction of a new residence and patio (1,186

square feet) replacing the existing residence within the 100 foot wetland buffer (“Application”);

and

WHEREAS, the Applicants’ property is located at 1064 Bayhead Drive (“Property”),

situated within the R-20 Residential District; and

WHEREAS, the Applicant revised the plans to move the proposed residence five feet

out of the wetland buffer toward the road and is in alignment with adjacent homes in the

neighborhood. The Applicant has minimized the intrusion into the wetland buffer, which is

now 335 square feet. The application’s revisions provide a net decrease of total impervious

area of 3,710 square feet, including 1,162 square feet within the wetland buffer. The

removal of impervious surfaces within the buffer area includes the flagstone patio

surrounding the existing 660 square foot pool. All roof water will now discharge to the front

yard outside of the wetland buffer. The stormwater management plan as described in the

SWPPP prepared by Benedict Salanitro, P.E. dated March 9, 2015 will include 5 Cultec 330XL-

HD units located in the front yard outside of the wetland buffer. Inspection ports will be

installed over the Cultic units for regular maintenance and inspection. This proposal

("Project") is described and illustrated on the following set of plans dated May 13, 2015 as

submitted by the Applicant and prepared by LABhaus which forms a part of the Application:

Alterations";

2. L001A - “Proposed Site Diagram with Zoning Envelope – 5’-00’’ Concession”;

4. ER-1 – “Drainage and Erosion Control Plan for the Proposed Residence at 1064 Bayhead

Drive”, dated March 7, 2015 and prepared by Benedict Salanitro, P.E.;

5. A004 – A006 – “Perspective Views, 1064 Bayhead Drive;

6. A101 – “Proposed Plan – First Floor”;

7. A012 - “Proposed Plan – Second Floor”;

8. A302 – “Building Elevations, South and North Elevations”;

9. A302 – “Building Elevations, East and West Elevations”;

10. Survey of a Parcel of Land on the Westerly Side of Street called “Bay Head”, distant 757.14

feet from the Northeasterly End of a curve having a radius of 18.00 at the Northwest

Corner of Flagler Drive and Orienta Avenue in the Village of Mamaroneck, Westchester

County, prepared by Richard A. Spinelli, Lic. Land Surveyor, July 3, 2014;

11. Stormwater Prevention Pollution Plan (SWPPP) prepared by Benedict Salanitro, P. E. dated

March 9, 2015;

12. Coastal Assessment Form ("CAF") revised June 3, 2015, and submitted pursuant to Local Law No. 30-1984;

13. Short-Form Environmental Assessment Form ("EAF") revised June 6, 2015.

WHEREAS, a duly noticed public meeting was held on the Application by the Planning Board on June 10, 2015 and a legally noticed public hearing was held on June 24, 2015 and closed on June 24, 2015, at which time all those wishing to be heard were given the opportunity to be heard; and

WHEREAS, the Planning Board has carefully reviewed the Application and considered

comments from the Village Planner in a memorandum dated June 6, 2015, the Acting Village

Engineer who reviewed the SWPPP in memorandums dated June 23, 2015, July 8, 2015 and July

9, 2015, and the Planning Board’s landscape consultant in a memorandum dated June 5, 2015,

the Applicant’s Engineer’s description of the proposed action demonstrating how the proposed

project conforms to the wetland criteria in Freshwater Wetlands Chapter 192 in a memorandum

dated June 10, 2015 and Applicant’s submission of Aerial Photographs of the Subject Property

showing Adjacent Homes and the 100 foot Wetland Buffer derived from the Westchester

County GIS website dated 2013; and

WHEREAS, the Applicant has satisfactorily addressed those comments from the Village’s

Consultants and Boards; and

WHEREAS, the Acting Village Engineer has evaluated the Applicant’s SWPPP prepared by

Benedict Salanitro P.E. March 9, 2015 and has recommended approval of the SWPPP in a

memorandum dated July 8, 2015; and

WHEREAS, the Planning Board determined on June 24, 2015, that the Project is a Type II

Action under SEQRA (NYS DEC 617.5 (c) (10)); and

WHEREAS, on June 24, 2015, on motion by Mr. Sjunnemark, seconded by Mr. Verni and

carried, the public hearing on the application was closed; and

WHEREAS, the Planning Board has completed its review and evaluation of the

Application, has fully considered the factors set forth in Village Code 192-14 E and determined

that such standards and conditions have been satisfied.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. The Planning Board hereby approves the SWPPP and grants a wetland permit for the

proposed removal of paved area and construction of new residence and patio within the

100 foot buffer limited to the addition of only 335 square feet intrusion in the wetland

buffer and the removal of 1,162 square feet of impervious surface within the buffer area.

The approval of this Application is subject to the following condition:

(a) The Applicants shall pay all outstanding consultant review fees in connection with the

Planning Board review of this Application.

2. When condition (1) has been satisfied, three (3) sets of the above-referenced plans

illustrating the approved conditions shall be submitted for the endorsement of the Planning

Board Chairman. One (1) set of the endorsed plans will be returned to the Applicant, and one

(1) set each will be provided to the Village Building Inspector and to the Planning Board

Secretary. Prior to issuance of a certificate of occupancy, the Building Department will verify

that the “as built” conditions conform to the final approved wetland permit.

Review of SWPPP

The purpose of this memorandum is to provide the Building Department with a summary of our review of themost recent documents received related to the proposed site improvements at 1064 Bay Head Drive. Theapplication proposes the construction of site improvements including demolition of an existing dwelling, pooland patio, and construction of a new dwelling, pool and patio. This review was focused on the engineeringdesign and the associated Village Code requirements in accordance with the following:

Village of Mamaroneck Code, Chapter 294 Stormwater Management and Erosion and SedimentControl and other sections, as applicable.

New York State Department of Environmental Conservation (NYSDEC) Stormwater ManagementDesign Manual, last revised January 2015.

New York State Standards and Specifications for Urban Erosion and Sediment Control, dated August2005.

DOCUMENTS REVIEWED

DISCUSSION

The Applicant previously provided a Stormwater Pollution Prevention Plan that describes the proposed siteimprovements, and has since provided an updated site plan drawing. The following is a summary of ourcomments, which have been satisfactorily addressed as shown in Bold Type. The project is partially locatedwithin the FEMA defined 100-year floodplain boundary.

1. Stormwater Runoff Analysis shall meet the requirements of a Stormwater Pollution Prevention Plan(SWPPP) in accordance with the required contents of Town Code §294-8, including:

a. Site map/construction drawing(s) showing the specific location(s) and size(s) of eachpostconstruction stormwater management practice; Addressed.

b. Documentation showing results of deep test and percolation test results; Addressed.Provided test results confirm that proposed system will fully drain within 48 hours asrequired by NYSDEC.

c. Hydrologic and hydraulic analysis for all structural components of the stormwater managementsystem for the applicable design storms; Addressed.

d. Comparison of postdevelopment stormwater runoff conditions with predevelopment runoffconditions; Addressed.

e. Dimensions, material specifications, and installation details for each postconstructionstormwater management practice; Addressed.

f. Construction phasing plan describing the intended sequence of operations; Addressed.

2. Details should be revised to match Village of Mamaroneck Standard Construction Details, available onthe Village Engineer’s website. Additional details shall be added to fully reflect the proposed work,including road and curb restoration. Addressed.
